195.206.1.Asusedinthissection,thefollowingtermsshallmean:
2 (1)"Addictionmitigationmedication",naltrexonehydrochloridethatis
3administeredinamannerapprovedbytheUnitedStatesFoodandDrug
4Administrationoranyacceptedmedicalpracticemethodofadministering;
5 [(1)](2)"Opioidantagonist",naloxonehydrochloridethatblockstheeffectsofan
6opioidoverdosethatisadministeredinamannerapprovedbytheUnitedStatesFoodand
7DrugAdministrationoranyacceptedmedicalpracticemethodofadministering;
8 [(2)](3)"Opioid-relateddrugoverdose",aconditionincluding,butnotlimitedto,
9extremephysicalillness,decreasedlevelofconsciousness,respiratorydepression,coma,or
10deathresultingfromtheconsumptionoruseofanopioidorothersubstancewithwhichan
11opioidwascombinedoraconditionthatalaypersonwouldreasonablybelievetobean
12opioid-relateddrugoverdosethatrequiresmedicalassistance.
13 2.Notwithstandinganyotherlaworregulationtothecontrary:
14 (1)Thedirectorofthedepartmentofhealthandseniorservices,ifalicensed
15physician,mayissueastatewidestandingorderforanopioidantagonistoranaddiction
16mitigationmedication;
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17 (2)Inthealternative,thedepartmentmayemployorcontractwithalicensed
18physicianwhomayissueastatewidestandingorderforanopioidantagonistoranaddiction
19mitigationmedicationwiththeexpresswrittenconsentofthedepartmentdirector.
20 3.Notwithstandinganyotherlaworregulationtothecontrary,anylicensed
21pharmacistinMissourimaysellanddispenseanopioidantagonistoranaddiction
22mitigationmedicationunderphysicianprotocolorunderastatewidestandingorderissued
23undersubsection2ofthissection.
24 4.Alicensedpharmacistwho,actingingoodfaithandwithreasonablecare,sellsor
25dispensesanopioidantagonistoranaddictionmitigationmedicationandanappropriate
26devicetoadministerthedrug,andtheprotocolphysician,shallnotbesubjecttoanycriminal
27orcivilliabilityoranyprofessionaldisciplinaryactionforprescribingordispensingthe
28opioidantagonistoranaddictionmitigationmedicationoranyoutcomeresultingfromthe
29administrationoftheopioidantagonistoranaddictionmitigationmedication. Aphysician
30issuingastatewidestandingorderundersubsection2ofthissectionshallnotbesubjectto
31anycriminalorcivilliabilityoranyprofessionaldisciplinaryactionforissuingthestanding
32orderorforanyoutcomerelatedtotheorderortheadministrationoftheopioidantagonistor
33anaddictionmitigationmedication.
34 5.Notwithstandinganyotherlaworregulationtothecontrary,itshallbepermissible
35foranypersontopossessanopioidantagonistoranaddictionmitigationmedication.
36 6.Anypersonwhoadministersanopioidantagonisttoanotherpersonshall,
37immediatelyafteradministeringthedrug,contactemergencypersonnel.Anypersonwho,
38actingingoodfaithandwithreasonablecare,administersanopioidantagonisttoanother
39personwhomthepersonbelievestobesufferinganopioid-relatedoverdoseshallbeimmune
40fromcriminalprosecution,disciplinaryactionsfromhisorherprofessionallicensingboard,
41andcivilliabilityduetotheadministrationoftheopioidantagonist.
196.1050.1.Theproceedsofanymonetarysettlementorportionofaglobal
2settlementbetweentheattorneygeneralofthestateandanydrugmanufacturers,distributors,
3orcombinationthereoftoresolveanopioid-relatedcauseofactionagainstsuchdrug
4manufacturers,distributors,orcombinationthereofinastateorfederalcourtshallonlybe
5utilizedtopayforopioidaddictiontreatmentandpreventionservicesandhealthcareandlaw
6enforcementcostsrelatedtoopioidaddictiontreatmentandprevention.Underno
7circumstancesshallsuchsettlementmoneysbeutilizedtofundotherservices,programs,
8orexpensesnotreasonablyrelatedtoopioidaddictiontreatmentandprevention.
9 2.(1)Thereisherebyestablishedinthestatetreasurythe"OpioidAddiction
10TreatmentandRecoveryFund",whichshallconsistoftheproceedsofanysettlement
11describedinsubsection1ofthissection,aswellasanyfundsappropriatedbythegeneral
12assembly,orgifts,grants,donations,orbequests.Thestatetreasurershallbecustodianofthe
SSHB2162	2 13fund.Inaccordancewithsections30.170and30.180,thestatetreasurermayapprove
14disbursements.Thefundshallbeadedicatedfundandmoneyinthefundshallbeusedbythe
15departmentofmentalhealth,thedepartmentofhealthandseniorservices,thedepartmentof
16socialservices,[and]thedepartmentofpublicsafety, thedepartmentofcorrections,and
17thejudiciaryforthepurposessetforthinsubsection1ofthissection.
18 (2)Notwithstandingtheprovisionsofsection33.080tothecontrary,anymoneys
19remaininginthefundattheendofthebienniumshallnotreverttothecreditofthegeneral
20revenuefund.
21 (3)Thestatetreasurershallinvestmoneysinthefundinthesamemannerasother
22fundsareinvested.Anyinterestandmoneysearnedonsuchinvestmentsshallbecreditedto
23thefund.
