115.045.Eachelectionauthorityshallhavetheauthoritytoemploysuchattorneys 2andotheremployeesasmaybenecessarytopromptlyandcorrectlyperformthedutiesofthe 3electionauthority.Whereanelectronicvotingsystemorvotingmachinesareused,the 4electionauthorityshalldesignatecompetentemployeestohavecustodyofandsupervise 5maintenanceofthevotingequipment.Boardofelectioncommissioners'employeesshallbe 6subjecttothesamerestrictionsandsubscribethesameoathasmembersoftheboardof 7electioncommissioners,exceptthatnoemployeeofaboardofelectioncommissionersshall 8berequiredtopostbondorresideandbearegisteredvoterwithinthejurisdictionofthe 9electionauthorityunlessdirectedtodosobytheboard.Employeeoathsandanybondsshall 10befiledandpreservedintheofficeoftheboard. 115.051.1.Ineachcountywhichdoesnothaveaboardofelectioncommissioners, 2thecountyclerkshallhavetherighttoemploysuchdeputiesandassistantsasarenecessaryto 3promptlyandcorrectlyregistervotersandconductelections.Whereanelectronicvoting HCSHB2140 4 4systemorvotingmachinesareused,thecountyclerkshalldesignatecompetentemployeesto 5havecustodyofandsupervisemaintenanceofthevotingequipment.Eachdeputyshallbe 6subjecttothesamerestrictionsandsubscribethesameoathasthecountyclerk,exceptthatno 7employeeshallberequiredtopostbondorresideandbearegisteredvoterwithinthe 8jurisdictionoftheelectionauthorityunlessdirectedtodosobytheclerk.Employeeoaths 9andanybondsshallbefiledandpreservedintheofficeofthecountyclerk. 10 2.Withinthetotalamountfordeputiesandassistantsapprovedbythecounty 11commission,thesalaryofeachdeputyandassistantshallbesetbythecountyclerk. 115.081.1.Eachelectionauthorityshallappointelectionjudgesforeachpolling 2placewithinitsjurisdictioninaccordancewiththeprovisionsofthissection. 3 2.Inallprimaryandgeneralelections,theelectionauthorityshallappointatleasttwo 4judgesfromeachmajorpoliticalpartytoserveateachpollingplace.Thecommitteeofeach 5majorpoliticalpartywithinthejurisdictionofanelectionauthorityisauthorizedto 6providetheelectionauthoritywithalistofelectionjudgecandidateswhomeetthe 7requirementsundersection115.085.Thecandidatesshallnotberequiredtoreside 8withinthejurisdictionoftheelectionauthority,asauthorizedundersection115.085.If 9acommitteeofamajorpoliticalpartywithinthejurisdictionofanelectionauthority 10failstoprovidetheprescribednumberofqualifiednamestofillallelectionjudge 11positionsbeforethedateestablishedbytheelectionauthority,theelectionauthoritymay 12selectjudgestofillthepositionsasprovidedbylaw.Iftheelectionauthoritydetermines 13thatanamesubmittedbyacommitteeofamajorpoliticalpartyisnotqualifiedtoserve 14asanelectionjudge,theelectionauthorityshallallowthepartytosubmitanothername 18orherresidence[priortothedeadlinetoregistertovote]. 19 4.Acoveredvoterasdefinedinsection115.275whohasbeendischargedfrom 20militaryservice,hasreturnedfromamilitarydeploymentoractivation,orhasseparatedfrom 21employmentoutsidetheterritoriallimitsoftheUnitedStatesafterthedeadlinetoregisterto 68chiefexecutiveofficeroftheagencyunderwhosedirectionheorsheisserving.Thepetition 69toclosetheresidentialaddressshallbeincorporatedintoanypetitionforprotectiveorder 70providedbycircuitclerkspursuanttochapter455.Ifsatisfiedthatthepersonfilingthe 71petitionmeetsthequalificationsofthissubsection,thecircuitcourtshallissueanordertothe 72electionauthoritytokeeptheresidentialaddressofthevoteraclosedrecordandtheaddress 73maybeusedonlyforthepurposesofadministeringelectionspursuanttothischapter.The 74electionauthoritymayrequirethevoterwhohasaclosedresidentialaddressrecordtoverify 75thathisorherresidentialaddresshasnotchangedortofileachangeofaddressandtoaffirm 76thatthereasonscontainedintheoriginalpetitionarestillaccuratepriortoreceivingaballot. 