168.021.1.Certificatesoflicensetoteachinthepublicschoolsofthestateshallbe
2grantedasfollows:
3 (1)Bythestateboard,underrulesandregulationsprescribedbyit:
4 (a)Uponthebasisofcollegecredit;
5 (b)Uponthebasisofexamination;
6 (2)Bythestateboard,underrulesandregulationsprescribedbythestateboardwith
7advicefromtheadvisorycouncilestablishedbysection168.015toanyindividualwho
8presentstothestateboardavaliddoctoraldegreefromanaccreditedinstitutionofhigher
9educationaccreditedbyaregionalaccreditingassociationsuchasNorthCentralAssociation.
10Suchcertificateshallbelimitedtothemajorareaofpostgraduatestudyoftheholder,shallbe
11issuedonlyaftersuccessfulcompletionoftheexaminationrequiredforgraduationpursuant
12torulesadoptedbythestateboardofeducation,andshallberestrictedtothosecertificates
13establishedpursuanttosubdivision(2)ofsubsection3ofthissection;
14 (3)Bythestateboard,whichshallissuetheprofessionalcertificateclassificationin
15boththegeneralandspecializedareasmostcloselyalignedwiththecurrentareasof

18 (a)Recommendationofastate-approvedbaccalaureate-levelteacherpreparation
19program;
20 (b)SuccessfulattainmentoftheMissouriqualifyingscoreontheexitassessmentfor
21teachersoradministratorsdesignatedbythestateboardofeducation.Applicantswhohave
22notsuccessfullyachievedaqualifyingscoreonthedesignatedexaminationswillbeissueda
23two-yearnonrenewableprovisionalcertificate;and
24 (c)Uponcompletionofabackgroundcheckasprescribedinsection168.133and
25possessionofavalidteachingcertificateinthestatefromwhichtheapplicant'steacher
26preparationprogramwascompleted;
27 (4)Bythestateboard,underrulesprescribedbyit,onthebasisofarelevant
28bachelor'sdegree,orhigherdegree,andapassingscoreforthedesignatedexitexamination,
29forindividualswhoseacademicdegreeandprofessionalexperiencearesuitabletoprovidea
30basisforinstructionsolelyinthesubjectmatterofbankingorfinancialresponsibility,atthe
31discretionofthestateboard.Suchcertificateshallbelimitedtothemajorareaofstudyofthe
32holderandshallberestrictedtothosecertificatesestablishedundersubdivision(2)of
33subsection3ofthissection.Holdersofcertificatesgrantedunderthissubdivisionshallbe
34exemptfromtheteachertenureactundersections168.102to168.130andeachschooldistrict
35shallhavethedecision-makingauthorityonwhethertohiretheholdersofsuchcertificates;
36 (5)Bythestateboard,underrulesandregulationsprescribedbyit,onthebasisof
37certificationbytheAmericanBoardforCertificationofTeacherExcellence(ABCTE)and
38verificationofabilitytoworkwithchildrenasdemonstratedbysixtycontacthoursinanyone
39ofthefollowingareasasvalidatedbytheschoolprincipal:sixtycontacthoursinthe
40classroom,ofwhichatleastforty-fivemustbeteaching;sixtycontacthoursasasubstitute
41teacher,withatleastthirtyconsecutivehoursinthesameclassroom;sixtycontacthoursof
42teachinginaprivateschool;orsixtycontacthoursofteachingasaparaprofessional,foran
43initialfour-yearABCTEcertificateoflicensetoteach,exceptthatsuchcertificateshallnotbe
44grantedfortheareasofearlychildhoodeducation,orspecialeducation.Forcertificationin
45theareaofelementaryeducation,ninetycontacthoursintheclassroomshallberequired,of
46whichatleastthirtyshallbeinanelementaryclassroom.Uponthecompletionofthe
47followingrequirements[listedinparagraphs(a),(b),(c),and(d)ofthissubdivision], an
48applicantshallbeeligibletoapplyforacareercontinuousprofessionalcertificateunder
49subdivision(3)ofsubsection3ofthissection:
50 (a)Completionofthirtycontacthoursofprofessionaldevelopmentwithinfouryears,
51whichmayincludehoursspentinclassinanappropriatecollegecurriculum;

