13Thestatetreasurershallinvestmoneysinthefundinthesamemannerasotherfundsare 14invested.Anyinterestandmoneysearnedonsuchinvestmentsshallbecreditedtothefund. 15 2.Thedepartmentmayprovidefinancialassistancefortrainingprojectsthroughthe 16[training] MissourionestartprogramfromtheMissourionestartjobdevelopmentfund 17toqualifiedcompaniesthatcreatenewjobswhichwillresultintheneedfortraining,orthat 18makenewcapitalinvestmentrelatingdirectlytotheretentionofjobsinanamountatleast 19fivetimesgreaterthantheamountofanyfinancialassistance.Financialassistancemayalso 20beprovidedtoaconsortiumofamajorityofqualifiedcompaniesorganizedtoprovide 21commontrainingtotheconsortiummembers'employees. 22 3.FundsintheMissourionestartjobdevelopmentfundshallbeappropriated,for 23recruitmentservicesandtoprovidefinancialassistancefortrainingprojectsthroughthe 24[training] Missourionestartprogram,bythegeneralassemblytothedepartment[and]. 25Recruitmentservicesshallbeadministeredbythedepartment.Financialassistancefor 26trainingprojectsshallbeadministeredbyalocaleducationagencycertifiedbythe HCSHB2418 8 27departmentforsuchpurpose.[Exceptforstate-sponsoredpreemploymenttraining,no 28qualifiedcompanyshallreceivemorethanfiftypercentofitstrainingprogramcostsfromthe 29Missourionestartjobdevelopmentfund.] Nofundsshallbeawardedorreimbursedtoany 30qualifiedcompanyforthetraining,retraining,orupgradingofskillsofpotentialemployees 31withthepurposeofreplacingorsupplantingemployeesengagedinanauthorizedwork 32stoppage.Uponapprovalbythedepartment,trainingprojectcosts,exceptthepurchaseof 33trainingequipmentandtrainingfacilities,shallbeeligibleforreimbursementwithfundsfrom 4June30,2023,thedepartmentofrevenueshallcredittothefund,asreceived,allnewjobs 5credits.[ForexistingMissouribusinessescreatingnewjobs,thetrainingprojectmayinclude 6retainedjobs.] Thefundshallalsoconsistofanygifts,contributions,grants,orbequests 7receivedfromfederal,private,orothersources.Thegeneralassembly,however,shallnot 8provideforanytransferofgeneralrevenuefundsintothefund.Moneysinthefundshallbe 9disbursedtothedepartmentunderregularappropriationsbythegeneralassembly.[The 10departmentshallhavethediscretiontodeterminetheappropriateamountoffundstoallocate HCSHB2418 9 11pertrainingproject.] ThroughJune30,2023,thedepartmentshalldisbursesuch 16fiscalyearshallnotlapsetothegeneralrevenuefund,asprovidedinsection33.080,butshall 17remaininthefund.AnyunobligatedfundsintheMissourionestartcommunitycollege 18newjobstrainingfundonJuly1,2023,shallbetransferredtotheMissourionestart 19communitycollegetrainingfundauthorizedundersubsection3ofthissection. 20 2.Thereisherebycreatedinthestatetreasuryafundtobeknownasthe"Missouri 21OneStartCommunityCollegeJobRetentionTrainingFund",thatshallbeadministeredby 22thedepartmentfortheMissourionestartprogram.ThroughJune30,2023,thedepartment 23ofrevenueshallcredittothefund,asreceived,allretainedjobscredits.[Forexisting 24Missouribusinessesretainingjobs,thetrainingprojectmayincludenewjobs.] Thefundshall 25alsoconsistofanygifts,contributions,grants,orbequestsreceivedfromfederal,private,or 26othersources.Thegeneralassembly,however,shallnotprovideforanytransferofgeneral 27revenuefundsintothefund.Moneysinthefundshallbedisbursedtothedepartmentunder 28regularappropriationsbythegeneralassembly.[Thedepartmentshallhavethediscretionto 29determinetheappropriateamountoffundstoallocatepertrainingproject.] ThroughJune 34Suchdisbursementsbythedepartmentshallbemadetothespecialfundforeachprojectas 35providedundersubsection[5]6ofthissection.Allmoneysremaininginthefundattheend 36ofanyfiscalyearshallnotlapsetothegeneralrevenuefund,asprovidedinsection33.080, 37butshallremaininthefund.AllunobligatedfundsintheMissourionestartcommunity 38collegejobretentiontrainingfundonJuly1,2023,shallbetransferredtotheMissouri 39onestartcommunitycollegetrainingfundauthorizedundersubsection3ofthissection. 