76designatedasaschooldistrictteachingpermitapprovedbytheschooldistrictissuing 77thepermitundersection168.029. 78 2.Allvalidteachingcertificatesissuedpursuanttolaworstateboardpoliciesand 79regulationspriortoSeptember1,1988,shallbeexemptfromtheprofessionaldevelopment 80requirementsofthissectionandshallcontinueineffectuntiltheyexpire,arerevokedor 81suspended,asprovidedbylaw.Whensuchcertificatesarerequiredtoberenewed,thestate 82boardoritsdesigneeshallgranttoeachholderofsuchacertificatethecertificatemostnearly 83equivalenttotheonesoheld.Anyonewhoholds,asofAugust28,2003,avalidPC-I,PC-II, 84orcontinuousprofessionalcertificateshall,uponexpirationofhisorhercurrentcertificate,be 85issuedtheappropriatelevelofcertificatebasedupontheclassificationsystemestablished 86pursuanttosubsection3ofthissection. 87 3.(1)Certificatesoflicensetoteachinthepublicschoolsofthestateshallbebased 88uponminimumrequirementsprescribedbythestateboardofeducationwhichshallinclude 89completionofabackgroundcheckasprescribedinsection168.133.Thestateboardshall 90provideforthefollowinglevelsofprofessionalcertification:aninitialprofessionalcertificate 91andacareercontinuousprofessionalcertificate. 92 (2)Theinitialprofessionalcertificateshallbeissueduponcompletionof 93requirementsestablishedbythestateboardofeducationandshallbevalidbasedupon 94verificationofactualteachingwithinaspecifiedtimeperiodestablishedbythestateboardof 95education.Thestateboardshallrequireholdersofthefour-yearinitialprofessionalcertificate 96to: 97 (a)Participateinamentoringprogramapprovedandprovidedbythedistrictfora 98minimumoftwoyears; 99 (b)Completethirtycontacthoursofprofessionaldevelopment,whichmayinclude 100hoursspentinclassinanappropriatecollegecurriculum,orforholdersofacertificateunder 101subdivision(4)ofsubsection1ofthissection,anamountofprofessionaldevelopmentin 102proportiontothecertificateholder'shoursintheclassroom,ifthecertificateholderis 103employedlessthanfulltime;and 104 (c)Participateinabeginningteacherassistanceprogram. 105 (3)(a)Thecareercontinuousprofessionalcertificateshallbeissuedupon 106verificationofcompletionoffouryearsofteachingundertheinitialprofessionalcertificate HCSHB1998 4 107anduponverificationofthecompletionoftherequirementsarticulatedinparagraphs(a)[,(b), 108and]to(c)ofsubdivision(2)ofthissubsectionorparagraphs(a)[,(b),(c),and]to(d)of 109subdivision(5)ofsubsection1ofthissection. 110 (b)Thecareercontinuousprofessionalcertificateshallbecontinuousbasedupon 111verificationofactualemploymentinaneducationalpositionasprovidedforinstateboard 112guidelinesandcompletionoffifteencontacthoursofprofessionaldevelopmentperyear 113whichmayincludehoursspentinclassinanappropriatecollegecurriculum.[Should] Ifthe 114possessorofavalidcareercontinuousprofessionalcertificate[fail]fails,inanygivenyear,to 115meetthefifteen-hourprofessionaldevelopmentrequirement,thepossessormay,withintwo 116years,makeupthemissinghours.Inordertomakeupformissinghours,thepossessorshall 117firstcompletethefifteen-hourrequirementforthecurrentyearandthenmaycounthoursin 118excessofthecurrentyearrequirementasmake-uphours.[Should] Ifthepossessor[fail]fails 119tomakeupthemissinghourswithintwoyears,thecertificateshallbecomeinactive.Inorder 120toreactivatethecertificate,thepossessorshallcompletetwenty-fourcontacthoursof 121professionaldevelopmentwhichmayincludehoursspentintheclassroominanappropriate 122collegecurriculumwithinthesixmonthspriortoorafterreactivatinghisorhercertificate. 