BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Sections84.341,84.342,84.343,84.344,84.345,84.346,84.347,86.200, 286.213,and105.726,RSMo,arerepealedandfournewsectionsenactedinlieuthereof,tobe 3knownassections84.325,86.200,86.213,and105.726,toreadasfollows: 84.325.1.OnorafterJuly1,2023,theboardofpolicecommissionersshall 2assumecontrolofanymunicipalpoliceforceestablishedwithinanycitynotwithina 3countyaccordingtotheproceduresandrequirementsofthissectionandanyrules 4promulgatedundersubsection6ofthissection.Thepurposeoftheseproceduresand 5requirementsistoprovideforanorderlyandappropriatetransitioninthegovernance 6ofthepoliceforceandprovideforanequitableemploymenttransitionforcommissioned 7andcivilianpersonnel. 8 2.Upontheassumptionofcontrolbytheboardofpolicecommissionersunder 9subsection1ofthissection,anymunicipalpolicedepartmentwithinanycitynotwithin 10acountyshallconvey,assign,andotherwisetransfertotheboardtitleandownershipof 11allindebtednessandassets,including,butnotlimitedto,allfundsandrealandpersonal 12propertyheldinthenameoforcontrolledbythemunicipalpolicedepartment. 13 3.Upontheassumptionofcontrolbytheboardofpolicecommissionersunder 14subsection1ofthissection,thestateshallacceptresponsibility,ownership,andliability EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 15assuccessor-in-interestforcontractualobligations,indebtedness,andotherlawful 16obligationsofthemunicipalpolicedepartment. 17 4.Theboardofpolicecommissionersshallinitiallyemploy,withoutareduction 18inrank,salary,orbenefits,allcommissionedandcivilianpersonnelofthemunicipal 19policedepartmentthatwereemployedbythemunicipalpolicedepartmentimmediately 20priortothedatetheboardassumedcontrol.Theboardshallrecognizeallaccrued 21yearsofservicethatsuchcommissionedandcivilianpersonnelhadwiththemunicipal 22policedepartmentaswellasallaccruedyearsofservicethatsuchcommissionedand 23civilianpersonnelhadpreviouslywiththeboardofpolicecommissioners.Such 24personnelshallbeentitledtothesameholidays,vacation,andsickleavetheywere 25entitledtoasemployeesofthemunicipalpolicedepartment. 26 5.Thecommissionedandcivilianpersonnelwhoretirefromservicewiththe 27municipalpolicedepartmentbeforetheboardofpolicecommissionersassumedcontrol 28ofthedepartmentundersubsection1ofthissectionshallcontinuetobeentitledtothe 29samepensionbenefitsprovidedasemployeesofthemunicipalpolicedepartmentand 30thesamebenefitssetforthinsubsection4ofthissection. 31 6.Thedepartmentofpublicsafetymaypromulgateallnecessaryrulesand 32regulationsfortheimplementationandadministrationofthissection.Anyruleor 33portionofarule,asthattermisdefinedinsection536.010,thatiscreatedunderthe 34authoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplieswithandis 35subjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.This 36sectionandchapter536arenonseverable,andifanyofthepowersvestedwiththe 37generalassemblypursuanttochapter536toreview,todelaytheeffectivedate,orto 38disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof 39rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2022,shallbe 40invalidandvoid. 86.200.Thefollowingwordsandphrasesasusedinsections86.200to86.366,unless 2adifferentmeaningisplainlyrequiredbythecontext,shallhavethefollowingmeanings: 3 (1)"Accumulatedcontributions",thesumofallmandatorycontributionsdeducted 4fromthecompensationofamemberandcreditedtothemember'sindividualaccount, 5togetherwithmembers'interestthereon; HB2432 8 19 4.Beforeacitynotwithinacountymayestablishamunicipalpolice 20 forceunderthissection,thecityshalladoptanordinanceaccepting 21 responsibility,ownership,andliabilityassuccessor-in-interestfor 22 contractualobligations,indebtedness,andotherlawfulobligationsofthe 23 boardofpolicecommissionerssubjecttotheprovisionsofsubsection2of 24 section84.345. 25 5.Acitynotwithinacountythatestablishesamunicipalpoliceforce 26 shallinitiallyemploy,withoutareductioninrank,salary,orbenefits,all 27 commissionedandcivilianpersonneloftheboardofpolicecommissioners 28 createdundersections84.010to84.340thatwereemployedbytheboard 29 immediatelypriortothedatethemunicipalpoliceforcewasestablished.Such 30 commissionedpersonnelwhopreviouslywereemployedbytheboardmay 31 onlybeinvoluntarilyterminatedbythecitynotwithinacountyforcause.The 32 cityshallalsorecognizeallaccruedyearsofservicethatsuchcommissioned 33 andcivilianpersonnelhadwiththeboardofpolicecommissioners.Such 34 personnelshallbeentitledtothesameholidays,vacation,andsickleavethey 35 wereentitledtoasemployeesoftheboardofpolicecommissioners. 