115.022.1.Notwithstandinganyprovisionoflawtothecontrary,noelection
2authorityshallacceptfunding,grants,orgifts,fromanysource,excludingin-kind
3donationsoffoodorbeveragesvaluedatlessthanonethousanddollarsperpolling
4place,forpreparing,administering,orconductinganelection,includingregistering
5voters.
6 2.Thissectiondoesnotprohibittheactualuseofapublicorprivatebuilding,
7withoutchargeorforareducedfee,forthepurposesofconductinganelection,
8includinguseasapollingplaceorforelectiontrainingpurposes.
115.111.1.Theelectionauthorityshallclearlydesignateobservationareasfor
2challengersandwatchers.Forwatchers,designatedareasshallbenocloserthanthree

10 2.(1)Theelectionauthorityshallprovidewatchersuniformand
11nondiscriminatoryaccesstoobserveallstagesoftheelectionprocess,includingbut
12notlimitedtothecertificationofvotingsystems,testingoftabulatingequipment,
13absenteevotinginpersonattheofficeoftheelectionauthority,canvassing,voter
14appeals,votetabulation,ballottransport,audits,andrecounts.
15 (2)Watchersorchallengersshallwearabadgewiththenameoftheindividual
16andthenameofthepoliticalpartyorballotmeasurecommitteetheindividualis
17representing.
18 (3)Awatcherorchallengershallnotwearanycampaignmaterialadvocating
19votingfororagainstacandidateorfororagainstanypositiononaballotmeasure.
20 (4)Ifanywatcherorchallengerinterfereswiththeorderlyprocessofvoting,oris
21guiltyofmisconductoranylawviolation,theelectionjudgesshallaskthewatcheror
22challengertoleavethepollingplaceorceasetheinterference.Iftheinterferencecontinues,
23theelectionjudgesshallnotifytheelectionauthority,whichshalltakesuchactionasitdeems
24necessary.Itshallbethedutyofthepolice,ifrequestedbytheelectionauthorityorjudgesof
25election,toexcludeanywatcherorchallengerfromthepollingplaceortheplacewherevotes
26arebeingcounted.Ifanychallengerisexcluded,anothermaybesubstitutedbythe
27designatingcommitteechairman.
28 (5)Awatcherorchallengershallnotinterferewithanyvoterinthepreparation
29orcastingofthevoter'sballotorhinderorpreventtheperformanceofthedutiesofany

115.151.1.Eachqualifiedapplicantwhoappearsbeforetheelectionauthorityshall

3applicationiswitnessedbytheelectionauthorityordeputyregistrationofficial.

