BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Sections160.518,160.545,161.092,163.023,168.021,and168.110, 2RSMo,arerepealedandsevennewsectionsenactedinlieuthereof,tobeknownassections 3160.518,160.545,161.092,162.084,163.023,168.021,and168.110,toreadasfollows: 160.518.1.Consistentwiththeprovisionscontainedinsection160.526,thestate 2boardofeducationshalldevelop,modify,andrevise,asnecessary,astatewideassessment 3system[thatprovidesmaximumflexibility] forlocalschooldistrictstodeterminethedegree 4towhichstudentsinthepublicschoolsofthestateareproficientintheknowledge,skills,and 5competenciesadoptedbysuchboardpursuanttosection160.514.Thestatewideassessment 6systemshallassessproblemsolving,analyticalability,evaluation,creativity,andapplication 7abilityinthedifferentcontentareasandshallbeperformance-basedtoidentifywhatstudents 8know,aswellaswhattheyareabletodo,andshallenableteacherstoevaluateactual 9academicperformance.Thestatewideassessmentsystemshallneitherpromotenorprohibit 10rotememorizationandshallnotincludeexistingversionsoftestsapprovedforusepursuantto 11theprovisionsofsection160.257,norenhancedversionsofsuchtests.Afterthestateboard 12ofeducationadoptsandimplementsacademicperformancestandardsasrequiredunder 13section161.855,thestateboardofeducationshalldevelopandadoptastandardized 14assessmentinstrumentunderthissectionbasedontheacademicperformancestandards 15adoptedundersection161.855.Thestatewideassessmentsystemshallmeasure,where EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 16appropriatebygradelevel,astudent'sknowledgeofacademicsubjectsincluding,butnot 17limitedto,readingskills,writingskills,mathematicsskills,worldandAmericanhistory, 18formsofgovernment,geographyandscience. 19 2.[Thestatewideassessmentsystemshallonlypermittheacademicperformanceof 20studentsineachschoolinthestatetobetrackedagainstprioracademicperformanceinthe 21sameschool. 22 3.]Thestateboardofeducationshallsuggest,butnotmandate,criteriaforaschoolto 23demonstratethatitsstudentslearntheknowledge,skillsandcompetenciesatexemplary 24levelsworthyofimitationbystudentsinotherschoolsinthestateandnation.Exemplary 25levelsshallbemeasuredbythestatewideassessmentsystemdevelopedpursuantto 26subsection1ofthissection,oruntilsaidstatewideassessmentsystemisavailable,by 27indicatorsapprovedforsuchusebythestateboardofeducation.Theprovisionsofotherlaw 28tothecontrarynotwithstanding,thecommissionerofeducationmay,uponrequestofthe 29schooldistrict,presentaplanforthewaiverofrulesandregulationstoanysuchschool,tobe 30knownas"OutstandingSchoolsWaivers",consistentwiththeprovisionsofsubsection[4]3 31ofthissection. 32 [4.]3.Foranyschoolthatmeetsthecriteriaestablishedbythestateboardof 33educationforthreesuccessiveschoolyearspursuanttotheprovisionsofsubsection[3]2of 34thissection,byAugustfirstfollowingthethirdsuchschoolyear,thecommissionerof 35educationshallpresentaplantothesuperintendentoftheschooldistrictinwhichsuchschool 36islocatedforthewaiverofrulesandregulationstopromoteflexibilityintheoperationsofthe 37schoolandtoenhanceandencourageefficiencyinthedeliveryofinstructionalservices.The 38provisionsofotherlawtothecontrarynotwithstanding,theplanpresentedtothe 39superintendentshallprovideasummarywaiver,withnoconditions,forthepupiltesting 40requirementspursuanttosection160.257,intheschool.Further,theprovisionsofotherlaw 41tothecontrarynotwithstanding,theplanshalldetailameansforthewaiverofrequirements 42otherwiseimposedontheschoolrelatedtotheauthorityofthestateboardofeducationto 43classifyschooldistrictspursuanttosubdivision(9)ofsubsection2ofsection161.092and 44suchotherrulesandregulationsasdeterminedbythecommissionerofeducation,excepting 45suchwaiversshallbeconfinedtotheschoolandnototherschoolsinthedistrictunlesssuch 46otherschoolsmeetthecriteriaestablishedbythestateboardofeducationconsistentwith 47subsection[3]2ofthissectionandthewaiversshallnotincludetherequirementscontainedin 48thissectionandsection160.514.Anywaiverprovidedtoanyschoolasoutlinedinthis 49subsectionshallbevoidonJunethirtiethofanyschoolyearinwhichtheschoolfailstomeet 50thecriteriaestablishedbythestateboardofeducationconsistentwithsubsection[3]2ofthis 51section. 