2municipalassembly,asthecasemaybe,ofsuchcitiesmaypassordinancesfor 3preservingorder,securingpropertyandpersonsfromviolence,dangerordestruction, 4protectingpublicandprivateproperty,andforpromotingtheinterestsandensuringthe 5goodgovernmentofthecities;butnoordinancesheretoforepassed,orthatmay 6hereafterbepassed,bythecommoncouncilormunicipalassemblyofthecities,shall,in 7anymanner,conflictorinterferewiththepowersortheexerciseofthepowersofthe 8boardsofpolicecommissionersofthecitiesascreatedbysection84.020,norshallthe 9citiesoranyofficeroragentofthecorporationofthecities,orthemayorthereof,inany 10mannerimpede,obstruct,hinder,orinterferewiththeboardsofpoliceoranyofficer,or 11agentorservantthereoforthereunder. 84.020.Inallcitiesofthisstatethatnowhave,ormayhereafterattain,apopulation 2offivehundredthousandinhabitantsorover,thereshallbe,andisherebyestablished,within EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 3andforsaidcities,aboardofpolice,toconsistoffourcommissioners,asprovidedinsections 484.040to84.080,togetherwiththe[mayor] presidentoftheboardofaldermenofsaid 5citiesforthetimebeing,orwhosoevermaybeofficiallyactinginthatcapacity,andsaid 6boardshallappointoneofitsmembersaspresident,andonememberwhoshallactasvice 7presidentduringtheabsenceofthepresident;andsuchpresidentorvicepresidentshallbethe 8executiveofficeroftheboardandshallactforitwhentheboardisnotinsession. 84.030.Beginningon[January9,1989] August28,2022,andnolaterthan 2September28,2022, thegovernorofthestateofMissouri,byandwiththeadviceand 3consentofthesenate,shallappointthefourcommissionersprovidedforinsection84.020, 4andonecommissionershallbeappointedforatermofoneyear;onecommissionershallbe 5appointedforatermoftwoyears;onecommissionershallbeappointedforatermofthree 6years;onecommissionershallbeappointedforatermoffouryears.Theirsuccessorsshall 7eachbeappointedforatermoffouryears,andsaidcommissionersshallholdofficefortheir 8termofappointmentanduntiltheirsuccessorsshallhavebeenappointedandqualified.In 9caseofavacancyinsaidboardforanycausewhatsoever,itshallbefilledbyappointmentfor 10theunexpiredterm,inthesamemannerasinthecaseoforiginalappointments.Thegovernor 11shallissuecommissionstothepersonssoappointed,designatingthetimeforwhichtheyare 12appointedincasetheappointmentistofillanunexpiredtermoccasionedbydeath, 13resignationoranyothercause,andwheneverthetermofofficeofanycommissionerexpires, 14theappointmentofhissuccessorshallbeforfouryears.[Thecommissionersnowholding 15officesunderexistinglawsinanycityofthisstatetowhichsections84.010to84.340apply 16aretoholdtheirofficesuntiltheexpirationoftheirterms,andtheirsuccessorsareduly 17appointedandqualified.] 84.100.Toenabletheboardstoperformthedutiesimposeduponthem,theyare 2herebyauthorizedandrequiredtoappoint,enrollandemployapermanentpoliceforceforthe 3citieswhichtheyshallequipandarmastheymayjudgenecessary.Exceptasprovidedbelow, 4thenumberofpatrolmentobeappointedshallnotbe[more] lessthanonethousand[six]one 5hundred[eighty-three] forty-twoofwhichnumbernotmorethantwohundredfiftyaretobe 6probationarypatrolmen.Anyincreaseinthenumberofpatrolmenauthorized,inadditionto 7thatprovidedforabove,shallbepermitteduponrecommendationbytheboardofpolice 8commissioners,withtheapprovalofthemunicipalboardofestimateandapportionment. 9[Thenumberofturnkeystobeappointedshallbesixty-five,exceptthatforeachpatrolman 10hereafterpromoted,demoted,removed,resignedorotherwiseseparatedfromtheforce,an 11additionalturnkeymaybeappointed,butundernocircumstancesshallmorethanone 12hundredfiftyturnkeysbeappointed.Aseachadditionalturnkeyisappointed,themaximum 13numberofpatrolmentobeappointedshallbereducedaccordinglysothatwhenonehundred 14fiftyturnkeyshavebeenappointed,thenumberofpatrolmentobeappointedshallnotbe HCSHB2432 2 15morethanonethousandfivehundredninety-eight] Theboardmaycontinuetoemployas 16manynon-commissionedpoliceciviliansasitdeemsnecessaryinordertoperformthe 17dutiesimposeduponthem,whichshallincludecitymarshalsandparkrangers. 