BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Section37.850,RSMo,isrepealedandtwonewsectionsenactedinlieu 2thereof,tobeknownassections37.850and161.841,toreadasfollows: 37.850.1.ThecommissionerofadministrationshallmaintaintheMissouri 2accountabilityportalestablishedinexecutiveorder07-24asafree,internet-basedtool 3allowingcitizenstodemandfiscaldisciplineandresponsibility. 4 2.TheMissouriaccountabilityportalshallconsistofaneasy-to-searchdatabaseof 5financialtransactionsrelatedtothepurchaseofgoodsandservices, includingallformsof 6compensationandbenefitspaidtooronbehalfofemployees,andthedistributionoffunds 7forstateprograms;allbondsissuedbyanypublicinstitutionofhighereducation, public 8schooldistrict,orpoliticalsubdivisionofthisstateoritsdesignatedauthorityafterAugust 928,2013;allobligationsissuedorincurredpursuanttosection99.820byanypolitical 10subdivisionofthisstateoritsdesignatedauthority;andtherevenuestreampledgedtorepay 11suchbondsorobligations;andalldebtincurredbyanypubliccharterschool. 12 3.TheMissouriaccountabilityportalshallbeupdatedeachstatebusinessdayand 13maintainedastheprimarysourceofinformationabouttheactivityofMissouri'sgovernment. 14 4.Upontheconductingofawithholdingorareleaseoffunds,thegovernorshall 15submitareportstatingallamountswithheldfromthestate'soperatingbudgetforthecurrent 16fiscalyear,asauthorizedbyArticleIV,Section27oftheMissouriConstitutionwhichshall 17be: 18 (1)Conspicuouslypostedontheaccountabilityportalwebsite; EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 19 (2)Searchablebytheamountswithheldorreleasedfromeachindividualfund;and 20 (3)Searchablebythetotalamountwithheldorreleasedfromtheoperatingbudget. 21 5.Everypoliticalsubdivisionofthestate,includingpublicinstitutionsofhigher 22education[butexcluding] andpublicschooldistricts,shallsupplyallinformationdescribed 23insubsection2ofthissectiontotheofficeofadministrationwithinsevendaysofissuingor 24incurringsuchcorrespondingbondorobligation.Forallsuchbondsorobligationsissuedor 25incurredpriortoAugust28,2013,everysuchpoliticalsubdivisionandpublicinstitutionof 26highereducationshallhaveninetydaystosupplysuchinformationtotheofficeof 27administration. 28 6.Everyschooldistrictandpubliccharterschoolshallsupplyallinformation 29describedinsubsection2ofthissectiontothedepartmentofelementaryandsecondary 30educationwithinsevendaysofissuingsuchbond,orincurringsuchdebt.Thedepartmentof 31elementaryandsecondaryeducationshallhaveforty-eighthourstodeliversuchinformation 32totheofficeofadministration.ForallsuchbondsissuedordebtincurredpriortoAugust28, 332013,everyschooldistrictandpubliccharterschoolshallhaveninetydaystosupplysuch 34informationtothedepartmentofelementaryandsecondaryeducation.Thedepartmentof 35elementaryandsecondaryeducationshallhaveforty-eighthourstodeliversuchinformation 36totheofficeofadministration. 161.841.1.Thissectionshallbeknownandmaybecitedasthe"Parents'Billof 2RightsActof2022". 3 2.Asusedinthissection,theterm"parent"meansachild'sparent,guardian,or 4otherpersonhavingcontrolorcustodyofthechild. 5 3.Thissectionshallbeconstruedtoempowerparentstoenforcethefollowing 6rightsagainstschooldistrictsandpublicschoolsinwhichtheirchildrenareenrolled 7thatreceiveanyfederalorstatemoneys: 8 (1)Therighttoknowwhattheirminorchildisbeingtaughtinschoolincluding, 9butnotlimitedto,curricula,books,andotherinstructionalmaterials; 10 (2)Therighttoreceiveinformationaboutwhoisteachingtheirminorchild 11including,butnotlimitedto,guestlecturersandoutsidepresenters; 12 (3)Therighttoreceiveinformationaboutindividualsandorganizations 13receivingschoolcontractsandfunding; 14 (4)Therighttovisittheschoolandcheckinontheirminorchildduringschool 15hours; 16 (5)Therighttoviewand,uponrequest,receiveallschoolrecords,medicalor 17otherwise,concerningtheirminorchild; 18 (6)Therighttoreceiveinformationaboutthecollectionandtransmissionof 19theirminorchild'sdata; HCSHB1858 2 20 (7)Therighttohavesufficientandeffectiveaccountabilityandtransparency 21regardingschoolboards;and 22 (8)Therighttoknowaboutsituationsaffectingtheirminorchild'ssafetyin 23school. 24 4.Thedepartmentofelementaryandsecondaryeducationshalldeveloppolicies 25andproceduresforschooldistrictsandpublicschoolstofollowtoaccommodateand 26assistparentsintheexerciseoftheparentalrightstoknowandreceiveinformationas 27describedinsubsection3ofthissection.Suchpoliciesandproceduresshalldescribethe 28methodseachschooldistrictandpublicschoolshallusetoprovidesuchinformationand 29shallallowparentstoexercisesuchparentalrightstothefullestextent.Eachschool 30boardshalladoptsuchpoliciesandproceduresforthe2023-24schoolyearandall 31subsequentschoolyears. 