85reutilizationauthorityforallexpensesdirectlyincurredinrelationtosuchpropertyunder 86sections92.700to92.920priortothetransfer. 92.815.1.Duringsuchwaitingperiodandatanytimepriortothetimeofforeclosure 2salebythesheriff,anyinterestedpartymayredeemanyparcelofrealestateasprovidedby 3sections92.700to92.920;exceptthatduringsuchtimeandatanytimepriortothetimeof 2.Suchsaleshallconveythewholeinterestofeverypersonhavingorclaimingany 6right,titleorinterestinorlienuponsuchrealestate,whethersuchpersonhasansweredor 7not,subjecttorights-of-waythereonofpublicutilitiesuponwhichtaxhasbeenotherwise 8paid,andsubjectonlytothetaxlienthereon,ifany,oftheUnitedStatesofAmerica. 9 3.Thecollectorshalladvancefromcurrenttaxcollectionsthesumsnecessarytopay 10forthepublicationofalladvertisementsrequiredbytheprovisionsofsections92.700to 1192.920andshallbeallowedcreditthereforinhisaccountswiththetaxingauthoritiesonapro 12ratabasis.Heshallgivecreditinsuchaccountsforallsuchadvancesrecoveredbyhim. 13Suchexpensesofpublicationshallbeapportionedprorataamongandtaxedascostsagainst 14therespectiveparcelsofrealestatedescribedinthejudgment;provided,however,thatnone 15ofthecostshereinenumerated,includingthecostsofpublication,shallconstituteanylien 16upontherealestateaftersuchsale. 17 4.Nopersonshallbeeligibletobidatthetimeofthesheriff'ssaleunlesssuch 18personhas,nolaterthantendaysbeforethesaledate,demonstratedtothesatisfaction 19ofthecollectororsheriffthatthepersonisnottheownerofanyparcelofrealestatein 20thecitythatissubjecttodelinquentpropertytaxes,unpaidspecialtaxbills,orvacant 21buildingfees.Aprospectivebiddershallbeprohibitedfromparticipatinginthe 22delinquentlandtaxsaleifheorshehaspreviouslybidatasheriff'ssaleandfailedto 23paybidamounts,confirmthesale,orsignasheriff'sdeed.Thecollectororsheriffmay 24requireprospectivebidderstosubmitanaffidavitattestingtotherequirementsofthis 25sectionandisexpresslyauthorizedtopermanentlyprecludeanyprospectivebidder 9thereonoftheUnitedStatesofAmerica,ifany,andallpersons,includingthestateof 10Missouri,anytaxingauthorityortaxdistrictasdefinedherein,judgmentcreditors, 11lienholders,minors,incapacitatedanddisabledpersons,andnonresidentswhomayhavehad 12anyright,title,interest,claim,orequityofredemptioninorto,orlienupon,suchlandsshall 17petitionaffectingsuchparcelofrealestatenotthendelinquent,orwhichmayhaveattached 18afterthefilingofthepetitionandpriortosheriff'ssaleandnotincludedinanyanswertosuch 19petition,but].Ifsuchparcelofrealestateissoldtothelandreutilizationauthoritythetitle 20theretoshallbefreeofany[such] lienstotheextentoftheinterestofanytaxingauthorityin 92.840.1.Withinsixmonthsafterthesheriffsellsanyparcelofrealestate,thecourt 2shall,uponitsownmotionoruponmotionofanyinterestedparty,setthecausedownfor 3hearingtoconfirmorsetasidetheforeclosuresaleoftherealestate,eventhoughsuch 4parcelsarenotalloftheparcelsofrealestatedescribedinthenoticeofsheriff'sforeclosure 5sale.Noticeofthehearingshallbesentbyanyinterestedparty,orthecourt,movingto 6confirmtheforeclosuresale,toeachpersonwho[received] wassentnoticeofsaleas 7specifiedin[subsection3]subsections4and5ofsection92.810andtoanyother 8necessarypartiesasrequiredbyprevailingnotionsofdueprocess. Atthetimeofsuch 9hearing,thesheriffshallmakereportofthesale,andthecourtshallhearevidenceofthevalue 10ofthepropertyofferedonbehalfofanyinterestedpartytothesuit,andshallimmediately 11determinewhetheranadequateconsiderationhasbeenpaidforeachsuchparcel.Anyparcel 12deemedtohavebeenpurchasedbythelandreutilizationauthoritypursuanttosection 1392.830shallnotrequireanyinquiryastovalue.Thecourt'sjudgmentshallincludea 14specificfindingthatadequatenoticewasprovidedtoallnecessarypartiespursuantto 15prevailingnotionsofdueprocessandsections92.700to92.920,recitingthenoticeefforts HCSSSSCSSB724 18 16ofthecollector,sheriff,andtaxsalepurchaser.Nothinginthissectionshallbe 17interpretedtoprecludeasuccessfultaxsalepurchaserfromassertingaclaimtoquiet 18titletothebiduponparcelpursuanttosection527.150. 