77Achangeofaddresswithinanelectionauthority'sjurisdictionshallnotrequirethatthevoter 78fileanewpetition.Anyvoterwhonolongerqualifiespursuanttothissubsectiontohavehis 79orherresidentialaddressasaclosedrecordshallnotifythecircuitcourt.Uponsuch HCSHB2140 9 80notification,thecircuitcourtshallvoidtheorderclosingtheresidentialaddressandsonotify 81theelectionauthority. 115.160.1.AllMissouridriver'slicenseapplicantsshallreceiveavoterregistration 2applicationformasasimultaneouspartoftheapplicationforadriver'slicense,renewalof 3driver'slicense,changeofaddress,duplicaterequestandanondriver'slicense. 4 2.Ifasingleapplicationformisused,thevoterregistrationapplicationportionofany 5applicationdescribedinsubsection1ofthissectionmaynotrequireanyinformationthat 6duplicatesinformationrequiredinthedriver'slicenseportionoftheform,exceptasecond 7signatureorotherinformationrequiredbylaw. 8 3.Afterconferringwiththesecretaryofstateasthechiefstateelectionofficial 9responsibleforoverseeingofthevoterregistrationprocess,thedirectorofrevenueshalladopt 10rulesandregulationspertainingtotheformatofthevoterregistrationapplicationusedbythe 11department.Thedirectorofrevenueshallutilizeelectronicvoterregistrationapplication 12formsandprovideforsecureelectronictransferofvoterregistrationinformationto 13electionauthorities.Thesecretaryofstateandthedirectorofrevenueshallensurethe 14confidentialityandintegrityofthevoterregistrationdatacollected,maintained, 15received,ortransmittedunderthissection. 16 4.Noinformationrelatingtothefailureofanapplicantforadriver'slicenseor 17nondriver'slicensetosignavoterregistrationapplicationmaybeusedforanypurposeother 18thanvoterregistration. 19 5.Anyvoterregistrationapplicationreceivedpursuanttotheprovisionsofthis 20sectionshallbeforwarded, inasecureandelectronicmanner,totheelectionauthority 21locatedwithinthatcountyoranycitynotwithinacounty,orifthereismorethanoneelection 22authoritywithinthecounty,thentotheelectionauthoritylocatednearesttothelocationwhere 23thedriver'slicenseapplicationwasreceived.Voterregistrationinformation,includingan 24electronicimageofthesignatureoftheapplicant,shallbetransmittedinaformat 25compatiblewiththeMissourivoterregistrationsystemestablishedinsection115.158 26thatallowsforreviewbytheelectionauthorityanddoesnotrequiretheelection 27authoritytomanuallyreentertheinformation.Theelectionauthorityreceivingthe 28applicationformsshallreviewtheapplicationsandforward, inasecureandelectronic 29manner,anyapplicationspertainingtoadifferentelectionauthoritytothatelectionauthority. 30 6.Acompletedvoterregistrationapplicationacceptedinthedriver'slicensing 31processshallbetransmittedtotheelectionauthoritydescribedinsubsection5ofthissection 32notlaterthan[five] threebusinessdaysaftertheformiscompletedbytheapplicant. 33 7.AnypersonregisteringtovotewhenapplyingfororrenewingaMissouridriver's 34licenseshallsubmitwiththeapplicationformacopyofabirthcertificate,aNativeAmerican 35tribaldocument,orotherproofofUnitedStatescitizenship,avalidMissouridriver'slicense, HCSHB2140 10 36orotherformofpersonalidentification.Anypersonwho,atthetimeofatransactionwith 37thedivisionofmotorvehicleanddriverlicensingofthedepartmentofrevenue,provides 38adocumentthatestablishesnoncitizenshipshallnotbeofferedtheopportunityto 39registertovoteaspartofthetransaction. 40 8.Thesecretaryofstateandthedirectorofrevenueshalljointlydevelopa 41processbywhichthedivisionofmotorvehicleanddriverlicensingofthedepartmentof 42revenue,uponobtainingaspartofalicensetransactionaperson'sfullname,dateof 43birth,driver'slicenseorstateidentificationnumber,residenceaddress,andmailing 44address,ifdifferentfromsuchperson'sresidenceaddress,mayuseinformationfrom 45thestatewidevoterregistrationdatabasetodeterminewhetherthepersonisalready 46registeredtovoteinthisstateand,ifso,whetherthepersonisregisteredattheaddress 47andunderthenamethepersonprovidedtothedivisionofmotorvehicleanddriver 48licensingofthedepartmentofrevenue. 