31 32thesentencingcourtmay,uponitsownmotionoramotionoftheprosecutingorcircuit 33attorney,makeafindingthattheoffenderisineligibletoearncompliancecreditsbecausethe 34natureandcircumstancesoftheoffenseorthehistoryandcharacteroftheoffenderindicate 35thatalongertermofprobation,parole,orconditionalreleaseisnecessaryfortheprotectionof 36thepublicortheguidanceoftheoffender.Themotionmaybemadeanytimepriortothefirst 37monthinwhichthepersonmayearncompliancecreditsunderthissectionoratahearing 38undersubsection5ofthissection.Theoffender'sabilitytoearncreditsshallbesuspended 39untilthecourtorboardmakesitsfinding.Ifthecourtorboardfindsthattheoffenderis 40eligibleforearnedcompliancecredits,thecreditsshallbegintoaccrueonthefirstdayofthe 41nextcalendarmonthfollowingtheissuanceofthedecision. 42 3.Earnedcompliancecreditsshallreducethetermofprobation,parole,orconditional 43releaseby[thirty] twentydaysforeachfullcalendarmonthofcompliancewiththetermsof 44supervision.Creditsshallbegintoaccrueforeligibleoffendersafterthefirstfullcalendar 45monthofsupervisionoronOctober1,2012,iftheoffenderbeganatermofprobation,parole, 46orconditionalreleasebeforeSeptember1,2012. 47 4.Forthepurposesofthissection,theterm"compliance"shallmeantheabsenceof 48aninitialviolationreportornoticeofcitationsubmittedbyaprobationorparoleofficer 49duringacalendarmonth,oramotiontorevokeormotiontosuspendfiledbyaprosecutingor 50circuitattorney,againsttheoffender. 51 5.Creditsshallnotaccrueduringanycalendarmonthinwhichaviolationreport, 52whichmayincludeareportofabsconderstatus,hasbeensubmitted,theoffenderisin 53custody,oramotiontorevokeormotiontosuspendhasbeenfiled,andshallbesuspended HB2088 2 54pendingtheoutcomeofahearing,ifahearingisheld.Ifnohearingisheld,orifahearingis 55heldandtheoffenderiscontinuedundersupervision,orthecourtorboardfindsthatthe 56violationdidnotoccur,thentheoffendershallbedeemedtobeincomplianceandshallbegin 57earningcreditsonthefirstdayofthenextcalendarmonthfollowingthemonthinwhichthe 58reportwassubmittedorthemotionwasfiled.Ifahearingisheld,allearnedcreditsshallbe 59rescindedif: 60 (1)Thecourtorboardrevokestheprobationorparoleorthecourtplacestheoffender 61inadepartmentprogramundersubsection4ofsection559.036orundersection217.785;or 62 (2)Theoffenderisfoundbythecourtorboardtobeineligibletoearncompliance 63creditsbecausethenatureandcircumstancesoftheviolationindicatethatalongertermof 64probation,parole,orconditionalreleaseisnecessaryfortheprotectionofthepublicorthe 65guidanceoftheoffender. 66 67Earnedcredits,ifnotrescinded,shallcontinuetobesuspendedforaperiodoftimeduring 68whichthecourtorboardhassuspendedthetermofprobation,parole,orrelease,andshall 69begintoaccrueonthefirstdayofthenextcalendarmonthfollowingtheliftingofthe 70suspension. 71 6.Offenderswhoaredeemedbythedivisiontobeabscondersshallnotearncredits. 72Forpurposesofthissubsection,"absconder"shallmeananoffenderundersupervisionwhose 73whereaboutsareunknownandwhohasleftsuchoffender'splaceofresidencywithoutthe 74permissionoftheoffender'ssupervisingofficerandwithoutnotifyingoftheirwhereabouts 75forthepurposeofavoidingsupervision.Anoffendershallnolongerbedeemedanabsconder 76whensuchoffenderisavailableforactivesupervision. 77 7.Notwithstandingsubsection2ofsection217.730tothecontrary,oncethe 78combinationoftimeservedincustody,ifapplicable,timeservedonprobation,parole,or 79conditionalrelease,andearnedcompliancecreditssatisfythetotaltermofprobation,parole, 80orconditionalrelease,theboardorsentencingcourtshallorderfinaldischargeofthe 81offender,solongastheoffenderhascompletedrestitutionandatleasttwoyearsofhisorher 82probation,parole,orconditionalrelease,whichshallincludeanytimeservedincustodyunder 83section217.718andsections559.036and559.115. 84 8.Theawardorrescissionofanycreditsearnedunderthissectionshallnotbesubject 85toappealoranymotionforpostconvictionrelief. 86 9.Atleasttwiceayear,thedivisionshallcalculatethenumberofmonthstheoffender 87hasremainingonhisorhertermofprobation,parole,orconditionalrelease,takinginto 88considerationanyearnedcompliancecreditsorwork-for-timecreditsundersection 89217.704, andnotifytheoffenderofthelengthoftheremainingterm. HB2088 3 90 10.Nolessthansixtydaysbeforethedateoffinaldischarge,thedivisionshallnotify 91thesentencingcourt,theboard,and,forprobationcases,thecircuitorprosecutingattorneyof 92theimpendingdischarge.Ifthesentencingcourt,theboard,orthecircuitorprosecuting 93attorneyuponreceivingsuchnoticedoesnottakeanyactionundersubsection5ofthis 94section,theoffendershallbedischargedundersubsection7ofthissection. 