53BoardforCertificationofTeacherExcellenceoradistrictmentoringprogramapprovedby
54thestateboardofeducation;
55 (c)Attainmentofasuccessfulperformance-basedteacherevaluation;and
56 (d)Participationinabeginningteacherassistanceprogram;[or]
57 (6)(a)Bythestateboard,underrulesandregulationsprescribedbyit,whichshall
58issueaninitialvisitingscholarscertificateatthediscretionoftheboard,basedonthe

60 [(a)]a.Verificationfromthehiringschooldistrictthattheapplicantwillbeemployed
61aspartofabusiness-educationpartnershipinitiativedesignedtobuildcareerpathways
62systemsforstudentsinagradeorgradesnotlowerthantheninthgradeforwhichthe
63applicant'sacademicdegreeorprofessionalexperiencequalifies[himorher]theapplicant;
64 [(b)]b.Appropriateandrelevantbachelor'sdegreeorhigher,occupationallicense,or
65industry-recognizedcredential;
66 [(c)]c.Completionoftheapplicationforaone-yearvisitingscholarscertificate;and
67 [(d)]d.Completionofabackgroundcheckasprescribedundersection168.133.
68 (b)Theinitialvisitingscholarscertificateshallcertifytheholderofsuchcertificateto
69teachforoneyear.Anapplicantshallbeeligibletorenewaninitialvisitingscholars
70certificateamaximumoftwotimes,baseduponthecompletionoftherequirementslisted
71under[paragraphs(a),(b),and(d)]subparagraphsa.,b.,andd.ofparagraph(a)ofthis
72subdivision;completionofprofessionaldevelopmentrequiredbytheschooldistrictand
73school;andattainmentofasatisfactoryperformance-basedteacherevaluation; or
74 (7)Bythestateboard,upontheissuanceofaschooldistrictteachingpermit
75undersection168.029.Anycertificategrantedasprovidedinthissubdivisionshallbe
76designatedasaschooldistrictteachingpermitapprovedbytheschooldistrictissuing
77thepermitundersection168.029.
78 2.Allvalidteachingcertificatesissuedpursuanttolaworstateboardpoliciesand
79regulationspriortoSeptember1,1988,shallbeexemptfromtheprofessionaldevelopment
80requirementsofthissectionandshallcontinueineffectuntiltheyexpire,arerevokedor
81suspended,asprovidedbylaw.Whensuchcertificatesarerequiredtoberenewed,thestate
82boardoritsdesigneeshallgranttoeachholderofsuchacertificatethecertificatemostnearly
83equivalenttotheonesoheld.Anyonewhoholds,asofAugust28,2003,avalidPC-I,PC-II,
84orcontinuousprofessionalcertificateshall,uponexpirationof[hisorher]theperson's
85currentcertificate,beissuedtheappropriatelevelofcertificatebasedupontheclassification
86systemestablishedpursuanttosubsection3ofthissection.
87 3.(1)Certificatesoflicensetoteachinthepublicschoolsofthestateshallbebased
88uponminimumrequirementsprescribedbythestateboardofeducationwhichshallinclude
HB1998	3 89completionofabackgroundcheckasprescribedinsection168.133.Thestateboardshall
90provideforthefollowinglevelsofprofessionalcertification:aninitialprofessionalcertificate
91andacareercontinuousprofessionalcertificate.
92 (2)Theinitialprofessionalcertificateshallbeissueduponcompletionof
93requirementsestablishedbythestateboardofeducationandshallbevalidbasedupon
94verificationofactualteachingwithinaspecifiedtimeperiodestablishedbythestateboardof
95education.Thestateboardshallrequireholdersofthefour-yearinitialprofessionalcertificate
96to:
97 (a)Participateinamentoringprogramapprovedandprovidedbythedistrictfora
98minimumoftwoyears;
99 (b)Completethirtycontacthoursofprofessionaldevelopment,whichmayinclude
100hoursspentinclassinanappropriatecollegecurriculum,orforholdersofacertificateunder
101subdivision(4)ofsubsection1ofthissection,anamountofprofessionaldevelopmentin
102proportiontothecertificateholder'shoursintheclassroom,ifthecertificateholderis
103employedlessthanfulltime;and
104 (c)Participateinabeginningteacherassistanceprogram.