54timeassuchstudenthasbeeneducatedforthreefullschoolyearsinaschoolinthisstate,or 55inanyotherstate,inwhichEnglishistheprimarylanguage. 56 [6.]5.Thestateboardofeducationshallidentifyor,ifnecessary,establishoneor 57moredevelopmentallyappropriatealternateassessmentsforstudentswhoreceivespecial 58educationalservices,asthattermisdefinedpursuanttosection162.675.Inthedevelopment 59ofsuchalternateassessments,thestateboardshallestablishanadvisorypanelconsistingofa 60majorityofactivespecialeducationteachersresidinginMissouriandothereducation 61professionalsasappropriatetoresearchavailableassessmentoptions.Theadvisorypanel 62shallattempttoidentifypreexistingdevelopmentallyappropriatealternateassessmentsbut 63shall,ifnecessary,developalternateassessmentsandrecommendoneormorealternate 64assessmentsforadoptionbythestateboard.Thestateboardshallconsiderthe 65recommendationsoftheadvisorycouncilinestablishingsuchalternateassessmentor 66assessments.Anystudentwhoreceivesspecialeducationalservices,asthattermisdefined 67pursuanttosection162.675,shallbeassessedbyanalternateassessmentestablishedpursuant 68tothissubsectionuponadeterminationbythestudent'sindividualizededucationprogram 69teamthatsuchalternateassessmentismoreappropriatetoassessthestudent'sknowledge, 70skillsandcompetenciesthantheassessmentdevelopedpursuanttosubsection1ofthis 71section.Thealternateassessmentshallevaluatethestudent'sindependentlivingskills,which 72includehoweffectivelythestudentaddressescommonlifedemandsandhowwellthestudent 73meetsstandardsforpersonalindependenceexpectedforsomeoneinthestudent'sagegroup, 74socioculturalbackground,andcommunitysetting. 75 [7.]6.Thestateboardofeducationshallalsodeveloprecommendationsregarding 76alternateassessmentsforanymilitarydependentwhorelocatestoMissouriafterthe 77commencementofaschoolterm,inordertoaccommodatesuchstudentwhileensuringthat 78[heorshe]suchstudentisproficientintheknowledge,skills,andcompetenciesadopted 79undersection160.514. 160.545.1.Thereisherebyestablishedwithinthedepartmentofelementaryand 2secondaryeducationthe"A+SchoolsProgram"tobeadministeredbythecommissionerof 3education.Theprogramshallconsistofgrantawardsmadetopublicsecondaryschoolsthat 4demonstrateacommitmenttoensurethat: 5 (1)Allstudentsbegraduatedfromschool; 6 (2)Allstudentscompleteaselectionofhighschoolstudiesthatischallengingandfor 7whichthereareidentifiedlearningexpectations;and 8 (3)Allstudents: 9 (a)Earncreditstowardanytypeofcollegedegreewhileinhighschool;or HB2652 3 10 (b)Proceedfromhighschoolgraduationtoacollegeorpostsecondaryvocationalor 11technicalschoolorhigh-wagejobwithworkplaceskilldevelopmentopportunities. 12 2.Thestateboardofeducationshallpromulgaterulesandregulationsforthe 13approvalofgrantsmadeundertheprogramtoschoolsthat: 14 (1)Establishmeasurabledistrictwideperformancestandardsforthegoalsofthe 15programoutlinedinsubsection1ofthissection;and 16 (2)Specifytheknowledge,skillsandcompetencies,inmeasurableterms,that 17studentsmustdemonstratetosuccessfullycompleteanyindividualcourseofferedbythe 18school,andanycourseofstudies[which] thatwillqualifyastudentforgraduationfromthe 19school;and 20 (3)Donotofferageneraltrackofcoursesthat,uponcompletion,canleadtoahigh 21schooldiploma;and 22 (4)Requirerigorouscourseworkwithstandardsofcompetencyinbasicacademic 23subjectsforstudentspursuingvocationalandtechnicaleducationasprescribedbyruleand 24regulationofthestateboardofeducation;and 