JOINTRESOLUTION
SubmittingtothequalifiedvotersofMissourianamendmentrepealingSections2and3of
ArticleVIIIoftheConstitutionofMissouri,andadoptingthreenewsectionsinlieu
thereofrelatingtoelections.
BeitresolvedbytheHouseofRepresentatives,theSenateconcurringtherein:
ThatatthenextgeneralelectiontobeheldinthestateofMissouri,onTuesdaynext
2followingthefirstMondayinNovember,2022,orataspecialelectiontobecalledbythe
3governorforthatpurpose,thereisherebysubmittedtothequalifiedvotersofthisstate,for
4adoptionorrejection,thefollowingamendmenttoArticleVIIIoftheConstitutionofthestate
5ofMissouri:
SectionA.Sections2and3,ArticleVIII,ConstitutionofMissouri,arerepealedand
2threenewsectionsadoptedinlieuthereof,tobeknownasSections2,3,and24,toreadas
3follows:
Section2.[All]OnlycitizensoftheUnitedStates,includingoccupantsofsoldiers'
2andsailors'homes,overtheageofeighteenwhoareresidentsofthisstateandofthepolitical
3subdivisioninwhichtheyoffertovoteareentitledtovoteatallelectionsbythepeople,ifthe
4electionisoneforwhichregistrationisrequirediftheyareregisteredwithinthetime
5prescribedbylaw,oriftheelectionisoneforwhichregistrationisnotrequired,iftheyhave
6beenresidentsofthepoliticalsubdivisioninwhichtheyoffertovoteforthirtydaysnext
7precedingtheelectionforwhichtheyoffertovote:Providedhowever,nopersonwhohasa
8guardianofhisorherestateorpersonbyreasonofmentalincapacity,appointedbyacourtof

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 9competentjurisdictionandnopersonwhoisinvoluntarilyconfinedinamentalinstitution
10pursuanttoanadjudicationofacourtofcompetentjurisdictionshallbeentitledtovote,and
11personsconvictedoffelony,orcrimeconnectedwiththeexerciseoftherightofsuffragemay
12beexcludedbylawfromvoting.
Section3.Allelectionsbythepeopleshallbebyballotorbyanymechanicalmethod
2prescribedbylaw.Votersshallonlycastasinglevoteforeachofficeorissueonwhich
3suchvoteriseligibletovote.Allelectionofficersshallbeswornoraffirmednottodisclose
4howanyvotervoted;provided,thatincasesofcontestedelections,grandjuryinvestigations
5andinthetrialofallcivilorcriminalcasesinwhichtheviolationofanylawrelatingto
6elections,includingnominatingelections,isunderinvestigationoratissue,suchofficersmay
7berequiredtotestifyandtheballotscastmaybeopened,examined,counted,andreceivedas
8evidence.
Section24.Thepersonreceivingthegreatestnumberofvotesataprimary
2electionasapartycandidateforanofficeshallbetheonlycandidateforthatpartyfor
3theofficeatthegeneralelection.