123Therequirementsofthisparagraphshallbemonitoredandverifiedbythelocalschooldistrict 124[which] thatemploystheholderofthecareercontinuousprofessionalcertificate. 125 (c)Aholderofacareercontinuousprofessionalcertificateshallbeexemptfromthe 126professionaldevelopmentcontacthourrequirementsofparagraph(b)ofthissubdivisionif 127suchteacherhasalocalprofessionaldevelopmentplaninplacewithinsuchteacher'sschool 128districtandmeetstwoofthethreefollowingcriteria: 129 a.Hastenyearsofteachingexperienceasdefinedbythestateboardofeducation; 130 b.Possessesamaster'sdegree;or 131 c.Obtainsarigorousnationalcertificationasapprovedbythestateboardof 132education. 133 4.Policiesandproceduresshallbeestablishedbywhichateacherwhowasnot 134retainedduetoareductioninforcemayretainthecurrentlevelofcertification.Thereshall 135alsobeestablishedpoliciesandproceduresallowingateacherwhohasnotbeenemployedin 136aneducationalpositionforthreeyearsormoretoreactivatehisorherlastlevelof 137certificationbycompletingtwenty-fourcontacthoursofprofessionaldevelopmentwhich 138mayincludehoursspentintheclassroominanappropriatecollegecurriculumwithinthesix 139monthspriortoorafterreactivatinghisorhercertificate. 140 5.Thestateboardshall,uponcompletionofabackgroundcheckasprescribedin 141section168.133,issueaprofessionalcertificateclassificationintheareasmostclosely 142alignedwithanapplicant'scurrentareasofcertification,commensuratewiththeyearsof 143teachingexperienceoftheapplicant,toanypersonwhoishiredtoteachinapublicschoolin HCSHB1998 5 144thisstateandwhopossessesavalidteachingcertificatefromanotherstateorcertification 145undersubdivision(4)ofsubsection1ofthissection,providedthatthecertificateholdershall 146annuallycompletethestateboard'srequirementsforsuchlevelofcertification,andshall 147establishpoliciesbywhichresidentsofstatesotherthanthestateofMissourimaybeassessed 148afeeforacertificateoflicensetoteachinthepublicschoolsofMissouri.Suchfeeshallbein 149anamountsufficienttorecoveranyorallcostsassociatedwiththeissuingofacertificateof 150licensetoteach.Theboardshallpromulgaterulestoauthorizetheissuanceofaprovisional 151certificateoflicense,whichshallbevalidforthreeyearsandshallallowtheholdertoassume 152classroomdutiespendingthecompletionofacriminalbackgroundcheckundersection 153168.133,foranyapplicantwho: 154 (1)IsthespouseofamemberoftheArmedForcesstationedinMissouri; 155 (2)Relocatedfromanotherstatewithinoneyearofthedateofapplication; 156 (3)Underwentacriminalbackgroundcheckinordertobeissuedateaching 157certificateoflicensefromanotherstate;and 158 (4)Otherwisequalifiesunderthissection. 159 6.Thestateboardmayassesstoholdersofaninitialprofessionalcertificateafee,to 160bedepositedintotheexcellenceineducationrevolvingfundestablishedpursuanttosection 161160.268,fortheissuanceofthecareercontinuousprofessionalcertificate.However,suchfee 162shallnotexceedthecombinedcostsofissuanceandanycriminalbackgroundcheckrequired 163asaconditionofissuance.ApplicantsfortheinitialABCTEcertificateshallberesponsible 164foranyfeesassociatedwiththeprogramleadingtotheissuanceofthecertificate,butnothing 165inthissectionshallprohibitadistrictfromdevelopingapolicythatpermitsfee 166reimbursement. 167 7.AnymemberofthepublicschoolretirementsystemofMissouriwhoentered 168coveredemploymentwithtenormoreyearsofeducationalexperienceinanotherstateor 169statesandheldacertificateissuedbyanotherstateandsubsequentlyworkedinaschool 170districtcoveredbythepublicschoolretirementsystemofMissourifortenormoreyearswho 171laterbecamecertificatedinMissourishallhavethatcertificatedatedbacktohisorher 172originaldateofemploymentinaMissouripublicschool. 