37.850.1.ThecommissionerofadministrationshallmaintaintheMissouri
2accountabilityportalestablishedinexecutiveorder07-24asafree,internet-basedtool
3allowingcitizenstodemandfiscaldisciplineandresponsibility.

19 4.Upontheconductingofawithholdingorareleaseoffunds,thegovernorshall
20submitareportstatingallamountswithheldfromthestate'soperatingbudgetforthecurrent
21fiscalyear,asauthorizedbyArticleIV,Section27oftheMissouriConstitutionwhichshall
22be:
23 (1)Conspicuouslypostedontheaccountabilityportalwebsite;
24 (2)Searchablebytheamountswithheldorreleasedfromeachindividualfund;and
25 (3)Searchablebythetotalamountwithheldorreleasedfromtheoperatingbudget.
26 5.Everypoliticalsubdivisionofthestate,includingpublicinstitutionsofhigher
27education[butexcluding], publicschooldistricts,andpubliccharterschoolsshallsupply
28allinformationdescribedinsubsection2ofthissectiontotheofficeofadministrationwithin
29[sevendaysofissuingorincurringsuchcorrespondingbondorobligation.Forallsuchbonds
30orobligationsissuedorincurredpriortoAugust28,2013,everysuchpoliticalsubdivision
31andpublicinstitutionofhighereducationshallhaveninetydaystosupplysuchinformation
32to]thenumberofdaysandinamannertobedeterminedbytheofficeofadministration.
33 6.Everyschooldistrictandpubliccharterschoolshallsupplyallinformation
34describedinsubdivisions(2),(4),(5),and(6)ofsubsection2ofthissectiontothe
35departmentofelementaryandsecondaryeducation[withinsevendaysofissuingsuchbond,
36orincurringsuchdebt]. Thedepartmentofelementaryandsecondaryeducationshallhave
37forty-eighthourstodeliversuchinformationtotheofficeofadministration.[Forallsuch
38bondsissuedordebtincurredpriortoAugust28,2013,everyschooldistrictandpublic
39charterschoolshallhaveninetydaystosupplysuchinformationtothedepartmentof

41shallhaveforty-eighthourstodeliversuchinformationtotheofficeofadministration.]
160.261.1.Thelocalboardofeducationofeachschooldistrictshallclearlyestablish
2awrittenpolicyofdiscipline,includingthedistrict'sdeterminationontheuseofcorporal
3punishmentandtheproceduresinwhichpunishmentwillbeapplied.Awrittencopyofthe
4district'sdisciplinepolicyandcorporalpunishmentprocedures,ifapplicable,shallbe
5providedtothepupilandparentorlegalguardianofeverypupilenrolledinthedistrictatthe
6beginningofeachschoolyearandalsomadeavailableintheofficeofthesuperintendentof
7suchdistrict,duringnormalbusinesshours,forpublicinspection.Nopupilshallbesubject
8tocorporalpunishmentproceduresoutlinedinthedisciplineandcorporalpunishment
9policywithoutaparentorguardianbeingnotifiedandprovidingwrittenpermissionfor
10thecorporalpunishment.Allemployeesofthedistrictshallannuallyreceiveinstruction
11relatedtothespecificcontentsofthepolicyofdisciplineandanyinterpretationsnecessaryto
12implementtheprovisionsofthepolicyinthecourseoftheirduties,includingbutnotlimited
13toapprovedmethodsofdealingwithactsofschoolviolence,discipliningstudentswith
14disabilitiesandinstructioninthenecessityandrequirementsforconfidentiality.
15 2.Thepolicyshallrequireschooladministratorstoreportactsofschoolviolenceto
16allteachersattheattendancecenterand,inaddition,tootherschooldistrictemployeeswitha
17needtoknow.Forthepurposesofthischapterorchapter167,"needtoknow"isdefinedas
18schoolpersonnelwhoaredirectlyresponsibleforthestudent'seducationorwhootherwise
19interactwiththestudentonaprofessionalbasiswhileactingwithinthescopeoftheir
20assignedduties.Asusedinthissection,thephrase"actofschoolviolence"or"violent
21behavior"meanstheexertionofphysicalforcebyastudentwiththeintenttodoserious
22physicalinjuryasdefinedinsection556.061toanotherpersonwhileonschoolproperty,
23includingaschoolbusinserviceonbehalfofthedistrict,orwhileinvolvedinschool
24activities.Thepolicyshallataminimumrequireschooladministratorstoreport,assoonas
25reasonablypractical,totheappropriatelawenforcementagencyanyofthefollowingcrimes,
26oranyactwhichifcommittedbyanadultwouldbeoneofthefollowingcrimes:

74 3.Thepolicyshallprovidethatanystudentwhoisonsuspensionforanyofthe
75offenseslistedinsubsection2ofthissectionoranyactofviolenceordrug-relatedactivity
76definedbyschooldistrictpolicyasaseriousviolationofschooldisciplinepursuantto
77subsection9ofthissectionshallhaveasaconditionofhisorhersuspensiontherequirement
78thatsuchstudentisnotallowed,whileonsuchsuspension,tobewithinonethousandfeetof
79anyschoolpropertyintheschooldistrictwheresuchstudentattendedschooloranyactivity
80ofthatdistrict,regardlessofwhetherornottheactivitytakesplaceondistrictpropertyunless:
81 (1)Suchstudentisunderthedirectsupervisionofthestudent'sparent,legalguardian,
82orcustodianandthesuperintendentorthesuperintendent'sdesigneehasauthorizedthe
83studenttobeonschoolproperty;
84 (2)Suchstudentisunderthedirectsupervisionofanotheradultdesignatedbythe
85student'sparent,legalguardian,orcustodian,inadvance,inwriting,totheprincipalofthe
86schoolwhichsuspendedthestudentandthesuperintendentorthesuperintendent'sdesignee
87hasauthorizedthestudenttobeonschoolproperty;
88 (3)Suchstudentisenrolledinandattendinganalternativeschoolthatislocated
89withinonethousandfeetofapublicschoolintheschooldistrictwheresuchstudentattended

94 4.Anystudentwhoviolatestheconditionofsuspensionrequiredpursuantto
95subsection3ofthissectionmaybesubjecttoexpulsionorfurthersuspensionpursuanttothe
96provisionsofsections167.161,167.164,and167.171.Inmakingthisdetermination
97considerationshallbegiventowhetherthestudentposesathreattothesafetyofanychildor
98schoolemployeeandwhethersuchstudent'sunsupervisedpresencewithinonethousandfeet
99oftheschoolisdisruptivetotheeducationalprocessorunderminestheeffectivenessofthe
100school'sdisciplinarypolicy.Removalofanypupilwhoisastudentwithadisabilityissubject
101tostateandfederalproceduralrights.Thissectionshallnotlimitaschooldistrict'sabilityto:
102 (1)Prohibitallstudentswhoaresuspendedfrombeingonschoolpropertyor
103attendinganactivitywhileonsuspension;
104 (2)Disciplinestudentsforoff-campusconductthatnegativelyaffectstheeducational
105environmenttotheextentallowedbylaw.
106 5.Thepolicyshallprovideforasuspensionforaperiodofnotlessthanoneyear,or
107expulsion,forastudentwhoisdeterminedtohavebroughtaweapontoschool,includingbut
108notlimitedtotheschoolplaygroundortheschoolparkinglot,broughtaweapononaschool

110violationofdistrictpolicy,exceptthat:
111 (1)Thesuperintendentor,inaschooldistrictwithnohighschool,theprincipalofthe
112schoolwhichsuchchildattendsmaymodifysuchsuspensiononacase-by-casebasis;and
113 (2)Thissectionshallnotpreventtheschooldistrictfromprovidingeducational
114servicesinanalternativesettingtoastudentsuspendedundertheprovisionsofthissection.
115 6.Forthepurposeofthissection,theterm"weapon"shallmeanafirearmasdefined
116under18U.S.C.Section921andthefollowingitems,asdefinedinsection571.010:a
117blackjack,aconcealablefirearm,anexplosiveweapon,afirearm,afirearmsilencer,agas
118gun,aknife,knuckles,amachinegun,aprojectileweapon,arifle,ashotgun,aspringgunor
119aswitchbladeknife;exceptthatthissectionshallnotbeconstruedtoprohibitaschoolboard
120fromadoptingapolicytoallowaCivilWarreenactortocarryaCivilWareraweaponon
121schoolpropertyforeducationalpurposessolongasthefirearmisunloaded.Thelocalboard
122ofeducationshalldefineweaponinthedisciplinepolicy.Suchdefinitionshallincludethe
123weaponsdefinedinthissubsectionbutmayalsoincludeotherweapons.
124 7.Allschooldistrictpersonnelresponsibleforthecareandsupervisionofstudents
125areauthorizedtoholdeverypupilstrictlyaccountableforanydisorderlyconductinschoolor
126onanypropertyoftheschool,onanyschoolbusgoingtoorreturningfromschool,during
127school-sponsoredactivities,orduringintermissionorrecessperiods.
128 8.Teachersandotherauthorizeddistrictpersonnelinpublicschoolsresponsiblefor
129thecare,supervision,anddisciplineofschoolchildren,includingvolunteersselectedwith
130reasonablecarebytheschooldistrict,shallnotbecivillyliablewhenactinginconformity
131withtheestablishedpoliciesdevelopedbyeachboard,includingbutnotlimitedtopoliciesof
132studentdisciplineorwhenreportingtohisorhersupervisororotherpersonasmandatedby
133statelawactsofschoolviolenceorthreatenedactsofschoolviolence,withinthecourseand
134scopeofthedutiesoftheteacher,authorizeddistrictpersonnelorvolunteer,whensuch
135individualisactinginconformitywiththeestablishedpoliciesdevelopedbytheboard.
136Nothinginthissectionshallbeconstruedtocreateanewcauseofactionagainstsuchschool
137district,ortorelievetheschooldistrictfromliabilityforthenegligentactsofsuchpersons.
138 9.Eachschoolboardshalldefineinitsdisciplinepolicyactsofviolenceandany
139otheractsthatconstituteaseriousviolationofthatpolicy."Actsofviolence"asdefinedby
140schoolboardsshallincludebutnotbelimitedtoexertionofphysicalforcebyastudentwith
141theintenttodoseriousbodilyharmtoanotherpersonwhileonschoolproperty,includinga
142schoolbusinserviceonbehalfofthedistrict,orwhileinvolvedinschoolactivities.School
143districtsshallforeachstudentenrolledintheschooldistrictcompileandmaintainrecordsof
144anyseriousviolationofthedistrict'sdisciplinepolicy.Suchrecordsshallbemadeavailable
145toteachersandotherschooldistrictemployeeswithaneedtoknowwhileactingwithinthe