25 (5)Haveapartnershipplandevelopedincooperationandwiththeadviceoflocal 26businesspersons,laborleaders,parents,andrepresentativesofcollegeandpostsecondary 27vocationalandtechnicalschoolrepresentatives,withtheplanthenapprovedbythelocal 28boardofeducation.Theplanshallspecifyamechanismtoreceiveinformationonanannual 29basisfromthosewhodevelopedtheplaninadditiontoseniorcitizens,communityleaders, 30andteacherstoupdatetheplaninordertobestmeetthegoalsoftheprogramasprovidedin 31subsection1ofthissection.Further,theplanshalldetailtheproceduresusedintheschoolto 32identifystudentsthatmaydropoutofschoolandtheinterventionservicestobeusedtomeet 33theneedsofsuchstudents.Theplanshalloutlinecounselingandmentoringservices 34providedtostudentswhowillentertheworkforceupongraduationfromhighschool,address 35apprenticeshipandinternprograms,andshallcontainproceduresfortherecruitmentof 36volunteersfromthecommunityoftheschooltoserveinschoolsreceivingprogramgrants. 37 3.Anynonpublicschoolinthisstatemayapplytothestateboardofeducationfor 38certificationthatitmeetstherequirementsofthissectionsubjecttothesamecriteriaaspublic 39highschools.Everynonpublicschoolthatappliesandhasmettherequirementsofthis 40sectionshallhaveitsstudentseligibleforreimbursementofpostsecondaryeducationunder 41subsection8ofthissectiononanequalbasistostudentswhograduatefrompublicschools 42thatmeettherequirementsofthissection.Anynonpublicschoolthatappliesshallnotbe 43eligibleforanygrantsunderthissection.Studentsofcertifiednonpublicschoolsshallbe 44eligibleforreimbursementofpostsecondaryeducationundersubsection8ofthissectionso 45longastheymeettheotherrequirementsofsuchsubsection.Forpurposesofsubdivision(5) 46ofsubsection2ofthissection,thenonpublicschoolshallbeincludedinthepartnershipplan HB2652 4 47developedbythepublicschooldistrictinwhichthenonpublicschoolislocated.For 48purposesofsubdivision(1)ofsubsection2ofthissection,thenonpublicschoolshall 49establishmeasurableperformancestandardsforthegoalsoftheprogramforeveryschooland 50gradeleveloverwhichthenonpublicschoolmaintainscontrol. 51 4.Aschooldistrictmayparticipateintheprogramirrespectiveofitsaccreditation 52classificationbythestateboardofeducation,provideditmeetsallotherrequirements. 53 5.Byruleandregulation,thestateboardofeducationmaydeterminealocalschool 54districtvariablefundmatchrequirementinorderforaschoolorschoolsinthedistrictto 55receiveagrantundertheprogram.However,noschoolinanydistrictshallreceiveagrant 56undertheprogramunlessthedistrictdesignatesasalariedemployeetoserveastheprogram 57coordinator,withthedistrictassumingaminimumofone-halfthecostofthesalaryandother 58benefitsprovidedtothecoordinator.Further,noschoolinanydistrictshallreceiveagrant 59undertheprogramunlessthedistrictmakesavailablefacilitiesandservicesforadultliteracy 60trainingasspecifiedbyruleofthestateboardofeducation. 61 6.Foranyschoolthatmeetstherequirementsfortheapprovalofthegrants 62authorizedbythissectionandspecifiedinsubsection2ofthissectionforthreesuccessive 63schoolyears,byAugustfirstfollowingthethirdsuchschoolyear,thecommissionerof 64educationshallpresentaplantothesuperintendentoftheschooldistrictinwhichsuchschool 65islocatedforthewaiverofrulesandregulationstopromoteflexibilityintheoperationsofthe 66schoolandtoenhanceandencourageefficiencyinthedeliveryofinstructionalservicesinthe 67school.Theprovisionsofotherlawtothecontrarynotwithstanding,theplanpresentedtothe 68superintendentshallprovideasummarywaiver,withnoconditions,forthepupiltesting 69requirementspursuanttosection160.257intheschool.Further,theprovisionsofotherlaw 70tothecontrarynotwithstanding,theplanshalldetailameansforthewaiverofrequirements 71otherwiseimposedontheschoolrelatedtotheauthorityofthestateboardofeducationto 72classifyschooldistrictspursuanttosubdivision(9)ofsubsection2ofsection161.092and 73suchotherrulesandregulationsasdeterminedbythecommissionerofeducation,exceptsuch 74waiversshallbeconfinedtotheschoolandnototherschoolsintheschooldistrictunlesssuch 75otherschoolsmeettherequirementsofthissubsection.However,anywaiverprovidedtoany 76schoolasoutlinedinthissubsectionshallbevoidonJunethirtiethofanyschoolyearin 77whichtheschoolfailstomeettherequirementsfortheapprovalofthegrantsauthorizedby 78thissectionasspecifiedinsubsection2ofthissection. 