19 2.Forthispurpose,thecourtshallhavepowertosummonanycityofficialorany 20privatepersontotestifyastothereasonablevalueoftheproperty,andifthecourtfindsthat 21adequateconsiderationhasbeenpaid,heshallconfirmthesaleandorderthesherifftoissuea 22deedwithrestrictionasprovidedhereintothepurchasersubjecttotheapplicationofan 23occupancypermitforallparcelsasprovidedinsubsection[5]7ofthissection.Ifthecourt 24findsthattheconsiderationpaidisinadequate,thepurchasermayincreasehisbidtosuch 25amountasthecourtmaydeemtobeadequate,whereuponthecourtmayconfirmthesale.If, 26however,thepurchaserdeclinestoincreasehisbidandmakesuchadditionalpayment,then 27thesaleshallbedisapproved,thelienofthejudgmentcontinued,andsuchparcelofreal 28estateshallbeagainadvertisedandofferedforsalebythesherifftothehighestbidderat 29publicauctionforcashatanysubsequentsheriff'sforeclosuresale. 30 3.Ifthesaleisconfirmed,thecourtshallordertheproceedsofthesaleappliedinthe 31followingorder: 32 (1)Tothepaymentofthecostsofthepublicationofthenoticeofforeclosureandof 33thesheriff'sforeclosuresale; 34 (2)Tothepaymentofallofthecollectorandsheriff'scostsincludingappraiser'sfee 35andattorney'sfees; 36 (3)Tothepaymentofalltaxbillsadjudgedtobedueintheorderoftheirpriority, 37includingprincipal,interestandpenaltiesthereon.If,aftersuchpayment,thereisanysum 38remainingoftheproceedsofthesheriff'sforeclosuresale,thecourtshallthereupontryand 39determinetheotherissuesinthesuitinaccordancewithsection92.775.Ifanyanswering 40partieshavespeciallyappealedasprovidedinsection92.845,thecourtshallretainthe 41custodyofsuchfundspendingdispositionofsuchappeal,andupondispositionofsuch 42appealshallmakesuchdistribution.Iftherearenotsufficientproceedsofthesaletopayall 43claimsinanyclassdescribed,thecourtshallorderthesametobepaidproratainaccordance 44withthepriorities. 45 4.Ifthereareanyfundsremainingoftheproceedsafterthesheriff'ssaleandafterthe 46distributionofsuchfundsassetoutinthissectionandnopersonentitledtoanysuchfunds, 47whetherornotapartytothesuit,shall,withintwoyearsaftersuchsale,appearandclaimthe 48funds,theyshallbedistributedtenpercenttotheaffordablehousingtrustfundor 49equivalentofsuchcityoperatingundersections92.700to92.920forpurposesthat 50promotethereductionandpreventionofvacantproperties,withtheremaindertobe 51distributedtotheappropriatetaxingauthorities. HCSSSSCSSB724 19 52 5.Anycityoperatingundertheprovisionsofsections92.700to92.920,by 53ordinance,mayelecttoallocateaportionofitsshareoftheproceedsofthesheriff'ssale 54towardsafundforthepurposeofdefendingagainstclaimschallengingthesufficiencyof 55noticeprovisionsunderthissection. 56 6.Forthepurposeofthissection,theterm"occupancypermit"shallmeanthe 57certificateof[useand]inspectionoroccupancypermitforresidentialorcommercial 58structuresasprovidedforintherevisedmunicipalcodeofanycitynotwithinacounty, 59whichnowhasormayhereafterhaveapopulationinexcessofthreehundredthousand 60inhabitants. 61 [6.]7.Ifthereisabuildingorstructureontheparcel,thepurchasershallapplyforan 62occupancypermitfromthecityorappropriategovernmentalagencywithintendaysafterthe 63confirmationhearing.Anypurchaserwhoisapubliccorporationactinginagovernmental 64capacityshallnotberequiredtoacquiretheoccupancypermit.Whenaparcel,acquiredata 65sheriffsale,containingabuildingissoldfromapubliccorporationactinginagovernmental 66capacity,thesubsequentpurchasershallberequiredtoapplyfortheoccupancypermit. 67Failuretoapplyforsuchoccupancypermitwithintendaysafterconfirmationshallresultin 68thesaleandconfirmationbeingimmediatelysetasidebythemotionofanyinterestedparty 69andthatparcelshallagainbeadvertisedandofferedforsalebythesherifftothehighest 70bidderatpublicauctionforcashatanysubsequentsheriffforeclosuresale. 