95 11.AnyoffenderwhowassentencedpriortoJanuary1,2017,toanoffensethatwas 96eligibleforearnedcompliancecreditsundersubsection1or2ofthissectionatthetimeof 97sentencingshallcontinuetoremaineligibleforearnedcompliancecreditssolongasthe 98offendermeetsalltheotherrequirementsprovidedunderthissection. 99 12.Theapplicationofearnedcompliancecreditsshallbesuspendeduponentryintoa 100treatmentcourt,asdescribedinsections478.001to478.009,andshallremainsuspendeduntil 101theoffenderisdischargedfromsuchtreatmentcourt.Uponsuccessfulcompletionof 102treatmentcourt,allearnedcompliancecreditsaccumulatedduringthesuspensionperiodshall 103beretroactivelyapplied,solongastheothertermsandconditionsofprobationhavebeen 104successfullycompleted. 217.704.1.Thissectionshallbeknownandmaybecitedasthe"EarningSafe 2ReentryThroughWorkActof2021". 3 2.Asusedinthissection,thefollowingtermsmean: 4 (1)"Eligibleemployment",anyoccupationorcombinationofoccupationsfor 5whichanoffendermayprovidedocumentationofverifiablewage-earninghoursinthe 6amountofatleastonehundredthirtyhoursperthirty-dayperiod; 7 (2)"Supportingdocumentation",employmentrecords,paystubs,employment 8letters,contracts,orsimilarlyreliablemethodsofemploymentverification,as 9determinedbythedivisionofprobationandparole; 10 (3)"Work-for-timecredit",acreditthatisequaltoaone-dayreductioninan 11offender'ssentencethatcanbeaccruedformaintainingeligibleemployment; 30 (3)Supervisedbyacourtortheboard;and 31 (4)Incompliancewiththeconditionsofsupervisionimposedbythesentencing 32courtorboard. 33 4.Asentencingcourtortheboardmay,uponitsownmotionoramotionofthe 34prosecutingorcircuitattorney,makeafindingthattheoffenderplacedonprobation, 35parole,orconditionalreleaseforanoffenselistedbelowisineligibletoearncompliance 36creditsbecausethenatureandcircumstancesoftheoffenseorthehistoryandcharacter 37oftheoffenderindicatethatalongertermofprobation,parole,orconditionalreleaseis 38necessaryfortheprotectionofthepublicortheguidanceoftheoffender.Themotion 39maybemadeanytimepriortothefirstmonthinwhichtheoffendermayearn 40compliancecreditsunderthissection.Anoffender'sabilitytoearncreditsshallbe 41suspendeduntilthecourtorboardmakesitsfinding.Ifthecourtorboardfindsthat 42theoffenderiseligibleforearnedcompliancecredits,thecreditsshallbegintoaccrueon 43thefirstdayofthenextcalendarmonthfollowingtheissuanceofthedecision.This 44subsectionappliestotheoffensesof: 45 (1)Involuntarymanslaughterintheseconddegree; 63 (2)Theofficershallverifytheoffender'seligibleemploymentthroughthe 64offender'ssupportingdocumentationandanyothermeansthatthedivisionof 65probationandparoledeterminesnecessary.Theofficershallrecordthesupporting 66documentationandtheoffender'saccrualofallwork-for-timecreditswithinfive 67workingdaysofverifyingtheoffender'seligibleemployment; 68 (3)Anoffender,includinganoffenderwhoisbeingsupervisedinanotherstate, 69shallaccruetwentywork-for-timecreditsforeverythirty-dayperiodinwhichthe 70offendermaintainseligibleemployment,exceptforthesixty-dayperiodimmediately 71priortothesupervisedoffender'sadjustedsentenceenddateduringwhichnowork-for- 72timecreditsshallaccrue; 73 (4)Ontherevocationofprobation,parole,orconditionalreleaseoronanew 74criminalconviction,anoffenderforfeitsallwork-for-timecreditpreviouslyaccrued; 75and 76 (5)Anoffendershallnotreceivework-for-timecreditsiftheoffender's 77supportingdocumentationisunverifiable,inaccurate,orabsent.Ifarequestforwork- 78for-timecreditsisdenied,theofficershallrecordthereasonforthedenialofwork-for- 79timecreditsandmakethatinformationavailabletotheoffender. 80 6.Anyoffenderwhoisdeemedbythedivisiontobeanabscondershallnotearn 81credits.Forpurposesofthissubsection,"absconder"meansanoffenderunder 82supervisionwhohasleftsuchoffender'splaceofresidencywithoutthepermissionofthe 83offender'ssupervisingofficerforthepurposeofavoidingsupervision.Anoffendershall 84nolongerbedeemedanabsconderwhensuchoffenderisavailableforactive 85supervision. 86 7.Theawardorrescissionofanycreditsearnedunderthissectionshallnotbe 87subjecttoappealoranymotionforpostconvictionrelief. 88 8.Theofficerresponsibleforsupervisinganoffenderwhoaccrueswork-for-time 89creditsshallnotifythesentencingcourtoftheoffender'saccrualofwork-for-time 90creditsnotlessthansixtydaysbeforethedateoffinaldischarge,whichincludesthe 91accrualofwork-for-timecreditsuptothedateofthenotification.
