18schoolboardmembers;oracommitteecreatedbytheschoolboard,anadministrator, 19oraprincipal. 20 (2)Thelistpostedundersubdivision(1)ofthissubsectionshallincludeatleast 21allofthefollowingforeachitemposted: 22 (a)Bibliographicinformationnecessarytoidentifyspecificlearningmaterials 23including,butnotlimitedto,textbooksandcurricula,andeducationalactivitiesusedfor 24pupilinstruction.Suchbibliographicinformationshallincludeatleastthetitle,author, 25organization,andanywebsiteassociatedwitheachspecificlearningmaterialor 26educationalactivity; 27 (b)Thefulltextoracopyofanylearningmaterialsoreducationalactivities 28createdbytheschoolboardorateacheremployedbytheschoolboardincluding,but 29notlimitedto,lessonplans,presentations,andvideos;and 30 (c)Aninternetlinktoanycurriculaadoptedbytheschoolboardtocomplywith 31theschoolboard'sdutiesunderparagraph(b)ofthissubdivisionoranyother 32requirementunderstatelaw. 33 (3)Eachschoolboardshallupdatethelistpostedundersubdivision(1)ofthis 34subsectionatleasttwiceeachschoolyear.Eachschoolboardshallperformthefirst 35updatebeforethefirstdayoftheschooltermandperformanotherupdatebetween 36JanuaryfirstandJanuaryfifteenth.Eachschoolboardshallnotifyparentsand 37guardiansthatthelisthasbeenupdatedbypostinganoticeontheschoolboard's 38websiteandprovidingnoticeinanewsletterorotherwrittencommunicationthatis 39regularlydistributedtoparentsandguardians. 40 (4)Eachschoolboardshallensurethateachlistpostedundersubdivision(1)of 41thissectionremainsavailabletothepublicontheschoolboard'swebsiteforatleastfive 42yearsafterthedatethelistisfirstpostedontheschoolboard'swebsite. 43 (5)Thissubsectionshallnotbeconstruedtorequireaschoolboardto: 44 (a)Digitallyreproducelearningmaterialsotherthanlearningmaterialscreated 45byateacheremployedbytheschoolboard;or 46 (b)Postordistributealearningmaterialoreducationalactivityinamanner 47thatwouldconstituteaninfringementofcopyrightunderthefederalCopyrightActof 481976(17U.S.C.Section101etseq.),asamended. 49 (6)Aresidentofaschooldistrictthatisgovernedbyaschoolboardmaybring 50anactionforinjunctiverelieforawritofmandamusinthecircuitcourtwith 51jurisdictionovertheschooldistricttocompeltheschoolboardtocomplywiththis HB2008 4 52subsection.Iftheresidentprevails,thecourtshallawardtosuchresidentreasonable 53attorney'sfeesnottoexceedfifteenthousanddollars. 54 (7)Thissubsectionshallapplyinthe2023-24schoolyearandallsubsequent 55schoolyears. ✔ HB2008 5
