ThefollowingisasummaryoftheHouseCommitteeSubstituteforHB
2011.
Thisbillrequirespublicschoolsandanypoliticalsubdivisionof
thestatethatservesstudentswithanindividualized education
programor"IEP"toimplementparentalconsentprocedures. Written
parentalconsentshallbeobtainedandmaintainedforinitial
placement,annualplacement,orotherrevisionstoastudent'sIEP
asoutlinedinthebill.
Iftheparentsandlocaleducationalagency(LEA)onlyreachan
agreementoncertainIEPservicesorinterimplacement,thechild's
newIEPshallbeimplementedintheareasofagreementandthe
child'slastagreed-uponIEPshallremainineffectintheareasof
disagreementuntilthedisagreementisresolved. Ifachildis
identifiedaseligibleforspecialeducationservices,theparents
havetherighttovisitanyprogramproposedfortheirchild.
TheDepartmentofElementaryandSecondaryEducationshalladopta
parentalconsentform,asdescribedinthebill,thateachschool
districtshallprovidetoparents,anddistrictsmaynotproceed
withimplementation ofastudent'sIEPwithouttheparentalconsent
formcompletedexceptasprovidedinthebill.

PROPONENTS: Supporterssaythatthelanguageaddressesparental
concernsrelatingtoIEPmeetingsandwillhelpschoolsandparents
worktogethertomeetstudent'sneeds.Thebillwillprovide
parentswithaclearerunderstandingofchangestoIEPlanguageand
requireparentalsupportbeforeanyIEPchangesmayoccur.Many
stateswithsimilarlanguagehaveseenadecreaseindueprocess
hearingsandthathavingaparentalbuyinisparamounttohelping
achildsucceed.