71 [7.]8.Thesheriffshallincludeadeedrestrictioninthesheriff'sdeed,issuedafter 72confirmationandaftertheapplicationofanoccupancypermitforanyparcelcontaininga 73buildingorstructure.Thedeedrestrictionshallstatethatthepurchasersatthesheriff'ssale 74whohadthepropertyconfirmedandwhoappliedforanoccupancypermitshallobtainan 75occupancypermitforthebuildingorstructurefromtheappropriategovernmentalagency 76priortoanysubsequenttransferorsaleofthisproperty.Thisdeedrestrictionshallnotexist 77asalienagainstsuchrealestate[whilethepurchasersholdsameintheamountoffive 78thousanddollars]. Thepurchasersofthepropertyatthesheriffsalewhohadtheproperty 79confirmedandappliedfortheoccupancypermitshallagreethatintheeventoftheirfailureto 80obtainanoccupancypermitpriortoanysubsequenttransferoftheproperty,theyshallpayto 81thesheriffthesumoffivethousanddollarsasfixed,liquidatedandascertaineddamages 82withoutproofoflossordamages.Thesedamagesshallnotconstitutealienonproperty, 83andthesheriffshallhavethediscretionarypowertofilealawsuitagainstsuchpurchaserfor 84collectionoftheseliquidateddamages.Theseliquidateddamagesshallbedistributedona 85proratedbasistotheappropriatetaxingauthorityafterthesheriffdeductsallcosts,expenses 86and[attorney] attorney'sfeesforsuchlawsuits.Thesheriffmayemployattorneysashe 87deemsnecessarytocollectliquidateddamages. HCSSSSCSSB724 20 88 9.Ifanysaleisnotconfirmedwithinsixmonthsafterthesale,anyset-asideof 89thesalemay,atthediscretionofthecourtorcollector,includeapenaltyoftwenty-five 90percentofthebidamountoverandabovetheopeningbidamount,andsuchpenalty 91shallbedirectedtotheaffordablehousingtrustfundortheequivalent,ifany,ofacity 92operatingundersections92.700to92.920. 93 10.Anyinterestedparty,otherthanthesheriff'ssalepurchaser,whomovesthe 94courttosetasideasheriff'ssaleaftertheissuanceofasheriff'sdeedmadeunderthe 95provisionsofsections92.700to92.920shallberequiredtopayintothecourtthe 96redemptionamountotherwisenecessaryundersection92.750priortothecourthearing 97anysuchmotiontosetaside.Thecourtmayhearanymotiontoconfirmbroughtunder 98thetermsofthissectioniftheredemptionamountisnotpaidbytheinterestedparty 99movingthecourttosetasidethesale. 92.852.Anysheriff'sdeedgivenpursuanttothemunicipallandreutilizationlawshall 2besubjecttoarecordingfeeforthecostsofrecordingthedeedthatshallbeassessedand 3collectedfromthepurchaserofthepropertyatthesametimetheproceedsfromthesaleare 4collected.Allsuchdeedsshallberecordedattheofficeoftherecorderofdeedswithintwo 5monthsafterthe[sheriff'sdeedisgiven] courtconfirmsthesale,ifnoproceedingtoset 6asidetheconfirmationjudgmentisbeforethecourt. 92.855.Eachsheriff'sdeedgivenpursuanttotheprovisionsofthemunicipalland 2reutilizationlawshallbe[presumptive] primafacieevidencethatthesuitandallproceedings 3thereinandallproceedingspriortheretofromandincludingassessmentofthelandsaffected 4therebyandallnoticesrequiredbylawwereregularandinaccordancewithallprovisionsof 5thelawrelatingthereto.[Aftertwoyearsfromthedateoftherecordingofsuchsheriff'sdeed, 6thepresumptionshallbeconclusive,unlessatthetimethatthissectiontakeseffectthetwo- 7yearperiodsincetherecordingofsuchsheriff'sdeedhasexpired,orlessthansixmonthsof 8suchperiodoftwoyearsremainsunexpired,inwhichlattercasethepresumptionshall 9becomeconclusivesixmonthsafterSeptember28,1971.Nosuittosetasideortoattackthe 10validityofanysuchsheriff'sdeedshallbecommencedormaintainedunlessthesuitisfiled 11priortothetimethatthepresumptionbecomesconclusive,asaforesaid.] 105.145.1.Thefollowingdefinitionsshallbeappliedtothetermsusedinthis 2section: 3 (1)"Governingbody",theboard,body,orpersonsinwhichthepowersofapolitical 4subdivisionasabodycorporate,orotherwise,arevested; 5 (2)"Politicalsubdivision",anyagencyorunitofthisstate,exceptcountiesandschool 6districts,whichnowis,orhereaftershallbe,authorizedtolevytaxesorempoweredtocause 7taxestobelevied. HCSSSSCSSB724 21 8 2.Thegoverningbodyofeachpoliticalsubdivisioninthestateshallcausetobe 9preparedanannualreportofthefinancialtransactionsofthepoliticalsubdivisioninsuch 10summaryformasthestateauditorshallprescribebyrule,exceptthattheannualreportof 11politicalsubdivisionswhosecashreceiptsforthereportingperiodaretenthousanddollarsor 12lessshallonlyberequiredtocontainthecashbalanceatthebeginningofthereportingperiod, 13asummaryofcashreceipts,asummaryofcashdisbursementsandthecashbalanceattheend 14ofthereportingperiod. 15 3.Withinsuchtimefollowingtheendofthefiscalyearasthestateauditorshall 16prescribebyrule,thegoverningbodyofeachpoliticalsubdivisionshallcauseacopyofthe 17annualfinancialreporttoberemittedtothestateauditor. 18 4.Thestateauditorshallimmediatelyonreceiptofeachfinancialreportacknowledge 19thereceiptofthereport. 