Thisbillestablishesthe"EarningSafeReentryThroughWorkActof
2021".
Offendersmayearnacreditthatisequaltoaone-dayreductionin
asentenceformaintainingeligibleemployment. ThedDivisionof
ProbationandParolewithintheDepartmentofCorrectionsshall
awardwork-for-timecreditstoanyoffenderwhois:
(1)NotsubjecttolifetimesupervisionunderSections217.735and
559.106,RSMoorotherwisefoundtobeineligibletoearncredits
byacourtasspecifiedinthebill;
(2)Onprobation,parole,orconditionalreleasefor:
(a)AnoffenselistedinChapter579;
(b)AnoffensepreviouslylistedinChapter195;or
(c)AnyclassDfelonyorclassEfelonyexcludingtheoffensesof
stalkinginthefirstdegree,rapeintheseconddegree,sexual
assault,sodomyintheseconddegree,deviatesexualassault,
assaultintheseconddegreeundersubdivision(2)ofsubsection1
ofSection565.052,sexualmisconductinvolvingachild,
endangeringthewelfareofachildinthefirstdegreeunder
subdivision(2)ofsubsection1ofSection568.045,incest,
invasionofprivacy,abuseofachild,oranyoffenseofaggravated
stalkingorassaultintheseconddegreeundersubdivision(2)of
subsection1ofSection565.060,assuchoffensesexistedpriorto
January1,2017;
(3)Supervisedbyacourtortheboard;and
(4)Incompliancewiththeconditionsofsupervisionimposedby
thesentencingcourtorboard.
Asentencingcourtortheboardmay,uponitsownmotionora
motionoftheprosecutingorcircuitattorney,makeafindingthat
theoffenderplacedonprobation,parole,orconditionalrelease
foranoffenselistedbelowisineligibletoearncompliance
creditsbecausethenatureandcircumstancesoftheoffenseorthe
historyandcharacteroftheoffenderindicatethatalongerterm
ofprobation,parole,orconditionalreleaseisnecessaryforthe protectionofthepublicortheguidanceoftheoffender. The
motionmaybemadeanytimepriortothefirstmonthinwhichthe
offendermayearncompliancecreditsunderthissection. An
offender'sabilitytoearncreditsshallbesuspendeduntilthe
courtorboardmakesitsfinding. Ifthecourtorboardfindsthat
theoffenderiseligibleforearnedcompliancecredits,thecredits
shallbegintoaccrueonthefirstdayofthenextcalendarmonth
followingtheissuanceofthedecision. Offensesforwhichacourt
orboardmaymakesuchmotionsare:
(1)Involuntarymanslaughterintheseconddegree;
(2)Assaultintheseconddegreeexceptundersubdivision(2)of
subsection1ofSection565.052orSection565.060asitexisted
priortoJanuary1,2017;
(3)Domesticassaultintheseconddegree;
(4)Assaultinthethirddegreewhenthevictimisaspecial
victimorassaultofalawenforcementofficerintheseconddegree
asitexistedpriortoJanuary1,2017;
(5)Statutoryrapeintheseconddegree;
(6)Statutorysodomyintheseconddegree;
(7)Endangeringthewelfareofachildinthefirstdegreeunder
subdivision(1)ofsubsection1ofSection568.045;or
(8)Anycaseinwhichthedefendantisfoundguiltyofafelony
offenseunderChapter571.
Eachsupervisedoffenderwhomaintainseligibleemploymentshall
accruework-for-timecreditsiftheoffenderprovidessupporting
documentationofeligibleemploymenttotheofficerresponsiblefor
theoffender'ssupervisionwithinfiveworkingdaysofthe
conclusionofeach30dayperiodinwhichtheoffendermaintains
eligibleemployment. Theofficershallverifytheoffender's
eligibleemploymentthroughtheoffender'ssupportingdocumentation
andanyothermeansthattheDivisionofProbationandParole
determinesnecessary. Theofficershallrecordthesupporting
documentationandtheoffender'saccrualofallwork-for-time
creditswithinfiveworkingdaysofverifyingtheoffender's
eligibleemployment.
Anoffender,includinganoffenderwhoisbeingsupervisedin
anotherstate,shallaccrue20work-for-timecreditsforevery30
dayperiodinwhichtheoffendermaintainseligibleemployment,
exceptforthe60dayperiodimmediatelypriortothesupervised offender'sadjustedsentenceenddateduringwhichnowork-for-time
creditsshallaccrue.Ontherevocationofprobation,parole,or
conditionalreleaseoronanewcriminalconviction,anoffender
forfeitsallwork-for-timecreditpreviouslyaccrued. Anoffender
shallnotreceivework-for-timecreditsiftheoffender's
supportingdocumentationisunverifiable,inaccurate,orabsent.
Ifarequestforwork-for-timecreditsisdenied,theofficershall
recordthereasonforthedenialofwork-for-timecreditsandmake
thatinformationavailabletotheoffender.
AnyoffenderwhoisdeemedbytheDivisiontobeanabscondershall
notearncredits. Thismeansoffenderswholeavetheirplaceof
residencywithoutthepermissionoftheoffender'ssupervising
officerforthepurposeofavoidingsupervision. Anoffendershall
nolongerbedeemedanabsconderwhensuchoffenderisavailable
foractivesupervision.
TheawardorrescissionofanycreditsearnedunderthisSection
shallnotbesubjecttoappealoranymotionforpostconviction
relief.
Theofficerresponsibleforsupervisinganoffenderwhoaccrues
work-for-timecreditsshallnotifythesentencingcourtofthe
offender'saccrualofwork-for-timecreditsnotlessthan60days
beforethedateoffinaldischarge,whichincludestheaccrualof
work-for-timecreditsuptothedateofthenotification.
ThisbillhasadelayedeffectivedateofJanuary1,2023.
PROPONENTS: Supporterssaythatthebillwillhelpwiththe
currentworkforceshortageandwouldincentivizeinmatestolearn
valuablejobskills.Studiesshowthatinmateparticipationin
jobsprogramsgreatlyreducesrecidivism. Theearlyreleaseof
inmatesisalsocosteffectiveandreducestheburdenontheparole
system.
