HCSHB2597 3 90 10.Nolessthansixtydaysbeforethedateoffinaldischarge,thedivisionshallnotify 91thesentencingcourt,theboard,and,forprobationcases,thecircuitorprosecutingattorneyof 92theimpendingdischarge.Ifthesentencingcourt,theboard,orthecircuitorprosecuting 93attorneyuponreceivingsuchnoticedoesnottakeanyactionundersubsection5ofthis 94section,theoffendershallbedischargedundersubsection7ofthissection. 95 11.AnyoffenderwhowassentencedpriortoJanuary1,2017,toanoffensethatwas 96eligibleforearnedcompliancecreditsundersubsection1or2ofthissectionatthetimeof 97sentencingshallcontinuetoremaineligibleforearnedcompliancecreditssolongasthe 98offendermeetsalltheotherrequirementsprovidedunderthissection. 99 12.Theapplicationofearnedcompliancecreditsshallbesuspendeduponentryintoa 100treatmentcourt,asdescribedinsections478.001to478.009,andshallremainsuspendeduntil 101theoffenderisdischargedfromsuchtreatmentcourt.Uponsuccessfulcompletionof 102treatmentcourt,allearnedcompliancecreditsaccumulatedduringthesuspensionperiodshall 103beretroactivelyapplied,solongastheothertermsandconditionsofprobationhavebeen 104successfullycompleted. 559.036.1.Atermofprobationcommencesonthedayitisimposed.Multipleterms 2ofMissouriprobation,whetherimposedatthesametimeoratdifferenttimes,shallrun 3concurrently.Termsofprobationshallalsorunconcurrentlywithanyfederalorotherstate 4jail,prison,probationorparoletermforanotheroffensetowhichthedefendantisorbecomes 5subjectduringtheperiod[, unlessotherwisespecifiedbytheMissouricourt]. 6 2.Thecourtmayterminateaperiodofprobationanddischargethedefendantatany 7timebeforecompletionofthespecifictermfixedundersection559.016ifwarrantedbythe 8conductofthedefendantandtheendsofjustice.Thecourtmayextendthetermofthe 9probation,butnomorethanoneextensionofanyprobationmaybeorderedexceptthatthe 10courtmayextendthetermofprobationbyoneadditionalyearbyorderofthecourtifthe 11defendantadmitsheorshehasviolatedtheconditionsofprobationorisfoundbythecourtto 12haveviolatedtheconditionsofhisorherprobation.Totaltimeonanyprobationterm, 13includinganyextensionshallnotexceedthemaximumtermestablishedinsection559.016. 14Totaltimeonanyprobationtermshallnotincludetimewhentheprobationtermis 15suspendedunderthissection.Proceduresfortermination,dischargeandextensionmaybe 16establishedbyruleofcourt. 17 3.Ifthedefendantviolatesaconditionofprobationatanytimepriortotheexpiration 18orterminationoftheprobationterm,thecourtmaycontinuehimorherontheexisting 19conditions,withorwithoutmodifyingorenlargingtheconditionsorextendingtheterm. 20 4.(1)Unlessthedefendantconsentstotherevocationofprobation,ifacontinuation, 21modification,enlargementorextensionisnotappropriateunderthissection,thecourtshall HCSHB2597 4 22orderplacementoftheoffenderin[oneofthe]adepartmentofcorrections'onehundred 23twenty-day[programs] programsolongas: 24 (a)TheunderlyingoffensefortheprobationisaclassDorEfelonyoranoffense 25listedinchapter579oranoffensepreviouslylistedinchapter195;exceptthat,thecourtmay, 26uponitsownmotionoramotionoftheprosecutingorcircuitattorney,makeafindingthatan 27offenderisnoteligibleiftheunderlyingoffenseisinvoluntarymanslaughterinthesecond 28degree,stalkinginthefirstdegree,assaultintheseconddegree,sexualassault,rapeinthe 29seconddegree,domesticassaultintheseconddegree,assaultinthethirddegreewhenthe 30victimisaspecialvictim,statutoryrapeintheseconddegree,statutorysodomyinthesecond 31degree,deviatesexualassault,sodomyintheseconddegree,sexualmisconductinvolvinga 32child,incest,endangeringthewelfareofachildinthefirstdegreeundersubdivision(1)or(2) 33ofsubsection1ofsection568.045,abuseofachild,invasionofprivacy,anycaseinwhich 34thedefendantisfoundguiltyofafelonyoffenseunderchapter571,oranoffenseof 