105 (3)(a)Thecareercontinuousprofessionalcertificateshallbeissuedupon
106verificationofcompletionoffouryearsofteachingundertheinitialprofessionalcertificate
107anduponverificationofthecompletionoftherequirementsarticulatedinparagraphs(a)[,(b),
108and]to(c)ofsubdivision(2)ofthissubsectionorparagraphs(a)[,(b),(c),and]to(d)of
109subdivision(5)ofsubsection1ofthissection.
110 (b)Thecareercontinuousprofessionalcertificateshallbecontinuousbasedupon
111verificationofactualemploymentinaneducationalpositionasprovidedforinstateboard
112guidelinesandcompletionoffifteencontacthoursofprofessionaldevelopmentperyear
113whichmayincludehoursspentinclassinanappropriatecollegecurriculum.[Should] Ifthe
114possessorofavalidcareercontinuousprofessionalcertificate[fail]fails,inanygivenyear,to
115meetthefifteen-hourprofessionaldevelopmentrequirement,thepossessormay,withintwo
116years,makeupthemissinghours.Inordertomakeupformissinghours,thepossessorshall
117firstcompletethefifteen-hourrequirementforthecurrentyearandthenmaycounthoursin
118excessofthecurrentyearrequirementasmake-uphours.[Should] Ifthepossessor[fail]fails
119tomakeupthemissinghourswithintwoyears,thecertificateshallbecomeinactive.Inorder
120toreactivatethecertificate,thepossessorshallcompletetwenty-fourcontacthoursof
121professionaldevelopmentwhichmayincludehoursspentintheclassroominanappropriate
122collegecurriculumwithinthesixmonthspriortoorafterreactivating[hisorher]the
123possessor'scertificate.Therequirementsofthisparagraphshallbemonitoredandverifiedby
124thelocalschooldistrict[which] thatemploystheholderofthecareercontinuousprofessional
125certificate.
HB1998	4 126 (c)Aholderofacareercontinuousprofessionalcertificateshallbeexemptfromthe
127professionaldevelopmentcontacthourrequirementsofparagraph(b)ofthissubdivisionif
128suchteacherhasalocalprofessionaldevelopmentplaninplacewithinsuchteacher'sschool
129districtandmeetstwoofthethreefollowingcriteria:
130 a.Hastenyearsofteachingexperienceasdefinedbythestateboardofeducation;
131 b.Possessesamaster'sdegree;or
132 c.Obtainsarigorousnationalcertificationasapprovedbythestateboardof
133education.
134 4.Policiesandproceduresshallbeestablishedbywhichateacherwhowasnot
135retainedduetoareductioninforcemayretainthecurrentlevelofcertification.Thereshall
136alsobeestablishedpoliciesandproceduresallowingateacherwhohasnotbeenemployedin
137aneducationalpositionforthreeyearsormoretoreactivate[hisorher]theteacher'slast
138levelofcertificationbycompletingtwenty-fourcontacthoursofprofessionaldevelopment
139whichmayincludehoursspentintheclassroominanappropriatecollegecurriculumwithin
140thesixmonthspriortoorafterreactivating[hisorher]theteacher'scertificate.
