ThefollowingisasummaryoftheHouseCommitteeSubstituteforHB
1696.
Currently,apersoncommitstheoffenseofunlawfuluseofaweapon
iftheydischargeorshootafirearmfromamotorvehicle. This
billallowsthedischargeofafirearmfromastationaryas
authorizedundertheMissouriWildlifeCode.
Thisbillalsoestablishes"Blair’sLaw"whichprovidesthata
personcommitstheoffenseofunlawfuluseofaweaponif,with
criminalnegligence,theydischargesafirearmwithinorintothe
limitsofanymunicipality. Theseprovisionswillnotapplyifthe
firearmisdischargedunderthecircumstanceslistedinthebill.
AnysuchpersonshallbeguiltyofaclassAmisdemeanorforthe
firstoffense,aclassEfelonyforasecondoffense,andaclassD
felonyforathirdorsubsequentoffense.

PROPONENTS: Supporterssaythatthisbillhastwopartstoit.
First,farmersandranchersneedtohavetheabilitytoprotect
theirlivestockfrompredatoryanimalswithoutthefearofbeing
chargedwithafelonyoffense. Thisbillwouldallowthemtodo
justthat.Inaddition,ownersoffirearmsneedtoactresponsibly
withtheweapons.Celebratorygunfirecaninjureorkillinnocent
people.Thisbillestablishconsequencesforcelebratorygunfire.
