4systemcreatedbythosesectionsoneitherapart-timeortemporary-substitutebasisnotto 5exceedatotaloffivehundredfiftyhoursinanyoneschoolyear,andthroughsuch 6employmentmayearnuptofiftypercentoftheannualcompensationpayableunderthe 7employer'ssalaryscheduleforthepositionorpositionsfilledbytheretiree,givensuch 8person'slevelofexperienceandeducation,withoutadiscontinuanceoftheperson's 9retirementallowance.Iftheemployerdoesnotutilizeasalaryschedule,orifthepositionin 10questionisnotsubjecttotheemployer'ssalaryschedule,aretireeemployedinaccordance 11withtheprovisionsofthissubsectionmayearnuptofiftypercentoftheannualcompensation 12paidtothepersonorpersonswholastheldsuchpositionorpositions.Ifthepositionor 13positionsdidnotpreviouslyexist,thecompensationlimitshallbedeterminedinaccordance 32dulycertificatedunderthelawsgoverningthecertificationofteachersinMissouriifsuch 33personwasemployedbythedistrict.Theretirementsystemmayrequiretheemployer,the 34third-partyemployer,theindependentcontractor,andtheretireesubjecttothissubsectionto 35providedocumentationshowingcompliancewiththissubsection.Ifsuchdocumentationis 45discontinuanceoftheperson'sretirementallowance.Suchpersonshallnotcontributetothe 46retirementsystemortothepubliceducationemployeeretirementsystemestablishedby 47sections169.600to169.715becauseofearningsduringsuchperiodofemployment,andsuch 48personshallnotearnmembershipserviceforsuchemployment.Theemployer'scontribution 49rateshallbepaidbythehiringemployerintothepubliceducationemployeeretirement 50systemestablishedbysections169.600to169.715.Ifsuchapersonisemployedinany 51capacitybyanemployerinexcessofthelimitationssetforthinthissubsection,theperson 52shallnotbeeligibletoreceivetheperson'sretirementallowanceforanymonthduringwhich 53thepersonissoemployed.Inaddition,suchpersonshallbecomeamemberofandcontribute 54toanyretirementsystemdescribedinthissubsectionifthepersonsatisfiestheretirement HB2494 2 55system'smembershipeligibilityrequirements.Theprovisionsofthissubsectionshallnot 56applytoanypersonretiredandcurrentlyreceivingaretirementallowanceinaccordancewith 57sections169.010to169.141employedbyapubliccommunitycollege. 58 3.BeginningontheeffectivedateofthissectionuntilDecember31,2025,any 59personretiredandcurrentlyreceivingaretirementallowanceundersections169.010to 60169.141,otherthanfordisability,maybeemployedinanycapacityforanemployer 61includedintheretirementsystemcreatedbythosesectionsoneitherapart-timeor 62temporary-substitutebasiswithoutadiscontinuanceoftheperson'sretirement 79retireesubjecttothissubsectiontoprovidedocumentationshowingcompliancewith 80thissubsection.Ifsuchdocumentationisnotprovided,theretirementsystemmaydeem 81theretireetohaveexceededthelimitationsprovidedinthissubsection. 169.660.1.OnandafterthefirstdayofJulynextfollowingtheoperativedate,any 2memberwhoissixtyormoreyearsofageandwhohasatleastfiveyearsofcreditable 3service,orwhohasattainedagefifty-fiveandhasatleasttwenty-fiveyearsofcreditable 4service,orwhohasatleastthirtyyearsofcreditableserviceregardlessofagemayretireand 5receivethefullretirementbenefitsbasedonthemember'screditableservice.Amember 6whosecreditableserviceatretirementislessthanfiveyearsshallnotbeentitledtoa 7retirementallowancebutshallbeentitledtoreceivethemember'scontributions. 8 12withoutadiscontinuanceoftheperson'sretirementallowance.Suchapersonshallnot 13contributetotheretirementsystem,ortothepublicschoolretirementsystemestablishedby 14sections169.010to169.141,becauseofearningsduringsuchperiodofemployment.Ifsuch 15apersonisemployedinanycapacitybysuchadistrictonaregular,full-timebasis,orthe 16person'spart-timeortemporary-substituteserviceinanycapacityexceedsfivehundredfifty 17hoursinanyoneschoolyear,thepersonshallnotbeeligibletoreceivetheperson'sretirement
