Torepealsection306.127,RSMo,andtoenactinlieuthereofonenewsectionrelatingto
boatingsafetyidentificationcards.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section306.127,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection306.127,toreadasfollows:
306.127.1.BeginningJanuary1,2005,everypersonbornafterJanuary1,1984,or
2asrequiredpursuanttosection306.128,whooperatesavesselonthe[lakes] watersofthis
3stateshallpossess,onthevessel,aboatingsafetyidentificationcardissuedbythewater
4patroldivisionoritsagentwhichshowsthatheorshehas:
5 (1)SuccessfullycompletedaboatingsafetycourseapprovedbytheNational
6AssociationofStateBoatingLawAdministratorsandcertifiedbythewaterpatroldivision.
7TheboatingsafetycoursemayincludeacoursesponsoredbytheUnitedStatesCoastGuard
8AuxiliaryortheUnitedStatesPowerSquadron.Thewaterpatroldivisionmayappoint
9agentstoadministeraboatereducationcourseorcourseequivalencyexaminationandissue
10boateridentificationcardsunderguidelinesestablishedbythewaterpatrol.Thewaterpatrol
11divisionshallmaintainalistofapprovedcourses;or
12 (2)Successfullypassedanequivalencyexaminationpreparedbythewaterpatrol
13divisionandadministeredbythewaterpatroldivisionoritsagent.Theequivalency
14examinationshallhaveadegreeofdifficultyequalto,orgreaterthan,thatofthe
15examinationsgivenattheconclusionofanapprovedboatingsafetycourse;or
16 (3)Avalidmaster's,mate's,oroperator'slicenseissuedbytheUnitedStatesCoast
17Guard.
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18 2.Thewaterpatroldivisionoritsagentshallissueapermanentboatingsafety
19identificationcardtoeachpersonwhocomplieswiththerequirementsofthissectionwhichis
20validforlifeunlessinvalidatedpursuanttolaw.
21 3.Thewaterpatroldivisionmaychargeafeeforsuchcardoranyreplacementcard
22thatdoesnotsubstantiallyexceedthecostsofadministratingthissection.Thewaterpatrol
23divisionoritsdesignatedagentshallcollectsuchfees.Thesefundsshallbeforwardedto
24generalrevenue.
25 4.Theprovisionsofthissectionshallnotapplytoanypersonwho:
26 (1)IslicensedbytheUnitedStatesCoastGuardtoserveasmasterofavessel;
27 (2)Operatesavesselonlyonaprivatelakeorpondthatisnotclassifiedaswatersof
28thestate;
29 (3)UntilJanuary1,2006,isanonresidentwhoisvisitingthestateforsixtydaysor
30less;
31 (4)Isparticipatinginaneventorregattaapprovedbythewaterpatrol;
32 (5)Isanonresidentwhohasproofofavalidboatingcertificateorlicenseissuedby
33anotherstateiftheboatingcourseisapprovedbytheNationalAssociationofStateBoating
34LawAdministrators(NASBLA);
35 (6)Isexemptedbyruleofthewaterpatrol;
36 (7)IscurrentlyservinginanybranchoftheUnitedStatesArmedForces,reserves,or
37MissouriNationalGuard,oranyspouseofapersoncurrentlyinsuchservice;or
38 (8)Haspreviouslysuccessfullycompletedaboatingsafetyeducationcourse
39approvedbytheNationalAssociationofStateBoatingLawAdministrators(NASBLA).
40 5.Thewaterpatroldivisionshallinformotherstatesoftherequirementsofthis
41section.
42 6.Noindividualshallbedetainedorstoppedstrictlyforthepurposeofchecking
43whethertheindividualpossessesaboatingsafetyidentificationcardoratemporaryboater
44educationpermit.
45 7.Anypersonorcompanythatrentsorsellsvesselsmayissueatemporaryboating
46safetyidentificationcardtoanindividualtooperatearentedvesseloravesselbeing
47consideredforsale,foraperiodofuptosevendays,providedthattheindividualmeetsthe
48minimumagerequirementsforoperatingavesselinthisstate.Inordertoqualifyforthe
49temporaryboatingsafetyidentificationcard,theapplicantshallprovideavaliddriver's
50licenseandshallsignanaffidavitthatheorshehasreviewedtheMissouristatehighway
51patrolhandbookofMissouriboatinglawsandresponsibilities.Anyindividualholdinga
52validtemporaryboatingsafetyidentificationcardshallbedeemedincompliancewiththe
53requirementsofthissection.TheMissouristatehighwaypatrolshallchargeafeeofnine
54dollarsforsuchtemporaryboatingsafetyidentificationcard.Individualsshallnotbeeligible
HB2503	2 55formorethanonetemporaryboatingsafetyidentificationcard.Nopersonorcompanymay
56issueatemporaryboatingsafetyidentificationcardtoanindividualundertheprovisionsof
57thissubsectionunlesssuchpersonorcompanyiscapableofsubmittingtheapplicant's
58temporaryboatingsafetyidentificationcardinformationandpaymentinanelectronicformat
59asprescribedbytheMissouristatehighwaypatrol.Thebusinessentityissuingatemporary
60boatingsafetyidentificationcardtoanindividualundertheprovisionsofthissubsectionshall
61transmittheapplicant'stemporaryboatingsafetyidentificationcardinformation
62electronicallytotheMissouristatehighwaypatrol,inamannerandformatprescribedby
63thesuperintendent,usinganelectroniconlineregistrationprocessdevelopedandprovidedby
64theMissouristatehighwaypatrol.Theelectroniconlineprocessdevelopedandprovidedby
65theMissouristatehighwaypatrolshallallowtheapplicanttopaythetemporaryboating
66safetyidentificationcardfeebycreditcardordebitcard.Notwithstandinganyprovisionin
67section306.185tothecontrary,allfeescollectedundertheauthorityofthissubsectionshall
68bedepositedinthewaterpatroldivisionfund.TheMissouristatehighwaypatrolshall
69promulgaterulesfordevelopingthetemporaryboatingsafetyidentificationcardandany
70requirementsnecessarytotheissuance,processing,andpaymentofthetemporaryboating
71safetyidentificationcard.TheMissouristatehighwaypatrolshall,byrule,developaboating
72safetychecklistforeachapplicantseekingatemporaryboatingsafetyidentificationcard.
73Nothinginthissubsectionshallallowaholderofatemporaryboatingsafetyidentification
74cardtoreceiveanotationontheperson'sdriver'slicenseornondriveridentificationunder
75section302.184.TheprovisionsofthissubsectionshallexpireonDecember31,2032.