35aggravatedstalkingorassaultofalawenforcementofficerintheseconddegreeassuch 36offensesexistedpriortoJanuary1,2017; 37 (b)Theprobationviolationisnottheresultofthedefendantbeinganabsconderor 38beingfoundguiltyof,pleadingguiltyto,orbeingarrestedonsuspicionofanyfelony, 39misdemeanor,orinfraction.Forpurposesofthissubsection,"absconder"shallmeanan 40offenderundersupervisionwhohasleftsuchoffender'splaceofresidencywithoutthe 41permissionoftheoffender'ssupervisingofficerforthepurposeofavoidingsupervision; 42 (c)Thedefendanthasnotviolatedanyconditionsofprobationinvolvingthe 43possessionoruseofweapons,orastay-awayconditionprohibitingthedefendantfrom 44contactingacertainindividual;and 45 (d)Thedefendanthasnotalreadybeenplacedinoneoftheprogramsbythecourtfor 46thesameunderlyingoffenseorduringthesameprobationterm. 47 (2)Uponreceivingtheorder,thedepartmentofcorrectionsshallconductan 48assessmentoftheoffenderandplacesuchoffenderineitherthe[appropriate] onehundred 49twenty-daystructuredcognitivebehavioralinterventionprogram[undersubsection3of 50section559.115]ortheonehundredtwenty-dayinstitutionaltreatmentprogram. The 51placementoftheoffenderinthestructuredcognitivebehavioralinterventionprogram 52orinstitutionaltreatmentprogramshallbeatthesolediscretionofthedepartment 53basedontheassessmentoftheoffender.Theprogramshallbeginuponreceiptofthe 54offenderbythedepartment.Thetimebetweenthecourt'sorderandreceiptofthe 55offenderbythedepartmentshallnotapplytowardtheprogram. 56 (3)[Notwithstandinganyoftheprovisionsofsubsection3ofsection559.115tothe 57contrary,oncethedefendanthassuccessfullycompletedtheprogramunderthissubsection, 58thecourtshallreleasethedefendanttocontinuetoservethetermofprobation,whichshall HCSHB2597 5 59notbemodified,enlarged,orextendedbasedonthesameincidentofviolation.] Upon 60successfulcompletionofaprogramunderthissubsection,asdeterminedbythe 61department,thedivisionofprobationandparoleshalladvisethesentencingcourtofthe 62defendant'sprobationaryreleasedatethirtydayspriortorelease.Oncethedefendant 63hassuccessfullycompletedaprogramunderthissubsection,thecourtshallreleasethe 64defendanttocontinuetoservethetermofprobation,whichshallnotbemodified, 65enlarged,orextendedbasedonthesameincidentofviolation. 66 (4)Ifthedepartmentdeterminesthedefendanthasnotsuccessfullycompleteda 67onehundredtwenty-dayprogramunderthissection,thedivisionofprobationand 68paroleshalladvisetheprosecutingattorneyandthesentencingcourtofthedefendant's 69unsuccessfulprogramexitandthedefendantshallberemovedfromtheprogram.The 70defendantshallbereleasedfromthedepartmentwithintenworkingdaysafterthecourt 71isnotifiedoftheunsuccessfulprogramexit,unlessthecourthasissuedawarrantin 72responsetotheunsuccessfulprogramexittofacilitatethereturnofthedefendanttothe 73countyofjurisdictionforfurthercourtproceedings.Ifadefendantisdischargedas 74unsuccessfulfromaonehundredtwenty-dayprogram,thesentencingcourtmay 75modify,enlarge,orrevokethedefendant'sprobationbasedonthesameincidentofthe 76violation. 77 (5)Timeservedintheprogramshallbecreditedastimeservedonanysentence 78imposedfortheunderlyingoffense. 79 5.Ifthedefendantconsentstotherevocationofprobationorifthedefendantisnot 80eligibleundersubsection4ofthissectionforplacementinaprogramandacontinuation, 81modification,enlargement,orextensionofthetermunderthissectionisnotappropriate,the 82courtmayrevokeprobationandorderthatanysentencepreviouslyimposedbeexecuted.If 83impositionofsentencewassuspended,thecourtmayrevokeprobationandimposeany 84sentenceavailableundersection557.011.Thecourtmaymitigateanysentenceof 85imprisonmentbyreducingtheprisonorjailtermbyallorpartofthetimethedefendantwas 86onprobation.Thecourtmay,uponrevocationofprobation,placeanoffenderonasecond 87termofprobation.Suchprobationshallbeforatermofprobationasprovidedbysection 88559.016,notwithstandinganyamountoftimeservedbytheoffenderonthefirsttermof 89probation. 