7undeliverablebythepostalservice.
8 3.Eachapplicantwhoregistersatavoterregistrationagencyorthedivisionofmotor
9vehicleanddriverslicensingofthedepartmentofrevenueshallbedeemedtoberegisteredas
10ofthedatetheapplicationissignedbytheapplicant,ifsuchapplicationisacceptedandnot
11rejectedbytheelectionauthorityandtheverificationnoticerequiredpursuanttosection
12115.155isnotreturnedasundeliverablebythepostalservice.Voterregistrationagencies
13[andthedivisionofmotorvehicleanddriverslicensingofthedepartmentofrevenue] shall
14transmitvoterregistrationapplicationformstotheappropriateelectionauthoritynotlater
15thanfivebusinessdaysaftertheformiscompletedbytheapplicant.
115.160.1.AllMissouridriver'slicenseapplicantsshallreceiveavoterregistration
2applicationformasasimultaneouspartoftheapplicationforadriver'slicense,renewalof
3driver'slicense,changeofaddress,duplicaterequestandanondriver'slicense.
4 2.Ifasingleapplicationformisused,thevoterregistrationapplicationportionofany
5applicationdescribedinsubsection1ofthissectionmaynotrequireanyinformationthat
6duplicatesinformationrequiredinthedriver'slicenseportionoftheform,exceptasecond
7signatureorotherinformationrequiredbylaw.
8 3.Afterconferringwiththesecretaryofstateasthechiefstateelectionofficial
9responsibleforoverseeingofthevoterregistrationprocess,thedirectorofrevenueshalladopt
10rulesandregulationspertainingtotheformatofthevoterregistrationapplicationusedbythe
11department.Thedirectorofrevenueshallutilizeelectronicvoterregistrationapplication
12formsandprovideforsecureelectronictransferofvoterregistrationinformationto
13electionauthorities.Thesecretaryofstateandthedirectorofrevenueshallensurethe
14confidentialityandintegrityofthevoterregistrationdatacollected,maintained,
15received,ortransmittedunderthissection.
16 4.Noinformationrelatingtothefailureofanapplicantforadriver'slicenseor
17nondriver'slicensetosignavoterregistrationapplicationmaybeusedforanypurposeother
18thanvoterregistration.
19 5.Anyvoterregistrationapplicationreceivedpursuanttotheprovisionsofthis
20sectionshallbeforwarded, inasecureandelectronicmanner,totheelectionauthority
21locatedwithinthatcountyoranycitynotwithinacounty,orifthereismorethanoneelection
22authoritywithinthecounty,thentotheelectionauthoritylocatednearesttothelocationwhere
23thedriver'slicenseapplicationwasreceived.Voterregistrationinformation,includingan
24electronicimageofthesignatureoftheapplicant,shallbetransmittedinaformat
25compatiblewiththeMissourivoterregistrationsystemestablishedinsection115.158
HCSSSSB812	3 26whichallowsforreviewbytheelectionauthorityanddoesnotrequiretheelection
27authoritytomanuallyreentertheinformation,providedthattheelectionauthorityshall
28printoutapapercopyoftheinformationandretainsuchinformationinthemanner
29requiredbysection115.145.Theelectionauthorityreceivingtheapplicationformsshall
30reviewtheapplicationsandforward, inasecureandelectronicmanner,anyapplications
31pertainingtoadifferentelectionauthoritytothatelectionauthority.
32 6.Acompletedvoterregistrationapplicationacceptedinthedriver'slicensing
33processshallbetransmittedtotheelectionauthoritydescribedinsubsection5ofthissection
34notlaterthan[five] threebusinessdaysaftertheformiscompletedbytheapplicant.
35 7.AnypersonregisteringtovotewhenapplyingfororrenewingaMissouridriver's
36licenseshallsubmitwiththeapplicationformacopyofabirthcertificate,aNativeAmerican
37tribaldocument,orotherproofofUnitedStatescitizenship,avalidMissouridriver'slicense,
38orotherformofpersonalidentification.Anypersonwho,atthetimeofatransactionwith
39thedivisionofmotorvehicleanddriverslicensingofthedepartmentofrevenue,
40providesadocumentthatestablishesnon-citizenshipshallnotbeofferedthe
41opportunitytoregistertovoteaspartofthetransaction.
115.205.1.[Any] Noperson[whois]shallbepaidorotherwisecompensatedfor
2soliciting[morethanten]voterregistrationapplications,otherthanagovernmentalentityora
3personwhoispaidorcompensatedbyagovernmentalentityforsuchsolicitation[, shallbe
4registeredwiththesecretaryofstateasavoterregistrationsolicitor]. Avoterregistration
5solicitorwhosolicitsmorethantenvoterregistrationapplicationsshallregisterforevery
6electioncyclethatbeginsonthedayafterthegeneralelectionandendsonthedayofthe
7generalelectiontwoyearslater.Avoterregistrationsolicitorshallbeatleasteighteenyears
8ofageandshallbearegisteredvoterinthestateofMissouri.
9 2.Eachvoterregistrationsolicitorshallprovidethefollowinginformationinwriting
10tothesecretaryofstate'soffice:
11 (1)Thenameofthevoterregistrationsolicitor;
12 (2)Theresidentialaddress,includingstreetnumber,city,state,andzipcode;
13 (3)Themailingaddress,ifdifferentfromtheresidentialaddress;and
14 (4)[Whetherthevoterregistrationsolicitorexpectstobepaidforsolicitingvoter
15registrations;
16 (5)Ifthevoterregistrationsolicitorexpectstobepaid,theidentityofthepayor;or
17 (6)]Thesignatureofthevoterregistrationsolicitor.
18 3.Thesolicitorinformationrequiredinsubsection2ofthissectionshallbesubmitted

3votingsystemsandmaypromulgaterulesandregulationstoimplementtheintentofsections
4115.225to115.235.
5 2.Noelectronicvotingsystemshallbeapprovedunlessit:
6 (1)Permitsvotinginabsolutesecrecy;
7 (2)Permitseachvotertovoteforasmanycandidatesforeachofficeasavoteris

HCSSSSB812	5 31 3.UntilJanuary1,2024,ifanyelectionauthorityusesdirect-recordelectronic
32touchscreenvotecountingmachines,theelectionauthoritymaycontinuetousesuch
33machinessolelyforvoterswhoaredisabledanddesiretousethem.Whenmachines
34requirereplacementduetowearandtear,malfunction,oranyotherreason,such
35machineshallbereplacedwithapaperballotmarkingmachinedesignedtoassistvoters
36whoaredisabled.Undernocircumstancesshalldirect-recordelectronictouchscreen
37votecountingmachinesbeusedafterJanuary1,2024.
38 4.Thesecretaryofstateshallpromulgaterulesandregulationstoallowtheuseofa
39computerizedvotingsystem.Theproceduresshallprovidefortheuseofacomputerized
40votingsystemwiththeabilitytoprovideapaperaudittrail.Notwithstandinganyprovisions
41ofthischaptertothecontrary,suchasystemmayallowforthestorageofprocessedballot
42materialsinanelectronicform.
43 [4.]5.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis
44createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies
45withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.
46Thissectionandchapter536arenonseverableandifanyofthepowersvestedwiththe
47generalassemblypursuanttochapter536toreview,todelaytheeffectivedateorto
48disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof
49rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2002,shallbeinvalid