115.165.1.Ifthevoterfilesachangeofaddressapplicationinpersonattheofficeof 2theelectionauthority,atthepollingplace,orpursuanttosection115.159,115.160,115.162or 3115.193,orotherwiseprovidessignedwrittennoticeofthemove,includingnoticeby 4facsimile, electronic,oronlinetransmission,anelectionauthoritymaychangetheaddresson 5avoterregistrationrecordforavoterwhomoveswithintheelectionauthority'sjurisdiction 6aftercomparingandverifyingthesignature.Beforechangingtheaddressonavoterrecord, 7theelectionauthorityshallbesatisfiedthattherecordisthatofthepersonprovidingthe 8changeofaddressinformation. 9 2.Aregisteredvoterwhohaschangedhisorherresidencewithinanelection 10authority'sjurisdictionandhasnotbeenremovedfromthelistofregisteredvoterspursuantto 11thischaptershallbepermittedtofileachangeofaddresswiththeelectionauthorityorbefore 12anelectionjudgeatapollingplaceandvoteatacentralpollingplaceoratthepollingplace 13thatserveshisorhernewaddressuponwrittenororalaffirmationbythevoterofthenew 14address. 15 3.Aregisteredvoterwhohaschangedhisorherresidencewithinthestateand 16hasnotbeenremovedfromthelistofregisteredvotersunderthischaptershallbe 17permittedtofileachangeofaddressinpersonattheofficeoftheelectionauthorityon 18electionday.Inordertochangeanaddressinpersononelectiondayunderthis 19subsection,aregisteredvotershallprovideaformofpersonalidentificationrequired 20undersubsection1ofsection115.427. 21 4.Iftheapplicantforregistrationwaslastregisteredinanotherjurisdictionwithin 22thisstateoranotherstate,theelectionauthorityshallsendnoticeoftheregistrationtothe 23electionauthoritywheretheapplicantwaspreviouslyregistered.Theelectionauthority 24sendingthenoticeshallprovideidentifyinginformationtoassisttheelectionauthority HCSHB2140 11 25receivingthenoticetodeterminewhetherthepersonnamedwaspreviouslyregisteredinsuch 26jurisdictionandwhether,basedontheidentifyinginformationprovided,theapplicationcan 27beremovedfromthevotingrecordintheformerjurisdiction. 28 [4.]5.Uponreceiptofanoticefromanotherelectionauthoritythatavoterhas 29registeredinanotherjurisdictioninthisstateoranotherstate,theelectionauthorityshall 30determinewhethersufficientinformationisprovidedinthenoticetoidentifytheperson 31namedinsuchnoticeaspreviouslyregisteredintheelectionauthority'sjurisdictionand 32presentlyremovablefromthevotingrecordsintheelectionauthority'sjurisdiction.Every 33electionauthorityisauthorizedtoexaminetheinformationprovidedinanoticeofduplicate 34registrationprovidedbytheMissourivoterregistrationsystemauthorizedpursuanttosection 35115.158todetermineifavoterinoneelectionauthority'svoterregistrationrecordshas 36subsequentlyregisteredinanotherjurisdiction.If,afterreviewingtheinformationprovided, 37theelectionauthorityissatisfiedthatthepersonidentifiedinthenoticeislistedasaregistered 38voterintheelectionauthority'sjurisdictionbuthassubsequentlyregisteredinanother 39jurisdiction,theelectionauthoritymayremovetheperson'sregistrationfromthelistof 40registeredvoters. 115.205.1.[Any] Noperson[whois]shallbepaidorotherwisecompensatedfor 2soliciting[morethanten]voterregistrationapplications,otherthanagovernmentalentityora 3personwhoispaidorcompensatedbyagovernmentalentityforsuchsolicitation[, shallbe 4registeredwiththesecretaryofstateasavoterregistrationsolicitor]. Avoterregistration 5solicitorwhosolicitsmorethantenvoterregistrationapplicationsshallregisterforevery 6electioncyclethatbeginsonthedayafterthegeneralelectionandendsonthedayofthe 7generalelectiontwoyearslater.Avoterregistrationsolicitorshallbeatleasteighteenyears 8ofageandshallbearegisteredvoterinthestateofMissouri. 