BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Sections168.500and168.515,RSMo,arerepealedandtwonewsections
2enactedinlieuthereof,tobeknownassections168.500and168.515,toreadasfollows:
168.500.1.Forthepurposeofprovidingcareerpay,whichshallbeasalary
2supplement,forpublicschoolteachers,whichforthepurposeofsections168.500to168.515
3shallincludeclassroomteachers,librarians,schoolcounselorsandcertificatedteacherswho
4holdpositionsasschoolpsychologicalexaminers,parentsasteacherseducators,school
5psychologists,specialeducationdiagnosticiansandspeechpathologists,andareonthe
6districtsalaryschedule,thereisherebycreatedandestablishedacareeradvancementprogram
7whichshallbeknownasthe"MissouriCareerDevelopmentandTeacherExcellencePlan",
8hereinafterknownasthe"careerplanorprogram".Participationbylocalschooldistrictsin
9thecareeradvancementprogramestablishedunderthissectionshallbevoluntary.Thecareer
10advancementprogramisamatchingfundprogram.Thegeneralassemblymaymakean
11annualappropriationtotheexcellenceineducationfundestablishedundersection160.268
12forthepurposeofprovidingthestate'sportionforthecareeradvancementprogram.The
13"CareerLadderForwardFundingFund"isherebyestablishedinthestatetreasury.Beginning
14withfiscalyear1998anduntilthecareerladderforwardfundingfundisterminatedpursuant
15tothissubsection,thegeneralassemblymayappropriatefundstothecareerladderforward
16fundingfund.Notwithstandingtheprovisionsofsection33.080tothecontrary,moneysin
17thefundshallnotbetransferredtothecreditofthegeneralrevenuefundattheendofthe

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18biennium.Allinterestorothergainreceivedfrominvestmentofmoneysinthefundshallbe
19creditedtothefund.Allfundsdepositedinthefundshallbemaintainedinthefunduntilsuch
20timeasthebalanceinthefundattheendofthefiscalyearisequaltoorgreaterthanthe
21appropriationforthecareerladderprogramforthefollowingyear,atwhichtimeallsuch
22revenuesshallbeusedtofund,inadvance,thecareerladderprogramforsuchfollowingyear
23andthecareerladderforwardfundingfundshallthereafterbeterminated.
24 2.Thedepartmentofelementaryandsecondaryeducation,atthedirectionofthe
25commissionerofeducation,shallstudyanddevelopmodelcareerplanswhichshallbemade
26availabletothelocalschooldistricts.Thesestatemodelcareerplansshall:
27 (1)Containthreestepsorstagesofcareeradvancement;
28 (2)Containadetailedprocedurefortheadmissionofteacherstothecareerprogram;
29 (3)Containspecificcriteriaforcareerstepqualificationsandattainment.These
30criteriashallclearlydescribetheminimumnumberofprofessionalresponsibilitiesrequiredof
31theteacherateachstageoftheplanandshallincludereferencetoclassroomperformance
32evaluationsperformedpursuanttosection168.128. Thecriteriamayinclude,butshallnot
33belimitedto,teacherexternshipsasprovidedinsection168.025;
34 (4)BeconsistentwiththeteachercertificationprocessrecommendedbytheMissouri
35advisorycouncilofcertificationforeducatorsandadoptedbythedepartmentofelementary
36andsecondaryeducation;
37 (5)ProvidethatpublicschoolteachersinMissourishallbecomeeligibletoapplyfor
38admissiontothecareerplansadoptedundersections168.500to168.515after[five] two
39yearsofpublicschoolteachinginMissouri.Allteachersseekingadmissiontoanycareer
40planshall,asaminimum,meettherequirementsnecessarytoobtainthefirstrenewable
41professionalcertificateasprovidedinsection168.021;
42 (6)Provideproceduresforappealingdecisionsmadeundercareerplansestablished
43undersections168.500to168.515.
44 3.Schooldistrictcareerplansshallrecognizeadditionalresponsibilitiesand
45volunteereffortsbyteachersinformulatingcriteriaforcareerladderadmissionand
46stageachievement.Suchadditionalresponsibilitiesandvolunteereffortsshallbe
47requiredtooccuroutsideofcompensatedhoursandmayinclude,butshallnotbe
48limitedto:
49 (1)Servingasacoach,supervisor,ororganizerforanyextracurricularactivity
50forwhichtheteacherdoesnotalreadyreceiveadditionalcompensation;
51 (2)Servingasamentorforstudents,whetherinaformalorinformalcapacity;
52 (3)Receivingadditionalteachertrainingorcertificationoutsideofthatoffered
53bytheschooldistrict;
HB2493	2 54 (4)Servingasatutororprovidingadditionallearningopportunitiestostudents;
55and
56 (5)Assistingstudentswithpostsecondaryeducationpreparationincluding,but
57notlimitedto,teachinganACTorSATpreparationcourseorassistingstudentswith
58completingcollegeorcareerschooladmissionorfinancialassistanceapplications.
59 4.Thecommissionerofeducationshallcausethedepartmentofelementaryand
60secondaryeducationtoestablishguidelinesforallcareerplansestablishedunderthissection,
61andcriteriathatmustbemetbyanyschooldistrictwhichseeksfundingforitscareerplan.
