36eachschoolshallprovidedrinkingwaterwithaleadconcentrationlevelbelowthe
37AmericanAcademyofPediatrics'recommendedmaximumlevelforschoolsofonepart
38perbillioninsufficientamountstomeetthedrinkingwaterneedsofallstudentsand
39staffasprovidedinthissection.
40 4.(1)BeforeJanuary1,2024,eachschoolshall:
41 (a)Conductaninventoryofalldrinkingwateroutletsandnonpotablewater
42fixturesineachoftheschool'sbuildings;
43 (b)RemoveanydrinkingwatercoolersthattheUnitedStatesEnvironmental
44ProtectionAgencyhasdeterminedarenotlead-freeunderthefederalLead
45ContaminationControlActof1988,asamended;
46 (c)Installafilterthatreducesleadindrinkingwateroneachdrinkingwater
47outlet,maintainsuchfilterstoensurethatleadconcentrationlevelsarebelowonepart
48perbillion,andreplacesuchfiltersatleastasfrequentlyasprovidedforinthe
49manufacturer'sinstructions.Thisparagraphshallapplyonlytoschoolswithdrinking
50waterdeterminedtohavealeadconcentrationlevelabovetheAmericanAcademyof
51Pediatrics'recommendedmaximumlevelforschoolsofonepartperbillion;and
52 (d)Uponrequest,providegeneralinformationonthehealtheffectsoflead
53contaminationandadditionalinformationalresourcesforemployeesandparentsof
54childrenateachschool.

56programs,kindergartens,andelementaryschoolstheprioritywhencomplyingwith
57paragraphs(a)to(c)ofsubdivision(1)ofthissubsection.
58 (3)Filtersdescribedinparagraph(c)ofsubdivision(1)ofthissubsectionand
59anyreplacementfiltersshallbecertifiedascompliantwithNSF/ANSI53-2017andshall
60incorporateanintegralperformanceindicationdeviceasspecifiedinsection6.1ofNSF/
61ANSI53-2017.
62 (4)Eachschoolshallprovidesufficientfilteredwatertomeetthedrinkingwater
63needsofallstudentsandstaff.
64 (5)Withinsixtydaysafterfiltersareinstalledasrequiredunderparagraph(c)
65ofsubdivision(1)ofthissubsectionandannuallythereafter,eachschoolshallconduct
66testingforleadbyfirst-drawandfollow-upflushsamplesofarandomsamplingofat
67leasttwenty-fivepercentofremediateddrinkingwateroutletsuntilallremediated
68sourceshavebeentestedasrecommendedbythe2018versionoftheUnitedStates
69EnvironmentalProtectionAgency's"Training,Testing,andTakingAction"program.
70Thetestingshallbeconductedandtheresultsanalyzedforbothtypesoftestsbyan
71entityorentitiesapprovedbythedepartment.
72 (6)Withintwoweeksafterreceivingtestresults,eachschoolshallmakeall
73testingresultsandanyleadremediationplansavailableontheschool'swebsite.
74 (7)Schooldistrictsshallsubmitsuchannualtestingresultstothecommission.
75 (8)Thissubsectionshallnotbeconstruedtopreventaschoolfromconducting
76morefrequenttestingthanrequiredunderthissection.
77 5.(1)Ifafirstdrawsampleshowsaleadconcentrationofonepartperbillionor
78greater,theaffectedschoolshall:
79 (a)Withinonebusinessdayafterreceivingthetestresult,shutoffthedrinking
80wateroutlet;
81 (b)Providebottledwaterifthereisnotenoughwatertomeetthedrinkingwater
82needsofthestudents,teachers,andstaff;and
83 (c)Withinthirtydaysafterreceivingthetestresult,determineinterim
84remediationstepstoimplementtoaddresstheelevatedleadconcentrationlevel.Such
85stepsshallbepostedtotheschoolwebsite.
86 (2)Ifapipe,solder,fitting,orfixtureisreplacedaspartofpermanent
87remediationunderparagraph(d)ofsubdivision(1)ofthissubsection,thereplacement
88shallbelead-free,assuchtermisdefinedin40CFR143.12,asamended.