40 3.Thereisherebycreatedinthestatetreasurythe"MissouriOneStart 41CommunityCollegeTrainingFund",whichshallbeadministeredbythedepartmentfor 42trainingprojectsintheMissourionestartprogram.BeginningJuly1,2023,the 43departmentofrevenueshallcredittothefund,asreceived,allnewandretainedjobs 44credits.Thefundshallalsoconsistofanygifts,contributions,grants,orbequests 45receivedfromfederal,private,orothersources.However,thegeneralassemblyshall 46notauthorizeanytransferofgeneralrevenuefundsintothefund.BeginningJuly1, 472023,thedepartmentshalldisbursemoneysinthefundunderregularappropriations HCSHB2418 10 48bythegeneralassembly.Thedepartmentshalldisbursesuchappropriatedfundsina 49timelymannerintothespecialfundsestablishedbycommunitycollegedistrictsfor 50trainingprojects,whichfundsshallbeusedtopaytrainingprojectcosts.Such 51disbursementsshallbemadetothespecialfundforeachtrainingprojectasprovided 52undersubsection6ofthissection.Allmoneysremaininginthefundattheendofany 53fiscalyearshallnotlapsetothegeneralrevenuefund,asprovidedinsection33.080,but 54shallremaininthefund. 55 [3.]4.Thedepartmentofrevenueshalldevelopsuchformsasarenecessaryto 56demonstrateaccuratelyeachqualifiedcompany'snewjobscreditpaidthroughJune30, 572023,intotheMissourionestartcommunitycollegenewjobstrainingfundorretainedjobs 58creditpaidthroughJune30,2023,intotheMissourionestartcommunitycollegejob 59retentiontrainingfund.Thedepartmentofrevenueshalldevelopsuchformsasare 60necessarytodemonstrateaccuratelyeachqualifiedcompany'sneworretainedjobs 61credit,orboth,whicheverisapplicable,paidbeginningJuly1,2023,intotheMissouri 62onestartcommunitycollegetrainingfund.Theneworretainedjobscredits, orboth, 63whicheverisapplicable,shallbeaccountedasseparatefromthenormalwithholdingtaxpaid 64tothedepartmentofrevenuebythequalifiedcompany.ThroughJune30,2023, 65reimbursementsmadebyallqualifiedcompaniestotheMissourionestartcommunitycollege 66newjobstrainingfundandtheMissourionestartcommunitycollegejobretentiontraining 67fundshallbenolessthanallallocationsmadebythedepartmenttoallcommunitycollege 68districtsforallprojects.BeginningJuly1,2023,reimbursementsmadebyallqualified 69companiestotheMissourionestartcommunitycollegetrainingfundshallbenoless 70thanallallocationsmadebythedepartmenttoallcommunitycollegedistrictsforall 71projects.Thequalifiedcompanyshallremittheamountoftheneworretainedjobscredit,as 72orboth,whicheverisapplicable,tothedepartmentofrevenueinthesamemanneras 73providedinsections143.191to143.265.Aqualifiedcompany’strainingprojectmay 74includebothnewjobsandretainedjobs. 75 [4.]5.Acommunitycollegedistrict,withtheapprovalofthedepartmentin 76consultationwiththeofficeofadministration,mayenterintoanagreementtoestablisha 77trainingprojectandprovidetrainingprojectservicestoaqualifiedcompany.The 78departmentshallhavethediscretiontodeterminetheappropriateamountoffundsto 79allocatepertrainingproject.Assoonaspossibleafterinitialcontactbetweenacommunity 80collegedistrictandapotentialqualifiedcompanyregardingthepossibilityofenteringintoan 81agreement,thecommunitycollegedistrictshallinformthedepartmentofthepotential 82trainingproject.Thedepartmentshallevaluatetheproposedtrainingprojectwithinthe 83overalljobtrainingeffortsofthestatetoensurethatthetrainingprojectwillnotduplicate 84otherjobtrainingprograms.Thedepartmentshallhavefourteendaysfromreceiptofanotice HCSHB2418 11 85ofintenttoapproveordisapproveatrainingproject.Ifnoresponseisreceivedbythe 86qualifiedcompanywithinfourteendays,thetrainingprojectshallbedeemedapproved. 