9 2.Eachvoterregistrationsolicitorshallprovidethefollowinginformationinwriting 10tothesecretaryofstate'soffice: 11 (1)Thenameofthevoterregistrationsolicitor; 12 (2)Theresidentialaddress,includingstreetnumber,city,state,andzipcode; 13 (3)Themailingaddress,ifdifferentfromtheresidentialaddress;and 14 (4)[Whetherthevoterregistrationsolicitorexpectstobepaidforsolicitingvoter 15registrations; 16 (5)Ifthevoterregistrationsolicitorexpectstobepaid,theidentityofthepayor;or 17 (6)]Thesignatureofthevoterregistrationsolicitor. 18 3.Thesolicitorinformationrequiredinsubsection2ofthissectionshallbesubmitted 19tothesecretaryofstate'sofficewiththefollowingoathandaffirmation: 20 "IHEREBYSWEARORAFFIRMUNDERPENALTYOFPERJURYTHATALL 21STATEMENTSMADEBYMEARETRUEANDCORRECT.". HCSHB2140 13 32 4.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis 33createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies 34withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028. 35Thissectionandchapter536arenonseverableandifanyofthepowersvestedwiththe 36generalassemblypursuanttochapter536toreview,todelaytheeffectivedateorto 37disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof 38rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2002,shallbeinvalid 39andvoid. 40 5.Ifanyelectionauthorityusesanytouchscreendirect-recordingelectronic 41vote-countingmachine,theelectionauthoritymaycontinuetousesuchmachine.Upon 42theremovalofsuchvotingmachinefromtheelectionauthority'sinventorybecauseof 43mechanicalmalfunction,wearandtear,oranyotherreason,themachineshallnotbe 44replacedandnoadditionaldirect-recordingelectronicvotingmachineshallbeaddedto 45theelectionauthority'sinventory.SuchmachinesshallnotbeusedbeginningJanuary 461,2024,exceptthatelectionauthoritiesmayallowthemachinestobeusedbyvoterswho 47aredisabledaslongasthemachinesarefunctional.Replacementofequipmentforuse 48byvoterswhoaredisabledshallbewithpaperballotmarkingdevicesdesignedtoassist 49voters. 50 6.Thesecretaryofstateshallhaveauthoritytorequirecybersecuritytesting, 51includingpenetrationtesting,ofvendormachines,programs,andsystems.Failureto 52participateinsuchtestingshallresultinarevocationofvendorcertification.Upon 53noticefromanotherjurisdictionofcybersecurityfailuresorcertificationwithholdsor 54revocation,thesecretaryofstateshallhaveauthoritytorevokeorwithholdcertification 55forvendors.Therequirementsofthissectionshallbesubjecttoappropriationforthe 56purposeofcybersecuritytesting. 115.237.1.Eachballotprintedordesignedforusewithanelectronicvotingsystem 2foranyelectionpursuanttothischaptershallcontainallquestionsandthenamesofalloffices 3andcandidatescertifiedorfiledpursuanttothischapterandnoother.BeginningJanuary1, 42024,theofficialballotshallbeapaperballotthatishandmarkedbythevoterorbya 5paperballotmarkingdevicedesignedtoassistvotersrequestingsuchassistanceas 6authorizedundersubsection5ofsection115.225.Asfaraspracticable,allquestionsand 7thenamesofallofficesandcandidatesforwhicheachvoterisentitledtovoteshallbeprinted 8ononepageexceptfortheballotforpoliticalpartycommitteepersonsinpollingplacesnot 9utilizinganelectronicvotingsystemwhichmaybeprintedseparatelyandinconformitywith 10therequirementscontainedinthissection.Asfaraspracticable,ballotscontainingonly 11questionsandthenamesofnonpartisanofficesandcandidatesshallbeprintedinaccordance 12withtheprovisionsofthissection,exceptthattheballotinformationmaybelistedinvertical HCSHB2140 14 13orhorizontalrows.Thenamesofcandidatesforeachofficeshallbelistedintheorderin 14whichtheyarefiled. 15 2.Inpollingplacesusingelectronicvotingsystems,theballotinformationmaybe 16arrangedinverticalorhorizontalrowsoronanumberofseparatepagesorscreens.Inany 17event,thenameofeachcandidate,thecandidate'sparty,theofficeforwhichheorsheisa 18candidate,andeachquestionshallbeindicatedclearlyontheballot. 19 3.Nothinginthissubchaptershallbeconstruedasprohibitingtheuseofaseparate 20paperballotforquestionsorforthepresidentialpreferenceprimaryinanypollingplaceusing 21anelectronicvotingsystem. 