BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Chapter272,RSMo,isamendedbyaddingtheretotwonewsections,tobe
2knownassections272.138and272.380,toreadasfollows:
272.138.1.Thissectionshallapplytoanownerofrealproperty,acontractor
2hiredbysuchowner,orboth.
3 2.Ifanownerofrealpropertyoracontractorhiredbysuchownerconstructs,
4maintains,orrepairsadivisionfenceandtheownerofadjoiningrealpropertydoesnot
5shareintheconstruction,maintenance,orrepairofsuchdivisionfence,theownerof
6realpropertyorcontractorwhoisconstructing,maintaining,orrepairingsuchdivision
7fencemayenterontheadjoiningpropertyfornotmorethantenfeetforthelengthof
8thedivisionfencetoconstruct,maintain,orrepairthedivisionfence.Suchownerof
9realpropertyorcontractorshallnotbeliablefordamagesforclearinganytrees,brush,
10orvegetationthatliesuponorwithinanadjoiningpropertyboundaryordivisionfence.
11 3.Noownerofrealpropertyorcontractorhiredbysuchownershallbedeemed
12tohavecommittedtheoffenseoftrespassundersection569.140orbesubjecttoliability
13understatelawforconductthatispermittedundersubsection2ofthissection.Except
14asprovidedinsubsection2ofthissection,suchownerorcontractorshallbeliablefor
15anydamagescausedbysuchowner'sorcontractor'sentryontotheadjoiningproperty
16including,butnotlimitedto,damagestocrops.
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 272.380.1.Thissectionshallapplytoanownerofrealproperty,acontractor
2hiredbysuchowner,orboth.
3 2.Ifanownerofrealpropertyoracontractorhiredbysuchownerconstructs,
4maintains,orrepairsadivisionfenceandtheownerofadjoiningrealpropertydoesnot
5shareintheconstruction,maintenance,orrepairofsuchdivisionfence,theownerof
6realpropertyorcontractorwhoisconstructing,maintaining,orrepairingsuchdivision
7fencemayenterontheadjoiningpropertyfornotmorethantenfeetforthelengthof
8thedivisionfencetoconstruct,maintain,orrepairthedivisionfence.Suchownerof
9realpropertyorcontractorshallnotbeliablefordamagesforclearinganytrees,brush,
10orvegetationthatliesuponorwithinanadjoiningpropertyboundaryordivisionfence.
