162.261.1.Thegovernmentandcontrolofaseven-directorschooldistrict,other
2thananurbandistrict,isvestedinaboardofeducationofsevenmembers,whoholdtheir
3officeforthreeyears,exceptasprovidedin[section] sections162.241and162.563, anduntil
4theirsuccessorsaredulyelectedandqualified.Anyvacancyoccurringintheboardshallbe
5filledbytheremainingmembersoftheboard;exceptthatiftherearemorethantwovacancies
6atanyonetime,thecountycommissionuponreceivingwrittennoticeofthevacanciesshall
7fillthevacanciesbyappointment.Iftherearemorethantwovacanciesatanyonetimeina
8countywithoutacountycommission,thecountyexecutiveuponreceivingwrittennoticeof
9thevacanciesshallfillthevacancies,withtheadviceandconsentofthecountycouncil,by

12 2.Noseven-director,urban,ormetropolitanschooldistrictboardofeducationshall
13hireaspouseofanymemberofsuchboardforavacantornewlycreatedpositionunlessthe
14positionhasbeenadvertisedpursuanttoboardpolicyandthesuperintendentofschools
15submitsawrittenrecommendationfortheemploymentofthespousetotheboardof

3candidateshalldeclareforatermofaspecificnumberofyearsandthedifferenttermsshall
4bevoteduponasseparatepropositions.
162.291.Exceptasprovidedinsection162.563,thevotersofeachseven-director
2districtotherthanurbandistrictsshall,atmunicipalelections,electtwodirectorswhoare
3citizensoftheUnitedStatesandresidenttaxpayersofthedistrict,whohaveresidedin[this
4state]thedistrictforoneyearnextprecedingtheirelectionorappointment,andwhoareat
5leasttwenty-fouryearsofage.
162.471.1.Thegovernmentandcontrolofanurbanschooldistrictisvestedina
2boardofsevendirectors.
3 2.Exceptasprovidedinsection162.563,eachdirectorshallbeavoterofthe
4districtwhohasresidedwithinthisstateforoneyearnextpreceding[his]thedirector's
5electionorappointmentandwhoisatleasttwenty-fouryearsofage.Alldirectors,exceptas
6otherwiseprovidedin[section] sections162.481[andsection], 162.492,and162.563,shall
7holdtheirofficesforsixyearsanduntiltheirsuccessorsaredulyelectedandqualified.All
8vacanciesoccurringintheboard,exceptasprovidedinsection162.492,shallbefilledby
9appointmentbytheboardassoonaspracticable,andthepersonappointedshallhold[his]
10officeuntilthenextschoolboardelection,when[his]asuccessorshallbeelectedforthe
11remainderoftheunexpiredterm.Thepoweroftheboardtoperformanyofficialdutyduring
12theexistenceofavacancycontinuesunimpairedthereby.
162.481.1.Exceptasotherwiseprovidedinthissectionand[insection] sections
2162.492and162.563, allelectionsofschooldirectorsinurbanschooldistrictsshallbeheld
3bienniallyatthesametimesandplacesasmunicipalelections.
4 2.Exceptasotherwiseprovidedinsubsections3,4,and5ofthissection,hereafter
5whenaseven-directordistrictbecomesanurbanschooldistrict,thedirectorsoftheprior
6seven-directordistrictshallcontinueasdirectorsoftheurbanschooldistrictuntilthe
7expirationofthetermsforwhichtheywereelectedanduntiltheirsuccessorsareelectedas
8providedinthissubsection.Thefirstbiennialschoolelectionfordirectorsshallbeheldinthe
9urbanschooldistrictatthetimeprovidedinsubsection1whichisonthedateofor
10subsequenttotheexpirationofthetermsofthedirectorsofthepriordistrictwhicharefirstto
11expire,anddirectorsshallbeelectedtosucceedthedirectorsofthepriordistrictwhoseterms
12haveexpired.Ifthetermsoftwodirectorsonlyhaveexpired,thedirectorselectedatthefirst
HB1804	2 13biennialschoolelectionintheurbanschooldistrictshallbeelectedfortermsofsixyears.If
14thetermsoffourdirectorshaveexpired,twodirectorsshallbeelectedfortermsofsixyears
15andtwoshallbeelectedfortermsoffouryears.Atthenextsucceedingbiennialelectionheld
16intheurbanschooldistrict,successorsfortheremainingdirectorsofthepriorseven-director
17districtshallbeelected.Ifonlytwodirectorsaretobeelectedtheyshallbeelectedforterms
18ofsixyearseach.Iffourdirectorsaretobeelected,twoshallbeelectedfortermsofsixyears
19andtwoshallbeelectedfortermsoftwoyears.Aftersevendirectorsoftheurbanschool
20districthavebeenelectedunderthissubsection,theirsuccessorsshallbeelectedfortermsof
21sixyears.