20 5.Inanyfiscalyearnomemberofthegoverningbodyofanypoliticalsubdivisionof 21thestateshallreceiveanycompensationorpaymentofexpensesaftertheendofthetime 22withinwhichthefinancialstatementofthepoliticalsubdivisionisrequiredtobefiledwith 23thestateauditoranduntilsuchtimeasthenoticefromthestateauditorofthefilingofthe 24annualfinancialreportforthefiscalyearhasbeenreceived. 25 6.Thestateauditorshallpreparesampleformsforfinancialreportsandshallmailthe 26sametothepoliticalsubdivisionsofthestate.Failureoftheauditortosupplysuchforms 27shallnotinanywayexcuseanypersonfromtheperformanceofanydutyimposedbythis 28section. 29 7.Allreportsorfinancialstatementshereinabovementionedshallbeconsideredtobe 30publicrecords. 31 8.Theprovisionsofthissectionapplytotheboardofdirectorsofevery 32transportationdevelopmentdistrictorganizedundersections238.200to238.275. 33 9.Anypoliticalsubdivisionthatfailstotimelysubmitacopyoftheannualfinancial 34statementtothestateauditorshallbesubjecttoafineoffivehundreddollarsperday. 35 10.Thestateauditorshallreportanyviolationofsubsection9ofthissectiontothe 36departmentofrevenue.Uponnotificationfromthestateauditor'sofficethatapolitical 37subdivisionfailedtotimelysubmitacopyoftheannualfinancialstatement,thedepartmentof 38revenueshallnotifysuchpoliticalsubdivisionbycertifiedmailthatthestatementhasnot 39beenreceived.Suchnoticeshallclearlysetforththefollowing: 40 (1)Thenameofthepoliticalsubdivision; 19 (7)"Taxingauthority",anygovernmental,managing,administering,orotherlawful 20authority,noworhereafterempoweredbylawtoissuetaxbills. 140.981.1.(1)Any[homerulecitywithmorethanseventy-onethousandbutfewer 2thanseventy-ninethousandinhabitants] citywithonethousandfivehundredormore 3inhabitantsmayestablishalandbankagencyforthemanagement,sale,transfer,andother 4dispositionofinterestsinrealestateownedbysuchlandbankagency. 5 (2)Uponrequestby: 6 (a)Anycitywithlessthanonethousandfivehundredinhabitantslocatedina 7nonchartercountyotherthanacountywithmorethaneightythousandbutfewerthan 8onehundredthousandinhabitantsandwithacountyseatwithmorethanseventy 9thousandbutfewerthaneightythousandinhabitants;or HCSSSSCSSB724 24 10 (b)Anyunincorporatedcommunitylocatedinanonchartercountyotherthana 11countywithmorethaneightythousandbutfewerthanonehundredthousand 12inhabitantsandwithacountyseatwithmorethanseventythousandbutfewerthan 13eightythousandinhabitants; 14 15thecountycommissionshallestablishalandbankagencyforthemanagement,sale, 16transfer,andotherdispositionofinterestsinrealestateownedbysuchlandbank 17agency. 18 (3)Any[such] landbankagencyestablishedundersubdivisions(1)or(2)ofthis 19subsectionshallbeestablishedtofosterthepublicpurposeofreturningland,includingland 20thatisinanonrevenue-generating,nontax-producingstatus,touseinprivateownership. 21 (4)Acitydescribedundersubdivision(1)ofthissubsectionmay,andacounty 22describedundersubdivision(2)ofthissubsectionshall,establishalandbankagencyby 23ordinance,resolution,orrule,asapplicable. 24 2.Alandbankagencyestablishedbyacityshallnotownanyinterestinrealestate 25locatedwhollyorpartiallyoutsidethecitythatestablishedthelandbank. 26 3.Thebeneficiariesofthelandbankagencyshallbethetaxingauthoritiesthatheld 27orownedtaxbillsagainsttherespectiveparcelsofrealestateacquiredbysuchlandbank 28agencypursuanttoasaleconductedundersection140.190,140.240,or140.250,andtheir 29respectiveinterestsineachparcelofrealestateshallbetotheextentandinproportiontothe 30prioritiesdeterminedbythecourtonthebasisthattheprincipalamountoftheirrespectivetax 31billsboretothetotalprincipalamountofallofthetaxbillsdescribedinthejudgment. 32 4.Alandbankagencycreatedunderthelandbankactshallbeapublicbody 33corporateandpoliticandshallhavepermanentandperpetualdurationuntilterminatedand 34dissolvedinaccordancewiththeprovisionsofsection140.1012. 