22 4.Whereelectronicvotingsystemsareusedandwhenwrite-invotesareauthorized 23bylaw,awrite-inballot,whichmaybeintheformofaseparatepaperballot,card,or 24envelope,maybeprovidedbytheelectionauthoritytopermiteachvotertowriteinthenames 25ofpersonswhosenamesdonotappearontheballot. 26 5.Noballotprintedordesignedforusewithanelectronicvotingsystemforany 27partisanelectionheldunderthischaptershallallowapersontovoteastraightpoliticalparty 28ticket.Forpurposesofthissubsection,a"straightpoliticalpartyticket"meansvotingforall 29ofthecandidatesforelectiveofficewhoareontheballotrepresentingasinglepoliticalparty 30byasingleselectionontheballot. 31 6.Thesecretaryofstateshallpromulgaterulesthatspecifyuniformstandardsfor 32ballotlayoutforeachelectronicorcomputerizedballotcountingsystemapprovedunderthe 33provisionsofsection115.225sothattheballotusedwithanycountingsystemis,where 34possible,consistentwiththeintentofthissection.Nothinginthissectionshallbeconstrued 35torequiretheformatspecifiedinthissectionifitdoesnotmeettherequirementsoftheballot 36countingsystemusedbytheelectionauthority. 37 7.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis 38createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies 39withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028. 40Thissectionandchapter536arenonseverableandifanyofthepowersvestedwiththe 41generalassemblypursuanttochapter536toreview,todelaytheeffectivedateorto 42disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof 43rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2002,shallbeinvalid 44andvoid. 115.257.1.Injurisdictionswhereelectronicvotingmachinesareused,theelection 2authorityshallcausethevotingmachinestobeputinorder,set,adjustedandmadereadyfor 3votingbeforetheyaredeliveredtopollingplaces. 4 2.Atleastfivedaysbeforepreparingelectronicvotingmachinesforanyelection, 5noticeofthetimeandplaceofsuchpreparationshallbemailedtoeachindependentcandidate HCSHB2140 15 6andthechairmanofthecountycommitteeofeachestablishedpoliticalpartynamedonthe 7ballot.Thepreparationshallbewatchedbytwoobserversdesignatedbytheelection 8authority,onefromeachmajorpoliticalparty,andshallbeopentorepresentativesofthe 9politicalparties,candidates,thenewsmediaandthepublic. 10 3.Whenanelectronicvotingmachinehasbeenexaminedbysuchobserversand 11showntobeingoodworkingorder,themachineshallbelockedagainstvoting.The 12observersshallcertifythevotecountoneachmachineissetatzero. 13 4.Afteranelectronicvotingmachinehasbeenproperlypreparedandlocked,itskeys 14shallberetainedbytheelectionauthorityanddeliveredtotheelectionjudgesalongwiththe 15otherelectionsupplies. 16 5.Forthepurposeofprocessingabsenteeballots,castbyvotersinpersonintheoffice 17oftheelectionauthoritythatisdeemeddesignatedasapollingplace, theelectionauthority 18maycausevotingmachines, ifused,tobeputinorder,set,adjusted,tested,andmadeready 19forvotingwithinonebusinessdayoftheprintingofabsenteeballotsasprovidedinsection 20115.281.Theelectionauthorityshallhavetherecordingcounterexceptfortheprotective 21counteronthevotingmachinesettozero(000).Afterthevotingmachineshavebeenmade 22readyforvoting,theelectionauthorityshallnotpermitanypersontohandleanyvoting 23machine,exceptvoterswhiletheyarevotingandothersexpresslyauthorizedbytheelection 24authority.Theelectionauthorityshallneitherbenorpermitanyotherpersontobeinany 25positionornearanypositionthatenablestheauthorityorpersontoseehowanyabsentee 26votervotesorhasvoted. 27 28whichhasoverthreehundredthousandinhabitants,andissituatedinmorethanonecounty,] 29Iftheelectionauthorityreceivestenormoreapplicationsforabsenteeballotsfromthesame 30addressit[may] 19stateandlocalelections,shallresultinseparateelectionprocedurestoensurethe 20sovereigntyofthestateofMissouritoconductelectionsinthemannerinwhichthe 21generalassemblyshalldeemnecessary. 