84.140.Theboardsshallgranteverymemberofthepoliceforcewhohasservedfor 2oneyearormoreatotalofthreeweeksvacationeachyearwithpay,andeachmemberofthe 3policeforcewhohasservedthedepartmentfor[twelve] fiveyearsormoreshallreceive 4[four] fiveweeksvacationeachyearwithpay,andeachmemberofthepoliceforcewhohas 5servedthedepartmentfor[twenty-one] tenyearsormoreshallreceive[five] sixweeks 6vacationeachyearwithpay,andeachmemberofthepoliceforcewhohasservedthe 7departmentfor[thirty] fifteenyearsormore[andiseligibletoparticipateinthedeferred 8retirementoptionplan]shallreceive[six]sevenweeksvacationeachyearwithpay[;however 9theboardmaygrantanadditionalweekofpaidvacationtomembersafteroneyearof 10service], andeachmemberofthepoliceforcewhohasservedthedepartmentfortwenty 11yearsormoreshallreceiveeightweeksvacationeachyearwithpay.Allmembersofthe 12policeforceshallreceive[fifteen] sixteenholidayswithpay,howevertheboardmaygrant 13additionalholidayswithpay,andonehundredfourdaysoffdutyeachyearwithpay,andthe 14boardsmayfromtimetotimegrantadditionaldaysoffdutyeachyearwithpaywheninthe 15judgmentoftheboards,thegrantingthereofwillnotmateriallyimpairtheefficiencyofthe 16department. 84.150.Themaximumnumberofofficersofthepoliceforceineachrankineach 2suchcityshallbeasfollows:onechiefofpolicewiththerankofcolonel;oneassistantchief 3ofpolicewiththerankoflieutenantcolonel;fouradditionallieutenantcolonels[, notto 4exceedfiveinnumberandothersuchranksandnumberofmemberswithinsuchranksasthe 5boardfromtimetotimedeemsnecessary]; tencaptains;fifty-sevenlieutenants;andone 6hundredandeighty-eightsergeants.Nofurtherappointmentstotherankofmajorshall 7hereafterbemade,butallmembersoftheforcenowholdingtherankofmajorshall 8continueinsuchrankuntiltheirpromotion,demotion,removal,resignation,orother 9separationfromtheforce.Theofficersofthepoliceforceshallhavecommissionsissuedto 10thembytheboardsofpolicecommissioners,andthoseheretoforeandthosehereafter 11commissionedshallservesolongastheyshallfaithfullyperformtheirdutiesandpossessthe 12necessarymentalandphysicalability,andbesubjecttoremovalonlyforcauseafterahearing 13bytheboard,whoareherebyinvestedwithexclusivejurisdictioninthepremises. 84.160.1.AsofAugust28,[2006] 2022, theboardofpolicecommissionersshall 2havetheauthoritytocomputeandestablishtheannualsalaryofeachmemberofthepolice 3forcewithoutreceivingpriorauthorizationfromthegeneralassembly, whichshallnotbe 4lessthantheannualsalariespaidtoeachmemberatthetimeoftheenactmentofthis HCSHB2432 3 5sectionandwhichannualsalaryshallincreasebynolessthanfourthousanddollarsas 6ofJuly1,2023. 7 2.Eachofficerofpoliceandpatrolmanwhoseregularassignmentrequires 8nonuniformedattiremayreceive,inadditiontohisorhersalary,anallowancenottoexceed 9threehundredsixtydollarsperannumpayablebiweekly.Notwithstandingtheprovisionsof 10subsection1ofthissectiontothecontrary,noadditionalcompensationorcompensatorytime 11offforovertime,courttime,orstandbycourttimeshallbepaidorallowedtoanyofficerof 12therankof[sergeant] lieutenantorabove.Notwithstandinganyotherprovisionoflawtothe 13contrary,nothinginthissectionshallprohibitthepaymentofadditionalcompensation 14pursuanttothissubsectiontoofficersoftheranksofsergeantsandabove,providedthat 15fundingforsuchcompensationshallnot: 16 (1)Bepaidfromthegeneralfundsofeitherthecityortheboardofpolice 17commissionersofthecity;or 18 (2)Beviolativeofanyfederallaworotherstatelaw. 19 3.Itisthedutyofthemunicipalassemblyorcommoncouncilofthecitiestomake 20thenecessaryappropriationfortheexpensesofthemaintenanceofthepoliceforceinthe 21mannerhereinandhereafterprovided;provided,thatinnoeventshallsuchmunicipal 22assemblyorcommoncouncilberequiredtoappropriateforsuchpurposes(including,butnot 23limitedto,costsoffundingpensionsorretirementplans)foranyfiscalyearasuminexcessof 24anylimitationimposedbyarticleX,section21,MissouriConstitution;andprovidedfurther, 25thatsuchmunicipalassemblyorcommoncouncilmayappropriateasuminexcessofsuch 26limitationforanyfiscalyearbyanappropriationsordinanceenactedinconformitywiththe 27provisionsofthecharterofsuchcities. 