140.982.Thegoverningbodyofthecityestablishingalandbankagency,[or]the 2chiefadministrativeofficerofthecityestablishingalandbankagency,orthegoverning 3bodyofthecountyestablishingalandbankagencyshallhavethepowertoorganizeand 4reorganizetheexecutive,administrative,clerical,andotherdepartmentsofthelandbank 5agencyandtofixtheduties,powers,andcompensationofallemployees,agents,and 6consultantsofthelandbankagency.Alandbankagencymayemployasecretary,an 7executivedirector,itsowncounselandlegalstaff,technicalexperts,andotheragentsand 8employees,permanentortemporary,asitmayrequireandmaydeterminethequalifications 9andfixthecompensationandbenefitsofsuchpersons.Alandbankagencymayalsoenter 10intocontractsandagreementswithpoliticalsubdivisionsforstaffingservicestobeprovided 11tothelandbankagencybypoliticalsubdivisionsoragenciesordepartmentsthereof,orfora HCSSSSCSSB724 25 12landbankagencytoprovidesuchstaffingservicestopoliticalsubdivisionsoragenciesor 13departmentsthereof. 140.983.Alandbankagencyestablishedunderthelandbankactshallhaveall 2powersnecessaryorappropriatetocarryoutandeffectuatethepurposesandprovisionsofthe 3landbankact,includingthefollowingpowersinadditiontothosehereinotherwisegranted: 4 (1)Toadopt,amend,andrepealbylawsfortheregulationofitsaffairsandthe 5conductofitsbusiness; 6 (2)Tosueandbesued,initsownname,andpleadandbeimpleadedinallcivil 7actionsincluding,butnotlimitedto,actionstocleartitletopropertyofthelandbankagency; 8 (3)Toadoptasealandtoalterthesameatpleasure; 9 (4)Toborrowfromprivatelenders,politicalsubdivisions,thestate,andthefederal 10governmentasmaybenecessaryfortheoperationandworkofthelandbankagency; 11 (5)Toissuenotesandotherobligationsaccordingtotheprovisionsofthischapter; 12 (6)Toprocureinsuranceorguaranteesfrompoliticalsubdivisions,thestate,the 13federalgovernment,oranyotherpublicorprivatesourcesofthepaymentofanybond,note, 14loan,orotherobligation,orportionthereof,incurredbythelandbankagencyandtopayany 15feesorpremiumsinconnectiontherewith; 43 (14)Tofix,charge,andcollectrents,fees,andchargesfortheuseofthepropertyof 44thelandbankagencyandforservicesprovidedbythelandbankagency; 45 (15)Toacquireproperty,whetherbypurchase,exchange,gift,lease,orotherwise, 46exceptnotpropertynotwhollylocatedinthecityorcountythatestablishedthelandbank 47agency;tograntoracquirelicensesandeasements;andtosell,lease,grantanoptionwith 48respectto,orotherwisedisposeof,anypropertyofthelandbankagency; 49 (16)Toenterintopartnerships,jointventures,andothercollaborativerelationships 50withpoliticalsubdivisionsandotherpublicandprivateentitiesfortheownership, 51management,development,anddispositionofrealproperty,exceptnotforpropertynot 52whollylocatedinthecitythatestablishedthelandbankagency;and 53 (17)Subjecttotheotherprovisionsofthischapterandallotherapplicablelaws,todo 54allotherthingsnecessaryorconvenienttoachievetheobjectivesandpurposesoftheland 55bankagencyorotherlawsthatrelatetothepurposesandresponsibilityofthelandbank 56agency. 140.985.1.Alandbankagencyshallholdinitsownnameallrealpropertyacquired 2bysuchlandbankagencyirrespectiveoftheidentityofthetransferorofsuchproperty. 3 2.Alandbankagencyshallmaintainandmakeavailableforpublicreviewand 4inspectionaninventoryandhistoryofallrealpropertythelandbankagencyholdsor 5formerlyheld.Thisinventoryandhistoryshallbeavailableonthelandbankagency's 6websiteandincludeataminimum: 7 (1)Whetheraparcelisavailableforsale; 8 (2)Theaddressoftheparcelifanaddresshasbeenassigned; 9 (3)Theparcelnumberifnoaddresshasbeenassigned; 10 (4)Theyearthataparcelenteredthelandbankagency'sinventory; 11 (5)Whetheraparcelhassold;and 12 (6)Ifaparcelhassold,thenameofthepersonorentitytowhichitwassold. 13 3.Thelandbankagencyshalldetermineandsetforthinpoliciesandproceduresthe 14generaltermsandconditionsforconsiderationtobereceivedbythelandbankagencyforthe 15transferofrealpropertyandinterestsinrealproperty.Considerationmaytaketheformof 16monetarypaymentsandsecuredfinancialobligations,covenants,andconditionsrelatedtothe HCSSSSCSSB724 27 17presentandfutureuseoftheproperty;contractualcommitmentsofthetransferee;andsuch 18otherformsofconsiderationasthelandbankagencydeterminestobeinthebestinterestof 19itspurpose. 20 4.Alandbankagencymayconvey,exchange,sell,transfer,lease,grant,releaseand 21demise,pledge,andhypothecateanyandallinterestsin,upon,ortopropertyofthelandbank 22agency.Alandbankagencymaygiftanyinterestin,upon,ortopropertytothecitythat 23establishedthelandbankagency. 