115.1500.1.Asusedinthissection,theterm"communications"shallmeanany 2federaldirectiveorguidancecommunicatedtothestateofMissourithroughtelephonic 3orelectronicmeans,throughthemail,orthroughin-personcontactpertainingto 4elections,includingthetimes,places,andmannerforcarryingoutelectionsinMissouri, 5receivedonoraftertheeffectivedateofthissection,byanystateagencyorperson, 6group,orentitychargedbythestatetoadministeranyofficialelectionoccurringwithin 7thestate.Thisincludes,butisnotlimitedto,anyguidanceissuedbytheDepartmentof HCSHB2140 44 8Justiceoranyotherfederalexecutiveagencyrelatedtoneworexistingvotingor 9electionlawsorprocedures. 10 2.Anystateagency,whetherthatagencyisinvolvedinelectionsornot,orany 11person,group,orentitychargedbythestatetoadministeranyofficialelection 12occurringwithinthestate,whoreceivesorsendsacommunicationwiththeDepartment 13ofJusticeoranyotherfederalexecutivebranchagencyrelatedtoneworexistingvoting 14orelectionlaws,shallprovidenoticetothegovernorandgeneralassemblyofthis 15communicationwithinfivebusinessdays. 16 3.Thenoticerequirementinsubsection2ofthissectionshallbepresumedto 17havebeenmetbasedonthepost-markeddateoneachlettersenttothegovernorand 18generalassembly,throughcertifiedmail,outliningthecommunicationtheagency, 19person,group,orentityreceivedfromorsenttotheDepartmentofJusticeoranyother 20federalexecutiveagency. 21 4.ThissectionshallexpireonFebruary1,2025. 7executiveagencyrelatedtoneworexistingvotingorelectionlaws. 8 2.Anyperson,group,orentitychargedbythestateofMissouritoadminister 9anyofficialelectionoccurringwithinthestatewhointendstoimplementanynew 10federalelectionguidancependingapprovalfromthestatelegislatureincompliancewith 11thisstatute,shallprovidenoticetothegeneralassemblyofitsintenttodosoatleast 12thirtydaysbeforeimplementingtheguidance. 13 3.Allnewfederalelectionguidanceshallbeapprovedbythestatelegislature 14beforeitisimplementedbyaperson,group,orentitychargedbythestatetoadminister 15anyofficialelectionoccurringwithinthestate. 16 4.Itshallbepresumedforpurposesofcompliancewiththissectionthatthe 17generalassemblyhasapprovedtheimplementationofthenewfederalelectionguidance 18ifthegeneralassemblyfailstovoteontheissuewithinthirtydaysfromwhennoticeis 19providedtothelegislatureundersubsection2ofthissection. 20 5.Aviolationofthissectionshallresultinafineintheamountoffivethousand 21dollarstobeleviedeverythirtydaysuntiltheimplementedguidanceisformally 22withdrawn. 23 6.ThissectionshallexpireonFebruary1,2025. HCSHB2140 45 115.1510.1.Asusedinthissection,theterm"newfederalelectionfunds"shall 2meananyfederalfundsreceivedonorafterthedatethisactissignedintolaw,bya 3person,group,orentitychargedbythestateofMissouritoadministeranyofficial 4electionoccurringwithinthestate. 5 2.Anyperson,group,orentitychargedbythestatetoadministeranyofficial 6electionoccurringwithinMissouriwhointendstoacceptordispersefederalelection 7fundspendingapprovalfromthestatelegislatureincompliancewiththissection,shall 8providenoticetothegeneralassemblyofitsintenttodosoatleastthirtydaysbefore 9acceptingthefunds.Iffundshavealreadybeenaccepted,thennoticemustbeprovided 10tothegeneralassemblythirtydaysbeforethefundsarebedispersed. 11 3.Allnewfederalelectionfundsshallbeapprovedbythegeneralassembly 12beforetheymaybeacceptedordispersedbyaperson,group,orentitychargedbythe 13statetoadministeranyofficialelectionoccurringwithinthestate. 14 4.Itshallbepresumedforpurposesofcompliancewiththissectionthatthe 15generalassemblyhasapprovedtheacceptanceanddispersalofnewfederalelection 16fundsifthegeneralassemblyfailstovoteontheissuewithinthirtydaysfromwhen 17noticeisprovidedtothegeneralassemblyinaccordancewithsubsection2ofthis 18section. 19 5.Aviolationofthissectionshallresultinafineintheamountofthenewfederal 20electionfundsacceptedordispersedinviolationofthissectionplusanadditionalone 21thousanddollars. 22 6.ThissectionshallexpireonFebruary1,2025.
