statefaircommission.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section262.217,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection262.217,toreadasfollows:
262.217.EffectiveSeptember1,1995,thereiscreateda"StateFairCommission"
2whosedomicileforthepurposesofsections262.215to262.280shallbethedepartmentof
3agricultureofthisstate.Thecommissionshallconsistofninemembers,[twoofwhomshall
4beactivefarmers,twoofwhomshallbeeithercurrentmembersorpastpresidentsofcounty
5orregionalfairboards,] oneofwhomshallbethedirectorofthedepartmentofagriculture[,
6oneofwhomshallbeemployedinagribusiness,andthreeat-largememberswhoshallbe
7Missouriresidents]. Thedirectorofthedepartmentofagriculture[shallbethechairmanof
8thecommissionuntilJanuary31,1997,and]shallnotbecountedagainstmembershipfroma
9congressionaldistrict[, atwhichtime].The[chairman] chairshallbeelectedfromamongthe
10membersofthecommissionbythecommissionmembers.Suchofficershallserveforaterm
11oftwoyears.Commissionersshallbereimbursedfortheiractualandnecessaryexpenses
12incurredwhenattendingmeetingsofthecommission,tobepaidfromappropriationsmade
13therefor.Commissionersshallbeappointedbythegovernor,withtheadviceandconsentof
14thesenate.[Thecountyfairassociationinthestatemaysubmittothegovernoralistof
15nomineesforappointment,threefromeachcongressionaldistrict,forthosecommission
16memberswhoarerequiredtobecurrentmembersorpastpresidentsofcountyfairboards.
17Notmorethanfourcommissionersexcludingthedirectorofagricultureshallbemembersof

19priorto[his]thecommissioner'sappointment.Theeightinitialcommissionersshallbe
20appointedasfollows:twoshallbeappointedfortermsofoneyear,twofortermsoftwo
21years,twofortermsofthreeyearsandtwofortermsoffouryears.Theirsuccessorsshallbe
22appointedfortermsoffouryears.Acommissionershallcontinuetoserveuntil[his]a
23successorisappointedandqualified.Wheneveranyvacancyoccursonthecommission,the
24governorshallfillthevacancybyappointmentfortheremainderofthetermofthe
25commissionerwhowasreplaced.Uptothreecommissionmembersmaybeappointed
26fromthecongressionaldistrictcontainingthestatefairgroundsasdescribedinsection
27262.220,butthereshallbenomorethantwocommissionmembersfrom[any]eachofthe
28othercongressional[district] districts.