87Disapprovalofanytrainingprojectshallbemadeinwritingandstatethereasonsforsuch 88disapproval.Ifanagreementisenteredinto,thedistrictandthequalifiedcompanyshall 89notifythedepartmentofrevenuewithinfifteencalendardays.Inadditiontoanyprovisions 90requiredundersubsection[6]7ofthissectionforaqualifiedcompanyapplyingtoreceivea 91neworretainedjobcredit,orboth,whicheverisapplicable,anagreementmayprovide,but 92shallnotbelimitedto: 93 118constitutealienuponthequalifiedcompany'sbusinesspropertyuntilpaid,shallhaveequal 119prioritywithordinarytaxesandshallnotbedivestedbyajudicialsale.Propertysubjectto 120suchlienmaybesoldforsumsdueanddelinquentatataxsale,withthesameforfeitures, HCSHB2418 12 121penalties,andconsequencesasforthenonpaymentofordinarytaxes.Thepurchasersatatax 122saleshallobtainthepropertysubjecttotheremainingpayments. 123 [5.]6.(1)Forprojectsthatarefundedexclusivelyunderparagraph(a)or(b)of 134paragraph(a)or(b)ofsubdivision(1)ofsubsection[4]5ofthissectiontothespecialfund 135foreachtrainingprojectinthesameproportionasthenewjobsorretainedjobscredits 136remittedbythequalifiedcompanyparticipatinginsuchprojectbearstothetotalnewjobsor 137retainedjobscreditsfromwithholdingremittedbyallqualifiedcompaniesparticipatingin 138projectsduringtheperiodforwhichthedisbursementismade,reducedbytheamountof 139fundsappropriatedunderparagraph[(b)](c)ofsubdivision(1)ofsubsection[4]5ofthis 140section. 141 [6.]7.Anyqualifiedcompanythatsubmitsanoticeofintentforretainedjobcredits 142shallenterintoanagreement,providingthatthequalifiedcompanyhas: 143 (1)Maintainedatleastonehundredfull-timeemployeesperyearattheproject 144facilityforthecalendaryearprecedingtheyearinwhichtheapplicationismade;and 145 (2)Madeoragreestomakeanewcapitalinvestmentofgreaterthanfivetimesthe 146amountofanyawardunder[thistraining] theMissourionestartprogramattheproject 147facilityoveraperiodoftwoconsecutiveyears,ascertifiedbythequalifiedcompanyand: 148 (a)Hasmadesubstantialinvestmentinnewtechnologyrequiringtheupgradingof 149employeeskills;or 150 (b)Islocatedinabordercountyofthestateandrepresentsapotentialriskof 151relocationfromthestate;or 152 (c)Hasbeendeterminedtorepresentasubstantialriskofrelocationfromthestateby 153thedirectorofthedepartmentofeconomicdevelopment. 154 [7.]8.Ifanagreementprovidesthatallorpartofthetraining[program] projectcosts 166whicheverisapplicable,fromwithholdingtobelessthantheamountprojectedinthe 167agreementforanytimeperiod,thenotherwithholdingtaxpaidbythequalifiedcompany 168undersections143.191to143.265shallbecreditedtotheapplicablefundbytheamountof 169suchdifference.Thequalifiedcompanyshallremittheamountoftheneworretainedjobs 170credit, orboth,whicheverisapplicable,tothedepartmentofrevenueinthemanner 171prescribedinsections143.191to143.265.Whenalltraining[program] projectcostshave 172beenpaid,theneworretainedjobscredits, orboth,whicheverisapplicable,shallcease; 173 (3)Thecommunitycollegedistrictparticipatinginaprojectshallestablishaspecial 174fundforandinthenameofthetrainingproject.Allfundsappropriatedbythegeneral 175assemblyfromthefundsestablishedunder[subsections1and2of]thissectionanddisbursed 176bythedepartmentforthetrainingprojectandotheramountsreceivedbythedistrictfor 177trainingprojectcostsasrequiredbytheagreementshallbedepositedinthespecialfund. 178Amountsheldinthespecialfundshallbeusedanddisbursedbythedistrictonlytopay 179trainingprojectcostsforsuchtrainingproject.Thespecialfundmaybedividedintosuch 180accountsandsubaccountsasshallbeprovidedintheagreement,andamountsheldtherein 181maybeinvestedinthesamemannerasthedistrict'sotherfunds; 182 (4)Anydisbursementfortrainingprojectcostsreceivedfromthedepartmentunder 183sections620.800to620.809anddepositedintothetrainingproject'sspecialfundmaybe 184irrevocablypledgedbyacommunitycollegedistrictforthepaymentoftheprincipal, 185premium,andinterestonthecertificateissuedbyacommunitycollegedistricttofinanceor 186refinance,inwholeorinpart,suchtrainingproject; 187 (5)Thequalifiedcompanyshallcertifytothedepartmentofrevenuethatthenewor 188retainedjobscredit, orboth,whicheverisapplicable,isinaccordancewithanagreement 189andshallprovideotherinformationthedepartmentofrevenuemayrequire; 190 (6)Anemployeeparticipatinginatrainingprojectshallreceivefullcreditunder 191section143.211fortheamountdesignatedasaneworretainedjobscredit; 192 (7)Ifanagreementprovidesthatallorpartoftraining[program] projectcostsareto 193bemetbyreceiptofneworretainedjobscredit,orboth,whicheverisapplicable,the HCSHB2418 14 194provisionsofthissubsectionshallalsoapplytoanysuccessortotheoriginalqualified 195companyuntiltheprincipalandinterestonthecertificateshavebeenpaid. 