RelatingtoanapplicationtoCongressforthecallingofanArticleVconventionofstatesto
proposeanamendmenttotheUnitedStatesConstitutionregardingtermlimitsfor
membersofCongress.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
WHEREAS,ArticleVoftheConstitutionoftheUnitedStatesrequiresaconvention
2tobecalledbytheCongressoftheUnitedStatesforthepurposeofproposinganamendment
3totheConstitutionuponapplicationoftwo-thirdsoftheLegislaturesoftheseveralstates;and

5 WHEREAS, theLegislatureoftheStateofMissourifavorsaproposaland
6ratificationofanamendmenttotheU.S.Constitution,whichshallsetalimitonthenumberof
7termsthatapersonmaybeelectedasamemberoftheUnitedStatesHouseofRepresentatives
8andasamemberoftheUnitedStatesSenate;and

10 WHEREAS,theNinety-ninthGeneralAssemblyofMissouri,SecondRegular
11Session,adoptedSenateConcurrentResolution40,whichcontainedanapplicationforan
12ArticleVConventiontoproposeanamendmentidenticaltothatproposedinthisresolution,
13butprovidedthattheapplicationwouldexpirefiveyearsafterthepassageofSenate

16 NOWTHEREFORE BEITRESOLVEDthatthemembersoftheHouseof
17RepresentativesoftheOneHundredFirstGeneralAssembly,SecondRegularSession,the
18Senateconcurringtherein,herebymakeanapplicationtoCongress,asprovidedbyArticleV
19oftheConstitutionoftheUnitedStatesofAmerica,tocallaconventionlimitedtoproposing
20anamendmenttotheConstitutionoftheUnitedStatesofAmericatosetalimitonthenumber 21oftermsthatapersonmaybeelectedasamemberoftheUnitedStatesHouseof
22Representativesandtosetalimitonthenumberoftermsthatapersonmaybeelectedasa
23memberoftheUnitedStatesSenate;and

25 BEITFURTHERRESOLVEDthatthisapplicationshallbeconsideredascovering
26thesamesubjectmatterastheapplicationsfromotherstatestoCongresstocallaconvention
27tosetalimitonthenumberoftermsthatapersonmaybeelectedtotheHouseof
28RepresentativesoftheCongressoftheUnitedStatesandtheSenateoftheUnitedStates;and
29thisapplicationshallbeaggregatedwithsameforthepurposeofattainingthetwo-thirdsof
30statesnecessarytorequireCongresstocallalimitedconventiononthissubject,butshallnot
31beaggregatedwithanyotherapplicationsonanyothersubject;and

33 BEITFURTHERRESOLVEDthatthisapplicationherebyrepeals,rescinds,
34cancels,rendersnullandvoid,andsupercedestheapplicationtotheCongressoftheUnited
35StatesforaconventionunderArticleVoftheConstitutionoftheUnitedStatesbythisstatein
36SenateConcurrentResolutionNo.40asadoptedbytheNinety-ninthGeneralAssembly,
37SecondRegularSession;and

39 BEITFURTHERRESOLVEDthattheChiefClerkoftheHouseofRepresentatives
40beinstructedtoprepareaproperlyinscribedcopyofthisresolutionforthePresidentand
41SecretaryoftheSenateoftheUnitedStatesandtotheSpeaker,Clerk,andJudiciary
42CommitteeChairmanoftheHouseofRepresentativesoftheCongressoftheUnitedStates,
43andcopiestoeachmemberoftheMissouriCongressionaldelegation,andthepresiding
44officersofeachofthelegislativehousesintheseveralstates,requestingtheircooperation.
