FISCAL ANALYSIS
ASSUMPTION
Officials from Department of Elementary and Secondary Education state section 170.347 
prohibits state exams from including any question or statement that promotes any concept or idea 
outlined in the section. DESE estimates a $500,000 expenditure to conduct a content and 
sensitivity review of the assessment item bank for all qualifying state exams. The $500,000 
includes: 


Oversight assumes DESE can accomplish this review for less than $500,000; however, 
Oversight does not have enough information to provide a cost estimate.  For purposes of the 
fiscal note, Oversight will reflect a cost to DESE in FY 2023 of “Less than” their $500,000 
estimate.
Officials from the Hurley R-1 School District assume the proposal will have no fiscal impact on 
their organization. 
Oversight does not anticipate a fiscal impact to school districts. However, Oversight received a 
limited number of responses from school districts related to the fiscal impact of this proposal. 
Oversight has presented this fiscal note on the best current information available. Upon the 
receipt of additional responses, Oversight will review to determine if an updated fiscal note 
should be prepared and seek the necessary approval to publish a new fiscal note. A listing of 
political subdivisions included in the Missouri Legislative Information System (MOLIS) 
database is available upon request.

No direct fiscal impact to small businesses would be expected as a result of this proposal.
FISCAL DESCRIPTION
This bill requires that state exams produced by the Department of Elementary and Secondary 
Education or required under sections 170.011, 170.013, or 170.345, RSMo, may not include 
specific questions or statements that promote concepts or ideas listed in the bill. Such concepts 
and ideas include but are not limited to: one race or sex is inherently superior to another race or 
sex; an individual's moral character, standing, or worth is necessarily determined by such 
individual's race or sex; and the advent of slavery in the territory that is now the United States 
constituted the true founding of the United States. 
This legislation is not federally mandated, would not duplicate any other program and would not 
require additional capital improvements or rental space.
