JOINTRESOLUTION
SubmittingtothequalifiedvotersofMissourianamendmentrepealingSections2and3of
ArticleVIIIoftheConstitutionofMissouri,andadoptingfournewsectionsinlieu
thereofrelatingtoelections.
BeitresolvedbytheHouseofRepresentatives,theSenateconcurringtherein:
ThatatthenextgeneralelectiontobeheldinthestateofMissouri,onTuesdaynext
2followingthefirstMondayinNovember,2022,orataspecialelectiontobecalledbythe
3governorforthatpurpose,thereisherebysubmittedtothequalifiedvotersofthisstate,for
4adoptionorrejection,thefollowingamendmenttoArticleVIIIoftheConstitutionofthestate
5ofMissouri:
SectionA.Sections2and3,ArticleVIII,ConstitutionofMissouri,arerepealedand
2fournewsectionsadoptedinlieuthereof,tobeknownasSections2,3,24,and25,toreadas
3follows:
Section2.[All]OnlycitizensoftheUnitedStates,includingoccupantsofsoldiers'
2andsailors'homes,overtheageofeighteenwhoareresidentsofthisstateandofthepolitical
3subdivisioninwhichtheyoffertovoteareentitledtovoteatallelectionsbythepeople,ifthe
4electionisoneforwhichregistrationisrequirediftheyareregisteredwithinthetime
5prescribedbylaw,oriftheelectionisoneforwhichregistrationisnotrequired,iftheyhave
6beenresidentsofthepoliticalsubdivisioninwhichtheyoffertovoteforthirtydaysnext
7precedingtheelectionforwhichtheyoffertovote:Providedhowever,nopersonwhohasa
8guardianofhisorherestateorpersonbyreasonofmentalincapacity,appointedbyacourtof
9competentjurisdictionandnopersonwhoisinvoluntarilyconfinedinamentalinstitution
10pursuanttoanadjudicationofacourtofcompetentjurisdictionshallbeentitledtovote,and
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 11personsconvictedoffelony,orcrimeconnectedwiththeexerciseoftherightofsuffragemay
12beexcludedbylawfromvoting.
Section3.Allelectionsbythepeopleshallbebypaperballotorbyanymechanical
2methodprescribedbylaw.Votersshallhaveonlyasinglevoteforeachofficeorissueon
3whichsuchvoteriseligibletovote.Allelectionofficersshallbeswornoraffirmednotto
4disclosehowanyvotervoted;provided,thatincasesofcontestedelections,grandjury
5investigationsandinthetrialofallcivilorcriminalcasesinwhichtheviolationofanylaw
6relatingtoelections,includingnominatingelections,isunderinvestigationoratissue,such
7officersmayberequiredtotestifyandtheballotscastmaybeopened,examined,counted,
8andreceivedasevidence.
Section24.Thepersonreceivingthegreatestnumberofvotesataprimary
2electionasapartycandidateforanofficeshallbetheonlycandidateforthatpartyfor
3theofficeatthegeneralelection.
Section25.1.Everyvotingmachineusedtoconductanelectioninthestateof
2Missourishallbetestedandcertifiedassecurepriortoeachelectioninwhichthe
3machinewillbeused.Suchtestingandcertificationshallmeetallfederalstandards.
4 2.EveryvotingmachineusedtoconductanelectioninthestateofMissourishall
5produceanindividual,permanentpaperrecordforeachvotecast,whichshallbemade
6availableforinspectionandverificationbythevoteratthetimethevoteiscast.Such
7individual,permanentpaperrecordshallbepreservedforuseinanyelectionaudit.
SectionB.Pursuanttochapter116,andotherapplicableconstitutionalprovisionsand
2lawsofthisstateallowingthegeneralassemblytoadoptballotlanguageforthesubmissionof
3thisjointresolutiontothevotersofthisstate,theofficialsummarystatementofthis
4resolutionshallbeasfollows:

6"ShalltheMissouriConstitutionbeamendedto:
7 •AllowonlycitizensoftheUnitedStatestovote;
8 •Allowvoterstohaveasinglevoteperofficeorissue;
9 •Allowvoterstohaveasinglevoteperofficeorissue;
10 •Requirethepluralitywinnerofapoliticalpartyprimarytobethesinglecandidate
11fortherequisiteofficeatageneralelection;and
12 •Requirepapervoterecordsandvotingmachinetests?".
