80programmaybedeliveredincampus-based,blended,oronlinemodalities.
81 3.(1)BeforeSeptember1,2022,andannuallythereafter,thedepartmentshall
82issuearequestforqualificationsforinterestedprogramproviderstobecomeapproved
83programprovidersandparticipateintheprogram.
84 (2)Eachapprovedprogramprovidershallmeetallofthefollowing
85qualifications:
86 (a)Beanaccreditedhighschooldiploma-grantingentity;
87 (b)Haveaminimumoftwoyearsofexperienceprovidingadultdropout
88recoveryservices;

90student.Suchacademicskillintakeassessmentsmaybeadministeredinpersonor
91online;
92 (d)Developalearningplanforeachstudentthatintegratesgraduation

94 (e)Provideacoursecatalogthatincludesallcoursesnecessarytomeet
95graduationrequirements;
96 (f)Offerremediationopportunitiesinliteracyandnumeracy,asapplicable;
97 (g)Offeremployabilityskillscertification,asapplicable;
98 (h)Offercareerpathwayscoursework,asapplicable;
99 (i)Abilitytoprovidepreparationforindustry-recognizedcredentialsor
100stackablecredentials,atechnicalskillsassessment,oracombinationthereof;and

102 (3)Uponconfirmationbythedepartmentthataninterestedprogramprovider
103meetsallofthequalificationslistedinsubdivision(2)ofthissubsection,aninterested
104programprovidershallbecomeanapprovedprogramprovider.
105 4.(1)Thedepartmentshallannouncetheapprovedprogramprovidersbefore
106Octobersixteenthannually,withauthorizationfortheapprovedprogramprovidersto
107beginenrollingstudentsbeforeNovemberfifteenthannually.
108 (2)Approvedprogramprovidersshallmaintainapprovalwithoutreapplying
109annuallyiftheapprovedprogramproviderhasnotbeenremovedfromtheapproved
110programproviderlistunderthissection.
111 5.Allapprovedprovidersshallcomplywithrequirementsasprovidedbythe
112departmenttoensure:
113 (1)Anaccurateaccountingofastudent'saccumulatedcreditstowardahigh
114schooldiploma;
115 (2)Anaccurateaccountingofcreditsnecessarytocompleteahighschool
116diploma;and
117 (3)Theprovisionofcourseworkalignedtotheacademicperformancestandards
118ofthestate.
119 6.(1)Exceptasprovidedinsubdivision(2)ofthissubsection,thedepartment
120shallpayanamountassetbythedepartmenttoapprovedprogramprovidersforthe
121followingmilestonesprovidedbytheapprovedprogramprovider:
122 (a)Completionofeachhalfunitofhighschoolcredit;
123 (b)Attainmentofanemployabilityskillscertification;
124 (c)Attainmentofanindustry-recognizedcredentialorstackablecredential
125requiringnomorethanfiftyhoursoftraining;

127requiringatleastfifty-onebutnomorethanonehundredhoursoftraining;
128 (e)Attainmentofanindustry-recognizedcredentialorstackablecredential

