JOINTRESOLUTION
SubmittingtothequalifiedvotersofMissourianamendmentrepealingSections50and51of
ArticleIIIoftheConstitutionofMissouri,andadoptingtwonewsectionsinlieu
thereofrelatingtoconstitutionalamendments,withadelayedeffectivedate.
BeitresolvedbytheHouseofRepresentatives,theSenateconcurringtherein:
ThatatthenextgeneralelectiontobeheldinthestateofMissouri,onTuesdaynext
2followingthefirstMondayinNovember,2022,orataspecialelectiontobecalledbythe
3governorforthatpurpose,thereisherebysubmittedtothequalifiedvotersofthisstate,for
4adoptionorrejection,thefollowingamendmenttoArticleIIIoftheConstitutionofthestate
5ofMissouri:
SectionA.Sections50and51,ArticleIII,ConstitutionofMissouri,arerepealedand
2twonewsectionsadoptedinlieuthereof,tobeknownasSections50and51,toreadas
3follows:
Section50.1.Initiativepetitionsproposingamendmentstotheconstitutionshallbe
2signedby[eight] tenpercentofthelegalvoters, registeredtovoteinMissouriandcitizens
3oftheUnitedStates,ineachof[two-thirdsof]thecongressionaldistrictsinthestate,and
4petitionsproposinglawsshallbesignedbyfivepercentofsuchvoters.Everysuchpetition
5shallbefiledwiththesecretaryofstatenotlessthansixmonthsbeforetheelectionandshall
6containanenactingclauseandthefulltextofthemeasure.Petitionsforconstitutional
7amendmentsshallnotcontainmorethanoneamendedandrevisedarticleofthisconstitution,
8oronenewarticlewhichshallnotcontainmorethanonesubjectandmattersproperly
9connectedtherewith,andtheenactingclausethereofshallbe"Beitresolvedbythepeopleof
10thestateofMissourithattheConstitutionbeamended:".Petitionsforlawsshallcontainnot
11morethanonesubjectwhichshallbeexpressedclearlyinthetitle,andtheenactingclause
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 12thereofshallbe"BeitenactedbythepeopleofthestateofMissouri:".Forpurposesofthis
13article,onlycitizensoftheUnitedStatesofAmericawhoareresidentsoftheStateof
14MissouriandwhoareproperlyregisteredtovoteintheStateofMissourishallbe
15consideredlegalvoters.
16 2.NotwithstandingSection2(b)ofArticleXIIofthisConstitution,oranyother
17provisionsofthisConstitutionorlawstothecontrary,iftwo-thirdsofthevotescast
18thereonareinfavorofanyamendment,whetherproposedbythegeneralassemblyor
19byinitiative,thesameshalltakeeffectattheendofthirtydaysaftertheelection.
Section51.Theinitiativeshallnotbeusedfortheappropriationofmoneyotherthan
2ofnewrevenuescreatedandprovidedforthereby,orforanyotherpurposeprohibitedbythis
3constitution.Exceptasprovidedinthisconstitution,anymeasureproposedshalltakeeffect
4whenapprovedby[amajority] two-thirdsofthevotescastthereon.Whenconflicting
5measuresareapprovedatthesameelectiontheonereceivingthelargestaffirmativevoteshall
6prevail.
SectionB.Underchapter116,RSMo,andotherapplicableconstitutionalprovisions
2andlawsofthisstateallowingthegeneralassemblytoadoptballotlanguageforthe
3submissionofajointresolutiontothevotersofthisstate,theofficialballottitleofthe
4amendmentproposedinSectionAshallbeasfollows:
5 "ShalltheMissouriConstitutionbeamendedto:
6 AllowonlycitizensoftheUnitedStatestoqualifyaslegalvoters;
7 Requireinitiativepetitionsproposingtoamendtheconstitutiontobereviewedbythe
8 votersineachcongressionaldistrict;and
9 Requireinitiativeamendmentstotheconstitutionbeapprovedbyatwo-thirdsvote?".
SectionC.TherepealandreenactmentofSections50and51ofthisresolutionshall
2becomeeffectiveonJanuary1,2023.