90 6.Probationshallnotberevokedwithoutgivingtheprobationernoticeandan 91opportunitytobeheardontheissuesofwhethersuchprobationerviolatedaconditionof 92probationand,ifaconditionwasviolated,whetherrevocationiswarrantedunderallthe 93circumstances.Notlessthanfivebusinessdayspriortothedatesetforahearingonthe 94violation,exceptforagoodcauseshown,thejudgeshallinformtheprobationerthatheorshe 95mayhavetherighttorequesttheappointmentofcounseliftheprobationerisunabletoretain HCSHB2597 6 96counsel.Iftheprobationerrequestscounsel,thejudgeshalldeterminewhethercounselis 97necessarytoprotecttheprobationer'sdueprocessrights.Ifthejudgedeterminesthatcounsel 98isnotnecessary,thejudgeshallstatethegroundsforthedecisionintherecord. 99 7.Theprosecutingorcircuitattorneymayfileamotiontorevokeprobationoratany 100timeduringthetermofprobation,thecourtmayissueanoticetotheprobationertoappearto 101answerachargeofaviolation,andthecourtmayissueawarrantofarrestfortheviolation. 102Suchnoticeshallbepersonallyservedupontheprobationer.Thewarrantshallauthorizethe 103returnoftheprobationertothecustodyofthecourtortoanysuitabledetentionfacility 104designatedbythecourt.Uponthefilingoftheprosecutor'sorcircuitattorney'smotionoron 105thecourt'sownmotion,thecourtmayimmediatelyenteranordersuspendingtheperiodof 106probationandmayorderawarrantforthedefendant'sarrest.Theprobationshallremain 107suspendeduntilthecourtrulesontheprosecutor'sorcircuitattorney'smotion,oruntilthe 108courtotherwiseorderstheprobationreinstated.Notwithstandinganyotherprovisionof 109thelaw,theprobationtermshallbetolledduringthetimeperiodwhentheprobationis 110suspendedunderthissection.Thecourtmaygranttheprobationercreditonthe 111probationtermforanyofthetolledperiodwhenreinstatingtheprobationterm. 112 8.Thepowerofthecourttorevokeprobationshallextendforthedurationoftheterm 113ofprobationdesignatedbythecourtandforanyfurtherperiodwhichisreasonablynecessary 114fortheadjudicationofmattersarisingbeforeitsexpiration,providedthatsomeaffirmative 115manifestationofanintenttoconductarevocationhearingoccurspriortotheexpirationofthe 116periodandthateveryreasonableeffortismadetonotifytheprobationerandtoconductthe 117hearingpriortotheexpirationoftheperiod.Ifthedelayofthehearingisattributableto 118theprobationer'sactionsortheprobationerotherwiseconsentsoracquiescestothe 119delay,thecourtshallhavebeenfoundtohavemadeeveryreasonableefforttoconduct 120thehearingwithintheprobationterm. 121 9.AdefendantwhowassentencedpriortoJanuary1,2017toanoffensethatwas 122eligibleatthetimeofsentencingunderparagraph(a)ofsubdivision(1)ofsubsection4ofthis 123sectionforthecourtordereddetentionsanctionshallcontinuetoremaineligibleforthe 124sanctionsolongasthedefendantmeetsalltheotherrequirementsprovidedundersubsection 1254ofthissection. 559.115.1.Neitherprobationnorparoleshallbegrantedbythecircuitcourtbetween 2thetimethetranscriptonappealfromtheoffender'sconvictionhasbeenfiledinappellate 3courtandthedispositionoftheappealbysuchcourt. 4 2.Unlessotherwiseprohibitedbysubsection8ofthissection,acircuitcourtonly 5uponitsownmotionandnotthatofthestateortheoffendershallhavethepowertogrant 6probationtoanoffenderanytimeuptoonehundredtwentydaysaftersuchoffenderhasbeen 7deliveredtothedepartmentofcorrectionsbutnotthereafter.Thecourtmayrequest HCSHB2597 7 8informationandarecommendationfromthedepartmentconcerningtheoffenderandsuch 9offender'sbehaviorduringtheperiodofincarceration.Exceptasprovidedinthissection,the 10courtmayplacetheoffenderonprobationinaprogramcreatedpursuanttosection217.777, 11ormayplacetheoffenderonprobationwithanyotherconditionsauthorizedbylaw. 