196 [8.]9.Toprovidefundsforthepresentpaymentofthetrainingprojectcosts[ofnew 197orretainedjobstrainingproject] throughthe[training] Missourionestartprogramas 198providedinthissection, acommunitycollegedistrictmayborrowmoneyandissueandsell 199certificatespayablefromasufficientportionofthefuturereceiptsofpaymentsauthorizedby 200theagreementincludingdisbursementsfromthe[Missourionestartcommunitycollegenew 201jobstrainingfundortheMissourionestartcommunitycollegejobretentiontrainingfund] 202fundsestablishedunderthissection, tothespecialfundestablishedbythecommunity 203collegedistrictforeachtrainingproject.Thetotalamountofoutstandingcertificatessoldby 204allcommunitycollegedistrictsshallnotexceedthetotalamountauthorizedunderlawasof 205January1,2013[, unlessanincreasedamountisauthorizedinwritingbyamajorityof 206membersofthecommittee]. Thecertificatesshallbemarketedthroughfinancialinstitutions 207authorizedtodobusinessinMissouri.Thereceiptsshallbepledgedtothepaymentof 208principalofandinterestonthecertificates.Certificatesmaybesoldatpublicsaleorat 209privatesaleatpar,premium,ordiscountofnotlessthanninety-fivepercentoftheparvalue 210thereof,atthediscretionoftheboardoftrustees,andmaybearinterestatsuchrateorratesas 211theboardoftrusteesshalldetermine,notwithstandingtheprovisionsofsection108.170tothe 212contrary.However,theprovisionsofchapter176shallnotapplytotheissuanceofsuch 213certificates.Certificatesmaybeissuedwithrespecttoasingletrainingprojectormultiple 214trainingprojectsandmaycontaintermsorconditionsastheboardoftrusteesmayprovideby 215resolutionauthorizingtheissuanceofthecertificates. 216 [9.]10.Certificatesissuedtorefundothercertificatesmaybesoldatpublicsaleorat 217privatesaleasprovidedinthissection,withtheproceedsfromthesaletobeusedforthe 218paymentofthecertificatesbeingrefunded.Therefundingcertificatesmaybeexchangedin 219paymentanddischargeofthecertificatesbeingrefunded,ininstallmentsatdifferenttimesor 220anentireissueorseriesatonetime.Refundingcertificatesmaybesoldorexchangedatany 221timeon,before,orafterthematurityoftheoutstandingcertificatestoberefunded.Theymay 222beissuedforthepurposeofrefundingalike,greater,orlesserprincipalamountofcertificates 223andmaybeararateofinterestthatishigher,lower,orequivalenttothatofthecertificates 224beingrenewedorrefunded. 225 [10.]11.Beforecertificatesareissued,theboardoftrusteesshallpublishoncea 226noticeofitsintentiontoissuethecertificates,statingtheamount,thepurpose,andtheproject 227orprojectsforwhichthecertificatesaretobeissued.Apersonwithstandingmay,within 228fifteendaysafterthepublicationofthenotice,byactioninthecircuitcourtofacountyinthe 229district,appealthedecisionoftheboardoftrusteestoissuethecertificates.Theactionofthe 230boardoftrusteesindeterminingtoissuethecertificatesshallbefinalandconclusiveunless HCSHB2418 15 231thecircuitcourtfindsthattheboardoftrusteeshasexceededitslegalauthority.Anaction 232shallnotbebroughtwhichquestionsthelegalityofthecertificates,thepoweroftheboardof 233trusteestoissuethecertificates,theeffectivenessofanyproceedingsrelatingtothe 234authorizationoftheproject,ortheauthorizationandissuanceofthecertificatesfromandafter 235fifteendaysfromthepublicationofthenoticeofintentiontoissue. 236 [11.]12.Theboardoftrusteesshallmakeafindingbasedoninformationsuppliedby 237thequalifiedcompanythatrevenuesprovidedintheagreementaresufficienttosecurethe 238faithfulperformanceofobligationsintheagreement. 