28 4.Notwithstandingtheprovisionsofsubsection1ofthissectiontothecontrary,the 29boardofpolicecommissionersshallpayadditionalcompensationforallhoursofservice 30renderedbyprobationarypatrolmen[and],patrolmen, andsergeantsinexcessofthe 31establishedregularworkingperiod,andtherateofcompensationshallbeoneandone-half 32timestheregularhourlyrateofpaytowhicheachmembershallnormallybeentitled;except 33that,thecourttimeandcourtstandbytimeshallbepaidattheregularhourlyrateofpayto 34whicheachmembershallnormallybeentitled.Nocreditshallbegivenordeductionsmade 35frompaymentsforovertimeforthepurposeofretirementbenefits. 36 5.Notwithstandingtheprovisionsofsubsection1ofthissectiontothecontrary, 37probationarypatrolmen[and], patrolmen, andsergeantsshallreceiveadditional 38compensationforauthorizedovertime,courttimeandcourtstandbytimewheneverthe 39totalaccumulatedtimeexceedsfortyhours.Theaccumulatedfortyhoursshallbetakenas 40compensatorytimeoffattheofficer'sdiscretionwiththeapprovalofhissupervisor. HCSHB2432 4 41 6.Theallowanceofcompensationorcompensatorytimeoffforcourtstandbytime 42shallbecomputedattherateofone-thirdofonehourforeachhourspentoncourtstandby 43time. 44 7.Theboardofpolicecommissioners[may] shalleffectprogramstoprovide 45additionalcompensationtoitsemployeesforsuccessfulcompletionofacademicworkatan 46accreditedcollegeoruniversity,inamountsnottoexceedtenpercentoftheiryearlysalaries 47orforfieldtrainingofficerandleadofficerresponsibilitiesinamountsnottoexceedthree 48percentoftheiryearlysalariesforfieldtrainingofficerresponsibilitiesandanadditionalthree 49percentoftheiryearlysalariesforleadofficerresponsibilities.Theboardmaydesignateup 50toonehundredfiftyemployeesasfieldtrainingofficersanduptofiftyemployeesaslead 51officers. 52 8.Theboardofpolicecommissioners: 53 (1)Shallprovideorcontractforlifeinsurancecoverageandforinsurancebenefits 54providinghealth,medicalanddisabilitycoverageforofficersandemployeesofthe 55departmenttothesameextentaswasprovidedbythecityundersection84.344; 56 (2)Shallprovideorcontractforinsurancecoverageprovidingsalarycontinuation 57coverageforofficersandemployeesofthepolicedepartmenttothesameextentaswas 58providedbythecityundersection84.344; 59 (3)Shallprovidehealth,medical,andlifeinsurancecoverageforretiredofficersand 60employeesofthepolicedepartmenttothesameextentaswasprovidedbythecityunder 61section84.344. Health,medicalandlifeinsurancecoverageshallbemadeavailablefor 62purchasetothespousesordependentsofdeceasedretiredofficersandemployeesofthe 63policedepartmentwhoreceivepensionbenefitspursuanttosections86.200to86.364tothe 64sameextentaswasprovidedbythecityundersection84.344,andshallbeattheratethat 65suchdependent'sorspouse'scoveragewouldcostundertheappropriateplanifthedeceased 66wereliving; 67 (4)Maypayanadditionalshiftdifferentialcompensationtomembersofthepolice 68forceforeveningandnighttourofdutyinanamountnottoexceedtenpercentoftheofficer's 69basehourlyrate. 70 9.Notwithstandingtheprovisionsofsubsection1ofthissectiontothecontrary,the 71boardofpolicecommissionersshallpayadditionalcompensationtomembersofthepolice 72forceuptoandincludingtherankofpoliceofficerforanyfullhourworkedbetweenthe 73hoursof11:00p.m.and7:00a.m.,inamountsequalto[five]tenpercentoftheofficer'sbase 74hourlypay. 75 10.Theboardofpolicecommissioners,fromtimetotimeandinitsdiscretion,may 76payadditionalcompensationtopoliceofficers,sergeantsandlieutenantsbypaying 77commissionedofficersintheaforesaidranksforaccumulated,unusedvacationtime.Any HCSHB2432 5 78suchpaymentsshallbemadeinincrementsofnotlessthanfortyhours,andatrates 79equivalenttothebasestraight-timeratesbeingearnedbysaidofficersatthetimeofpayment; 80exceptthat,nosuchofficershallberequiredtoacceptpaymentforaccumulatedunused 81vacationtime. 