36 6.(1)Commissionedandcivilianpersonnelofamunicipalpolice 37 forceestablishedunderthissectionwhoarehiredpriortoSeptember1,2023, 38 shallnotbesubjecttoaresidencyrequirementofretainingaprimaryresidence 39 inacitynotwithinacountybutmayberequiredtomaintainaprimary 40 residencelocatedwithinaone-hourresponsetime. 41 (2)Commissionedandcivilianpersonnelofamunicipalpoliceforce 42 establishedunderthissectionwhoarehiredafterAugust31,2023,maybe 43 subjecttoaresidencyrulenomorerestrictivethanarequirementofretaininga 44 primaryresidenceinacitynotwithinacountyforatotalofsevenyearsandof 45 thenallowingthepersonneltomaintainaprimaryresidenceoutsidethecity 46 notwithinacountysolongastheprimaryresidenceislocatedwithinaone- 47 hourresponsetime. 48 7.Thecommissionedandcivilianpersonnelwhoretirefromservice 49 withtheboardofpolicecommissionersbeforetheestablishmentofa 50 municipalpoliceforceundersubsection1ofthissectionshallcontinuetobe 51 entitledtothesamepensionbenefitsprovidedunderchapter86andthesame 52 benefitssetforthinsubsection5ofthissection. 53 8.Ifthecitynotwithinacountyelectstoestablishamunicipalpolice 54 forceunderthissection,thecityshallestablishaseparatedivisionforthe 55 operationofitsmunicipalpoliceforce.Thecivilservicecommissionofthe 56 citymayadoptrulesandregulationsappropriatefortheuniqueoperationofa 57 policedepartment.Suchrulesandregulationsshallreserveexclusive 58 authorityoverthedisciplinaryprocessandproceduresaffectingcommissioned 59 officerstothecivilservicecommission;however,untilsuchtimeasthecity 60 adoptssuchrulesandregulations,thecommissionedpersonnelshallcontinue 61 tobegovernedbytheboardofpolicecommissioner'srulesandregulationsin 62 effectimmediatelypriortotheestablishmentofthemunicipalpoliceforce, 63 withthepolicechiefactinginplaceoftheboardofpolicecommissionersfor 64 purposesofapplyingtherulesandregulations.Unlessotherwiseprovidedfor, 65 existingcivilservicecommissionrulesandregulationsgoverningtheappealof 66 disciplinarydecisionstothecivilservicecommissionshallapplytoall HB2432 9 67 commissionedandcivilianpersonnel.Thecivilservicecommission'srules 68 andregulationsshallprovidethatrecordspreparedfordisciplinarypurposes 69 shallbeconfidential,closedrecordsavailablesolelytothecivilservice 70 commissionandthosewhopossessauthoritytoconductinvestigations 71 regardingdisciplinarymatterspursuanttothecivilservicecommission'srules 72 andregulations.Ahearingofficershallbeappointedbythecivilservice 73 commissiontohearanysuchappealsthatinvolvedisciplineresultingina 74 suspensionofgreaterthanfifteendays,demotion,ortermination,butthecivil 75 servicecommissionshallmakethefinalfindingsoffact,conclusionsoflaw, 76 anddecisionwhichshallbesubjecttoanyrightofappealunderchapter536. 77 9.Acitynotwithinacountythatestablishesandmaintainsa 78 municipalpoliceforceunderthissection: 79 (1)Shallprovideorcontractforlifeinsurancecoverageandfor 80 insurancebenefitsprovidinghealth,medical,anddisabilitycoveragefor 81 commissionedandcivilianpersonnelofthemunicipalpoliceforcetothesame 82 extentaswasprovidedbytheboardofpolicecommissionersundersection 83 84.160; 84 (2)Shallprovideorcontractformedicalandlifeinsurancecoverage 85 foranycommissionedorcivilianpersonnelwhoretiredfromservicewiththe 86 boardofpolicecommissionersorwhowereemployedbytheboardofpolice 87 commissionersandretirefromthemunicipalpoliceforceofacitynotwithina 88 countytothesameextentsuchmedicalandlifeinsurancecoveragewas 89 providedbytheboardofpolicecommissionersundersection84.160; 90 (3)Shallmakeavailablemedicalandlifeinsurancecoveragefor 91 purchasetothespousesordependentsofcommissionedandcivilianpersonnel 92 whoretirefromservicewiththeboardofpolicecommissionersorthe 93 municipalpoliceforceanddeceasedcommissionedandcivilianpersonnelwho 94 receivepensionbenefitsundersections86.200to86.366attheratethatsuch 95 dependent'sorspouse'scoveragewouldcostundertheappropriateplanifthe 96 deceasedwereliving;and 97 (4)Maypayanadditionalshiftdifferentialcompensationto 98 commissionedandcivilianpersonnelforeveningandnighttoursofdutyin 99 anamountnottoexceedtenpercentoftheofficer'sbasehourlyrate. 