620.803.1.Thedepartmentshallestablisha"MissouriOneStartProgram"toassist
2[qualified] companies[inthe]withrecruitmentservices,trainingofemployeesinnewjobs,
3andtheretrainingorupgradingofskillsoffull-timeemployeesinretainedjobsasprovidedin
4sections620.800to620.809.The[training] Missourionestartprogramshallbefunded
5throughappropriationstothefundsestablishedundersections620.806and620.809.The
6departmentshall,tothemaximumextentpracticable,prioritizefundingunderthe[training]
7Missourionestartprogramtoassistqualifiedcompaniesintargetedindustries.
8 2.[Thereisherebycreatedthe"MissouriOneStartJobTrainingJointLegislative
9OversightCommittee".ThecommitteeshallconsistofthreemembersoftheMissourisenate
10appointedbythepresidentprotemporeofthesenateandthreemembersofthehouseof
11representativesappointedbythespeakerofthehouse.Nomorethantwoofthemembersof
HCSHB2418	6 12thesenateandtwoofthemembersofthehouseofrepresentativesshallbefromthesame
13politicalparty.Membersofthecommitteeshallreporttothegovernor,thepresidentpro
14temporeofthesenate,andthespeakerofthehouseofrepresentativesonallassistanceto
15qualifiedcompaniesundertheprovisionsofsections620.800to620.809providedduringthe
16precedingfiscalyear.ThereportofthecommitteeshallbedeliverednolaterthanOctober
17firstofeachyear.Thedirectorofthedepartmentshallreporttothecommitteesuch
18informationasthecommitteemaydeemnecessaryforitsannualreport.Membersofthe
19committeeshallreceivenocompensationinadditiontotheirsalaryasmembersofthegeneral
20assemblybutmayreceivetheirnecessaryexpenseswhileattendingthemeetingsofthe
21committee,tobepaidoutofthejointcontingentfund.
22 3.]Thedepartmentshallpublishguidelinesandmaypromulgaterulesandregulations
23governingthe[training] Missourionestartprogram.Inestablishingsuchguidelinesand
24promulgatingsuchrulesandregulations,thedepartmentshallconsidersuchfactorsasthe
25potentialnumberofnewjobstobecreatedornumberofjobstoberetained,thepotential
26numberofnewminorityjobscreated,theamountofnewcapitalinvestmentinnewor
27existingfacilitiesandequipment,thesignificanceofstatebenefitstothequalifiedcompany's
28decisiontolocateorexpandinMissouri,theeconomicneedoftheaffectedcommunity,and
29theimportanceofthequalifiedcompanytotheeconomicdevelopmentofthestate.Anyrule
30orportionofarule,asthattermisdefinedinsection536.010,thatiscreatedunderthe
31authoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplieswithandis
32subjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.Thissection
33andchapter536arenonseverableandifanyofthepowersvestedwiththegeneralassembly
34pursuanttochapter536toreview,todelaytheeffectivedate,ortodisapproveandannula
35rulearesubsequentlyheldunconstitutional,thenthegrantofrulemakingauthorityandany
36ruleproposedoradoptedafterAugust28,2013,shallbeinvalidandvoid.

620.806.1.Thereisherebycreatedinthestatetreasuryafundtobeknownasthe
2"MissouriOneStartJobDevelopmentFund",thatshallbeadministeredbythedepartmentfor
3thepurposesoftheMissourionestartprogram.Thefundshallconsistofallmoneyswhich
4maybeappropriatedtoitbythegeneralassemblyandalsoanygifts,contributions,grants,or
5bequestsreceivedfromfederal,privateorothersources,including,butnotlimitedto,any
6blockgrantorothersourcesoffundingrelatingtojobtraining,school-to-worktransition,
7welfarereform,vocationalandtechnicaltraining,housing,infrastructure,development,and
8humanresourceinvestmentprogramswhichmaybeprovidedbythefederalgovernmentor
9othersources.Thestatetreasurershallbecustodianofthefundandmayapprove
10disbursementsfromthefundinaccordancewithsections30.170and30.180.
11Notwithstandingtheprovisionsofsection33.080tothecontrary,anymoneysremainingin
12thefundattheendofthebienniumshallnotreverttothecreditofthegeneralrevenuefund.
13Thestatetreasurershallinvestmoneysinthefundinthesamemannerasotherfundsare
14invested.Anyinterestandmoneysearnedonsuchinvestmentsshallbecreditedtothefund.
15 2.Thedepartmentmayprovidefinancialassistancefortrainingprojectsthroughthe
16[training] MissourionestartprogramfromtheMissourionestartjobdevelopmentfund
17toqualifiedcompaniesthatcreatenewjobswhichwillresultintheneedfortraining,orthat
18makenewcapitalinvestmentrelatingdirectlytotheretentionofjobsinanamountatleast
19fivetimesgreaterthantheamountofanyfinancialassistance.Financialassistancemayalso
20beprovidedtoaconsortiumofamajorityofqualifiedcompaniesorganizedtoprovide
21commontrainingtotheconsortiummembers'employees.
22 3.FundsintheMissourionestartjobdevelopmentfundshallbeappropriated,for
23recruitmentservicesandtoprovidefinancialassistancefortrainingprojectsthroughthe
24[training] Missourionestartprogram,bythegeneralassemblytothedepartment[and].
25Recruitmentservicesshallbeadministeredbythedepartment.Financialassistancefor
26trainingprojectsshallbeadministeredbyalocaleducationagencycertifiedbythe
HCSHB2418	8 27departmentforsuchpurpose.[Exceptforstate-sponsoredpreemploymenttraining,no
28qualifiedcompanyshallreceivemorethanfiftypercentofitstrainingprogramcostsfromthe
29Missourionestartjobdevelopmentfund.] Nofundsshallbeawardedorreimbursedtoany
30qualifiedcompanyforthetraining,retraining,orupgradingofskillsofpotentialemployees
31withthepurposeofreplacingorsupplantingemployeesengagedinanauthorizedwork
32stoppage.Uponapprovalbythedepartment,trainingprojectcosts,exceptthepurchaseof
33trainingequipmentandtrainingfacilities,shallbeeligibleforreimbursementwithfundsfrom
34theMissourionestartjobdevelopmentfund.Notwithstandinganyprovisionoflawtothe
35contrary,noqualifiedcompanywithinaserviceindustryshallbeeligiblefortraining
36assistanceunderthissubsectionunlesssuchqualifiedcompanyprovidesservicesininterstate
37commerce,whichshallmeanthatthequalifiedcompanyderivesamajorityofitsannual
38revenuesfromoutofthestate.
39 [3.]4.Uponappropriation,alocaleducationagencymaypetitionthedepartmentto
40utilizetheMissourionestartjobdevelopmentfundinordertocreateorimprovetraining
41facilities,trainingequipment,trainingstaff,trainingexpertise,trainingprogramming,and
42administration.Thedepartmentshallreviewallpetitionsandmayawardfundsfromthe
43Missourionestartjobdevelopmentfundforreimbursementoftrainingprojectcostsand
44trainingprojectservicesasitdeemsnecessary.
45 [4.]5.Thedepartmentmaypromulgaterulestoimplementtheprovisionsofthis
46section.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis
47createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies
48withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.
49Thissectionandchapter536arenonseverableandifanyofthepowersvestedwiththe
50generalassemblypursuanttochapter536toreview,todelaytheeffectivedate,orto
51disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof
52rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2019,shallbeinvalid
