4operatedforthepurposeofteachingcosmetologyasdefinedinthissectionandmeetingthe
5criteriasetforthunder34C.F.R.Part600,Sections600.1and600.2;
6 (2)"Apprentice"or"student",apersonwhoisengagedintrainingwithina
7cosmetologyestablishmentorschool,andwhilesotrainingperformsanyofthepracticesof
8theclassifiedoccupationswithinthischapterundertheimmediatedirectionandsupervision
9ofalicensedcosmetologistorinstructor;
10 (3)"Board",thestateboardofcosmetologyandbarberexaminers;
11 (4)"Cosmetologist",anypersonwho,forcompensation,engagesinthepracticeof
12cosmetology,asdefinedinsubdivision(5)ofthissection;
13 (5)"Cosmetology"includesperformingorofferingtoengageinanyactsofthe
14classifiedoccupationsofcosmetologyforcompensation,whichshallinclude:
15 (a)"ClassCH-hairdresser"includesarranging,dressing,curling,singeing,waving,
16permanentwaving,cleansing,cutting,bleaching,tinting,coloringorsimilarworkuponthe

24 (b)"ClassMO-manicurist"includescutting,trimming,polishing,coloring,tinting,
25cleaningorotherwisebeautifyingaperson'sfingernails,applyingartificialfingernails,
26massaging,cleaningaperson'shandsandarms;pedicuring,whichincludescutting,trimming,
27polishing,coloring,tinting,cleaningorotherwisebeautifyingaperson'stoenails,applying
28artificialtoenails,massagingandcleaningaperson'slegsandfeet;
29 (c)"ClassCA-hairdressingandmanicuring"includesallpracticesofcosmetology,
30asdefinedinparagraphs(a)and(b)ofthissubdivision;
31 (d)"ClassE-estheticians"includestheuseofmechanical,electricalapparatusesor
32appliances,orbytheuseofcosmeticpreparations,antiseptics,tonics,lotionsorcreams,not
33toexceedtenpercentphenol,engagesforcompensation,eitherdirectlyorindirectly,inany
34one,oranycombination,ofthefollowingpractices:massaging,cleansing,stimulating,
35manipulating,exercising,beautifyingorsimilarworkuponthescalp,face,neck,ears,arms,
36hands,bust,torso,legsorfeetandremovingsuperfluoushairbymeansotherthanelectric
37needleoranyothermeansofarchingortintingeyebrowsortintingeyelashes,ofanyperson;
38 (6)"Cosmetologyestablishment",thatpartofanybuildingwhereinorwhereuponany
39oftheclassifiedoccupationsareregularlypracticedincludinganyspacerentedwithina
40licensedestablishmentbyapersonlicensedunderthischapter,forthepurposeofregularly
41renderingcosmetologyservices. Theterm"cosmetologyestablishment"shallnotinclude
42anyplaceinwhichcosmetologyservicesareprovidedononlyanoccasionalbasisorfor
43onlyoneclient;
44 (7)"Cross-overlicense",alicensethatisissuedtoanypersonwhohasmetthe
45licensureandexaminationrequirementsforbothbarberingandcosmetology;
46 (8)"Hairbraider",anypersonwho,forcompensation,engagesinthepracticeofhair
47braiding;
48 (9)"Hairbraiding",inaccordancewiththerequirementsofsection329.275,theuse
49oftechniquesthatresultintensiononhairstrandsorrootsbytwisting,wrapping,waving,
50extending,locking,orbraidingofthehairbyhandormechanicaldevice,butdoesnotinclude
51theapplicationofdyes,reactivechemicals,orotherpreparationstoalterthecolorofthehair
52ortostraighten,curl,oralterthestructureofthehair;

54cosmetologyasdefinedinparagraph(a)ofsubdivision(5)ofthissection;
55 (11)"Instructor",anypersonwhoislicensedtoteachcosmetologyoranypracticesof
56cosmetologypursuanttothischapter;
57 (12)"Manicurist",anypersonwho,forcompensation,engagesinanyorallofthe
58practicesinparagraph(b)ofsubdivision(5)ofthissection;
59 (13)"Parentalconsent",thewritteninformedconsentofaminor'sparentorlegal
60guardianthatmustbeobtainedpriortoprovidingbodywaxingonornearthegenitalia;
61 (14)"Schoolofcosmetology"or"schoolofmanicuring",anestablishmentoperated
62forthepurposeofteachingcosmetologyasdefinedinsubdivision(5)ofthissection.