100 10.Acitynotwithinacountythatestablishesamunicipalpoliceforce 101 undersections84.343to84.346shallestablishatransitioncommitteeoffive 102 membersforthepurposeof:coordinatingandimplementingthetransitionof 103 authority,operations,assets,andobligationsfromtheboardofpolice 104 commissionerstothecity;windingdowntheaffairsoftheboard;making 105 nonbindingrecommendationsforthetransitionofthepoliceforcefromthe 106 boardtothecity;andotherrelatedduties,ifany,establishedbyexecutive 107 orderofthecity'smayor.Oncetheordinancereferencedinthissectionis 108 enacted,thecityshallprovidewrittennoticetotheboardofpolice 109 commissionersandthegovernorofthestateofMissouri.Withinthirty 110 daysofsuchnotice,themayorshallappointthreememberstothecommittee, 111 twoofwhomshallbemembersofastatewidelawenforcementassociation 112 thatrepresentsatleastfivethousandlawenforcementofficers.Theremaining 113 membersofthecommitteeshallincludethepolicechiefofthemunicipal 114 policeforceandapersonwhocurrentlyorpreviouslyservedasa HB2432 10 115 commissionerontheboardofpolicecommissioners,whoshallbeappointedto 116 thecommitteebythemayorofsuchcity.] [84.345.1.Exceptasrequiredfortheboardofpolicecommissioners 2 toconcludeitsaffairsandpursuelegalclaimsanddefenses,uponthe 3 establishmentofamunicipalpoliceforce,thetermsofofficeofthe 4 commissionersoftheboardofpolicecreatedundersections84.020and 5 84.030shallexpire,andtheprovisionsofsections84.010to84.340shallnot 6 applytoanycitynotwithinacountyoritsmunicipalpoliceforceasofsuch 7 date.Theboardshallcontinuetooperate,ifnecessary,towinddownthe 8 board'saffairsuntilthetransferofownershipandobligationsundersubsection 9 2ofsection84.344hasbeencompleted.Duringsuchtime,theboardofpolice 10 commissionersshalldesignateandauthorizeitssecretarytoactonbehalfof 11 theboardforpurposesofperformingtheboard'sdutiesandanyotheractions 12 incidenttothetransferandwindingdownoftheboard'saffairs. 13 2.Foranyclaim,lawsuit,orotheractionarisingoutofactions 14 occurringbeforethedateofcompletionofthetransferprovidedunder 15 subsection2ofsection84.344,thestateshallcontinuetoprovidelegal 16 representationassetforthinsection105.726,andthestatelegalexpensefund 17 shallcontinuetoprovidereimbursementforsuchclaimsundersection 18 105.726.Thissubsectionappliestoallclaims,lawsuits,andotheractions 19 broughtagainstanycommissioner,policeofficer,employee,agent, 20 representative,oranyindividualorentityactingorpurportingtoactonits 21 ortheirbehalf. 22 3.Notwithstandinganyotherprovisionoflaw,rule,orregulationto 23 thecontrary,anycitynotwithinacountythatestablishesamunicipalpolice 24 forceundersections84.343to84.346shallnotberestrictedorlimitedinany 25 wayintheselectionofapolicechieforchiefofthedivisioncreatedunder 26 subsection8ofsection84.344. 27 4.Itshallbethedutyofthesheriffforanycitynotwithinacounty, 28 whenevercalleduponbythepolicechiefofthemunicipalpoliceforce,toact 29 underthepolicechief'scontrolforthepreservationofthepublicpeaceand 30 quiet;and,whenevertheexigencyorcircumstancesmay,inthepolicechief's 31 judgment,warrantit,saidpolicechiefshallhavethepowertoassumethe 32 controlandcommandofalllocalandmunicipalconservatorsofthepeaceof 33 thecity,whethersheriff,constable,policemenorothers,andtheyshallact 34 undertheordersofthesaidpolicechiefandnototherwise.] [84.346.Anypolicepensionsystemcreatedunderchapter86forthe 2 benefitofapoliceforceestablishedundersections84.010to84.340shall 3 continuetobegovernedbychapter86,andshallapplytoanypoliceforce 4 establishedundersection84.343to84.346.Otherthananyprovisionthat 5 makeschapter86applicabletoamunicipalpoliceforceestablishedunder 6 section84.343to84.346,nothinginsections84.343to84.346shallbe 7 construedaslimitingorchangingtherightsorbenefitsprovidedunderchapter 8 86.] HB2432 11 [84.347.Notwithstandingtheprovisionsofsection1.140tothe 2 contrary,theprovisionsofsections84.343to84.346shallbenonseverable.If 3 anyprovisionofsections84.343to84.346isforanyreasonheldtobeinvalid, 4 suchdecisionshallinvalidatealloftheremainingprovisionsofthisact.] ✔ HB2432 12