141 5.Thestateboardshall,uponcompletionofabackgroundcheckasprescribedin
142section168.133,issueaprofessionalcertificateclassificationintheareasmostclosely
143alignedwithanapplicant'scurrentareasofcertification,commensuratewiththeyearsof
144teachingexperienceoftheapplicant,toanypersonwhoishiredtoteachinapublicschoolin
145thisstateandwhopossessesavalidteachingcertificatefromanotherstateorcertification
146undersubdivision(4)ofsubsection1ofthissection,providedthatthecertificateholdershall
147annuallycompletethestateboard'srequirementsforsuchlevelofcertification,andshall
148establishpoliciesbywhichresidentsofstatesotherthanthestateofMissourimaybeassessed
149afeeforacertificateoflicensetoteachinthepublicschoolsofMissouri.Suchfeeshallbein
150anamountsufficienttorecoveranyorallcostsassociatedwiththeissuingofacertificateof
151licensetoteach.Theboardshallpromulgaterulestoauthorizetheissuanceofaprovisional
152certificateoflicense,whichshallbevalidforthreeyearsandshallallowtheholdertoassume
153classroomdutiespendingthecompletionofacriminalbackgroundcheckundersection
154168.133,foranyapplicantwho:
155 (1)IsthespouseofamemberoftheArmedForcesstationedinMissouri;
156 (2)Relocatedfromanotherstatewithinoneyearofthedateofapplication;
157 (3)Underwentacriminalbackgroundcheckinordertobeissuedateaching
158certificateoflicensefromanotherstate;and
159 (4)Otherwisequalifiesunderthissection.
160 6.Thestateboardmayassesstoholdersofaninitialprofessionalcertificateafee,to
161bedepositedintotheexcellenceineducationrevolvingfundestablishedpursuanttosection
162160.268,fortheissuanceofthecareercontinuousprofessionalcertificate.However,suchfee
HB1998	5 163shallnotexceedthecombinedcostsofissuanceandanycriminalbackgroundcheckrequired
164asaconditionofissuance.ApplicantsfortheinitialABCTEcertificateshallberesponsible
165foranyfeesassociatedwiththeprogramleadingtotheissuanceofthecertificate,butnothing
166inthissectionshallprohibitadistrictfromdevelopingapolicythatpermitsfee
167reimbursement.
168 7.AnymemberofthepublicschoolretirementsystemofMissouriwhoentered
169coveredemploymentwithtenormoreyearsofeducationalexperienceinanotherstateor
170statesandheldacertificateissuedbyanotherstateandsubsequentlyworkedinaschool
171districtcoveredbythepublicschoolretirementsystemofMissourifortenormoreyearswho
172laterbecamecertificatedinMissourishallhavethatcertificatedatedbackto[hisorher]the
173member'soriginaldateofemploymentinaMissouripublicschool.
174 8.Withinthirtydaysofreceivinganapplicationfromaspouseofanactiveduty
175memberoftheArmedForcesoftheUnitedStateswhohasbeentransferredorisscheduledto
176betransferredtothestateofMissouri,orwhohasbeentransferredorisscheduledtobe
177transferredtoanadjacentstateandisorwillbedomiciledinthestateofMissouri,orhas
178movedtothestateofMissourionapermanentchange-of-stationbasisandhassuccessfully
179completedthebackgroundcheckdescribedundersubsection5ofthissectionandsection
180168.133,thestateboardshallissuetosuchapplicantafullcertificateoflicensetoteach,
181providedthattheapplicanthaspaidallnecessaryfeesandhasotherwisemetallrequirements
182tobeissuedsuchacertificate.
168.029.1.Asprovidedinthissection,anyschooldistrictmayissueaschool
2districtteachingpermittoanyindividualwhodoesnotholdateachingcertificateissued
3bythestateboardofeducation.
4 2.(1)Aschooldistrictmayemployanyindividualtowhomthedistrictissuesa
5schooldistrictteachingpermit.
6 (2)(a)Anyschooldistrictthatissuesaschooldistrictteachingpermitas
7providedinthissectionshalldevelopapolicylistingthequalificationsanindividual
8shallmeettobeeligiblefortheteachingpermit.Theschooldistrictshallsubmitsuch
9policytothedepartmentofelementaryandsecondaryeducation,butsuchpolicyshall
10notbesubjecttoapprovalordisapprovalbythedepartment.
11 (b)Thequalificationsrequiredintheschooldistrict'spolicyshallinclude,but
12notbelimitedto:
13 a.Attainmentofabachelor'sdegree;
14 b.Participationinprofessionaldevelopmentinlessonplanningandclassroom
15management;
16 c.Participationinamentoringprogramfortheteacherpossessingthepermit;
17and

19 (c)Immediatelyafteremployinganindividualasprovidedinthissection,the
20schooldistrictshallsendtothestateboardofeducationawrittenstatementidentifying
21theindividual,theindividual'squalificationsasateacher,andthesubjectorclassthe
22individualwillteach.