24 5.Acitymay,initsresolutionorordinancecreatingalandbankagency,establisha 25hierarchicalrankingofprioritiesfortheuseofrealpropertyconveyedbysuchlandbank 26agency,subjecttosubsection7ofthissection,including,butnotlimitedto: 27 (1)Useforpurelypublicspacesandplaces; 28 (2)Useforaffordablehousing; 29 (3)Useforretail,commercial,andindustrialactivities; 30 (4)Useaswildlifeconservationareas;and 31 (5)Suchotherusesandinsuchhierarchicalorderasdeterminedbysuchcityor 32county. 33 34Ifacityorcounty, initsresolutionorordinancecreatingalandbankagency,establishes 35prioritiesfortheuseofrealpropertyconveyedbythelandbankagency,suchprioritiesshall 36beconsistentwithandnomorerestrictivethanmunicipalorcountyplanningandzoning 37ordinances. 38 6.Thelandbankagencymaydelegatetoofficersandemployeestheauthorityto 39enterintoandexecuteagreements,instrumentsofconveyance,andallotherrelated 40documentspertainingtotheconveyanceofpropertybythelandbankagency. 41 7.Alandbankagencyshallonlyacceptwrittenoffersequaltoorgreaterthanthefull 42amountofalltaxbills,interest,penalties,attorney'sfees,andcostsonrealpropertyto 43purchasetherealpropertyheldbythelandbankagency. 44 8.Whenanyparcelofrealestateacquiredbyalandbankagencyissoldorotherwise 45disposedofbysuchlandbankagency,theproceedstherefromshallbeappliedanddistributed 46inthefollowingorder: 47 (1)Tothepaymentoftheexpensesofthesale; 48 (2)Tofulfilltherequirementsoftheresolution,indenture,orotherfinancing 49documentsadoptedorenteredintoinconnectionwithbonds,notes,orotherobligationsofthe 50landbankagency,totheextentthatsuchrequirementsmayapplywithrespecttosuchparcel 51ofrealestate; HCSSSSCSSB724 28 52 (3)Tothebalancetoberetainedbythelandbankagencytopaythesalariesandother 53expensesofsuchlandbankagencyandofitsemployeesasprovidedforinitsannualbudget; 54and 55 (4)Anyfundsinexcessofthosenecessarytomeettheexpensesoftheannualbudget 56ofthelandbankagencyinanyfiscalyearandareasonablesumtocarryoverintothenext 57fiscalyeartoassurethatsufficientfundswillbeavailabletomeetinitialexpensesforthat 58nextfiscalyear,exclusiveofnetprofitfromthesaleofancillaryparcels,shallbepaidtothe 59respectivetaxingauthoritiesthat,atthetimeofthedistribution,aretaxingtherealproperty 60fromwhichtheproceedsarebeingdistributed.Thedistributionsshallbeinproportiontothe 61amountsofthetaxesleviedonthepropertiesbythetaxingauthorities.Distributionshallbe 62madeonJanuaryfirstandJulyfirstofeachyear,andatsuchothertimesasthelandbank 63agencymaydetermine. 64 9.Whenanyancillaryparcelissoldorotherwisedisposedofbysuchlandbank 65agency,theproceedstherefromshallbeappliedanddistributedinthefollowingorder: 66 (1)Tothepaymentofalllandtaxesandrelatedchargesthendueonsuchparcel; 67 (2)Tothepaymentoftheexpensesofsale; 68 (3)Tofulfilltherequirementsoftheresolution,indenture,orotherfinancing 69documentsadoptedorenteredintoinconnectionwithbonds,notes,orotherobligationsofthe 70landbankagency,totheextentthatsuchrequirementsmayapplywithrespecttosuchparcel 71ofrealestate; 72 (4)Tothebalancetoberetainedbythelandbankagencytopaythesalariesandother 73expensesofsuchlandbankagencyandofitsemployeesasprovidedforinitsannualbudget; 74and 75 (5)Anyfundsinexcessofthosenecessarytomeettheexpensesoftheannualbudget 76ofthelandbankagencyinanyfiscalyear,andareasonablesumtocarryoverintothenext 77fiscalyeartoassurethatsufficientfundswillbeavailabletomeetinitialexpensesforthat 78nextfiscalyear,shallbepaidinaccordancewithsubdivision(4)ofsubsection8ofthis 79section. 80 10.Ifalandbankagencyownsmorethanfiveparcelsofrealpropertyinasinglecity 81blockandnowrittenoffertopurchaseanyofthosepropertieshasbeensubmittedtothe 82agencyinthepasttwelvemonths,thelandbankagencyshallreduceitsrequestedpricefor 83thosepropertiesandadvertisethediscountpublicly. 140.986.1.Nolaterthantwoyearsfromthedateitacquiredtheproperty,aland 2bankagencyshalleithersell,puttoaproductiveuse,orshowsignificantprogresstowards 3sellingorputtingtoaproductiveuseaparcelofrealproperty.Aproductiveusemaybe 4rentingtheproperty;demolishingallstructuresoftheproperty;restoringpropertyofhistoric 5value;orusingthepropertyforacommunitygarden,park,orotheropenpublicspace. HCSSSSCSSB724 29 6 2.Thegoverningbodyofthecityorcountymaygrantthelandbankagencyaone- 7yearextensionifthebodydeterminesbyamajorityvotethatunforeseencircumstanceshave 8delayedthesaleorproductiveuseofaparcelofproperty. 