SectionA.Section162.091,RSMo,isrepealedandtwonewsectionsenactedinlieu
2thereof,tobeknownassections162.089and162.091,toreadasfollows:
162.089.1.(1)Eachmemberofanyschoolboardofanypublicschooldistrict
2shallbesubjecttorecallfromofficebytheregisteredvotersoftheschooldistrictsuch
3memberwaselectedtorepresent.Suchrecallelectionshallbehelduponthesubmission
4ofapetitionsignedbyregisteredvotersofthedistrictequalinnumbertoatleastten
5percentofthenumberofvoterswhovotedinthemostrecentelectionheldtoelecta
6districtboardmemberinsuchdistrict.
7 (2)Noproceedingsshallbecommencedagainstanymemberunderthissection
8if,atthetimeofcommencement,suchmember:
9 (a)Hasnotheldofficeduringthemember'stermformorethanninetydays;

66 3.(1)Aftertheelectionauthoritycertifiesthenotice,theproponentsofthe
67recallmaybegincirculatingapetitionforrecallandcollectingsignaturesonsuch
68petition.
69 (a)Anypersoncirculatingapetitionforrecallshallbearegisteredvoterinthe
70districtoftheboardmembersoughttoberecalled.
71 (b)Collectionofsignaturesmaybeginaftersevendayshavepassedfollowingthe
72electionauthority'scertificationwiththedateofthecertificationcountedasthefirst

HB1747	3 91 4.(1)Withinsixtydaysafterthebeginningdateforthecollectionofsignatures,
92thecompletedpetitionwiththerequirednumberofsignaturesshallbefiledwiththe
93electionauthority.Thesignaturestothepetitionneednotallbeattachedtoonepaper,
94butthepersonwhofilesthepetitionwiththeelectionauthorityshallsigneachpage
95attestingthatthesignaturesattachedaretrueandcorrecttothebestofsuchperson's
96knowledgeandbelief.Suchsignatureoneachpageofthepetitionshallbenotarized.
97 (2)Withinfifteenbusinessdaysafterthedateoffilingthesignedpetition,the
98electionauthorityshallexaminethepetitionanddeterminewhetherthepetitionis
99signedbytherequirednumberofregisteredvoters.Signaturesthatcannotbeverified
100shallnotbecounted.
101 (3)(a)Iftheelectionauthorityfindsthesignedpetitiontobeinsufficient,the
102electionauthorityshall,withinthreebusinessdaysaftersuchdetermination,send
103notificationoftheinsufficiencybyregisteredmailtothepersonwhofiledthesigned
104petition.Theelectionauthorityshallspecifytheerrors,omissions,orotherproblems
105thatcausetheinsufficiency.
106 (b)Thesignedpetitionshallbereturnedtothepersonwhofiledthesigned
107petition,withoutprejudicetotherefilingofthepetitionorthefilingofanewpetition.
108 (c)Thepersonwhofiledthesignedpetitionshallhavethirtydaysafterthedate
109ofnotificationofinsufficiencytocorrecttheinsufficienciesandrefilethepetition.Ifthe
110petitionisnotcorrectedandrefiled,thepetitionandallitssignaturesshallbevoid.
111 (4)Iftheelectionauthorityfindsthesignedpetitiontobesufficient,theelection
112authorityshallattachtothepetitionacertificateshowingtheresultoftheexamination.
113Theelectionauthorityshall,withinthreebusinessdaysafterthecertification,send
114notificationofthesufficiencyandcertificationbyregisteredmailtothepersonwhofiled
115thesignedpetition,theschooldistrictadministration,theschoolboard,andtheboard
116membersoughttoberecalled.
117 5.(1)Uponreceiptofthenotificationofthesufficiencyofthepetitionandthe
118electionauthority'scertification,theelectionauthorityshallorderthequestiontobe
119submittedtothevotersofthedistrictononeofthefollowingdays:
120 (a)Thenextgeneralelectionday;
121 (b)AtaspecialelectiontobecalledonthefirstTuesdayafterthefirstMondayin
122Novemberofodd-numberedyearsifthatdateisnofewerthanninetycalendardays
123afterthedateofnotification;or
124 (c)Atthenextelectioninwhichthevotersoftheschooldistrictvoteforany
125schoolboardmemberonthegeneralmunicipalelectionday,ifthatdateisnofewerthan
126ninetycalendardaysafterthedateofnotification.

128subsectionbeforethetermofthememberwhoisthesubjectoftherecallpetition
129expires,norecallelectionshallbeheldandsuchmembermayservetheremainderofthe

131 6.(1)Thenameofthememberwhoisthesubjectoftherecallshallappearon

145terms,thesuccessorshallbethecandidatereceivingthenexthighestnumberofvotes
146aftertheseatsforexpiredboardmembertermsarefilled.Ifthenumberofcandidatesis
147notgreaterthanthenumberofseatsofexpiredboardmemberterms,asuccessorshall
148bechoseninthesamemannerasanyvacancyonthedistrictboardisfilled.
149 7.Aschoolboardmemberwhohasbeenrecalledshallnotfillthevacancy
150createdbytherecall,butsuchmembermayseekelectiontotheschoolboardatany
151electionnotheldtofillthevacancycreatedbythemember'srecall.
152 8.Exceptasotherwiseprovidedinthissection,theprovisionsofchapter115
153governingtheconductofelectionsshallapply,ifappropriate,torecallelectionsheld
154underthissection.Thecostsoftheelectionshallbepaidasprovidedinchapter115.
162.091.1.Asusedinthissection,theterm"publicofficial"meansany:
2 (1)Countyclerk[,];
3 (2)Countytreasurer[,];
4 (3)Schoolboardmember,officer,oremployee[,]; or
5 (4)Otherofficer[,].
6 2.Anypublicofficialwhowillfullyneglectsorrefusestoperformanydutyimposed
7upon[him]suchpublicofficialbychapters160to168[,] orchapter170,171,177[and],or
8178,orwhowillfullyviolatesanyprovisionof[these] suchchapters,isguiltyofa

10dollarsorbyimprisonmentinthecountyjailnottoexceedoneyear.
11 3.Anypersonaggrievedbythewillfulneglectorrefusalofapublicofficialto
12performanydutyimposeduponsuchpublicofficialbychapters160to168orchapter
13170,171,177,or178shallhaveacivilclaimfordamagesagainstsuchpublicofficialfor:
14 (1)Injunctiverelief;
15 (2)Compensatorydamages;
16 (3)Punitivedamages;
17 (4)Costsoflitigationincluding,butnotlimitedto,expertwitnessfees;and
18 (5)Reasonableattorney'sfeesfortheprosecutionoftheaction.
19 4.Neithersovereignimmunitynorofficialimmunityshallbeadefenseinany
20suchcivilaction.
