160.2700.Forpurposesofsections160.2700to160.2725,"adulthighschool"means
2aschoolthat:
3 (1)Isforindividualswhodonothaveahighschooldiplomaandwhoaretwenty-one
4yearsofageorolder;
5 (2)Offersanindustrycertificationprogramorprogramsandahighschooldiplomain
6amannerthatallowsstudentstoearnadiplomaatthesametimethattheyearnanindustry
7certification;
8 (3)Offers[on-site] childcareforchildrenofenrolledstudentsattendingtheschool;
9and
10 (4)Isnoteligibletoreceivefundingundersection160.415or163.031.
160.2705.1.Thedepartmentofelementaryandsecondaryeducationshallauthorize
2beforeJanuary1,2018,aMissouri-basednonprofitorganizationmeetingthecriteriaunder
3subsection2ofthissectiontoestablishandoperatefouradulthighschools,with:
4 (1)Oneadulthighschooltobelocatedinacitynotwithinacounty;
5 (2)Oneadulthighschooltobelocatedinacountyofthethirdclassificationwithouta
6townshipformofgovernmentandwithmorethanforty-onethousandbutfewerthanforty-
7fivethousandinhabitantsoracountycontiguoustothatcounty;
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 8 (3)Oneadulthighschooltobelocatedinacountyofthefirstclassificationwith
9morethantwohundredsixtythousandbutfewerthanthreehundredthousandinhabitantsora
10countycontiguoustothatcounty;and
11 (4)Oneadulthighschooltobelocatedinacountyofthefirstclassificationwith
12morethanonehundredfiftythousandbutfewerthantwohundredthousandinhabitants.
13 2.Thedepartmentofelementaryandsecondaryeducationshallgrantthe
14authorizationdescribedundersubsection1ofthissectionbasedonabidprocess
15conductedinaccordancewiththerulesandregulationsgoverningpurchasingthroughthe
16officeofadministration.Thesuccessfulbiddershall:
17 (1)Demonstratetheabilitytoestablish,withintwenty-onemonthsofthereceiptof
18theauthorization,fouradulthighschoolsofferinghighschooldiplomas,anindustry
19certificationprogramorprograms,and[on-site] childcareforchildrenofthestudents
20attendingthehighschools;
21 (2)Commitatleasttwomilliondollarsininvestmentforthepurposeofestablishing
22thenecessaryinfrastructuretooperatefouradulthighschools;
23 (3)Demonstratesubstantialandpositiveexperienceinprovidingservices,including
24industrycertificationsandjobplacementservices,toadultstwenty-oneyearsofageorolder
25whoseeducationalandtrainingopportunitieshavebeenlimitedbyeducationaldisadvantages,
26disabilities,homelessness,criminalhistory,orsimilarcircumstances;
27 (4)Establishapartnershipwithastate-supportedpostsecondaryeducationinstitution
28ormorethanonesuchpartnership,ifapartnershiporpartnershipsarenecessaryinorderto
29meettherequirementsforanadulthighschool;
30 (5)Establishacomprehensiveplanthatsetsforthhowtheadulthighschoolswillhelp
31addresstheneedforasufficientlytrainedworkforceinthesurroundingregionforeachadult
32highschool;
33 (6)Establishpartnershipsandstrategiesforengagingthecommunityandbusiness
34leadersincarryingoutthegoalsofeachadulthighschool;
35 (7)Establishtheabilitytomeetqualitystandardsthroughcertifiedteachersand
36programsthatsupporteachstudentinhisorhergoaltofindamorerewardingjob;
37 (8)Establishaplanforassistingstudentsinovercomingbarrierstoeducational
38successincluding,butnotlimitedto,educationaldisadvantages,homelessness,criminal
39history,disability,includinglearningdisabilitysuchasdyslexia,andsimilarcircumstances;
40 (9)Establishaprocessfordeterminingoutcomesoftheadulthighschool,including
41outcomesrelatedtoastudent'sabilitytofindamorerewardingjobthroughtheattainmentof
42ahighschooldiplomaandjobtrainingandcertification;and
43 (10)Bidsshallnotincludeanadministrativefeegreaterthantenpercent.
HCSHB2618&2492	2 44 3.(1)Thedepartmentofelementaryandsecondaryeducationshallestablish
45academicrequirementsforstudentstoobtainhighschooldiplomas.
46 (2)Requirementsforahighschooldiplomashallbebasedonanadultstudent'sprior
47highschoolachievementandtheremainingcreditsandcourseworkthatwouldbenecessary
48forthestudenttoreceiveahighschooldiplomaifheorshewereinatraditionalhighschool
49setting.Theadultstudentshallmeettherequirementswiththesamelevelofacademicrigor
50aswouldotherwisebenecessarytoattainsuchcredits.
51 (3)Theadulthighschoolauthorizedunderthissectionshallawardhighschool
52diplomastostudentswhosuccessfullymeettheestablishedacademicrequirements.The
53adulthighschoolauthorizedunderthissectionshallconferthediplomaasthoughthestudent
54earnedthediplomaatatraditionalhighschool.Thediplomashallhavenodifferentiating
55marks,titles,orothersymbols.
56 (4)Studentsatadulthighschoolsmaycompleterequiredcourseworkattheirown
57paceandasavailablethroughtheadulthighschool.Theyshallnotberequiredtosatisfyany
58specificnumberofclassminutes.Theadulthighschoolmayalsomakeclassesavailableto
59studentsonlineasmaybeappropriate.However,studentsshallnotcompletethemajorityof
60instructionoftheschool'scurriculumonlineorthroughremoteinstruction.Forthepurposes
61ofthissubsection,synchronousinstructionconnectingstudentstoaliveclassconducted
62inaMissouriadulthighschoolshallbetreatedthesameasin-personinstruction.
63 (5)Thedepartmentofelementaryandsecondaryeducationshallnotcreateadditional
64regulationsorburdensontheadulthighschoolorthestudentsattendingtheadulthigh
65schoolsbeyondcertifyingnecessarycreditsandensuringthatstudentshavesufficiently
66masteredthesubjectmattertomakethemeligibleforcredit.
67 4.Anadulthighschoolshallbedeemeda"secondaryschoolsystem"forthe
68purposesofsubdivision(15)ofsubsection1ofsection210.211.