9 3.Ifalandbankagencyownsaparcelofrealpropertythatdoesnothaveaproductive 10useaftertwoyears,ordoesnotreceiveanextensionundersubsection2ofthissection,the 11propertyshallbeofferedforpublicsaleusingtheproceduresundersections140.170to 12140.190. 140.991.1.Thereshallbeanannualauditoftheaffairs,accounts,expenses,and 2financialtransactionsofalandbankagencybyacertifiedpublicaccountantbeforeApril 3thirtiethofeachyear,whichaccountantshallbeemployedbythelandbankagencyonor 4beforeMarchfirstofeachyear.Certifiedcopiesoftheauditshallbefurnishedtothecityor 5countythatestablishedthelandbankagency,andthecityorcountyshallposttheauditonits 6publicwebsite.Copiesoftheauditshallalsobeavailableforpublicinspectionattheoffice 7ofthelandbankagency. 8 2.Thelandbankagencymaybeperformanceauditedatanytimebythestateauditor 9orbytheauditorofthecityorcountythatestablishedthelandbankagency.Thecostofsuch 10auditshallbepaidbythelandbankagency,andcopiesshallbemadeavailabletothepublic 11andpostedonthelandbankagency'swebsitewithinthirtydaysofthecompletionofthe 12audit. 140.1009.1.Alandbankagencyshallbeauthorizedtofileanactiontoquiettitle 2undersection527.150astoanyrealpropertyinwhichthelandbankagencyhasaninterest. 3Forpurposesofanyandallsuchactions,thelandbankagencyshallbedeemedtobethe 4holderofsufficientlegalandequitableinterests,andpossessoryrights,soastoqualifythe 5landbankagencyasanadequatepetitionerinsuchaction. 6 2.Priortothefilingofanactiontoquiettitle,thelandbankagencyshallconductan 7examinationoftitletodeterminetheidentityofanyandallpersonsandentitiespossessinga 8claimorinterestinortotherealproperty.Serviceofthepetitiontoquiettitleshallbe 9providedtoallsuchinterestedpartiesbythefollowingmethods: 10 (1)Registeredorcertifiedmailtosuchidentityandaddressasreasonably 11ascertainablebyaninspectionofpublicrecords; 12 (2)Inthecaseofoccupiedrealproperty,byfirstclassmailaddressedto"Occupant"; 13 (3)Bypostingacopyofthenoticeontherealproperty; 14 (4)Bypublicationinanewspaperofgeneralcirculationinthecityorcountyin 15whichthepropertyislocated;and 16 (5)Suchothermethodsasthecourtmayorder. HCSSSSCSSB724 30 17 3.Aspartofthepetitiontoquiettitle,thelandbankagencyshallfileanaffidavit 18identifyingallpartiespotentiallyhavinganinterestintherealpropertyandtheformofnotice 19provided. 20 4.Thecourtshallscheduleahearingonthepetitionwithinninetydaysfollowing 21filingofthepetitionand,astoallmattersuponwhichananswerwasnotfiledbyaninterested 22party,thecourtshallissueitsfinaljudgmentwithinonehundredtwentydaysofthefilingof 23thepetition. 24 5.Alandbankagencyshallbeauthorizedtojoininasinglepetitiontoquiettitleone 25ormoreparcelsofrealproperty. 140.1012.1.Alandbankagencymaybedissolvedasapublicbodycorporateand 2politicnosoonerthansixtycalendardaysafteranordinanceorresolutionforsuchdissolution 3ispassedbythecityorcountythatestablishedthelandbankagency. 4 2.Nolessthansixtycalendardays'advancewrittennoticeofconsiderationofsuchan 5ordinanceorresolutionofdissolutionshallbegiventothelandbankagency,shallbe 6publishedinalocalnewspaperofgeneralcirculationwithinsuchcityorcounty, andshallbe 7sentcertifiedmailtoeachtrusteeofanyoutstandingbondsofthelandbankagency. 8 3.Nolandbankagencyshallbedissolvedwhilethereremainsanyoutstandingbonds, 9notes,orotherobligationsofthelandbankagencyunlesssuchbonds,notes,orother 10obligationsarepaidordefeasedpursuanttotheresolution,indenture,orotherfinancing 11documentunderwhichsuchbonds,notes,orotherobligationswereissuedpriortoor 12simultaneouslywithsuchdissolution. 