12 3.Thecourtmayrecommendplacementofanoffenderinadepartmentofcorrections 13onehundredtwenty-dayprogramunderthissubsection[orordersuchplacementunder 14subsection4ofsection559.036]. [Upontherecommendationororderofthecourt,] The 15departmentofcorrectionsshallassesseachoffendertodeterminetheappropriateonehundred 16twenty-dayprograminwhichtoplacetheoffender,whichmayincludeplacementinthe 17[shockincarceration] structuredcognitivebehavioralinterventionprogramorinstitutional 18treatmentprogram.Theplacementofanoffenderinthestructuredcognitivebehavioral 19interventionprogramorinstitutionaltreatmentprogramshallbeatthesolediscretion 20ofthedepartmentbasedontheassessmentoftheoffenderandavailablebedspace. 21Whenthecourtrecommendsandreceivesplacementofanoffenderinadepartmentof 22correctionsonehundredtwenty-dayprogram,theoffendershallbereleasedonprobationif 23thedepartmentofcorrectionsdeterminesthattheoffenderhassuccessfullycompletedthe 24programexceptasfollows.Uponsuccessfulcompletionofaprogramunderthissubsection, 25thedivisionofprobationandparoleshalladvisethesentencingcourtofanoffender's 26probationaryreleasedatethirtydayspriortorelease.Thecourtshallfollowthe 27recommendationofthedepartmentunlessthecourtdeterminesthatprobationisnot 28appropriate.Ifthecourtdeterminesthatprobationisnotappropriate,thecourtmayorderthe 29executionoftheoffender'ssentenceonlyafterconductingahearingonthematterwithin 30ninetytoonehundredtwentydaysfromthedatetheoffenderwasdeliveredtothedepartment 31ofcorrections.Ifthedepartmentdeterminestheoffenderhasnotsuccessfullycompleteda 32onehundredtwenty-dayprogramunderthissubsection,the[offendershallberemovedfrom 33theprogramandthecourtshallbeadvisedoftheremoval.] divisionofprobationandparole 34shalladvisetheprosecutingattorneyandthesentencingcourtofthedefendant's 35unsuccessfulprogramexitandthedefendantshallberemovedfromtheprogram.The 36departmentshallreportontheoffender'sparticipationintheprogramandmayprovide 37recommendationsfortermsandconditionsofanoffender'sprobation.Thecourtshallthen 38havethepowertograntprobationorordertheexecutionoftheoffender'ssentence. 39 4.Ifthecourtisadvisedthatanoffenderisnoteligibleforplacementinaone 40hundredtwenty-dayprogramundersubsection3ofthissection,thecourtshallconsiderother 41authorizeddispositions.Ifthedepartmentofcorrectionsonehundredtwenty-dayprogram 42undersubsection3ofthissectionisfull,thecourtmayplacetheoffenderinaprivateprogram 43approvedbythedepartmentofcorrectionsorthecourt,theexpensesofsuchprogramtobe 44paidbytheoffender,orinanavailableprogramofferedbyanotherorganization.Ifthe HCSHB2597 8 45offenderisconvictedofaclassC,classD,orclassEnonviolentfelony,thecourtmayorder 46probationwhileawaitingappointmenttotreatment. 47 5.Exceptwhentheoffenderhasbeenfoundtobeapredatorysexualoffender 48pursuanttosection566.125,thecourtshallrequestthedepartmentofcorrectionstoconducta 49sexualoffenderassessmentifthedefendanthasbeenfoundguiltyofsexualabusewhen 50classifiedasaclassBfelony.Uponcompletionoftheassessment,thedepartmentshall 51providetothecourtareportontheoffenderandmayproviderecommendationsfortermsand 52conditionsofanoffender'sprobation.Theassessmentshallnotbeconsideredaonehundred 53twenty-dayprogramasprovidedundersubsection3ofthissection.Theprocessforgranting 54probationtoanoffenderwhohascompletedtheassessmentshallbeasprovidedunder 55subsections2and6ofthissection. 56 6.Unlesstheoffenderisbeinggrantedprobationpursuanttosuccessfulcompletionof 57aonehundredtwenty-dayprogramthecircuitcourtshallnotifythestateinwritingwhenthe 58courtintendstograntprobationtotheoffenderpursuanttotheprovisionsofthissection.The 59statemay,inwriting,requestahearingwithintendaysofreceiptofthecourt'snotification 60thatthecourtintendstograntprobation.Uponthestate'srequestforahearing,thecourtshall 61grantahearingassoonasreasonablypossible.Ifthestatedoesnotrespondtothecourt's 62noticeinwritingwithintendays,thecourtmayproceeduponitsownmotiontogrant 63probation. 