79 7.Foranyschoolyear,grantsauthorizedbysubsections1,2,and5ofthissection 80shallbefundedwiththeamountappropriatedforthisprogram,lessthosefundsnecessaryto 81reimburseeligiblestudentspursuanttosubsection8or9ofthissection. 82 8.Thedepartmentofhighereducationandworkforcedevelopmentshall,byrule, 83establishaprocedureforthereimbursementofthecostoftuition,booksandfeestoany HB2652 5 84publiccommunitycollegeorvocationalortechnicalschoolorwithinthelimitsestablishedin 85subsection11ofthissectionforanytwo-yearprivatevocationalortechnicalschoolforany 86student: 87 (1)Whohasattendedahighschoolinthestateforatleasttwoyearsthatmeetsthe 88requirementsofsubsection2ofthissectionandwhohasgraduatedfromsuchaschool; 89exceptthat,studentswhoareactivedutymilitarydependents,andstudentswhoare 90dependentsofretiredmilitarywhorelocatetoMissouriwithinoneyearofthedateofthe 91parent'sretirementfromactivedutywhomeetallotherrequirementsofthissubsectionand 92areattendingaschoolthatmeetstherequirementsofsubsection2ofthissectionshallbe 93exemptfromthetwo-yearattendancerequirementofthissubdivision;and 94 (2)Whohasmadeagoodfaithefforttofirstsecureallavailablefederalsourcesof 95fundingthatcouldbeappliedtothereimbursementdescribedinthissubsection;and 96 (3)Whohasearnedaminimalgradeaveragewhileinhighschoolorthroughthe 97semesterimmediatelybeforetakingthecourseforwhichreimbursementissoughtas 98determinedbyruleofthedepartmentofhighereducationandworkforcedevelopment,and 99otherrequirementsforthereimbursementauthorizedbythissubsectionasdeterminedbyrule 100andregulationofthedepartment;and 101 (4)WhoisacitizenorpermanentresidentoftheUnitedStates. 102 9.Thedepartmentofhighereducationandworkforcedevelopmentshall,byrule, 103establishaprocedureforthereimbursementofthecostoftuition,andfeesforanydual-credit 104ordual-enrollmentcourseofferedtoastudentinhighschoolinassociationwithaninstitution 105ofhighereducationorvocationalortechnicalschool,subjecttotherequirementsof 106subsection11ofthissection,foranystudentwhomeetstherequirementsestablishedin 107subsection8ofthissectionimmediatelybeforetakingthecourseforwhichreimbursementis 108sought. 109 10.Thecommissionerofeducationshalldevelopaprocedureforevaluatingthe 110effectivenessoftheprogramdescribedinthissection.Suchevaluationshallbeconducted 111annuallywiththeresultsoftheevaluationprovidedtothegovernor,speakerofthehouse,and 112presidentprotemporeofthesenate. 113 11.Foratwo-yearprivatevocationalortechnicalschooltoobtainreimbursements 114undersubsection8or9ofthissection,thefollowingrequirementsshallbesatisfied: 115 (1)Suchtwo-yearprivatevocationalortechnicalschoolshallbeamemberofthe 116NorthCentralAssociationandbeaccreditedbytheHigherLearningCommissionasofJuly 1171,2008,andmaintainsuchaccreditation; 118 (2)Suchtwo-yearprivatevocationalortechnicalschoolshallbedesignatedasa501 119(c)(3)nonprofitorganizationundertheInternalRevenueCodeof1986,asamended; HB2652 6 120 (3)Notwo-yearprivatevocationalortechnicalschoolshallreceivetuition 121reimbursementsinexcessofthetuitionratechargedbyapubliccommunitycollegefor 122courseworkofferedbytheprivatevocationalortechnicalschoolwithintheserviceareaof 123suchcollege;and 124 (4)Thereimbursementsprovidedtoanytwo-yearprivatevocationalortechnical 125schoolshallnotviolatetheprovisionsofArticleIX,Section8,orArticleI,Section7,ofthe 126MissouriConstitutionorthefirstamendmentoftheUnitedStatesConstitution. 