Torepealsection196.1050,RSMo,andtoenactinlieuthereofonenewsectionrelatingtothe
opioidaddictiontreatmentandrecoveryfund.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section196.1050,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection196.1050,toreadasfollows:
196.1050.1.Theproceedsofanymonetarysettlementorportionofaglobal
2settlementbetweentheattorneygeneralofthestateandanydrugmanufacturers,distributors,
3orcombinationthereoftoresolveanopioid-relatedcauseofactionagainstsuchdrug
4manufacturers,distributors,orcombinationthereofinastateorfederalcourtshallonlybe
5utilizedtopayforopioidaddictiontreatmentandpreventionservicesandhealthcareandlaw
6enforcementcostsrelatedtoopioidaddictiontreatmentandprevention.Underno
7circumstancesshallsuchsettlementmoneysbeutilizedtofundotherservices,programs,
8orexpensesnotreasonablyrelatedtoopioidaddictiontreatmentandprevention.
9 2.(1)Thereisherebyestablishedinthestatetreasurythe"OpioidAddiction
10TreatmentandRecoveryFund",whichshallconsistoftheproceedsofanysettlement
11describedinsubsection1ofthissection,aswellasanyfundsappropriatedbythegeneral
12assembly,orgifts,grants,donations,orbequests.Thestatetreasurershallbecustodianofthe
13fund.Inaccordancewithsections30.170and30.180,thestatetreasurermayapprove
14disbursements.Thefundshallbeadedicatedfundandmoneyinthefundshallbeusedbythe
15departmentofmentalhealth,thedepartmentofhealthandseniorservices,thedepartmentof
16socialservices,[and]thedepartmentofpublicsafety, thedepartmentofcorrections,the

19 (2)Notwithstandingtheprovisionsofsection33.080tothecontrary,anymoneys
20remaininginthefundattheendofthebienniumshallnotreverttothecreditofthegeneral
21revenuefund.
22 (3)Thestatetreasurershallinvestmoneysinthefundinthesamemannerasother
23fundsareinvested.Anyinterestandmoneysearnedonsuchinvestmentsshallbecreditedto
24thefund.