23 3.Noindividualauthorizedtoteachasprovidedinthissectionshallbe
24authorizedtoteachinanotherschooldistrictunlesstheotherdistrictissuesteaching
25permitsasprovidedinthissectionandrecognizestheissuingdistrict'steachingpermit.
26Anyteachingpermitissuedasprovidedinthissectionshallbevalidintheschooldistrict
27issuingtheteachingpermitandinanyschooldistrictrecognizingtheteachingpermitas

30 4.Thepercentageofaschooldistrict'steachersissuedanyteachingpermitas
31providedinthissectionandemployedbytheschooldistrictshallnotexceedfifteen
32percentofthetotalnumberofteachersemployedbytheschooldistrict.
33 5.Anyindividualissuedateachingpermitasprovidedinthissectionshallbe
34issuedateachingcertificatebythestateboardofeducationundersubdivision(7)of
35subsection1ofsection168.021.Anyindividualissuedateachingpermitasprovidedin

168.036.1.Inadditiontograntingcertificatesoflicensetoteachinpublic
2schoolsofthestateundersection168.021,thestateboardofeducationshallgrant
3substituteteachercertificatesasprovidedinthissectiontoanyindividualseekingto
4substituteteachinanypublicschoolinthisstate.
5 2.(1)Thestateboardshallnotgrantacertificateoflicensetoteachunderthis
6sectiontoanyindividualwhohasnotcompletedabackgroundcheckasdescribedin
7section168.133.
HB1998	7 8 (2)Abackgroundcheckconductedunderthissubsectionshallbevalidforfour
9yearsforpurposesofthecertificategrantedunderthissectionandshallbe
10transferrablefromoneschooldistricttoanotherdistrictexceptasprovidedin
11subdivision(3)ofthissubsection.
12 (3)Aschooldistrictemployingasubstituteteacherwhohasacertificategranted
13underthissectionmayrequiretheteachertocompletethebackgroundcheckannually.
14Aschooldistrictmayrequirethebackgroundcheckrequiredinthissectionforanewly
15hiredsubstituteteachertobeconductedattheteacher'sexpense.
16 (4)Thestateboardmayrefusetoissueorrenew,suspend,orrevokeany
17certificatesoughtorissuedunderthissectioninthesamemannerandforthesame
18reasonsasprovidedinsection168.071.
19 3.Thestateboardmaygrantacertificateunderthissectiontoanyindividual
20whohascompletedthebackgroundcheckrequiredinthissectionandwhohas
21completed:
22 (1)Atleastthirty-sixsemesterhoursatanaccreditedinstitutionofhigher
23educationandtheorientationrequiredinsubsection6ofthissection;or
24 (2)Thetwenty-houronlinetrainingprogramrequiredinthissectionandwho
25possessesahighschooldiplomaortheequivalentthereof.
26 4.Thestateboardmaygrantacertificateunderthissectiontoanyhighly
27qualifiedindividualwithexpertiseinatechnicalorbusinessfieldorwithexperiencein
28theArmedForcesoftheUnitedStateswhohascompletedthebackgroundcheck
29requiredinthissectionbutdoesnotmeetanyofthequalificationsinsubdivision(1)or
30(2)ofsubsection3ofthissectionifthesuperintendentoftheschooldistrictsponsors
31suchindividualandtheschoolboardoftheschooldistrictinwhichtheindividualseeks
32tosubstituteteachvotestoapprovesuchindividualtosubstituteteach.
33 5.(1)Anindividualtowhomthestateboardgrantsacertificateunderthis
34sectionmaybeasubstituteteacherinanypublicschoolinthestateifaschooldistrict
35superintendent,schooldistrictassistantsuperintendent,orpublicschoolprincipalin
36thisstateagreestoemploytheindividualasasubstituteteacher.
37 (2)Noindividualtowhomthestateboardgrantsacertificateunderthissection
38andwhoisundertwentyyearsofageshallbeasubstituteteacheringradesnineto
39twelve.