127 12.Thedepartmentofhighereducationandworkforcedevelopmentshalldistribute 128reimbursementsinthefollowingmanner: 129 (1)Tocommunitycollegeorvocationalortechnicalschoolstudents; 130 (2)Afterallstudentsfromsubdivision(1)ofthissubsectionhavebeenreimbursed,to 131anydual-creditordual-enrollmentstudentonthebasisoffinancialneed. 161.092.1.Asusedinthissection,"attendancecenter"meansanyindividual 2publicelementaryorsecondaryschool. 3 2.Thestateboardofeducationshall: 4 (1)Adoptrulesgoverningitsownproceedingsandformulatepoliciesforthe 5guidanceofthecommissionerofeducationandthedepartmentofelementaryandsecondary 6education; 7 (2)Carryouttheeducationalpoliciesofthestaterelatingtopublicschoolsthatare 8providedbylawandsuperviseinstructioninthepublicschools; 9 (3)Directtheinvestmentofallmoneysreceivedbythestatetobeappliedtothe 10capitalofanypermanentfundestablishedforthesupportofpubliceducationwithinthe 11jurisdictionofthedepartmentofelementaryandsecondaryeducationandseethatthefunds 12areappliedtothebranchesofeducationalinterestofthestatethatbygrant,gift,deviseorlaw 13theywereoriginallyintended,andifnecessaryinstitutesuitforandcollectthefundsand 14returnthemtotheirlegitimatechannels; 15 (4)Causetobeassembledinformationwhichwillreflectcontinuouslythecondition 16andmanagementofthepublicschoolsofthestate; 17 (5)Requireofcountyclerksortreasurers,boardsofeducationorotherschool 18officers,recordersandtreasurersofcities,townsandvillages,copiesofallrecordsrequiredto 19bemadebythemandallotherinformationinrelationtothefundsandconditionofschools 20andthemanagementthereofthatisdeemednecessary; 21 (6)Provideblankssuitableforusebyofficialsinreportingtheinformationrequired 22bytheboard; 23 (7)Whenconditionsdemand,causethelawsrelatingtoschoolstobepublishedina 35education,providedthatthisconditionshallnotapplytoanyrequirementforwhichatime 36lineforadoptionismandatedineitherfederalorstatelaw.Suchrulesshallincludeaprocess 37toallowanydistrictthatisaccreditedwithoutprovisionthatdoesnotmeetthestateboard's 38promulgatedcriteriaforaclassificationdesignationofaccreditedwithdistinctiontopropose 39alternativecriteria, 48ethnicity;theirprofessionaltraining[,]; andtheiraveragesalary; 49 (c)Astatementofthereceiptsanddisbursementsofpublicschoolfundsofevery 50description,theirsources,andthepurposesforwhichtheyweredisbursed; 51 (d)Research-basedandcitedsuggestionsfortheimprovementofpublicschools; 52and 53 (e)Anyotherinformationrelativetotheeducationalinterestsofthestatethatthelaw 54requiresortheboarddeemsimportant; 55 (11)Makeanannualreporttothegeneralassemblyandthegovernorconcerning 87completionofabackgroundcheckasprescribedinsection168.133.Thestateboardshall 88provideforthefollowinglevelsofprofessionalcertification:aninitialprofessionalcertificate 89andacareercontinuousprofessionalcertificate. 90 (2)Theinitialprofessionalcertificateshallbeissueduponcompletionof 91requirementsestablishedbythestateboardofeducationandshallbevalidbasedupon 92verificationofactualteachingwithinaspecifiedtimeperiodestablishedbythestateboardof 93education.Thestateboardshallrequireholdersofthefour-yearinitialprofessionalcertificate 94to: 95 113thefifteen-hourprofessionaldevelopmentrequirement,thepossessormay,withintwoyears, 114makeupthemissinghours.Inordertomakeupformissinghours,thepossessorshallfirst 115completethefifteen-hourrequirementforthecurrentyearandthenmaycounthoursinexcess 116ofthecurrentyearrequirementasmake-uphours.Shouldthepossessorfailtomakeupthe 117missinghourswithintwoyears,thecertificateshallbecomeinactive.Inordertoreactivate 118thecertificate,thepossessorshallcompletetwenty-fourcontacthoursofprofessional 119developmentwhichmayincludehoursspentintheclassroominanappropriatecollege 120curriculumwithinthesixmonthspriortoorafterreactivating[hisorher]thepossessor's 121certificate.Therequirementsofthisparagraphshallbemonitoredandverifiedbythelocal 122schooldistrictwhichemploystheholderofthecareercontinuousprofessionalcertificate. 