BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Section170.231,RSMo,isrepealedandonenewsectionenactedinlieu 2thereof,tobeknownassection170.231,toreadasfollows: 170.231.1.Theschoolboardofeachschooldistrictandthegoverningboardof 2eachcharterschoolshallprovidethatallpublicschoolinstructionalmaterialintendedfor 3useinconnectionwithanypublicschoolclassroominstruction,oranypublicschoolresearch 4orexperimentationprogramorproject,shallbeavailableforinspectionbyanyperson.For 5thepurposeofthissection,"classroominstruction"shallmeananypublicschoolinstruction 6involvingteachersandstudentsorpeersandstudents;"researchorexperimentationprogram 7orproject"shallmeananypublicschoolresearchorexperimentationprogramorproject 8designedtoexploreordevelopnewandunproventeachingmethodsandtechniques. 9 2.(1)Theschoolboardofeachschooldistrictandthegoverningboardofeach 10charterschoolshallprominentlypostonthehomepageoftheschoolboard'sorcharter 11school'swebsite,insuchamannerthattheinformationisavailabletothepublic,the 12curriculaintendedforusebysuchschooldistrictorcharterschoolinconnectionwith 13schoolinstructioninmath,socialstudies,science,English,foreignlanguage,finearts, 14health,physicaleducation,andvocationaleducation.Ifsuchschoolboardorgoverning 15boardadoptsachangeofanycurriculumusedbysuchschooldistrictorcharterschool, 16suchschoolboard'sorcharterschool'swebsiteshallbeupdatedwithinthirtydaysafter 17suchchangeisadopted. EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18 (2)Theschoolboardofeachschooldistrictandthegoverningboardofeach 19charterschoolshallnotifyparentsandguardiansthatthecurriculalistonthewebsite 20hasbeenupdatedbypostinganoticeonsuchschoolboard'sorcharterschool'swebsite 21andprovidingnoticeinanewsletterorotherwrittencommunicationthatisregularly 22distributedtoparentsandguardians. 23 (3)Wherethecurricularmaterialsbeingmadeavailabletoparentsforreview 24aresubjecttocopyright,trademark,orotherintellectualpropertyprotection,the 25reviewprocessshallincludetechnicalandproceduralsafeguardstoensurethatthe 26materialsarenotabletobewidelydisseminatedtothegeneralpublicinviolationofthe 27intellectualpropertyrightsofthepublisherandcontentvalidityisnotundermined. 28 (4)Aresidentofaschooldistrictmaybringanactionforinjunctivereliefora 29writofmandamusinthecircuitcourtwithjurisdictionovertheschooldistricttocompel 30theschoolboardofsuchschooldistrictorthegoverningboardofacharterschool 31withintheboundariesofsuchschooldistricttocomplywiththissubsection.Ifthe 32residentprevails,thecourtshallawardtosuchresidentreasonableattorney'sfeesnotto 33exceedfifteenthousanddollars. 34 (5)Thissubsectionshallapplyinthe2023-24schoolyearandallsubsequent 35schoolyears. ✔ HCSHB2008 2
