208.030.1.Thefamilysupportdivisionshallmakemonthlypaymentstoeachperson 2whowasarecipientofoldageassistance,aidtothepermanentlyandtotallydisabled,andaid 3totheblindandwho: 4 (1)ReceivedsuchassistancepaymentsfromthestateofMissouriforthemonthof 5December,1973,towhichtheywerelegallyentitled;and 6 (2)IsaresidentofMissouri. 7 2.Theamountofsupplementalpaymentmadetopersonswhomeettheeligibility 8requirementsforandreceivefederalsupplementalsecurityincomepaymentsshallbeinan 9amount,asestablishedbyruleandregulationofthefamilysupportdivision,sufficientto, 10whenaddedtoallotherincome,equaltheamountofcashincomereceivedinDecember, 111973;except,inestablishingtheamountofthesupplementalpayments,thereshallbe 12disregardedcost-of-livingincreasesprovidedforinTitlesIIandXVIofthefederalSocial 26theamountofcashincomereceivedinDecember,1973;except,inestablishingtheamountof 27thesupplementalpayment,thereshallbedisregardedcost-of-livingincreasesprovidedforin 28TitlesIIandXVIofthefederalSocialSecurityActandanyotherbenefitsorincomerequired 29tobedisregardedbyanactofCongressoftheUnitedStatesoranyregulationduly 35bonafideresidentsofthestateofMissouri.Thepaymentshallbeintheamountprescribedin 36subsection1ofsection209.040,lessanyfederalsupplementalsecurityincomepayment. 37 5.Thefamilysupportdivisionshallmakemonthlypaymentstopersonsagetwenty- 38oneoroverwhomeettheeligibilityrequirementsineffectonDecember31,1973,orless 39restrictiverequirementsasestablishedbyruleorregulationofthefamilysupportdivision, 40whowerereceivingoldageassistance,permanentandtotaldisabilityassistance,general 41reliefassistance,oraidtotheblindassistancelawfully,whoarenoteligiblefornursinghome 42careundertheTitleXIXprogram,andwhoresideinalicensedresidentialcarefacility,a 43licensedassistedlivingfacility,alicensedintermediatecarefacilityoralicensedskilled 44nursingfacilityinMissouriandwhosetotalcashincomeisnotsufficienttopaytheamount 45chargedbythefacility;andtoallapplicantsagetwenty-oneoroverwhoarenoteligiblefor 46nursinghomecareundertheTitleXIXprogramwhoareresidinginalicensedresidentialcare 47facility,alicensedassistedlivingfacility,alicensedintermediatecarefacilityoralicensed 48skillednursingfacilityinMissouri,whomakeapplicationafterDecember31,1973,provided 49theymeettheeligibilitystandardsforoldageassistance,permanentandtotaldisability 50assistance,generalreliefassistance,oraidtotheblindassistanceineffectonDecember31, 511973,orlessrestrictiverequirementsasestablishedbyruleorregulationofthefamilysupport 52division,whoarebonafideresidentsofthestateofMissouri,andwhosetotalcashincomeis 53notsufficienttopaytheamountchargedbythefacility.UntilJuly1,1983,theamountofthe 54totalstatepaymentforhomecareinlicensedresidentialcarefacilitiesshallnotexceedone HB2727 2 55hundredtwentydollarsmonthly,forcareinlicensedintermediatecarefacilitiesorlicensed 56skillednursingfacilitiesshallnotexceedthreehundreddollarsmonthly,andforcarein 57licensedassistedlivingfacilitiesshallnotexceedtwohundredtwenty-fivedollarsmonthly. 58BeginningJuly1,1983,forfiscalyear1983-1984andeachyearthereafter,theamountofthe 59totalstatepaymentforhomecareinlicensedresidentialcarefacilitiesshall[notexceedone 60hundredfifty-sixdollarsmonthly] besubjecttoappropriation, forcareinlicensed 61intermediatecarefacilitiesorlicensedskillednursingfacilitiesshallnotexceedthreehundred 62ninetydollarsmonthly,andforcareinlicensedassistedlivingfacilitiesshallnotexceedtwo 63hundredninety-twodollarsandfiftycentsmonthly.Nointermediatecareorskillednursing 64paymentshallbemadetoapersonresidinginalicensedintermediatecarefacilityorina 65licensedskillednursingfacilityunlesssuchpersonhasbeendetermined,byhisorherown 66physicianordoctor,tomedicallyneedsuchservicessubjecttoreviewandapprovalbythe 67department.Residentialcarepaymentsmaybemadetopersonsresidinginlicensed 68intermediatecarefacilitiesorlicensedskillednursingfacilities.Anypersoneligibleto 69receiveamonthlypaymentpursuanttothissubsectionshallreceiveanadditionalmonthly 70paymentequaltotheMedicaidvendornursingfacilitypersonalneedsallowance.Theexact 71amountoftheadditionalpaymentshallbedeterminedbyruleofthedepartment.This 72additionalpaymentshallnotbeusedtopayforanysuppliesorservices,orforanyotheritems 73thatwouldhavebeenpaidforbythefamilysupportdivisionifthatpersonwouldhavebeen 74receivingmedicalassistancebenefitsunderTitleXIXofthefederalSocialSecurityActfor 75nursinghomeservicespursuanttotheprovisionsofsection208.159.Notwithstandingthe 76previouspartofthissubsection,thepersoneligibleshallnotreceivethisadditionalpaymentif