40 6.Anindividualtowhomthestateboardgrantsacertificateunderthissection
41shallcompleteanorientationdevelopedandofferedbytheschooldistrictforwhichthe
42individualoriginallyteaches.Theorientationforsuchindividualshallcontainatleast
43twohoursofsubjectsappropriateforsubstituteteachersandshallcontaininstruction
44ontheschooldistrict'sbestpracticesforclassroommanagement.Suchorientation
HB1998	8 45completedinanyschooldistrictmaybeacceptedbyanysubsequentdistrictinwhichthe
46individualsubstituteteaches.Asubsequentschooldistrictmayrequiretheindividualto
47completeaseparateanddistinctlocalorientationfortheparticularschooldistrict
48beforetheindividualmaysubstituteteachinthesubsequentschooldistrict.
49 7.Acertificategrantedunderthissectionshallbevalidforfouryears.A
50certificategrantedunderthissectionshallexpireattheendofanycalendaryearin
51whichtheindividualfailstosubstituteteachforatleastfivedaysorfortyhoursofin-
52seatinstruction.
53 8.Thedepartmentofelementaryandsecondaryeducationshalldevelopan
54onlinetrainingprogramforindividualsgrantedacertificateundersubdivision(2)of
55subsection3ofthissection.Thetrainingprogramshallconsistoftwentyhoursof
56trainingrelatedtosubjectsappropriateforsubstituteteachersasdeterminedbythe
57department.Asubstituteteachershallcompleteanorientationforsubstituteteachers
58providedbytheschooldistrictinwhichthesubstituteteacherteaches.
59 9.Anyindividualpossessingavalidcertificateoflicensetoteachgrantedbythe
60stateboardshallbedeemedtobeasubstituteteacherunderthissectioniftheindividual
61hascompletedabackgroundcheckasrequiredinthissection.
62 10.Thestateboardmayexercisetheboard'sauthorityunderchapter161to
63promulgateallnecessaryrulesandregulationsnecessaryfortheadministrationofthis
64section.
168.133.1.Asusedinthissection,"screenedvolunteer"shallmeananypersonwho
2assistsaschoolbyprovidinguncompensatedserviceandwhomayperiodicallybeleftalone
3withstudents.Theschooldistrictshallensurethatacriminalbackgroundcheckisconducted
4forallscreenedvolunteers,whoshallcompletethecriminalbackgroundcheckpriortobeing
5leftalonewithastudent.Screenedvolunteersinclude,butarenotlimitedto,personswho
6regularlyassistintheofficeorlibrary,mentorortutorstudents,coachorsuperviseaschool-
7sponsoredactivitybeforeorafterschool,orchaperonestudentsonanovernighttrip.

13totheindividualhavingcontactwithanypupil.Suchpersonsinclude,butarenotlimitedto,
14administrators,teachers,substituteteachers,aides,paraprofessionals,assistants,secretaries,
15custodians,cooks,screenedvolunteers,andnurses.Theschooldistrictshallalsoensurethata
16criminalbackgroundcheckisconductedforschoolbusdrivers.Thedistrictmayallowsuch
17driverstooperatebusespendingtheresultofthecriminalbackgroundcheck.Forbusdrivers,

23Personnelwhohavesuccessfullyundergoneacriminalbackgroundcheckandacheckofthe
24familycaresafetyregistryaspartoftheprofessionallicenseapplicationprocessundersection
25168.021andwhohavereceivedclearanceonthecheckswithinoneprioryearofemployment
26shallbeconsideredtohavecompletedthebackgroundcheckrequirement.Acriminal
27backgroundcheckunderthissectionshallincludeasearchofanyinformationpublicly
28availableinanelectronicformatthroughapublicindexorsinglecasedisplay.
29 3.Inordertofacilitatethecriminalhistorybackgroundcheck,theapplicantshall
30submitasetoffingerprintscollectedpursuanttostandardsdeterminedbytheMissouri
31highwaypatrol.Thefingerprintsshallbeusedbythehighwaypatroltosearchthecriminal
32historyrepositoryandshallbeforwardedtotheFederalBureauofInvestigationforsearching
33thefederalcriminalhistoryfiles.