89 (3)Ifatestresultexceedsonepartperbillion,theaffectedschoolshallcontact
90parentsandstaffviawrittennotificationwithinsevenbusinessdaysafterreceivingthe
91testresult.Thenotificationshallincludeatleast:

93 (b)Adescriptionofanyremedialstepstaken;and
94 (c)Adescriptionofgeneralhealtheffectsofleadcontaminationandcommunity
95specificresources.
96 6.(1)Inadditiontotheapportionmentspayabletoaschooldistrictunder
97chapter163,thedepartmentofnaturalresourcesisherebyauthorizedtoapportionto
98anyschooladditionalfundingforthefiltration,testing,andotherremediationof
99drinkingwatersystemsrequiredunderthissection,subjecttoappropriation.
100 (2)Totheextentpermittedbyfederallaw,aschooldistrictmayseek
101reimbursementorotherfundsforcomplianceincurredunderthissectionunderany
102applicablefederallawincluding,butnotlimitedto,America'sWaterInfrastructureAct
103of2018andtheWaterInfrastructureFinanceandInnovationActof2014,33U.S.C.
104Section3901etseq.
105 (3)Disadvantagedschooldistrictsshallreceivefundingpriorityunderthis
106subsection.
107 7.Thecommission,inconjunctionwiththedepartmentofelementaryand
108secondaryeducation,shallpublishareportbienniallybasedonthefindingsfromthe
109watertestingconductedunderthissection.Suchreportshallbesenttothegovernor
110andthejointcommitteeoneducationandshallbemadeavailableonthewebsiteofthe
111commission.
112 8.Thecommissionshall:
113 (1)OnorbeforeJuly1,2023,provideguidancetoschoolsregardingthe
114maintenanceoffiltersandfiltrationsystemsandthedevelopmentandimplementation
115offlushingplans.Suchguidanceshallincluderecommendationsforflushingafter
116stagnanttimesincluding,butnotlimitedto,themorningofeachschooldayandafter
117weekends,schoolholidays,andsummerbreak.Flushingplansshallincludedetailsfor
118flushingtheincomingwaterlineandthefilter;and
119 (2)OnorbeforeJuly1,2023,createanonlineprogramtoprovidetrainingfor
120custodialstaffonthemaintenanceoffiltersandfiltrationsystemsandonthe
121implementationofflushingplans,emphasizingthatpropermaintenanceiscriticalto
122improveddrinkingwaterqualityandsafety.
123 9.(1)Forpublicschools,thecommissionshallensurecompliancewiththis
124section.Eachschooldistrictshallberesponsibleforensuringcompliancewithineach
125schoolwithintheschooldistrict'sjurisdiction.
126 (2)Thecommissionshallhavetheauthoritytoenteraschoolbuildinggoverned
127bythissectiontodeterminecompliancewiththissection.
HCSHB2532	4 128 10.NoschoolbuildingconstructedafterJanuary4,2014,asprovidedinthe
129federalReductionofLeadinDrinkingWaterAct(42U.S.C.Section300g-6),as
130amended,shallberequiredtoinstall,maintain,orreplacefiltersunderparagraph(c)of
131subdivision(1)ofsubsection4ofthissection.
132 11.Aschoolthattestsanddoesnotfindadrinkingwatersourcewithalead
133concentrationabovetheacceptablelevelasdefinedinsubsection3ofthissectionshall
134berequiredtotestonlyeveryfiveyears.
135 12.Thecommissionmaypromulgateallnecessaryrulesandregulationsforthe
136administrationofthissection.Anyruleorportionofarule,asthattermisdefinedin
137section536.010,thatiscreatedundertheauthoritydelegatedinthissectionshall
138becomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter
139536and,ifapplicable,section536.028.Thissectionandchapter536arenonseverable,
140andifanyofthepowersvestedwiththegeneralassemblypursuanttochapter536to
141review,todelaytheeffectivedate,ortodisapproveandannularulearesubsequently
142heldunconstitutional,thenthegrantofrulemakingauthorityandanyruleproposedor
143adoptedafterAugust28,2022,shallbeinvalidandvoid.