173 8.Withinthirtydaysofreceivinganapplicationfromaspouseofanactiveduty 174memberoftheArmedForcesoftheUnitedStateswhohasbeentransferredorisscheduledto 175betransferredtothestateofMissouri,orwhohasbeentransferredorisscheduledtobe 176transferredtoanadjacentstateandisorwillbedomiciledinthestateofMissouri,orhas 177movedtothestateofMissourionapermanentchange-of-stationbasisandhassuccessfully 178completedthebackgroundcheckdescribedundersubsection5ofthissectionandsection 179168.133,thestateboardshallissuetosuchapplicantafullcertificateoflicensetoteach, HCSHB1998 6 180providedthattheapplicanthaspaidallnecessaryfeesandhasotherwisemetallrequirements 181tobeissuedsuchacertificate. 168.029.1.Asprovidedinthissection,anyschooldistrictmayissueaschool 2districtteachingpermittoanyindividualwhodoesnotholdateachingcertificateissued 3bythestateboardofeducation. 4 2.(1)Aschooldistrictmayemployanyindividualtowhomthedistrictissuesa 5schooldistrictteachingpermit. 6 (2)(a)Anyschooldistrictthatissuesaschooldistrictteachingpermitas 7providedinthissectionshalldevelopapolicylistingthequalificationsanindividual 8shallmeettobeeligiblefortheteachingpermit.Theschooldistrictshallsubmitsuch 9policytothedepartmentofelementaryandsecondaryeducation,butsuchpolicyshall 10notbesubjecttoapprovalordisapprovalbythedepartment. 11 (b)Thequalificationsrequiredintheschooldistrict'spolicyshallinclude,but 12notbelimitedto: 13 a.Attainmentofabachelor'sdegree; 14 b.Participationinongoingprofessionaldevelopmentinlessonplanning, 15classroommanagement,methodsofreadinginstruction,andtheeducationofthe 16exceptionalchild; 17 c.Participationinamentoringprogramfortheteacherpossessingthepermit; 18and 19 d.Completionofabackgroundcheckasrequiredinsection168.133. 20 (c)Immediatelyafteremployinganindividualasprovidedinthissection,the 21schooldistrictshallsendtothestateboardofeducationawrittenstatementidentifying 22theindividual,theindividual'squalificationsasateacher,andthesubjectorclassthe 23individualwillteach. 24 3.Noindividualauthorizedtoteachasprovidedinthissectionshallbe 25authorizedtoteachinanotherschooldistrictunlesstheotherdistrictissuesteaching 26permitsasprovidedinthissectionandrecognizestheissuingdistrict'steachingpermit. 27Anyteachingpermitissuedasprovidedinthissectionshallbevalidintheschooldistrict 28issuingtheteachingpermitandinanyschooldistrictrecognizingtheteachingpermitas 29providedinthissection.Anyteachingpermitissuedasprovidedinthissectionshall 30remainvalidunlesstheissuingdistrictrevokestheteachingpermitforcause. 31 4.Thepercentageofaschooldistrict'steachersissuedanyteachingpermitas 32providedinthissectionandemployedbytheschooldistrictshallnotexceedfifteen 33percentofthetotalnumberofteachersemployedbytheschooldistrict. 34 5.Anyindividualissuedateachingpermitasprovidedinthissectionshallbe 35issuedateachingcertificatebythestateboardofeducationundersubdivision(7)of HCSHB1998 7 36subsection1ofsection168.021.Anyindividualissuedateachingpermitasprovidedin 37thissectionmaybeissuedateachingcertificatebythestateboardofeducationunder 38theapplicableprovisionsofsubdivisions(1)to(6)ofsubsection1ofsection168.021if 39theindividualhastaughtwithateachingpermitissuedasprovidedinthissectionforat 40leastfouryearsandmeetsthequalificationsestablishedinchapter168. 41 6.Noschooldistrictissuingteachingpermitsasprovidedinthissectionshallbe 42deemedateachertraininginstitutionorteachereducationprogramforpurposesof 43section161.097. 