ThisbillrepealstheexistingMissouriPostconviction Drug
TreatmentProgram,butauthorizestheMissouriDepartmentof
Correctionstodetermineifoffendersshouldbeeligibleforeither
astructuredcognitivebehavioralinterventionprogramoran
institutionaltreatmentprogram. Theseprogramslast120daysand
uponsuccessfulcompletion,anoffendermaybereleasedtocontinue
toserveprobation. Termsofprobationarenotmodifiedbythe
bill.
IftheDepartmentdeterminesthatanoffenderhasnotcompleteda
program,thenitprovidesnoticetotheprosecutingattorneyand
sentencingcourtwhichhave10daystoissueawarrantorarrange
forfurthercourtproceedingsbeforereleaseofanoffender. The
sentencingcourtmaymodify,enlarge,orrevokeprobationbasedon
failuretocompleteaprogram.