84.170.1.Whenanyvacancyshalltakeplaceinanygradeofofficers,itshallbe 2filledfromthenextlowestgrade;provided,however,thatprobationarypatrolmenshallserve 3atleastsixmonthsassuchbeforebeingpromotedtotherankofpatrolman;patrolmenshall 4serveatleastthreeyearsassuchbeforebeingpromotedtotherankofsergeant;sergeants 5shallserveatleastoneyearassuchbeforebeingpromotedtotherankoflieutenant; 6lieutenantsshallserveatleastoneyearassuchbeforebeingpromotedtotherankofcaptain; 7andinnocaseshallthechieforassistantchiefbeselectedfrommennotmembersoftheforce 8orbelowthegradeofcaptain.Patrolmenshallserveatleastthreeyearsassuchbefore 9promotiontotherankofdetective;theinspectorshallbetakenfrommenintheranknot 10belowthegradeoflieutenant. 11 2.Theboardsofpoliceareherebyauthorizedtomakeallsuchrulesandregulations, 12notinconsistentwithsections84.010to84.340,orotherlawsofthestate,astheymayjudge 13necessary,fortheappointment,employment,uniforming,discipline,trialandgovernmentof 14thepolice.Atthetimeoftheeffectivedateofthisactanduntilsuchtimeastheboard 15adoptsotherinvestigativeanddisciplinarypoliciesandproceduresnotinconsistentwith 16section590.502,disciplineandinvestigativeproceduresforcommissionedandcivilian 17employeesofthepoliceforceshallberegulatedbyrule7ofthepolicemanualofthe 18policedepartmentineffectasofNovember4,2013,exceptthatwhererule7isinconflict 19withsection590.502,theboardshallcomplywiththerequirementsofsection590.502. 20Undernocircumstancesshalltheboardinitiallyorhereafteradoptinvestigativeand 21disciplinaryproceduresthatdonotincludethesummaryhearingboardprocedures 22providedforinrule7ofthepolicemanualofthepolicedepartmentineffectasof 23November4,2013.Thesaidboardsshallalsohavepowertorequireofanyofficeror 24policemanbondwithsuretieswhentheymayconsideritdemandedbythepublicinterests. 25Alllawfulrulesandregulationsoftheboardshallbeobeyedbythepoliceforceonpainof 26dismissalorsuchlighterpunishment,eitherbysuspension,fine,reductionorforfeitureof 27pay,orotherwiseastheboardsmayadjudge. 28 3.Theauthoritypossessedbytheboardofpoliceincludes,butisnotlimitedto,the 29authoritytodelegateportionsofitspowersauthorizedinsection84.120,includingpresiding 30overadisciplinaryhearing,toahearingofficerasdeterminedbytheboard. 84.225.Anyofficerorservantofthemayororcommoncouncilormunicipal 2assemblyofthesaidcities,orotherpersonswhatsoever,whoshallforciblyresistor 3obstructtheexecutionorenforcementofanyoftheprovisionsofsections84.010to HCSHB2432 6 484.340orrelatingtothesame,orwhoshalldisburseorfailtodisburseanymoneyin 5violationthereof,orwhoshallhinderorobstructtheorganizationormaintenanceof 6saidboardofpolice,orthepoliceforcethereinprovidedtobeorganizedand 7maintained,orwhoshallmaintainorcontrolanypoliceforceotherthantheonetherein 8providedfor,orwhoshalldelayorhinderthedueenforcementofsections84.010to 984.340byfailingorneglectingtoperformthedutiesbysaidsectionsimposeduponhim 10orher,shallbeliabletoapenaltyofonethousanddollarsforeachandeveryoffense, 11recoverablebytheboardsbyactionatlawinthenameofthestate,andshallforever 12thereafterbedisqualifiedfromholdingorexercisinganyofficeoremployment 13whatsoeverunderthemayororcommoncouncilormunicipalassemblyofsaidcities,or 14undersections84.010to84.340;provided,however,thatnothinginthissectionshallbe 15construedtointerferewiththepunishment,underanyexistingoranyfuturelawsofthis 16state,ofanycriminaloffensewhichshallbecommittedbythesaidpartiesinorabout 17theresistance,obstruction,hindrance,conspiracy,combination,ordisbursement 18aforesaid. 