44 7.Anyindividualissuedateachingpermitasprovidedinthissectionshallbe 45deemedateacherforpurposesofminimumsalaryrequirementsinsection163.172;the 46teachertenureactinsections168.102to168.130;andthepublicschoolretirement 47systemscreatedinsections169.010to169.141,sections169.270to169.400,andsections 48169.410to169.540. 168.036.1.Inadditiontograntingcertificatesoflicensetoteachinpublic 2schoolsofthestateundersection168.021,thestateboardofeducationshallgrant 3substituteteachercertificatesasprovidedinthissectiontoanyindividualseekingto 4substituteteachinanypublicschoolinthisstate. 5 2.(1)Thestateboardshallnotgrantacertificateoflicensetoteachunderthis 6sectiontoanyindividualwhohasnotcompletedabackgroundcheckasrequiredunder 7section168.021. 8 (2)Thestateboardmayrefusetoissueorrenew,suspend,orrevokeany 9certificatesoughtorissuedunderthissectioninthesamemannerandforthesame 10reasonsasundersection168.071. 11 3.Thestateboardmaygrantacertificateunderthissectiontoanyindividual 12whohascompleted: 13 (1)Atleastthirty-sixsemesterhoursatanaccreditedinstitutionofhigher 14education;or 15 (2)Thetwenty-houronlinetrainingprogramrequiredinthissectionandwho 16possessesahighschooldiplomaortheequivalentthereof. 17 4.Thedepartmentofelementaryandsecondaryeducationshalldevelopand 18maintainanonlinetrainingprogramforindividuals,whichshallconsistoftwentyhours 19oftrainingrelatedtosubjectsappropriateforsubstituteteachersasdeterminedbythe 20department. 21 5.Thestateboardmaygrantacertificateunderthissectiontoanyhighly 22qualifiedindividualwithexpertiseinatechnicalorbusinessfieldorwithexperiencein 23theArmedForcesoftheUnitedStateswhohascompletedthebackgroundcheck 24requiredinthissectionbutdoesnotmeetanyofthequalificationsundersubdivision(1) HCSHB1998 8 25or(2)ofsubsection3ofthissectionifthesuperintendentoftheschooldistrictinwhich 26theindividualseekstosubstituteteachsponsorssuchindividualandtheschoolboardof 27theschooldistrictinwhichtheindividualseekstosubstituteteachvotestoapprovesuch 28individualtosubstituteteach. 29 6.(1)Notwithstandinganyotherprovisionstothecontrary,beginningonthe 30effectivedateofthissectionandendingonJune30,2025,anypersonwhoisretiredand 31currentlyreceivingaretirementallowanceundersections169.010to169.141orsections 32169.600to169.715,otherthanfordisability,maybeemployedtosubstituteteachona 33part-timeortemporarysubstitutebasisbyanemployerincludedintheretirement 34systemwithoutadiscontinuanceoftheperson'sretirementallowance.Suchaperson 35shallnotcontributetotheretirementsystem,ortothepublicschoolretirementsystem 36establishedbysections169.010to169.141ortothepubliceducationemployee 37retirementsystemestablishedbysections169.600to169.715,becauseofearningsduring 38suchperiodofemployment. 39 (2)Inadditiontotheconditionssetforthinsubdivision(1)ofthissubsection, 40anypersonretiredandcurrentlyreceivingaretirementallowanceundersections 41169.010to169.141,otherthanfordisability,whoisemployedbyathirdpartyoris 42performingworkasanindependentcontractormaybeemployedtosubstituteteachon 43apart-timeortemporarysubstitutebasis,ifsuchpersonisperformingworkforan 44employerincludedintheretirementsystemwithoutadiscontinuanceoftheperson's 45retirementallowance. 46 (3)Ifapersonisemployedunderthissubsectiononaregular,full-timebasisthe 47personshallnotbeentitledtoreceivetheperson'sretirementallowanceforanymonth 48duringwhichthepersonissoemployed.Theretirementsystemmayrequirethe 49employer,thethird-partyemployer,theindependentcontractor,andtheretireesubject 50tothissubsectiontoprovidedocumentationshowingcompliancewiththissubsection.If 51suchdocumentationisnotprovided,theretirementsystemmaydeemtheretireetohave 52exceededthelimitationsprovidedinthissubsection. 