SectionA.Sections169.560and169.660,RSMo,arerepealedandtwonewsections
2enactedinlieuthereof,tobeknownassections169.560and169.660,toreadasfollows:
169.560.1.BeginningonJanuary1,2026,anypersonretiredandcurrently
2receivingaretirementallowancepursuanttosections169.010to169.141,otherthanfor
3disability,maybeemployedinanycapacityforanemployerincludedintheretirement
4systemcreatedbythosesectionsoneitherapart-timeortemporary-substitutebasisnotto
5exceedatotaloffivehundredfiftyhoursinanyoneschoolyear,andthroughsuch
6employmentmayearnuptofiftypercentoftheannualcompensationpayableunderthe
7employer'ssalaryscheduleforthepositionorpositionsfilledbytheretiree,givensuch
8person'slevelofexperienceandeducation,withoutadiscontinuanceoftheperson's
9retirementallowance.Iftheemployerdoesnotutilizeasalaryschedule,orifthepositionin
10questionisnotsubjecttotheemployer'ssalaryschedule,aretireeemployedinaccordance
11withtheprovisionsofthissubsectionmayearnuptofiftypercentoftheannualcompensation
12paidtothepersonorpersonswholastheldsuchpositionorpositions.Ifthepositionor
13positionsdidnotpreviouslyexist,thecompensationlimitshallbedeterminedinaccordance
14withrulesdulyadoptedbytheboardoftrusteesoftheretirementsystem;providedthat,it
15shallnotexceedfiftypercentoftheannualcompensationpayableforthepositionbythe
16employerthatismostcomparabletothepositionfilledbytheretiree.Inanycasewherea
17retireefillsmorethanonepositionduringtheschoolyear,thefifty-percentlimitonpermitted
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18earningshallbebasedsolelyontheannualcompensationofthehighestpaidposition
19occupiedbytheretireeforatleastone-fifthofthetotalhoursworkedduringtheyear.Sucha
20personshallnotcontributetotheretirementsystemortothepubliceducationemployee
21retirementsystemestablishedbysections169.600to169.715becauseofearningsduringsuch
22periodofemployment.Ifsuchapersonisemployedinanycapacitybysuchanemployerin
23excessofthelimitationssetforthinthissubsection,thepersonshallnotbeeligibletoreceive
24theperson'sretirementallowanceforanymonthduringwhichthepersonissoemployed.In
25addition,suchpersonshallcontributetotheretirementsystemifthepersonsatisfiesthe
26retirementsystem'smembershipeligibilityrequirements.Inadditiontotheconditionsset
27forthabove,thissubsectionshallapplytoanypersonretiredandcurrentlyreceivinga
28retirementallowanceundersections169.010to169.141,otherthanfordisability,whois
29employedbyathirdpartyorisperformingworkasanindependentcontractor,ifsuchperson
30isperformingworkforanemployerincludedintheretirementsystemasatemporaryorlong-
31termsubstituteteacherorinanyotherpositionthatwouldnormallyrequirethatpersontobe
32dulycertificatedunderthelawsgoverningthecertificationofteachersinMissouriifsuch
33personwasemployedbythedistrict.Theretirementsystemmayrequiretheemployer,the
34third-partyemployer,theindependentcontractor,andtheretireesubjecttothissubsectionto
35providedocumentationshowingcompliancewiththissubsection.Ifsuchdocumentationis
36notprovided,theretirementsystemmaydeemtheretireetohaveexceededthelimitations
37providedinthissubsection.
38 2.Notwithstandinganyotherprovisionofthissection,beginningJanuary1,2026,
39anypersonretiredandcurrentlyreceivingaretirementallowanceinaccordancewithsections
40169.010to169.141,otherthanfordisability,maybeemployedbyanemployerincludedin
41theretirementsystemcreatedbythosesectionsinapositionthatdoesnotnormallyrequirea
42personemployedinthatpositiontobedulycertificatedunderthelawsgoverningthe
43certificationofteachersinMissouri,andthroughsuchemploymentmayearnuptosixty
44percentoftheminimumteacher'ssalaryassetforthinsection163.172,withouta
45discontinuanceoftheperson'sretirementallowance.Suchpersonshallnotcontributetothe
46retirementsystemortothepubliceducationemployeeretirementsystemestablishedby
47sections169.600to169.715becauseofearningsduringsuchperiodofemployment,andsuch
48personshallnotearnmembershipserviceforsuchemployment.Theemployer'scontribution
49rateshallbepaidbythehiringemployerintothepubliceducationemployeeretirement
50systemestablishedbysections169.600to169.715.Ifsuchapersonisemployedinany
51capacitybyanemployerinexcessofthelimitationssetforthinthissubsection,theperson
52shallnotbeeligibletoreceivetheperson'sretirementallowanceforanymonthduringwhich
53thepersonissoemployed.Inaddition,suchpersonshallbecomeamemberofandcontribute
54toanyretirementsystemdescribedinthissubsectionifthepersonsatisfiestheretirement

56applytoanypersonretiredandcurrentlyreceivingaretirementallowanceinaccordancewith
57sections169.010to169.141employedbyapubliccommunitycollege.
