HB1747 2 55 (4)(a)Iftheelectionauthorityfindsthatthenoticeofintentioncontainsthe 56requiredinformationunderthissection,theelectionauthorityshallattachtothe 57affidavitacertificationshowingthatthenoticehasbeenproperlyfiled. 58 (b)Withinthreebusinessdaysafterthecertification,theelectionauthorityshall 59sendnotificationofthefilingofthenoticebyregisteredmailtotheschooldistrict 60administration,theschoolboard,andtheboardmembersoughttoberecalled. 61 (c)Withinfourteendaysafterthereceiptofthenotice,theboardmemberwhois 62thesubjectofthenoticemayfilewiththeelectionauthorityastatement,notexceeding 63twohundredwordsinlength,inanswertothestatementoftheproponents.Ifan 64answerisfiled,theelectionauthorityshallmaketheansweravailableforpublicviewing 65uponrequestattheelectionauthority'soffice. 66 3.(1)Aftertheelectionauthoritycertifiesthenotice,theproponentsofthe 67recallmaybegincirculatingapetitionforrecallandcollectingsignaturesonsuch 68petition. 69 (a)Anypersoncirculatingapetitionforrecallshallbearegisteredvoterinthe 70districtoftheboardmembersoughttoberecalled. 71 (b)Collectionofsignaturesmaybeginaftersevendayshavepassedfollowingthe 72electionauthority'scertificationwiththedateofthecertificationcountedasthefirst 73day.Theelectionauthorityshallindicatethedateonwhichcollectionofsignaturesmay 74begininthecertificationofthenotice.Thenumberofsignaturesrequiredtoequalthe 75tenpercentofvotersnecessaryundersubsection1ofthissectionshallbedeterminedby 76theelectionauthority. 77 (2)Eachpageofthepetitionforrecallshallinclude: 78 (a)Thenameandofficeofthememberforwhomrecallissought; 79 (b)Thegroundsforrecalldescribedinparticular,innomorethantwohundred 80words; 81 (c)Astatementthatthepetitionsignatoriesareregisteredvotersofthedistrict 82inwhichthemembersoughttoberecalledserves;and 83 (d)Spaceforthedateofthesigning,thesigner'sprintedname,thehouse 84numberandstreetnameofeachsigner'sresidence,andeachsigner'ssignature. 85 (3)Eachsignershallbearegisteredvoterintheschooldistrict. 86 (4)Eachsignershallprovidethedateofthesigning,thesigner'sprintedname, 87thehousenumberandstreetnameofthesigner'sresidence,andthesigner'ssignature. 88 (5)Everypersonsigningapetitionshalldosointhepresenceofthepersonwho 89iscirculatingthepetitionandwhowillexecutetheaffidavitofverificationforeachpage 90ofthepetition. HB1747 3 91 4.(1)Withinsixtydaysafterthebeginningdateforthecollectionofsignatures, 92thecompletedpetitionwiththerequirednumberofsignaturesshallbefiledwiththe 93electionauthority.Thesignaturestothepetitionneednotallbeattachedtoonepaper, 94butthepersonwhofilesthepetitionwiththeelectionauthorityshallsigneachpage 95attestingthatthesignaturesattachedaretrueandcorrecttothebestofsuchperson's 96knowledgeandbelief.Suchsignatureoneachpageofthepetitionshallbenotarized. 97 (2)Withinfifteenbusinessdaysafterthedateoffilingthesignedpetition,the 98electionauthorityshallexaminethepetitionanddeterminewhetherthepetitionis 99signedbytherequirednumberofregisteredvoters.Signaturesthatcannotbeverified 100shallnotbecounted. 101 (3)(a)Iftheelectionauthorityfindsthesignedpetitiontobeinsufficient,the 102electionauthorityshall,withinthreebusinessdaysaftersuchdetermination,send 103notificationoftheinsufficiencybyregisteredmailtothepersonwhofiledthesigned 104petition.Theelectionauthorityshallspecifytheerrors,omissions,orotherproblems 105thatcausetheinsufficiency. 106 (b)Thesignedpetitionshallbereturnedtothepersonwhofiledthesigned 107petition,withoutprejudicetotherefilingofthepetitionorthefilingofanewpetition. 108 (c)Thepersonwhofiledthesignedpetitionshallhavethirtydaysafterthedate 109ofnotificationofinsufficiencytocorrecttheinsufficienciesandrefilethepetition.Ifthe 110petitionisnotcorrectedandrefiled,thepetitionandallitssignaturesshallbevoid. 111 (4)Iftheelectionauthorityfindsthesignedpetitiontobesufficient,theelection 112authorityshallattachtothepetitionacertificateshowingtheresultoftheexamination. 113Theelectionauthorityshall,withinthreebusinessdaysafterthecertification,send 114notificationofthesufficiencyandcertificationbyregisteredmailtothepersonwhofiled 115thesignedpetition,theschooldistrictadministration,theschoolboard,andtheboard 116membersoughttoberecalled. 117 5.(1)Uponreceiptofthenotificationofthesufficiencyofthepetitionandthe 118electionauthority'scertification,theelectionauthorityshallorderthequestiontobe 119submittedtothevotersofthedistrictononeofthefollowingdays: 120 (a)Thenextgeneralelectionday; 121 (b)AtaspecialelectiontobecalledonthefirstTuesdayafterthefirstMondayin 122Novemberofodd-numberedyearsifthatdateisnofewerthanninetycalendardays 123afterthedateofnotification;or 124 (c)Atthenextelectioninwhichthevotersoftheschooldistrictvoteforany 125schoolboardmemberonthegeneralmunicipalelectionday,ifthatdateisnofewerthan 126ninetycalendardaysafterthedateofnotification.