62 [4.]5.Aparticipatinglocalschooldistrictmayhavetheoptionofimplementinga
63careerplandevelopedbythedepartmentofelementaryandsecondaryeducationoralocal
64planwhichhasbeendevelopedwithadvicefromteachersemployedbythedistrictandwhich
65hasmetwiththeapprovalofthedepartmentofelementaryandsecondaryeducation.In
66approvinglocalcareerplans,thedepartmentofelementaryandsecondaryeducationmay
67considerprovisionsintheplanofthelocaldistrictforrecognitionofteachermobilityfrom
68onedistricttoanotherwithinthisstate.
69 [5.]6.Thecareerplansoflocalschooldistrictsshallnotdiscriminateonthebasisof
70race,sex,religion,nationalorigin,color,creed,orage.Participationinthecareerplanofa
71localschooldistrictisoptional,andanyteacherwhodeclinestoparticipateshallnotbe
72penalizedinanyway.
73 [6.]7.Inordertoreceivefundsunderthissection,aschooldistrictwhichisnot
74subjecttosection162.920musthaveatotallevyforoperatingpurposeswhichisinexcessof
75theamountallowedinSection11(b)ofArticleXoftheMissouriConstitution;andaschool
76districtwhichissubjecttosection162.920musthaveatotallevyforoperatingpurposes
77whichisequaltoorinexcessoftwenty-fivecentsoneachhundreddollarsofassessed
78valuation.
79 [7.]8.Thecommissionerofeducationshallcausethedepartmentofelementaryand
80secondaryeducationtoregardaspeechpathologistwhoholdsbothavalidcertificateof
81licensetoteachandacertificateofclinicalcompetencetohavefulfilledthestandards
82requiredtobeplacedonstageIIIofthecareerprogram,providedthatsuchspeechpathologist
83hasbeenemployedbyapublicschoolinMissouriforatleast[five]twoyearsandisapproved
84forplacementatsuchstageIIIbythelocalschooldistrict.
85 [8.]9.Beginninginfiscalyear2012,thestateportionofcareerladderpaymentsshall
86onlybemadeavailabletolocalschooldistrictsifthegeneralassemblymakesan
87appropriationforsuchprogram.Paymentsauthorizedundersections168.500to168.515
88shallonlybemadeavailableinayearforwhichastateappropriationismade.Anystate
89appropriationshallbemadeprospectivelyinrelationtotheyearinwhichworkunderthe
90programisperformed.
HB2493	3 91 [9.]10.Nothinginthissectionshallbeconstruedtoprohibitalocalschooldistrict
92fromfundingtheprogramforitsteachersforworkperformedinyearsforwhichnostate
93appropriationismadeavailable.
168.515.1.Eachteacherselectedtoparticipateinacareerplanestablishedunder
2sections168.500to168.515,whomeetstherequirementsofsuchplan,mayreceiveasalary
3supplement,thestate'sshareofwhichshallbedistributedundersection163.031,equaltothe
4followingamountsappliedtothecareerladderentitlementofsection163.031:
5 (1)CareerstageIteachersmayreceiveuptoanadditionalonethousandfivehundred
6dollarsperschoolyear;
7 (2)CareerstageIIteachersmayreceiveuptoanadditionalthreethousanddollarsper
8schoolyear;
9 (3)CareerstageIIIteachersmayreceiveuptoanadditionalfivethousanddollarsper
10schoolyear.Allteacherswithineachstagewithinthesameschooldistrictshallreceiveequal
11salarysupplements.
12 2.Thestatemaymakepaymentspursuanttosection163.031tothelocalschool
13districtforthepurposeofprovidingfundingtothelocalschooldistrictforthepaymentofany
14salarysupplementsprovidedforinthissection,subjecttotheavailabilityoffundsas
15appropriatedeachyearanddistributedonamatchingbasiswherethepercentageofstate
16fundingshallbe[forty] sixtypercentandthepercentageoflocalfundingshallbe[sixty] forty
17percent.
18 3.Notlessthaneveryfourthyear,beginningwithcalendaryear1988,thegeneral
19assembly,throughthejointcommitteeestablishedundersection160.254,shallreviewthe
20amountofthecareerpayprovidedforinthissectiontodetermineifanyincreasesare
21necessarytoreflecttheincreasesinthecostoflivingwhichhaveoccurredsincethesalary
22supplementswerelastreviewedorset.
23 4.Toparticipateinthesalarysupplementprogramestablishedunderthissection,a
24schooldistrictmaysubmittothevotersofthedistrictapropositiontoincreasetaxesforthis
25purpose.Ifaschooldistrict'scurrenttaxrateceilingisatorabovetheratefromwhichan
26increasewouldrequireatwo-thirdsmajority,theschoolboardmaysubmittothevotersofthe
27districtapropositiontoreduceoreliminatetheamountofthelevyreductionresultingfrom
28section164.013.Ifamajorityofthevotersvotingthereonvoteinfavoroftheproposition,
29theboardmaycertifythatseventy-fivepercentoftherevenuegeneratedfromthissourceshall
30beusedtoimplementthesalarysupplementprogramestablishedunderthissection.
31 5.Innocaseshallaschooldistrictusestatefundsreceivedunderthissectionnor
32localrevenuegeneratedfromataxestablishedundersubsection4ofthissectiontocomply
33withtheminimumsalaryrequirementsforteachersestablishedpursuanttosection163.172.
