SectionA.Chapter161,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection161.854,toreadasfollows:
161.854.1.Asusedinthissection,thefollowingtermsmean:
2 (1)"Individualizededucationprogram"or"IEP",awrittenstatementfora
3childwithadisabilitythatisdeveloped,reviewed,andrevisedinaccordancewith34
4CFR300.320to300.324andunder20U.S.C.Section1401,asamended;
5 (2)"Localeducationalagency"or"LEA",apublicschoolorotherpolitical
6subdivisionofthestateservinganystudentwithanIEP;
7 (3)"Parent",asdefinedin34CFR300.30;
8 (4)"Publicschool",thesamedefinitionasinsection160.011.
9 2.Eachlocaleducationalagencyshallimplementparentalconsentproceduresas
10describedin34CFR300.300andthissection.
11 3.Eachlocaleducationalagencyshallobtainwrittenparentalconsentforinitial
12placement,annualplacement,placementchange,removalofaserviceorservices,or
13reductionofserviceminutesbymorethantwenty-fivepercentintheindividualized
14educationprogramofachildwithdisabilitiespriortosuchplacement,removal,or
15reduction.TheLEAshallmaintainwrittendocumentationofthedateofparental
16consentforinitialplacement,annualplacement,orrevisiontotheIEP.
17 4.Iftheparentsandlocaleducationalagencyfailtoreachanagreementonthe
18child'sindividualizededucationprogrambutreachanagreementoncertainIEP
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 19servicesorinterimplacement,thechild'snewIEPshallbeimplementedintheareasof
20agreementandthechild'slastagreed-uponIEPshallremainineffectintheareasof
21disagreementuntilthedisagreementisresolved.
22 5.Parentshavetherighttovisitanyprogramorclassroomproposedfortheir
23childbeforeconsentingtoIEPchangesifthechildisidentifiedaseligibleforspecial
24educationservices.
25 6.Thedepartmentofelementaryandsecondaryeducationshalladoptaparental
26consentformthateachlocaleducationalagencyshalluseforanyactionrelatedtoa
27child'sindividualizededucationprogram.Suchformshallbeprovidedtotheparentin
28theparent'snativelanguage,asdescribedin34CFR300.503,andshallincludeatleast
29thefollowing:
30 (1)Astatementthattheparentisaparticipantofthechild'sIEPteamandhas
31therighttoconsentorrefuseconsenttotheactionsasdescribedinthissectionproposed
32bytheIEPteamorLEA.Thestatementshallincludeatleastinformationthatthe
33refusalofparentalconsentmeansthattheschooldistricthasnoauthoritytoproceed
34withtheactionswithoutparentalconsentortheLEAfilingadueprocesscomplaintin
35accordancewith34CFR300.507to300.508;
36 (2)A"Doesconsent"box,signatureline,anddateline;
37 (3)A"DoesNOTconsent"box,signatureline,anddateline;and
38 (4)A"Partialconsent"box,signatureline,dateline,andspaceindicatingthe
39areasofagreement.
40 7.Alocaleducationalagencyshallnotproceedwithimplementingachild's
41individualizededucationprogramwithoutparentalconsentunlesstheLEAdocuments
42reasonableefforts,asoutlinedintheproceduralsafeguardsnoticerequiredunder34
43CFR300.504,toobtaintheparent'sconsentandtheparenthasfailedtorespondorthe
44LEAobtainsapprovalthroughadueprocesscomplaintandhearinginwhichthe
45hearingofficerorcommissionerfindsthattheIEPwiththeproposedchangeorchanges
46providesforafreeappropriatepubliceducationforthestudentinaccordancewith34
47CFR300.507to300.513.
48 8.Ifalocaleducationalagencyandparentfailtoreachanagreement,either
49partymayrequestafacilitatedindividualizededucationprogrammeeting,mediation,
50dueprocesscomplaintandhearing,orotherdisputeresolutionoptionsasoutlinedinthe
51proceduralsafeguardsnotice.
52 9.Thissectionshallnotbeconstruedtoabrogateanyparentalrightidentifiedin
53theIndividualswithDisabilitiesEducationAct(IDEA)andsuchact'simplementing
54regulations.
