HB2586 2 33 (4)Anypersonsellingnew,used,orremanufacturedtiresatretailshallaccept,atthe 34pointoftransfer,inaquantityequaltothenumberoftiressold,scraptiresfromcustomers,if 35offeredbysuchcustomers.Anypersonacceptingscraptiresmaychargeareasonablefee 36reflectingthecostofpropermanagementofanyscraptiresaccepted;andwhichtireis 37requiredtobeacceptedonaone-for-onebasisatthetimeofaretailsalepursuanttothis 38subdivision.Alltireretailersorotherbusinessesthatgeneratescraptiresshalluseascraptire 39haulerpermittedbythedepartment,exceptthatbusinessesthatgenerateoracceptscraptires 40inthenormalcourseofbusinessmayhaulsuchscraptireswithoutapermit,ifsuchhaulingis 41performedwithoutanyconsiderationandsuchbusinessmaintainsrecordsonthescraptires 42hauledasrequiredbysections260.270to260.276.Retailersshallnotbeliableforillegal 43disposalofscraptiresaftersuchscraptiresaredeliveredtoascraptirehauler,scraptire 44collectioncenter,scraptiresite,scraptireprocessingfacilityorscraptireend-userfacilityif 45suchentityispermittedbythedepartmentofnaturalresources. 46 (5)Itshallbeunlawfulforanypersontotransportscraptiresforconsiderationwithin 47thestatewithoutapermit. 48 (6)Scraptiresmaynotbedepositedinalandfillunlessthetireshavebeencut, 49chippedorshredded. 50 2.WithinsixmonthsafterAugust28,1990,ownersandoperatorsofanyscraptire 51siteshallprovidethedepartmentofnaturalresourceswithinformationconcerningthesite's 52location,size,andapproximatenumberofscraptiresthathavebeenaccumulatedatthesite 53andshallinitiatestepstocomplywithsections260.270to260.276. 54 3.Thedepartmentofnaturalresourcesshallpromulgaterulesandregulations 55pertainingtocollection,storageandprocessingandtransportationofscraptiresandsuch 56rulesandregulationsshallinclude: 57 (1)Methodsofcollection,storageandprocessingofscraptires.Suchmethodsshall 58considerthegenerallocationofscraptiresbeingstoredwithregardtopropertyboundaries 59andbuildings,pestcontrol,accessibilitybyfire-fightingequipment,andotherconsiderations 60astheyrelatetopublichealthandsafety; 67 (3)Requirementsforperformancebondsorotherformsoffinancialassurancefor 68scraptiresites,scraptireend-userfacilities,andscraptireprocessingfacilities; 69 (4)Exemptionsfromtherequirementsofsections260.270to260.276;and HB2586 3 70 (5)ByJanuary1,1996,requirementsforrecord-keepingproceduresforretailersand 71otherbusinessesthatgeneratescraptires,scraptirehaulers,scraptirecollectioncenters,scrap 72tiresites,scraptireprocessingfacilities,andscraptireend-userfacilities.Requiredrecord 73keepingshallincludethesourceandnumberorweightoftiresreceivedandthedestination 74andnumberoftiresorweightoftiresortirepiecesshippedorotherwisedisposedofandsuch 75recordsshallbemaintainedforatleastthreeyearsfollowingtheendofthecalendaryearof 76suchactivity.Detailedrecordkeepingshallnotberequiredwhereanycharitable,fraternal,or 77othernonprofitorganizationconductsaprogramwhichresultsinthevoluntarycleanupof 78landorwaterresourcesortheturninginofscraptires. 79 4.Whenforfeitureofperformancebondsorotherformsoffinancialassurance 80occurs,forfeitedfundsshallbedepositedintothesolidwasteforfeituresaccount 81postclosurefundasdescribedinsection260.228.Suchforfeitedfundsshallbe 82appropriatedtoandexpendedbythedepartmentforcorrectiveaction,closure,or 83postclosurepurposes.Anyforfeitedfundsfromscraptiresites,scraptireend-user 84facilities,andscraptireprocessingfacilitiescurrentlyheldinthestategeneralrevenue 85fundshallbetransferredtothesolidwasteforfeituresaccountpostclosurefund. 86 5.Permitfeesforscraptiresitesandcommercialscraptirehaulersshallbe 87establishedbyruleandshallnotexceedthecostofadministeringsections260.270to 88260.275.Permitfeesshallbedepositedintoanappropriatesubaccountofthesolidscrap 89managementfund. 90 [5.]6.Thedepartmentshall: 91 (1)Encouragethevoluntaryestablishmentofscraptirecollectioncentersatretailtire 92sellingbusinessesandscraptireprocessingfacilities;and 93 (2)Investigate,locateanddocumentexistingsiteswheretireshavebeenorcurrently 94arebeingaccumulated,andinitiateeffortstobringthesesitesintocompliancewithrulesand 95regulationspromulgatedpursuanttotheprovisionsofsections260.270to260.276. 96 [6.]7.Anypersonlicensedasanautodismantlerandsalvagedealerunderchapter 97301maywithoutfurtherlicense,permitorpaymentoffee,storebutshallnotburyon[his] 98suchperson'sproperty,uptofivehundredscraptiresthathavebeenchipped,cutor 99shredded,ifsuchtiresareonlyfromvehiclesacquiredby[him] suchperson, andsuchtires 100arestoredinaccordancewiththerulesandregulationsadoptedbythedepartmentpursuantto 101thissection.Anytireretailerorwholesalermayholdmorethanfivehundredscraptiresfora 102periodnottoexceedthirtydayswithoutbeingpermittedasascraptiresite,ifsuchtiresare 103storedinamannerwhichprotectshumanhealthandtheenvironmentpursuanttoregulations 104adoptedbythedepartment. 105 [7.]8.Notwithstandinganyotherprovisionsofsections260.270to260.276,aperson 106wholeasesorownsrealpropertymayusescraptiresforsoilerosionabatementanddrainage HB2586 4 107purposesinaccordancewithproceduresapprovedbythedepartment,ortosecurecoversover 108silage,hay,straworagriculturalproducts. 109 [8.]9.Thedepartmentoftransportationshall,beginningJuly1,1991,undertake,as 110partofitscurrentlyscheduledhighwayimprovementprojects,demonstrationprojectsusing 111recoveredrubberfromscraptiresassurfacingmaterial,structuralmaterial,subbasematerial 112andfill,consistentwithstandardengineeringpractices.Thedepartmentshallevaluatethe 113efficacyofusingrecoveredrubberinhighwayimprovements,andshallencouragethe 114modificationofroadconstructionspecifications,whenpossible,fortheuseofrecovered 115rubberinhighwayimprovementprojects. 116 [9.]10.Thedirectormayrequestaprosecutingattorneytoinstituteaprosecutionfor 117anyviolationofthissection.Inaddition,theprosecutorofanycountyorcircuitattorneyof 118anycitynotwithinacountymay,byinformationorindictment,instituteaprosecutionforany 119violationofthissection. ✔ HB2586 5