13 4.Upondissolutionofalandbankagencypursuanttothissection,allrealproperty, 14personalproperty,andotherassetsofthelandbankagencyshallbetransferredbyappropriate 15writteninstrumenttoandshallbecometheassetsofthecityorcountythatestablishedthe 16landbankagency.Suchcityorcountyshallactexpeditiouslytoreturnsuchrealpropertyto 17thetaxrollsandshallmarketandsellsuchrealpropertyusinganopen,publicmethodthat 18ensuresthebestpossiblepricesarerealizedwhileensuringsuchrealpropertyisreturnedtoa 19suitable,productiveuseforthebettermentoftheneighborhoodinwhichsuchrealpropertyis 20located.Anysuchrealpropertythatwasacquiredbythedissolvedlandbankagency 21pursuanttoasaleconductedundersection140.190,140.240,or140.250shallbeheldbythe 22cityorcountyintrustforthetaxbillownersandtaxingauthoritieshavinganinterestinany 23taxlienswhichwereforeclosed,astheirinterestsmayappearinthejudgmentofforeclosure 24and,uponthesaleorotherdispositionofanysuchpropertybysuchcityorcounty, the 25proceedstherefromshallbeappliedanddistributedinthefollowingorder: 26 (1)Tothepaymentoftheexpensesofsale; 27 (2)Tothereasonablecostsincurredbysuchcityorcountyinmaintainingand 28marketingsuchproperty;and HCSSSSCSSB724 31 29 (3)Thebalanceshallbepaidtotherespectivetaxingauthoritiesthat,atthetimeof 30thedistribution,aretaxingtherealpropertyfromwhichtheproceedsarebeingdistributed. 164.450.1.Anyschooldistrictlocatedinwholeorinpartinanycountywith 2morethanfourhundredthousandbutfewerthanfivehundredthousandinhabitants 3thatreceivesvoterapprovalfortheissuanceofbondsunderthischaptershallmaintain 4adetailedaccountingofeachandeveryexpenditurebytheschooldistrictforthe 5moneysgeneratedbysuchissuance.Anysuchschooldistrictshallberequiredto 6maintainabudgetforeachprojectapprovedbytheschooldistrictusingmoneysfrom 7theissuanceofbonds.Suchbudgetshalldetailtheexactcostoftheprojectandthe 8sourceofallmoneysusedtofundtheproject.Allinformationrequiredunderthis 9subsectionregardingexpendituresandbudgetsshallbemaintainedandupdatedonthe 10websiteoftheschooldistrictandshallbepubliclyavailable. 11 2.Continuationofanyprojectundertakenbyaschooldistrictasdescribed 12undersubsection1ofthissectionshallbehaltedimmediatelyuponexceedingthe 13budgetedamountofmoneystocompletesuchprojectbymorethantenpercent.The 14continuationofanysuchprojectdescribedunderthissubsectionshallnotoccuruntil 15suchtimeastheschooldistrictreceivesvoterapprovalunderthischapterforthe 16issuanceoffurtherbondedindebtednessspecificallyforsuchproject. 17 3.Anytaxpayerresidingwithinaschooldistrictthatviolatestheprovisionsof 18thissectionmayseek,andacourtshallorder,injunctivereliefagainstsuchschool 19districtinanycourtofcompetentjurisdictiontoenforcetheprovisionsofthissection. 230.205.1.Thealternativecountyhighwaycommissionprovidedbysections 2230.200to230.260shallnotbecomeoperativeinanycountyunlessadoptedbyavoteofthe 3majorityofthevotersofthecountyvotinguponthequestionatanelection.Allcountiesof 4thisstatewhichhaveadoptedthealternativecountyhighwaycommissionmayabolishit[and 5returntothecountyhighwaycommissionprovidedforbysections230.010to230.110]by 6submittingthequestiontoavoteofthevotersofthecountyinthemannerprovidedbylawor 7byavoteofthegoverningbody. 8 2.Anycountywhichdoesnotadoptthealternativecountyhighwaycommission 9providedbysections230.200to230.260,oranycountyinwhich[amajorityofthevotersof 10thecountyvotinguponthequestionreject] thealternativecountyhighwaycommission 11providedbysections230.200to230.260isabolished,shall[retain] adopteitherthecounty 12highwaycommissionprovidedbysections230.010to230.110ortheprovisionsofsections 13231.010to231.130. 233.095.Saidboardshallhaveauthoritytoexpend[notmorethanone-fourthof]the 2revenuewhichmaynoworwhichmayhereafterbepaidintoitstreasuryforthepurposeof 3gradingandrepairinganyroadsorstreetswithinthecorporatelimitsofanycitywithinsaid HCSSSSCSSB724 32 4specialroaddistrictinconformitywiththeestablishedgradeofsaidroadsandstreetsinsaid 5citiesandforthepurposeofconstructingandmaintainingmacadam,gravel,rockorpaved 6roadsorstreetswithinthecorporatelimitsofanycitywithinthesaidspecialroaddistrictin 7conformitywiththeestablishedgradeofsaidroadsandstreetsinsaidcity;provided,thatno 8partoftherevenueofanyspecialroaddistrictinthisstatebeexpendedoutsideofthecounty 9inwhichsuchspecialroaddistrictissituated. 407.475.1.Exceptwhenspecificallyrequiredorauthorizedbyfederallaw,no 2stateagencyorstateofficialshallimposeanyadditionalannualfilingorreporting
