Torepealsection573.040,RSMo,andtoenactinlieuthereofonenewsectionrelatingtothe
offenseoffurnishingpornographicmaterialtominors,withpenaltyprovisions.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section573.040,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection573.040,toreadasfollows:
573.040.1.Apersoncommitstheoffenseoffurnishingpornographicmaterialto
2minorsif,knowingofitscontentandcharacter,heorshe:
3 (1)Furnishesanymaterialpornographicforminors,knowingthatthepersontowhom
4itisfurnishedisaminororactinginrecklessdisregardofthelikelihoodthatsuchpersonisa
5minor;or
6 (2)Produces,presents,directsorparticipatesinanyperformancepornographicfor
7minorsthatisfurnishedtoaminorknowingthatanypersonviewingsuchperformanceisa
8minororactinginrecklessdisregardofthelikelihoodthataminorisviewingthe
9performance;or
10 (3)Furnishes,produces,presents,directs,participatesinanyperformanceor
11otherwisemakesavailablematerialthatispornographicforminorsviacomputer,electronic
12transfer,internetorcomputernetworkifthepersonmadethematteravailabletoaspecific
13individualknownbythedefendanttobeaminor.
14 2.Itisnotadefensetoaprosecutionforaviolationofthissectionthattheperson
15beingfurnishedthepornographicmaterialisapeaceofficermasqueradingasaminor.
16 3.Theoffenseoffurnishingpornographicmaterialtominorsorattemptingtofurnish
17pornographicmaterialtominorsisaclassAmisdemeanorunlessthepersonhasbeenfound
