SectionA.Chapter170,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection170.027,toreadasfollows:
170.027.1.Asusedinthissection,"drivereducationcourse"meansacourse
2developedbythestateboardofeducationtobeofferedineachpublicschoolandcharter
3schoolofferingcoursestopupilsingradestentotwelvethatmeetstheminimum
4requirementstoallowapupiltoqualifyforatemporaryinstructionpermitunder
5chapter302andthatoffersinstructionintheuseandoperationofmotorvehicles
6including,butnotlimitedto,instructioninthesafeoperationofmotorvehiclesand
7rulesoftheroadandthelawsofthisstaterelatingtomotorvehicles.
8 2.Eachpupilingradestentotwelveshallcompleteadrivereducationcourse
9beforereceivingacertificateofgraduationfromanypublichighschooloranycharter
10highschool.
11 3.Thedrivereducationcourserequiredbythissectionshall:
12 (1)Instructpupilsabouttheoperationofmotorvehicles;
13 (2)Emphasizethedevelopmentofknowledge,attitudes,habits,andskills
14necessaryforthesafeoperationofmotorvehicles;
15 (3)Provideinstructionondistracteddrivingasamajortrafficsafetyissue;
16 (4)Provideinstructiononspecialhazardsexistingatemergencysituationsand
17requiredsafetyanddrivingprecautionsthatshallbeobservedinsuchsituationsandat

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18highwayconstructionandmaintenancezones,railroadcrossings,andtheapproaches
19thereto;
20 (5)Provideinstructionconcerninglawenforcementproceduresfortrafficstops,
21includingademonstrationoftheproperactionstobetakenduringatrafficstopand
22appropriateinteractionswithlawenforcement;and
23 (6)Providesuchotherinstructiondevelopedbythestateboardofeducationin
24conjunctionwiththedepartmentoftransportationdeemednecessarytoinstructpupils
25ontheoperationandequipmentofmotorvehicles.
26 4.Thestateboardofeducationmaypromulgateallnecessaryrulesand
27regulationsfortheadministrationofthissection.Anyruleorportionofarule,asthat
28termisdefinedinsection536.010,thatiscreatedundertheauthoritydelegatedinthis
29sectionshallbecomeeffectiveonlyifitcomplieswithandissubjecttoallofthe
30provisionsofchapter536and,ifapplicable,section536.028.Thissectionandchapter
31536arenonseverable,andifanyofthepowersvestedwiththegeneralassembly
32pursuanttochapter536toreview,todelaytheeffectivedate,ortodisapproveandannul
33arulearesubsequentlyheldunconstitutional,thenthegrantofrulemakingauthority
34andanyruleproposedoradoptedafterAugust28,2022,shallbeinvalidandvoid.