123 (c)Aholderofacareercontinuousprofessionalcertificateshallbeexemptfromthe 124professionaldevelopmentcontacthourrequirementsofparagraph(b)ofthissubdivisionif 125suchteacherhasalocalprofessionaldevelopmentplaninplacewithinsuchteacher'sschool 126districtandmeetstwoofthethreefollowingcriteria: 127 a.Hastenyearsofteachingexperienceasdefinedbythestateboardofeducation; 128 b.Possessesamaster'sdegree;or 129 c.Obtainsarigorousnationalcertificationasapprovedbythestateboardof 130education. 131 4.Policiesandproceduresshallbeestablishedbywhichateacherwhowasnot 132retainedduetoareductioninforcemayretainthecurrentlevelofcertification.Thereshall 133alsobeestablishedpoliciesandproceduresallowingateacherwhohasnotbeenemployedin HB2652 15 134aneducationalpositionforthreeyearsormoretoreactivate[hisorher]theteacher'slast 135levelofcertificationbycompletingtwenty-fourcontacthoursofprofessionaldevelopment 136whichmayincludehoursspentintheclassroominanappropriatecollegecurriculumwithin 137thesixmonthspriortoorafterreactivating[hisorher]theteacher'scertificate. 138 5.Thestateboardshall,uponcompletionofabackgroundcheckasprescribedin 139section168.133,issueaprofessionalcertificateclassificationintheareasmostclosely 140alignedwithanapplicant'scurrentareasofcertification,commensuratewiththeyearsof 141teachingexperienceoftheapplicant,toanypersonwhoishiredtoteachinapublicschoolin 142thisstateandwhopossessesavalidteachingcertificatefromanotherstateorcertification 143undersubdivision(4)ofsubsection1ofthissection,providedthatthecertificateholdershall 144annuallycompletethestateboard'srequirementsforsuchlevelofcertification,andshall 145establishpoliciesbywhichresidentsofstatesotherthanthestateofMissourimaybeassessed 146afeeforacertificateoflicensetoteachinthepublicschoolsofMissouri.Suchfeeshallbein 147anamountsufficienttorecoveranyorallcostsassociatedwiththeissuingofacertificateof 148licensetoteach.Theboardshallpromulgaterulestoauthorizetheissuanceofaprovisional 149certificateoflicense,whichshallbevalidforthreeyearsandshallallowtheholdertoassume 150classroomdutiespendingthecompletionofacriminalbackgroundcheckundersection 151168.133,foranyapplicantwho: 152 (1)IsthespouseofamemberoftheArmedForcesstationedinMissouri; 153 (2)Relocatedfromanotherstatewithinoneyearofthedateofapplication; 154 (3)Underwentacriminalbackgroundcheckinordertobeissuedateaching 155certificateoflicensefromanotherstate;and 156 (4)Otherwisequalifiesunderthissection. 157 6.Thestateboardmayassesstoholdersofaninitialprofessionalcertificateafee,to 158bedepositedintotheexcellenceineducation[revolving] fundestablishedpursuanttosection 159160.268,fortheissuanceofthecareercontinuousprofessionalcertificate.However,suchfee 160shallnotexceedthecombinedcostsofissuanceandanycriminalbackgroundcheckrequired 161asaconditionofissuance.ApplicantsfortheinitialABCTEcertificateshallberesponsible 162foranyfeesassociatedwiththeprogramleadingtotheissuanceofthecertificate,butnothing 163inthissectionshallprohibitadistrictfromdevelopingapolicythatpermitsfee 164reimbursement. 165 7.AnymemberofthepublicschoolretirementsystemofMissouriwhoentered 166coveredemploymentwithtenormoreyearsofeducationalexperienceinanotherstateor 167statesandheldacertificateissuedbyanotherstateandsubsequentlyworkedinaschool 168districtcoveredbythepublicschoolretirementsystemofMissourifortenormoreyearswho 169laterbecamecertificatedinMissourishallhavethatcertificatedatedbackto[hisorher]the 170member'soriginaldateofemploymentinaMissouripublicschool.