22 3.Inanyschooldistrictinwhichamajorityofthedistrictislocatedinanyhomerule
23citywithmorethanonehundredfifty-fivethousandbutfewerthantwohundredthousand
24inhabitants,electionsshallbeheldannuallyatthesametimesandplacesasgeneralmunicipal
25electionsforallyearswhereoneormoretermsexpire,andthetermsshallbeforthreeyears
26anduntiltheirsuccessorsaredulyelectedandqualifiedforalldirectorselectedonandafter
27August28,1998.
28 4.Foranyschooldistrictwhichbecomesanurbanschooldistrictbyreasonofthe
292000federaldecennialcensus,electionsshallbeheldannuallyatthesametimesandplaces
30asgeneralmunicipalelectionsforallyearswhereoneormoretermsexpire,andtheterms
31shallbeforthreeyearsanduntiltheirsuccessorsaredulyelectedandqualifiedforall
32directorselectedonandafterAugust28,2001.
33 5.Inanyschooldistrictinanycountywithacharterformofgovernmentandwith
34morethanthreehundredthousandbutfewerthanfourhundredfiftythousandinhabitants
35whichbecomesanurbanschooldistrictbyreasonofthe2010federaldecennialcensus,
36electionsshallbeheldannuallyatthesametimesandplacesasgeneralmunicipalelections
37forallyearswhereoneormoretermsexpire,andthetermsshallbeforthreeyearsanduntil
38theirsuccessorsaredulyelectedandqualifiedforalldirectorselectedonandafterApril2,
392012.
40 6.Inanyurbanschooldistrictinacountyofthefirstclassificationwithmorethan
41eighty-threethousandbutfewerthanninety-twothousandinhabitantsandwithahomerule
42citywithmorethanseventy-sixthousandbutfewerthanninety-onethousandinhabitantsas
43thecountyseat,electionsshallbeheldannuallyatthesametimesandplacesasgeneral
44municipalelectionsforallyearswhereoneormoretermsexpire,anduponexpirationofany
45termafterAugust28,2015,thetermofofficeshallbeforthreeyearsanduntiltheir
46successorsaredulyelectedandqualified.
162.491.1.Directorsforurbanschooldistricts,otherthanthosedistrictscontaining
2thegreaterpartofacityofoveronehundredthirtythousandinhabitants,maybenominated
3bypetitiontobefiledwiththesecretaryoftheboardandsignedbyanumberofvotersinthe
HB1804	3 4districtequaltotenpercentofthetotalnumberofvotescastforthedirectorreceivingthe
5highestnumberofvotescastatthenextprecedingbiennialelection,exceptasprovidedin
6subsection4ofthissection.
7 2.Thissectionshallnotbeconstruedasprovidingthesolemethodofnominating
8candidatesfortheofficeofschooldirectorinurbanschooldistricts[which] thatdonot
9containthegreaterpartofacityofoverthreehundredthousandinhabitants.
10 3.Adirectorforanyurbanschooldistrictcontainingacityofgreaterthanone
11hundredthirtythousandinhabitantsandlessthanthreehundredthousandinhabitantsmaybe
12nominatedasanindependentcandidatebyfilingwiththesecretaryoftheboardapetition
13signedbyfivehundredregisteredvotersofsuchschooldistrict.
14 4.Inanyurbanschooldistrictlocatedinacountyofthefirstclassificationwithmore
15thaneighty-threethousandbutfewerthanninety-twothousandinhabitantsandwithahome
16rulecitywithmorethanseventy-sixthousandbutfewerthanninety-onethousandinhabitants
17asthecountyseat,acandidatefordirectorshallfileadeclarationofcandidacywiththe
18secretaryoftheboardandshallnotberequiredtosubmitapetition.
19 5.Nocandidateforelectionasaschoolboarddirectorrepresentingasubdistrict
20asprovidedinsection162.563shallberequiredtofileadeclarationofcandidacyas
21providedinthissectionasthesolemethodoffilingforcandidacy.
