12 2.(1)Thecommissionermayapproveandauthorizeuptofourpilotrecovery
13highschools,geographicallylocatedinmetropolitanareasthroughoutthestate,tobe
14establishedbyschooldistrictsorgroupsofschooldistrictsforthepurposeof
15demonstratingtheeffectivenessoftherecoveryhighschoolmodelinthisstate.The
16commissionershallissuearequestforproposalsfromschooldistrictstooperateapilot
17recoveryhighschool.Suchproposalsmaybesubmittedbyanindividualschooldistrict
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18proposingtooperatearecoveryhighschoolorbyagroupofschooldistrictsproposing
19tojointlyoperatesuchaschool.Suchproposalsshallbesubmittedtothecommissioner
20nolaterthanDecemberfirstoftheschoolyearpriortotheschoolyearinwhichthe
21recoveryhighschoolisproposedtobeginoperation.Theapprovaloftheboardshallbe
22requiredfortherecoveryhighschooltobeginoperation.
23 (2)Proposalsshalldetailhowthedistrictordistrictswillsatisfythecriteriafora
24highschooleducationprogramunderstatelawandboardruleandhowtherecovery
25highschoolwillsatisfytherequirementsforaccreditationbytheAssociationof
26RecoverySchoolsoranotherrecoveryschoolaccreditationorganizationauthorizedby
27theboard.Theproposalshallincludeafinancialplanoutliningtheanticipatedpublic
28andprivatefundingthatwillallowtherecoveryhighschooltooperateandmeetthe
29school'seducationalandrecoverycriteria.Thedistrictordistrictsmaypartnerwith
30oneormorelocalnonprofitorganizationsorotherlocaleducationalagenciesregarding
31establishmentandoperationofarecoveryhighschoolandmayestablishajointboard
32tooverseetheoperationoftherecoveryhighschoolasprovidedinamemorandumof
33understandingenteredwithsuchorganizationororganizations.
34 (3)Byapprovaloftheproposalupontherecommendationofthecommissioner,
35theboardshallbedeemedtohaveauthorizedallnecessaryequivalenciesandwaiversof
36regulationsenumeratedintheproposal.
37 (4)Thecommissionermayspecifyanauthorizationperiodfortherecoveryhigh
38school,whichshallbenolessthanfouryears.BeforeJulyfirstofeachyeartherecovery
39highschoolisinoperation,theschooldistrictorgroupofschooldistricts,inconsultation
40withtherecoveryhighschool,shallsubmittothecommissionerananalysisofthe
41recoveryhighschool'seducational,recovery,andotherrelatedoutcomesasspecifiedin
42theproposal.Thecommissionershallreviewtheanalysisandrenewanyrecoveryhigh
43schoolmeetingtherequirementsofthissectionandtherequirementsoftheschool's
44proposalandmayincludetermsandconditionstoaddressareasneedingcorrectionor
45improvement.Thecommissionermayrevokeorsuspendtheauthorizationofa
46recoveryhighschoolnotmeetingtherequirementsofthissectionortherequirementsof
47theschool'sproposal.
48 (5)Pupilattendance,dropoutrate,studentperformanceonstatewide
49assessments,andotherdataconsideredintheMissourischoolimprovementprogram
50andschoolaccreditationshallnotbeattributedtothegeneralaccreditationofeithera
51sendingdistrictorthedistrictordistrictsoperatingtherecoveryhighschoolandmaybe
52usedbythecommissioneronlyintherenewalprocessfortherecoveryhighschoolas
53providedinthissubsection.

55operatingarecoveryhighschoolfortheenrollmentofaneligiblestudentwhois
56currentlyenrolledinorresidesinthesendingdistrict.

58sendingdistrictinarecoveryhighschoolcreatedunderthissection.Astudentover
59eighteenyearsofageresidinginasendingdistrictmayseektoenrollinarecoveryhigh
60school.
