2knownassection161.854,toreadasfollows:
161.854.1.Asusedinthissection,thefollowingtermsmean:
2 (1)"Individualizededucationprogram"or"IEP",awrittenstatementfora
3childwithadisabilitythatisdeveloped,reviewed,andrevisedinaccordancewith34
4CFR300.320to300.324andunder20U.S.C.Section1401,asamended;
5 (2)"Localeducationalagency"or"LEA",apublicschoolorotherpolitical
6subdivisionofthestateservinganystudentwithanIEP;
7 (3)"Parent",aparent,guardian,orotherpersonhavingcontrolorcustodyofa
8child;
9 (4)"Publicschool",thesamedefinitionasinsection160.011.
10 2.Eachlocaleducationalagencyshallimplementparentalconsentproceduresas
11describedin34CFR300.300andthissection.
12 3.Eachlocaleducationalagencyshallobtainwrittenparentalconsentforinitial
13placement,annualplacement,andanyrevisiontotheindividualizededucationprogram
14ofachildwithdisabilitiespriortosuchplacementorrevision.TheLEAshallmaintain
15writtendocumentationofthedateofparentalconsentforinitialplacement,annual
16placement,orrevisiontotheIEP.

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17 4.Iftheparentsandlocaleducationalagencyfailtoreachanagreementonthe
18child'sindividualizededucationprogrambutreachanagreementoncertainIEP
19servicesorinterimplacement,thechild'snewIEPshallbeimplementedintheareasof
20agreementandthechild'slastagreed-uponIEPshallremainineffectintheareasof
21disagreementuntilthedisagreementisresolved.
22 5.Parentshavetherighttoobserveanyprogramproposedfortheirchildifthe
23childisidentifiedaseligibleforspecialeducationservices.
24 6.Thedepartmentofelementaryandsecondaryeducationshalladoptaparental
25consentformthateachlocaleducationalagencyshalluseforanyactionrelatedtoa
26child'sindividualizededucationprogram.Suchformshallbeprovidedtotheparentin
27theparent'snativelanguage,asdescribedin34CFR300.503,andshallincludeatleast
28thefollowing:
29 (1)Astatementthattheparentisaparticipantofthechild'sIEPteamandhas
30therighttoconsentorrefuseconsenttotheactionsproposedbytheIEPteamorLEA.
31Thestatementshallincludeatleastinformationthattherefusalofparentalconsent
32meansthattheschooldistricthasnoauthoritytoproceedwiththeactionswithout
33parentalconsentortheLEAfilingadueprocesscomplaintinaccordancewith34CFR
34300.507to300.508;
35 (2)A"Doesconsent"box,signatureline,anddateline;
36 (3)A"DoesNOTconsent"box,signatureline,anddateline;and
37 (4)A"Partialconsent"box,signatureline,dateline,andspaceindicatingthe

39 7.Alocaleducationalagencyshallnotproceedwithimplementingachild's
40individualizededucationprogramwithoutparentalconsentunlesstheLEAdocuments
41reasonableefforts,asoutlinedintheproceduralsafeguardsnoticerequiredunder34
42CFR300.504,toobtaintheparent'sconsentandtheparenthasfailedtorespondorthe
43LEAobtainsapprovalthroughadueprocesscomplaintandhearinginaccordancewith
4434CFR300.507to300.513.
45 8.Ifalocaleducationalagencyandparentfailtoreachanagreement,either
46partymayrequestafacilitatedindividualizededucationprogrammeeting,mediation,
47dueprocesscomplaintandhearing,orotherdisputeresolutionoptionsasoutlinedinthe
48proceduralsafeguardsnotice.
49 9.Thissectionshallnotbeconstruedtoabrogateanyparentalrightidentifiedin
50theIndividualswithDisabilitiesEducationAct(IDEA)andsuchact'simplementing
51regulations.