147schooldistrictinwhichthestudentsubsequentlyattemptstoenroll.
148 10.Spanking,whenadministeredbycertificatedpersonnelandinthepresenceofa
149witnesswhoisanemployeeoftheschooldistrict,ortheuseofreasonableforcetoprotect
150personsorproperty,whenadministeredbypersonnelofaschooldistrictinareasonable

13preparationprogramsinMissouri.Theadvisoryboardshallincludeatleastthreeactive
14elementaryorsecondaryclassroomteachersandatleastthreefacultymemberswithin
15approvededucatorpreparationprograms.Theclassroom-teachermembersshallbe
16selectedtorepresentvariousregionsofthestateanddistrictsofdifferentsizes.The
17facultyrepresentativesshallrepresentinstitutionsfromvariousregionsofthestateand
18sizesofprogram.Theadvisoryboardshallholdregularmeetingsthatallowmembers
19toshareneedsandconcernsandplanstrategiestoenhanceteacherpreparation.
20 3.Uponapprovalbythestateboardofeducationoftheteachereducationprogramat
21aparticularteachertraininginstitution,anypersonwhograduatesfromthatprogram,and
22whomeetsotherrequirementswhichthestateboardofeducationshallprescribebyrule,
23regulationandstatuteshallbegrantedacertificateorlicensetoteachinthepublicschoolsof
24thisstate.However,nosuchruleorregulationshallrequirethattheprogramfromwhichthe
25persongraduatesbeaccreditedbyanynationalorregionalaccreditationassociation.
26 4.Thestateboardofeducationshall,inconsultationwithMABEP,alignliteracy
27andreadinginstructioncourseworkforteachereducationprogramsinearlychildhood,

14asappropriateforsuchvehicleandmeetanyadditionalrequirementsoftheschool
15district. Thestateboardofeducationmayalsoadoptrulesandregulationsgoverningtheuse
16ofauthorizedcommoncarriersforthetransportationofstudentsonfieldtripsorotherspecial
17tripsforeducationalpurposes.Everyschooldistrict,itsofficersandemployees,andevery
18personemployedundercontractbyaschooldistrictshallbesubjecttosuchregulations.The
19stateboardofeducationshallcooperatewiththestatetransportationdepartmentandthestate
20highwaypatrolinplacingsuitablewarningsignsatintervalsonthehighwaysofthestate.
21 2.Notwithstandingtheprovisionsofsubsection1ofthissection,anyschoolboardin
22thestateofMissouriinanurbandistrictcontainingthegreaterpartofthepopulationofacity
23whichhasmorethanthreehundredthousandinhabitantsmaycontractwithanymunicipality,
24bi-stateagency,orothergovernmentalentityforthepurposeoftransportingschoolchildren
25attendingagradeorgradesnotlowerthantheninthnorhigherthanthetwelfthgrade,
26providedthatsuchcontractshallbeforadditionaltransportationservices,andshallnot
27replaceorfulfillanyoftheschooldistrict'sobligationspursuanttosection167.231.The
28schooldistrictmaynotifystudentsoftheoptiontousedistrict-contractedtransportation
29services.
30 3.Anyofficeroremployeeofanyschooldistrictwhoviolatesanyoftheregulations
31orfailstoincludeobligationtocomplywithsuchregulationsinanycontractexecutedbyhim
32onbehalfofaschooldistrictshallbeguiltyofmisconductandsubjecttoremovalfromoffice
33oremployment.Anypersonoperatingaschoolbusundercontractwithaschooldistrictwho