61 (3)Aneligiblestudentshallmeanastudentwhoisinrecoveryfromsubstance
62usedisorderorsubstancedependency,orsuchaconditionalongwithco-occurring
63disorderssuchasanxiety,depression,andattentiondeficithyperactivitydisorder,and
64whoisdeterminedbytherecoveryhighschooltobeastudentwhowouldacademically
65andclinicallybenefitfromplacementintherecoveryhighschoolandiscommittedto
66workingonthestudent'srecovery.Therecoveryhighschoolshallconsideravailable
67informationincluding,butnotlimitedto,anyrecommendationofadrugcounselor,
68alcoholismcounselor,orsubstanceabusecounselorlicensedorcertifiedunder
69applicablelawsandregulations.
70 (4)Arecoveryhighschoolshallnotlimitordenyadmissiontoaneligiblestudent
71basedonrace,ethnicity,nationalorigin,disability,incomelevel,proficiencyinthe
72Englishlanguage,orathleticability.
73 4.(1)Therecoveryhighschoolshallannuallyadoptapolicyestablishinga
74tuitionrateforitsstudentsnolaterthanFebruaryfirstoftheprecedingschoolyear.
75 (2)Thesendingdistrictofaneligiblestudentwhoisenrolledinandattendinga
76recoveryhighschoolshallpaytuitiontotherecoveryhighschoolequaltothelesserof:
77 (a)Thetuitionrateestablishedundersubdivision(1)ofthissubsection;or
78 (b)Thestateadequacytarget,asdefinedinsection163.011,plustheaverage
79sumproducedperchildbythelocaltaxeffortabovethestateadequacytargetofthe
80sendingdistrict.
81 (3)Ifcostsassociatedwiththeprovisionofspecialeducationandrelated
82disabilityservicestothestudentexceedthetuitiontobepaidundersubdivision(2)of
83thissubsection,thesendingdistrictshallremainresponsibleforpayingtheexcesscostto
84therecoveryhighschool.
85 (4)Thecommissionermayenterintoanagreementwiththeappropriateofficial
86oragencyofanotherstatetodevelopareciprocityagreementforotherwiseeligible,
87nonresidentstudentsseekingtoattendarecoveryhighschoolinthisstate.Arecovery
88highschoolmayenrollotherwiseeligiblestudentsresidinginastateotherthanthisstate
89asprovidedinsuchreciprocityagreement.Suchreciprocityagreementshallrequirethe
90out-of-statestudent'sdistrictofresidencetopaytotherecoveryhighschoolanannual
HB1753	3 91amountequaltoonehundredfivepercentofthetuitionratefortherecoveryhighschool
92establishedunderthissubsection.Ifanotherwiseeligiblestudentresidesinastatethat
93isnotsubjecttoareciprocityagreement,suchstudentmayattendarecoveryhigh
94schoolprovidedsuchstudentpaystotheschoolonehundredfivepercentofthetuition
95ratefortherecoveryhighschoolestablishedunderthissubsection.Nostudentenrolled
96andattendingarecoveryhighschoolunderthissubdivisionshallbeincludedasa
97residentpupilforanystateaidpurposeunderchapter163.
98 5.Theboard,inconsultationwiththedepartmentofmentalhealth,may
99promulgaterulestoimplementtheprovisionsofthissection.Anyruleorportionofa
100rule,asthattermisdefinedinsection536.010,thatiscreatedundertheauthority
101delegatedinthissectionshallbecomeeffectiveonlyifitcomplieswithandissubjectto
102alloftheprovisionsofchapter536and,ifapplicable,section536.028.Thissectionand
103chapter536arenonseverable,andifanyofthepowersvestedwiththegeneralassembly
104pursuanttochapter536toreview,todelaytheeffectivedate,ortodisapproveandannul
105arulearesubsequentlyheldunconstitutional,thenthegrantofrulemakingauthority
106andanyruleproposedoradoptedafterAugust28,2022,shallbeinvalidandvoid.