58 3.BeginningontheeffectivedateofthissectionuntilDecember31,2025,any
59personretiredandcurrentlyreceivingaretirementallowanceundersections169.010to
60169.141,otherthanfordisability,maybeemployedinanycapacityforanemployer
61includedintheretirementsystemcreatedbythosesectionsoneitherapart-timeor
62temporary-substitutebasiswithoutadiscontinuanceoftheperson'sretirement
63allowance.Suchapersonshallnotcontributetotheretirementsystemortothe
64publiceducationemployeeretirementsystemestablishedbysections169.600to169.715
65becauseofearningsduringsuchperiodofemployment.Ifsuchapersonisemployedin
66anycapacitybysuchanemployerinexcessofthelimitationssetforthinthissubsection,
67thepersonshallnotbeeligibletoreceivetheperson'sretirementallowanceforany
68monthduringwhichthepersonissoemployed.Inaddition,suchpersonshall
69contributetotheretirementsystemifthepersonsatisfiestheretirementsystem's
70membershipeligibilityrequirements.Inadditiontotheconditionssetforthabove,this
71subsectionshallapplytoanypersonretiredandcurrentlyreceivingaretirement
72allowanceundersections169.010to169.141,otherthanfordisability,whoisemployed
73byathirdpartyorisperformingworkasanindependentcontractorifsuchpersonis
74performingworkforanemployerincludedintheretirementsystemasatemporaryor
75long-termsubstituteteacherorinanyotherpositionthatwouldnormallyrequirethat
76persontobedulycertificatedunderthelawsgoverningthecertificationofteachersin
77Missouriifsuchpersonwasemployedbythedistrict.Theretirementsystemmay
78requiretheemployer,thethird-partyemployer,theindependentcontractor,andthe
79retireesubjecttothissubsectiontoprovidedocumentationshowingcompliancewith
80thissubsection.Ifsuchdocumentationisnotprovided,theretirementsystemmaydeem
81theretireetohaveexceededthelimitationsprovidedinthissubsection.
169.660.1.OnandafterthefirstdayofJulynextfollowingtheoperativedate,any
2memberwhoissixtyormoreyearsofageandwhohasatleastfiveyearsofcreditable
3service,orwhohasattainedagefifty-fiveandhasatleasttwenty-fiveyearsofcreditable
4service,orwhohasatleastthirtyyearsofcreditableserviceregardlessofagemayretireand
5receivethefullretirementbenefitsbasedonthemember'screditableservice.Amember
6whosecreditableserviceatretirementislessthanfiveyearsshallnotbeentitledtoa
7retirementallowancebutshallbeentitledtoreceivethemember'scontributions.
8 2.BeginningJanuary1,2026,anypersonretiredandcurrentlyreceivinga
9retirementallowancepursuanttosections169.600to169.715,otherthanfordisability,may
10beemployedoneitherapart-timeortemporary-substitutebasisbyadistrictincludedinthe
HB2494	3 11retirementsystemnottoexceedatotaloffivehundredfiftyhoursinanyoneschoolyear,
12withoutadiscontinuanceoftheperson'sretirementallowance.Suchapersonshallnot
13contributetotheretirementsystem,ortothepublicschoolretirementsystemestablishedby
14sections169.010to169.141,becauseofearningsduringsuchperiodofemployment.Ifsuch
15apersonisemployedinanycapacitybysuchadistrictonaregular,full-timebasis,orthe
16person'spart-timeortemporary-substituteserviceinanycapacityexceedsfivehundredfifty
17hoursinanyoneschoolyear,thepersonshallnotbeeligibletoreceivetheperson'sretirement
18allowanceforanymonthduringwhichthepersonissoemployed.
19 3.Thesystemshallpayamonthlyretirementallowanceforthemonthinwhicha
20retiredmemberorbeneficiaryreceivingaretirementallowancedies.
21 4.BeginningontheeffectivedateofthissectionuntilDecember31,2025,any
22personretiredandcurrentlyreceivingaretirementallowanceundersections169.600to
23169.715,otherthanfordisability,maybeemployedoneitherapart-timeortemporary-
24substitutebasisbyadistrictincludedintheretirementsystemwithoutadiscontinuance
25oftheperson'sretirementallowance.Suchapersonshallnotcontributetothe
26retirementsystem,ortothepublicschoolretirementsystemestablishedbysections
27169.010to169.141,becauseofearningsduringsuchperiodofemployment.Ifsucha
28personisemployedinanycapacitybysuchadistrictonaregular,full-timebasis,the
29personshallnotbeeligibletoreceivetheperson'sretirementallowanceforanymonth
30duringwhichthepersonissoemployed.
SectionB.Becauseimmediateactionisnecessarytoremedythecurrentsevere
2shortageofqualifiedteachersinthestateduetoavarietyoffactors,sectionAofthisactis
3deemednecessaryfortheimmediatepreservationofthepublichealth,welfare,peace,and
4safety,andisherebydeclaredtobeanemergencyactwithinthemeaningoftheconstitution,
5andsectionAofthisactshallbeinfullforceandeffectuponitspassageandapproval.