84.325.1.OnAugust28,2022,theboardofpolicecommissionersshallassume 2controlofanymunicipalpoliceforceestablishedwithinanycitynotwithinacounty 3accordingtotheproceduresandrequirementsofthissectionandanyrulespromulgated 4undersubsection6ofthissection.Thepurposeoftheseproceduresandrequirementsis 5toprovideforanorderlyandappropriatetransitioninthegovernanceofthepolice 6forceandprovideforanequitableemploymenttransitionforcommissionedandcivilian 7personnel. 8 2.Upontheassumptionofcontrolbytheboardofpolicecommissionersunder 9subsection1ofthissection,anymunicipalpolicedepartmentwithinanycitynotwithin 10acountyshallconvey,assign,andotherwisetransfertotheboardtitleandownershipof 11allindebtednessandassets,including,butnotlimitedto,allfundsandrealandpersonal 12propertyheldinthenameoforcontrolledbythemunicipalpolicedepartment.This 13expresslyexcludesanyfundsheldbythecityinthenameof,forthebenefitof,orfor 14futurecontributiontoanypolicepensionsystemcreatedunderchapter86.Suchcities 15shallthereafterceasetheoperationofanypolicedepartmentorpoliceforce. 16 3.Upontheassumptionofcontrolbytheboardofpolicecommissionersunder 17subsection1ofthissection,thestateshallacceptresponsibility,ownership,andliability 18assuccessor-in-interestforcontractualobligationsandotherlawfulobligationsofthe 19municipalpolicedepartment.Asusedherein,"obligations"shallnotinclude,andshall 20notbeconstruedtoinclude,thecity'sobligationtomakecontributionspursuantto 21section86.337toanypolicepensionsystemcreatedunderchapter86. HCSHB2432 7 22 4.Theboardofpolicecommissionersshallinitiallyemploy,withoutareduction 23inrank,salary,orbenefits,allcommissionedandcivilianpersonnelofthemunicipal 24policedepartmentthatwereemployedbythemunicipalpolicedepartmentimmediately 25priortothedatetheboardassumedcontrol.Theboardshallrecognizeallaccrued 26yearsofservicethatsuchcommissionedandcivilianpersonnelhadwiththemunicipal 27policedepartmentaswellasallaccruedyearsofservicethatsuchcommissionedand 28civilianpersonnelhadpreviouslywiththeboardofpolicecommissioners.Such 29personnelshallbeentitledtothesameholidays,vacation,sickleave,sickbonustime, 30andannualstep-increasestheywereentitledtoasemployeesofthemunicipalpolice 31department. 32 5.Thecommissionedandcivilianpersonnelwhoretirefromservicewiththe 33municipalpolicedepartmentbothbeforeandaftertheboardofpolicecommissioners 34assumedcontrolofthedepartmentundersubsection1ofthissectionshallcontinuetobe 35entitledtothesamepensionbenefitsprovidedasemployeesofthemunicipalpolice 36departmentandthesamebenefitssetforthinsubsection4ofthissection. 37 6.Theboardofpolicecommissionersmaypromulgateallnecessaryrulesand 38regulationsfortheimplementationandadministrationofthissection.Anyruleor 39portionofarule,asthattermisdefinedinsection536.010,thatiscreatedunderthe 40authoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplieswithandis 41subjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.This 42sectionandchapter536arenonseverableandifanyofthepowersvestedwiththe 43generalassemblypursuanttochapter536toreview,todelaytheeffectivedate,orto 44disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof 45rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2022,shallbe 46invalidandvoid. 84.346.Anypolicepensionsystemcreatedunderchapter86forthebenefitofa 2policeforceestablishedundersections[84.010] 84.005to84.340shallcontinuetobe 3governedbychapter86,andshallapplytoanypoliceforceestablishedundersection84.343 4to84.346.Otherthananyprovisionthatmakeschapter86applicabletoamunicipalpolice 5forceestablishedundersection84.343to84.346,nothinginsections84.343to84.346shall 6beconstruedaslimitingorchangingtherightsorbenefitsprovidedunderchapter86. 105.726.1.Nothinginsections105.711to105.726shallbeconstruedtobroadenthe 2liabilityofthestateofMissouribeyondtheprovisionsofsections537.600to537.610,norto 3abolishorwaiveanydefenseatlawwhichmightotherwisebeavailabletoanyagency, 4officer,oremployeeofthestateofMissouri.Sections105.711to105.726donotwaivethe 5sovereignimmunityofthestateofMissouri.