130 (f)Attainmentofanaccreditedhighschooldiploma.
131 (2)Noapprovedprogramprovidershallreceivefundingforastudentunderthis
132sectioniftheapprovedprogramproviderreceivesfederalorstatefundingorprivate
133tuitionforthatstudent.Noapprovedprogramprovidershallchargestudentfeesofany
134kindincluding,butnotlimitedto,textbookfees,tuitionfees,labfees,orparticipation
135feesunlessthestudentchoosestoobtainadditionaleducationofferedbytheprogram
136providerthatisnotincludedinthestate-fundedprogram.
137 (3)Paymentsmadeunderthissubsectionshallbesubjecttoanappropriation
138madetothedepartmentforsuchpurposes.
139 7.(1)Approvedprogramprovidersshallsubmitmonthlyinvoicestothe
140departmentbeforetheeleventhcalendardayofeachmonthformilestonesmetinthe
141previouscalendarmonth.
142 (2)Thedepartmentshallpayapprovedprogramprovidersintheorderinwhich
143invoicesaresubmitteduntilallavailablefundsareexhausted.
144 (3)Thedepartmentshallprovideawrittenupdatetoapprovedprogram
145providersbythelastcalendardayofeachmonth.Theupdateshallincludethe
146aggregatetotaldollarsthathavebeenpaidtoapprovedprogramproviderstodateand
147theestimatednumberofenrollmentsstillavailablefortheprogramyear.
148 8.BeforeJulysixteenthofeachyear,eachprovidershallreportthefollowing
149metricstothedepartment:
150 (1)Thetotalnumberofstudentswhohavebeenfundedthroughtheprogram;
151 (2)Thetotalnumberofcreditsearned;
152 (3)Thetotalnumberofemployabilityskillscertificationsissued;
153 (4)Thetotalnumberofindustry-recognizedcredentials,stackablecredentials,
154andtechnicalskillsassessmentsearnedforeachtieroffunding;and
155 (5)Thetotalnumberofgraduates.
156 9.(1)BeforeSeptembersixteenthofeachyear,anapprovedeligibleprogram
157providershallconductandsubmittothedepartmenttheaggregateresultsofasurveyof
158individualswhograduatedfromtheprogramoftheapprovedeligibleprogramprovider
159underthissection.Thesurveyshallbeconductedintheyearaftertheyearinwhichthe
160individualsgraduateandthenextfourconsecutiveyears.
161 (2)Thesurveyshallincludeatleastthefollowingdatacollectionelementsfor
162eachyearthesurveyisconducted:
HB2325	5 163 (a)Theindividual'semploymentstatus,includingwhethertheindividualis
164employedfulltimeorparttime;
165 (b)Theindividual'shourlywages;
166 (c)Theindividual'saccesstoemployer-sponsoredhealthcare;and
167 (d)Theindividual'spostsecondaryenrollmentstatus,includingwhetherthe
168individualhascompletedapostsecondarycertificateordegreeprogram.
169 10.(1)Upontheendofthesecondfiscalyearoftheprogram,thedepartment
170shallreviewdatafromeachapprovedprogramprovidertoensurethateachisachieving
171minimumprogramperformancestandardsincluding,butnotlimitedto:
172 (a)Aminimumofafiftypercentgraduationrate;and
173 (b)Anaveragecostpergraduateofseventhousanddollarsorless.
174 (2)Anyapprovedprogramproviderthatfailstomeettheminimumprogram
175performancestandardsdescribedinsubdivision(1)ofthissubsectionshallbeplacedon
176probationarystatusfortheremainderofthefiscalyearbythedepartment.
177 (3)Anyapprovedprogramproviderthatfailstomeettheminimumprogram
178performancestandardsdescribedinsubdivision(1)ofthissubsectionfortwo
179consecutiveyearsshallberemovedfromtheapprovedproviderlistbythedepartment.
180 11.(1)Noapprovedprogramprovidershalldiscriminateagainstastudenton
181thebasisofrace,color,religion,nationalorigin,ancestry,sex,sexuality,gender,orage.
182 (2)Ifanapprovedprogramproviderdeterminesthatastudentwouldbebetter
183servedbyparticipatinginadifferentprogram,theapprovedprovidermayreferthe
184studenttothestate'sadultbasiceducationservices.
185 12.(1)Thereisherebycreatedinthestatetreasurythe"WorkforceDiploma
186ProgramFund",whichshallconsistofanygrants,gifts,donations,bequests,ormoneys
187appropriatedunderthissection.Thestatetreasurershallbecustodianofthefund.In
188accordancewithsections30.170and30.180,thestatetreasurermayapprove
189disbursements.Thefundshallbeadedicatedfundand,uponappropriation,moneys
190inthefundshallbeusedsolelyasprovidedinthissection.
191 (2)Notwithstandingtheprovisionsofsection33.080tothecontrary,anymoneys
192remaininginthefundattheendofthebienniumshallnotreverttothecreditofthe
193generalrevenuefund.
194 (3)Thestatetreasurershallinvestmoneysinthefundinthesamemanneras
195otherfundsareinvested.Anyinterestandmoneysearnedonsuchinvestmentsshallbe
196creditedtothefund.
197 13.Thedirectorofthedepartmentmaypromulgateallnecessaryrulesand
198regulationsfortheadministrationofthissection.Anyruleorportionofarule,asthat
199termisdefinedinsection536.010,thatiscreatedundertheauthoritydelegatedinthis
HB2325	6 200sectionshallbecomeeffectiveonlyifitcomplieswithandissubjecttoallofthe
201provisionsofchapter536and,ifapplicable,section536.028.Thissectionandchapter
202536arenonseverable,andifanyofthepowersvestedwiththegeneralassembly
203pursuanttochapter536toreview,todelaytheeffectivedate,ortodisapproveandannul
204arulearesubsequentlyheldunconstitutional,thenthegrantofrulemakingauthority
205andanyruleproposedoradoptedafterAugust28,2022,shallbeinvalidandvoid.
206 14.Undersection23.253oftheMissourisunsetact:
207 (1)Theprovisionsofthenewprogramauthorizedunderthissectionshall
208automaticallysunsetsixyearsaftertheeffectivedateofthissectionunlessreauthorized
209byanactofthegeneralassembly;and
210 (2)Ifsuchprogramisreauthorized,theprogramauthorizedunderthissection
211shallautomaticallysunsettwelveyearsaftertheeffectivedateofthereauthorizationof
212thissection;and
213 (3)ThissectionshallterminateonSeptemberfirstofthecalendaryear
214immediatelyfollowingthecalendaryearinwhichtheprogramauthorizedunderthis
215sectionissunset.