53 7.Acertificategrantedunderthissectionshallbevalidforfouryears.A 54certificategrantedunderthissectionshallexpireattheendofanycalendaryearin 55whichtheindividualfailstosubstituteteachforatleastfivedaysorfortyhoursofin- 56seatinstruction. 57 8.(1)Anindividualtowhomthestateboardgrantsacertificateunderthis HCSHB1998 9 61 (2)Noindividualtowhomthestateboardgrantsacertificateunderthissection 62andwhoisundertwentyyearsofageshallbeasubstituteteacheringradesnineto 63twelve. 64 9.Eachschooldistrictmaydevelopanorientationforindividualstowhomthe 65stateboardgrantsacertificateunderthissectionforsuchindividualsemployedbythe 66schooldistrictandmayrequiresuchindividualstocompletesuchorientation.Such 67orientationshallcontainatleasttwohoursofsubjectsappropriateforsubstitute 68teachersandshallcontaininstructionontheschooldistrict'sbestpracticesfor 69classroommanagement. 70 10.BeginningJanuary1,2023,anysubstituteteachermay,atthetimesuch 71substituteteachersubmitsthefingerprintsandinformationrequiredforthe 72backgroundcheckrequiredundersection168.021,designateuptofiveschool 73districtstowhichsuchsubstituteteacherhassubmittedanapplicationforsubstitute 74teachingtoreceivetheresultsofthesubstituteteacher'scriminalhistorybackground 75checkandfingerprintcollection.Thetotalamountofanyfeesfordisseminatingsuch 76resultstouptofiveschooldistrictsunderthissubsectionshallnotexceedfiftydollars. 77 11.Thestateboardmayexercisetheboard'sauthorityunderchapter161to 78promulgateallnecessaryrulesandregulationsnecessaryfortheadministrationofthis 79section. 168.037.1.Thedepartmentofelementaryandsecondaryeducationshallcreate 2andmaintainaweb-basedsurveyforcollectinganonymousinformationfromsubstitute 3teachersinMissouripublicschools.Thesurveywillcollectanonymous,nonbiased,real- 4timedatathatschooldistricts,charterschools,andthestatecanaccesstostudyand 5improvetheeffectivenessofsubstituteteachersinsupportinginstructionandlearning 6andtoimprovecircumstancesthatmaycauseashortageofavailablesubstitute 7teachers. 8 2.(1)Eachsubstituteteacherinapublicschoolshallcompletethesurvey 9describedinsubsection1ofthissectionattheendofeachdayofteaching.Thedistrict 10orcharterschoolinwhichthesubstituteteacheristeachingforthatdayshallprovide, 11byemail,aweblinktothesurvey.Ifneeded,thedistrictorcharterschoolshallalso 12providebriefaccesstoacomputerorotherconnecteddevicesufficienttoallowthe 13surveytobecompleted.Thesurveycanalsobecompletedon-sitebythesubstitute 14teacherusingapersonaldevice. 15 (2)Thesurveydescribedinsubsection1ofthissectionshallincludeata 16minimum,questionsregarding:theageandlevelofeducationofthesubstituteteacher, 17thedateofteaching,thedistrictandschool,thegradeorgradestaught,information HCSHB1998 10 18aboutsupportandinteractionwithschoolstaff,anystudenthealthorsafetyissues 19experienced,andrateofsubstituteteacherpay. 20 3.Districtsandcharterschoolsshallannuallyprovideinformationtothe 21departmentofelementaryandsecondaryeducationregarding:useofthird-party 22employmentagenciesforsubstituteteachers,dailyrateofsubstituteteacherpay, 23employmentoffull-timeandpart-timesubstituteteachers,substituteteacher 24recruitmentefforts,thesubstituteteacherinterviewprocess,anduseofcurrent 25schoolstaffassubstituteteachersduringotherassignedtime. ✔ HCSHB1998 11