32 5.Noschooldistrictorpublicschoolshallrequirenondisclosureagreementsor 33similarformsforaparent'sreviewofcurricula.Eachpublicschoolorschooldistrict 34shallallowparentstomakeacopyofcurriculumdocumentsorreceivesuchcurriculum 35documentsinanelectronicformat,providedthatnorequestwouldcausean 36infringementofcopyrightprotectionsprovidedunderthefederalCopyrightActof 371976(17U.S.C.Section101etseq.),asamended. 38 6.Noschooldistrictorpublicschoolshallrequirenondisclosureagreementsor 39similarformsforaparent'sreviewofindividualizededucationprogrammeetings, 40mediations,dueprocesshearings,orotherdisputeresolutionoptionsasoutlinedin 41accordancewith34CFR300.320to300.324andunder20U.S.C.Section1401,as 42amended. 43 7.Noschooldistrictorpublicschoolshallallowstudentinvolvementinschool 44assemblies,fieldtrips,orotherextracurricularactivitiesunlessthechild'sparents 45providewrittenauthorizationforsuchstudentinvolvement. 46 8.Noschooldistrictorpublicschoolshallcollectanybiometricdataorother 47sensitivepersonalinformationaboutaminorchildwithoutobtainingwrittenparental 48consentbeforecollectingsuchdataorinformation. 49 9.Noschooldistrictorpublicschoolshallprovideanyschoolrecordsas 50describedinsubdivision(5)ofsubsection3ofthissectioninviolationofanyrelevant 51stateorfederalprivacylaworpoliciesprotectingorlimitingaccesstosuchminorchild's 52schoolrecords. 53 10.Eachschoolboardmeetingpertainingtocurriculaorgeneralsafetyshallbe 54heldinpublicandallowforpubliccomments,subjecttotheauthorizedclosureofany 55portionofsuchmeetingundersection610.021. HCSHB1858 3 56 11.Eachschooldistrictandpublicschoolshallnotifyparentsinatimelymanner 57ofallreportedincidentspertainingtostudentsafetyincluding,butnotlimitedto,any 58felonyormisdemeanorcommittedbyteachersorotherschoolemployeesandanyactor 59instancereportableundersubsections1,2,or3ofsection167.117. 60 12.Eachschooldistrictandpublicschoolmayadoptreasonableproceduresfor 61parentstofollowwhenexercisingtheparentalrighttovisittheschoolandtheirminor 62childduringschoolhours.Noschooldistrictorpublicschoolshallallowanindividual 63tohaveanyinteractionwithaminorchildinviolationofanyorderenteredunderany 64provisionofstateorfederallawrestrictingorprohibitingsuchindividualfrom 65interactingwithsuchminorchild. 66 13.Eachschoolboardshallaffirmtheboard'scommitmenttoensuring 67sufficientandeffectiveaccountabilityandtransparencytoparentsintheschooldistrict 68byadoptingpoliciesthatrequiremembersoftheboardtocollectivelyandindividually: 69 (1)Recognizeandaffirmtheprotectedrightofparentstodirecttheeducationof 70theirminorchild; 71 (2)Assistparentsintheexerciseofparentalrightstothefullestextent; 72 (3)Encouragecommunicationbetweenparentsandschoolboardmembers 73relatingtoparentalrightsandparentalconcernsabouttheirminorchild'seducation 74andeducationalexperience; 75 (4)Collaboratewithparentstoidentifywaysinwhichparentscanexercise 76parentalrightsandcommunicatesuchwaystoparentsinaclear,consistentmannerthat 77canbeeasilyunderstoodbyallparentsintheschooldistrict;and 78 (5)Conductschoolboardmeetingsinamannerthatinformsparentsofschool 79boarddecisionsandactionswhileencouragingandremainingresponsivetoparental 80input,requests,concerns,andrights. 81 14.Parentsmaybringacivilactionforinjunctivereliefagainsttheschool 82districtorpublicschoolinwhichtheirchildisenrolledifsuchschooldistrictorpublic 83schoolviolatesthissection.Suchactionshallbebroughtinthecountywherethe 84violationoccurred.Ifacourtfindsthattheschooldistrictorpublicschoolhas 85knowinglyengagedinmultipleorrepeatedviolationsofthissection,thedepartmentof 86elementaryandsecondaryeducationshallwithholdallmoneysprovidedbymonthly 87distributionofstateformulafundingtosuchschooldistrictorpublicschooluntilsuch 88schooldistrictorpublicschoolisincompliancewiththissection.Aftertheschool 89districtorpublicschoolprovidesevidencethatsuchschooldistrictorpublicschoolisin 90compliancewiththissection,thedepartmentshallrestorethedistributionofthefunding 91toitsoriginalamountbeforethedistributionwaswithheld.Anymoneysthatwere 92withheldunderthissubsectionshallbereleasedtosuchschooldistrictorpublicschool HCSHB1858 4 93onlyifsuchschooldistrictorpublicschoolestablishescompliancewiththissectionin 94thesameschoolyearinwhichthedepartmentwithheldsuchmoneys. ✔ HCSHB1858 5