329.045.1.Everycosmetologyestablishment[inwhichtheoccupationof
2cosmetologyispracticed] shallberequiredtoobtainalicensefromtheboard.Every
3establishmentrequiredtobelicensedshallpaytotheboardanestablishmentfeeforthefirst
4threelicensedcosmetologistsestheticianand/ormanicurists,and/orapprenticesandan
5additionalfeeforeachadditionallicensee.Thefeeshallbedueandpayableontherenewal
6dateand,ifthefeeremainsunpaidthereafter,thereshallbealatefeeinadditiontotheregular
7establishmentfeeor,ifanewestablishmentopensanytimeduringthelicensingperiodand
8doesnotregisterbeforeopening,thereshallbeadelinquentfeeinadditiontotheregular
9establishmentfee.Thelicenseshallbekeptpostedinplainviewwithintheestablishmentat
10alltimes.
11 2.Anewlicenseshallbeobtainedforacosmetologyestablishmentwithinforty-five
12dayswhentheestablishmentchangesownershiporlocation.Thestateinspectorshallinspect
13thesanitaryconditionsrequiredforlicensureforanestablishmentthathaschangedownership
14orlocationwithoutrequiringtheownertoclosebusinessordeviateinanywayfromthe
15establishment'sregularhoursofoperation.
329.110.1.Ifanapplicantforexaminationforcosmetologypassestheexamination
2tothesatisfactionoftheboardandhaspaidthefeerequiredandcompliedwiththe
3requirementspertainingtothischapter,theboardshallcausetobeissuedalicensetothat
4effect.Thelicenseshallbeevidencethatthepersontowhomitisissuedisentitledtoengage
5inthepractices,occupationoroccupationsstipulatedthereinasprescribedinthischapter.
6Thelicenseshallbeconspicuouslydisplayedinhisorherprincipaloffice,placeofbusiness,
7oremployment.
8 2.Wheneveranyonewhohasbeenlicensedinaccordancewiththischapterpractices
9anyoftheoccupationsauthorizedinthischapteroutsideoforawayfromtheperson's
10principaloffice,placeofbusiness,oremployment,heorsheshalldelivertoeachpersonin
11hisorhercareacertificateofidentification.Thiscertificateshallcontainhisorhersignature,
HB2131	3 12thenumberanddateofhisorherlicense,thepostofficeaddressandthedateuponwhichthe
13certificateofidentificationisdeliveredtothepersonunderhisorhercare.
14 3.(1)Notwithstandingsubsections1and2ofthissection,acosmetologist
15licensedunderthischaptershallnotberequiredtomaintainaprincipaloffice,placeof
16business,oremploymentinordertoengageinthepracticeofcosmetology.
17 (2)Acosmetologistlicensedunderthischaptermayprovidecosmetology
18servicesoutsideoforawayfromalicensedcosmetologyestablishmentonaregularbasis
19andshallnotberequiredtoprovideanycosmetologyservicesatalicensedcosmetology
20establishmentinordertomaintainhisorherlicense.
21 (3)Acosmetologistlicensedunderthischapterwhodoesnotmaintaina
22principaloffice,placeofbusiness,oremploymentshalldelivertoeachpersoninhisor
23hercareacertificateofidentificationasdescribedundersubsection2ofthissection.