64 7.Anoffender'sfirstincarcerationunderthissectionpriortoreleaseonprobation 65shallnotbeconsideredapreviousprisoncommitmentforthepurposeofdetermininga 66minimumprisontermundertheprovisionsofsection558.019. 67 8.Notwithstandinganyotherprovisionoflaw,probationmaynotbegrantedpursuant 68tothissectiontooffenderswhohavebeenconvictedofmurderintheseconddegreepursuant 69tosection565.021;forciblerapepursuanttosection566.030asitexistedpriortoAugust28, 702013;rapeinthefirstdegreeundersection566.030;forciblesodomypursuanttosection 71566.060asitexistedpriortoAugust28,2013;sodomyinthefirstdegreeundersection 72566.060;statutoryrapeinthefirstdegreepursuanttosection566.032;statutorysodomyin 73thefirstdegreepursuanttosection566.062;childmolestationinthefirstdegreepursuantto 74section566.067whenclassifiedasaclassAfelony;abuseofachildpursuanttosection 75568.060whenclassifiedasaclassAfelony;oranoffenderwhohasbeenfoundtobea 76predatorysexualoffenderpursuanttosection566.125;anyoffenseundersection557.045; 77oranyoffenseinwhichthereexistsastatutoryprohibitionagainsteitherprobationorparole. HCSHB2597 9 5 2.Thedepartmentofcorrectionsshallestablishbyregulationthe 6 "MissouriPostconvictionDrugTreatmentProgram".Theprogramshall 7 includenoninstitutionalandinstitutionalplacement.Theinstitutionalphaseof 8 theprogrammayincludeanyoffenderunderthesupervisionandcontrolofthe 9 departmentofcorrections.Thedepartmentshallestablishrulesdetermining 10 how,whenandwhereanoffendershallbeadmittedintoorremovedfromthe 11 program. 12 3.Anyfirst-timeoffenderwhohasbeenfoundguiltyofviolatingthe 13 provisionsofchapter195or579,orwhosecontrolledsubstanceabusewasa 14 precipitatingorcontributingfactorinthecommissionofhisoffense,andwho 15 isplacedonprobationmayberequiredtoparticipateinthenoninstitutional 16 phaseoftheprogram,whichmayincludeeducation,treatmentand 17 rehabilitationprograms.Personsrequiredtoattendaprogrampursuantto 18 thissectionmaybechargedareasonablefeetocoverthecostsoftheprogram. 19 Failureofanoffendertocompletesuccessfullythenoninstitutionalphaseof 20 theprogramshallbesufficientcausefortheoffendertoberemandedtothe 21 sentencingcourtforassignmenttotheinstitutionalphaseoftheprogramor 22 anyotherauthorizeddisposition. 23 4.Aprobationershallbeeligibleforassignmenttotheinstitutional 24 phaseofthepostconvictiondrugtreatmentprogramifhehasfailedto 25 completesuccessfullythenoninstitutionalphaseoftheprogram.Ifspaceis 26 available,thesentencingcourtmayassigntheoffendertotheinstitutional 27 phaseoftheprogramasaspecialconditionofprobation,withoutthenecessity 28 offormalrevocationofprobation. 29 5.Theavailabilityofspaceintheinstitutionalprogramshallbe 30 determinedbythedepartmentofcorrections.Ifthesentencingcourtisadvised 31 thatthereisnospaceavailable,thenthecourtshallconsiderotherauthorized 32 dispositions. 33 6.Anytimeafterninetydaysandpriortoonehundredtwentydays 34 afterassignmentoftheoffendertotheinstitutionalphaseoftheprogram,the 35 departmentshallsubmittothecourtareportoutliningtheperformanceofthe 36 offenderintheprogram.Ifthedepartmentdeterminesthattheoffenderwill 37 notparticipateorhasfailedtocompletetheprogram,thedepartmentshall 38 advisethesentencingcourt,whoshallcausetheoffendertobebroughtbefore 39 thecourtforconsiderationofrevocationoftheprobationorotherauthorized 40 disposition.Iftheoffendersuccessfullycompletestheprogram,the 41 departmentshallreleasetheindividualtotheappropriateprobationand 42 paroledistrictofficeandsoadvisethecourt. 43 7.Timespentintheinstitutionalphaseoftheprogramshallcountas 44 timeservedonthesentence.] ✔ HCSHB2597 10
