Toamendchapter324,RSMo,byaddingtheretoonenewsectionrelatingtoanexemption
fromlicensurerequirementsforcertainpersons,withanemergencyclause.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Chapter324,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection324.1450,toreadasfollows:
324.1450.1.Forpurposesofthissection,theterm"licensingauthority"means
2anyboard,commission,committee,council,orofficewithinthedivisionofprofessional
3registrationthatissueslicenses.
4 2.Notwithstandingtheprovisionsofanyothersection,anypersonwhoholdsa
5validcurrentlicenseissuedbyanotherstate,aterritoryoftheUnitedStates,orthe
6DistrictofColumbiathatallowsthepersontopracticeanoccupationorprofessionfor
7whichlicensureisrequiredinthisstatebyalicensingauthorityshallbeexemptfromthe
8licensurerequirementsofthelicensingauthorityif:
9 (1)ThepersonisanactivedutyorreservememberoftheArmedForcesofthe
10UnitedStates,amemberoftheNationalGuard,acivilianemployeeoftheUnitedStates
11DepartmentofDefense,anauthorizedpersonalservicescontractorunder10U.S.C.
12Section1091,oraprofessionalotherwiseauthorizedbytheUnitedStatesDepartmentof
13Defense;
14 (2)Thepersonpracticesthesameoccupationorprofessioninthisstateatthe
15samepracticelevelforwhichthepersonholdshisorhercurrentlicense;and
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 16 (3)Theperson'spracticeofhisorheroccupationorprofessioninthisstateis
17onlythroughapartnershipwiththefederalInnovativeReadinessTrainingprogram
18withintheUnitedStatesDepartmentofDefense.
19 3.Theexemptionprovidedinthissectionshallnotallowthepersontoengagein
20hisorheroccupationorprofessioninthisstate,exceptaspartofthefederalInnovative
21ReadinessTrainingprogramwithintheUnitedStatesDepartmentofDefense.The
22exemptionappliesonlyif:
23 (1)Thepracticeoftheperson'soccupationorprofessionisrequiredbythe
24federalInnovativeReadinessTrainingprogramundermilitaryorders;and
25 (2)Theservicesprovidedbythepersonarewithinthescopeofpracticeforthe
26person'soccupationorprofessioninthisstate.
SectionB.Becauseimmediateactionisnecessarytoensurethatpersonsareableto
2effectivelyserveintheInnovativeReadinessTrainingprogram,theenactmentofsection
3324.1450ofsectionAofthisactisdeemednecessaryfortheimmediatepreservationofthe
4publichealth,welfare,peace,andsafety,andisherebydeclaredtobeanemergencyactwithin
5themeaningoftheconstitution,andtheenactmentofsection324.1450ofsectionAofthisact
6shallbeinfullforceandeffectuponitspassageandapproval.