239 [12.]13.Certificatesissuedunderthissectionshallnotbedeemedtobean 240indebtednessofthestate,thecommunitycollegedistrict,oranyotherpoliticalsubdivisionof 241thestate,andtheprincipalandinterestonanycertificatesshallbepayableonlyfromthe 242sourcesprovidedinsubdivision(1)ofsubsection[4]5ofthissectionwhicharepledgedin 243theagreement. 244 [13.]14.Pursuanttosection23.253oftheMissourisunsetact: 245 (1)Theprogramauthorizedundersections620.800to620.809shallbereauthorized 246asofAugust28,2018,andshallexpireonAugust28,2030;and 247 (2)Ifsuchprogramisreauthorized,theprogramauthorizedundersections620.800to 248620.809shallautomaticallysunsettwelveyearsaftertheeffectivedateofthereauthorization 249ofsections620.800to620.809;and 250 (3)Sections620.800to620.809shallterminateonSeptemberfirstofthecalendar 251yearimmediatelyfollowingthecalendaryearinwhichaprogramauthorizedundersections 252620.800to620.809issunset. 253 [14.]15.Anyagreementorobligationenteredintobythedepartmentthatwasmade 254undertheprovisionsofsections620.800to620.809priortoAugust28,2019,shallremainin 255effectaccordingtotheprovisionsofsuchagreementorobligation. 620.2475.1.Asusedinthissection,thefollowingtermsshallmean: 2 (1)"Aerospaceproject",aprojectundertakenbyorforthebenefitofaqualified 3companywithaNorthAmericanIndustryClassificationSystemindustryclassificationof 43364involvingthecreationofatleasttwothousandnewjobswithintenyearsfollowingthe 5approvalofanoticeofintentpursuanttosection620.2020andforwhichthedepartmentof 6economicdevelopmenthasprovidedaproposalforbenefitsunderjobcreation,worker 7training,andinfrastructuredevelopmentprogramsonorbeforeJune10,2014; 8 (2)"Jobcreation,workertraining,andinfrastructuredevelopmentprograms",the 9Missouriworksprogramestablishedundersections620.2000to620.2020,theMissouri 10businessuseincentivesforlarge-scaledevelopmentactestablishedundersections100.700to 11100.850,theMissourionestarttrainingprogramestablishedundersections620.800to HCSHB2418 16 12620.809,andtherealpropertytaxincrementallocationredevelopmentactestablishedunder 13sections99.800to99.865. 14 2.Provisionsoflawtothecontrarynotwithstanding,nobenefitsauthorizedunderjob 15creation,workertraining,andinfrastructuredevelopmentprogramsforanaerospaceproject 16shallbeconsideredindeterminingcompliancewithapplicablelimitationsontheaggregate 17amountofbenefitsthatmaybeawardedannuallyorcumulativelyundersubdivision(3)of 18subsection10ofsection99.845,subsection5ofsection100.850,subsection[8]9ofsection 19620.809,andsubsection7ofsection620.2020.Noaerospaceprojectshallbeauthorizedfor 20statebenefitsunderjobcreation,workertraining,andinfrastructuredevelopmentprograms 21thatexceed,intheaggregate,onehundredfiftymilliondollarsannuallyunderallsuch 22programs. 23 3.Foranyaerospaceprojectreceivingstatebenefitsunderthissection,the 24departmentofeconomicdevelopmentshalldelivertothegeneralassemblyanannualreport 25providingdetailedinformationonthestatebenefitsreceivedandprojectedtobereceivedby 26theaerospaceprojectandshallalsodenotethenumberofminoritiesthathavebeentrained 27undertheMissourionestarttrainingprogramestablishedundersections620.800to620.809. 28 4.Anyaerospaceprojectreceivingbenefitsunderthissectionshallannuallyreportto 29thegeneralassemblyandthedepartmentofeconomicdevelopmentitsminorityandwomen 30employmentoutreachefforts. 31 5.Foraerospaceprojectsreceivingbenefitsunderthissection,innoeventshall 32disbursementsofnewstaterevenuesundersections99.800to99.865bemadetosatisfybond 33obligationsincurredforimprovementsthatdonotdirectlybenefitsuchproject. 34 6.Foraerospaceprojectsreceivingbenefitsunderthissection,inthetenthyear 35followingtheapprovalofanoticeofintentundersections620.2000to620.2020,the 36departmentofeconomicdevelopmentshalldeterminethenetfiscalbenefittothestate 37resultingfromsuchprojectandshalltakeanyactionnecessarytoensureapositivenetfiscal 38benefittothestatebynolaterthanthelastyearinwhichtheaerospaceprojectreceives 39benefitsunderthissection. ✔ HCSHB2418 17