115.237.1.BeginningJanuary1,2023,theofficialballotshallbeapaperballot

5 2.Eachballotprintedordesignedforusewithanelectronicvotingsystemforany
6electionpursuanttothischaptershallcontainallquestionsandthenamesofallofficesand
7candidatescertifiedorfiledpursuanttothischapterandnoother.Asfaraspracticable,all
8questionsandthenamesofallofficesandcandidatesforwhicheachvoterisentitledtovote
9shallbeprintedononepageexceptfortheballotforpoliticalpartycommitteepersonsin
10pollingplacesnotutilizinganelectronicvotingsystemwhichmaybeprintedseparatelyand
11inconformitywiththerequirementscontainedinthissection.Asfaraspracticable,ballots
12containingonlyquestionsandthenamesofnonpartisanofficesandcandidatesshallbe
13printedinaccordancewiththeprovisionsofthissection,exceptthattheballotinformation
14maybelistedinverticalorhorizontalrows.Thenamesofcandidatesforeachofficeshallbe
15listedintheorderinwhichtheyarefiled.

21separatepaperballotforquestionsorforthepresidentialpreferenceprimaryinanypolling
22placeusinganelectronicvotingsystem.
23 [4.]5.Whereelectronicvotingsystemsareusedandwhenwrite-invotesare
24authorizedbylaw,awrite-inballot,whichmaybeintheformofaseparatepaperballot,card,
25orenvelope,maybeprovidedbytheelectionauthoritytopermiteachvotertowriteinthe
26namesofpersonswhosenamesdonotappearontheballot.
27 [5.]6.Noballotprintedordesignedforusewithanelectronicvotingsystemforany
28partisanelectionheldunderthischaptershallallowapersontovoteastraightpoliticalparty
29ticket.Forpurposesofthissubsection,a"straightpoliticalpartyticket"meansvotingforall
30ofthecandidatesforelectiveofficewhoareontheballotrepresentingasinglepoliticalparty
31byasingleselectionontheballot.
32 [6.]7.Thesecretaryofstateshallpromulgaterulesthatspecifyuniformstandardsfor
33ballotlayoutforeachelectronicorcomputerizedballotcountingsystemapprovedunderthe
34provisionsofsection115.225sothattheballotusedwithanycountingsystemis,where
35possible,consistentwiththeintentofthissection.Nothinginthissectionshallbeconstrued
36torequiretheformatspecifiedinthissectionifitdoesnotmeettherequirementsoftheballot
37countingsystemusedbytheelectionauthority.
38 [7.]8.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis

6 2.Theterm"newfederalelectionfunds"shallmeananyfederalfundsreceived
7onorafterthedatethissectionissignedintolaw,byaperson,group,orentitycharged
8bythestateofMissouritoadministeranyofficialelectionoccurringwithinthestate.
9 3.Anyperson,group,orentitychargedbythestatetoadministeranyofficial
10electionoccurringwithinMissouriwhointendstoacceptordisbursefederalelection
11fundspendingapprovalfromthestatelegislatureincompliancewiththissection,must
12providenoticetothestatelegislatureofitsintenttodosobeforeacceptingthefunds.If
13fundshavealreadybeenaccepted,thenapprovalmustbeprovidedbythestate
14legislaturebeforethefundsmaybedisbursed.
15 4.Noperson,group,orentitychargedbythestatetoadministeranyofficial
16electionoccurringwithinthestateshallacceptordisbursenewfederalelectionfunds
17withoutanexplicitstateorfederallegalrequirementtosoorpriorapprovalofthe
18legislatureoritsdesigneeinaccordancewiththissection.
19 5.Itshallbepresumedforpurposesofcompliancewiththissectionthatthe
20legislaturehasapprovedtheacceptanceanddisbursementofnewfederalelectionfunds
21ifthestatelegislaturefailstovoteontheissuewithinonehundredtwentydaysfrom
22whennoticeisprovidedtothelegislaturepursuanttosubsection3ofthissection.
23 6.Aviolationofthissectionwillresultinafineintheamountofthenewfederal
24electionfundsacceptedordisbursedinviolationofthissectionplusanadditionalone
25thousanddollars.
26 7.ThissectionisrepealedFebruary1,2025,unlessreviewedandsavedfrom
27repealbytheLegislature.
116.160.1.Ifthegeneralassemblyadoptsajointresolutionproposinga
2constitutionalamendmentorabillwithoutafiscalnotesummary,whichistobereferredtoa
3voteofthepeople,afterreceiptofsuchresolutionorbillthesecretaryofstateshallpromptly
4forwardtheresolutionorbilltothestateauditor.Ifthegeneralassemblyadoptsajoint
5resolutionproposingaconstitutionalamendmentorabillwithoutanofficialsummary
6statement,whichistobereferredtoavoteofthepeople,withintwentydaysafterreceiptof
7theresolutionorbill,thesecretaryofstateshallprepareandtransmittotheattorneygenerala
8summarystatementofthemeasureastheproposedsummarystatement.Thesecretaryof
9statemayseektheadviceofthelegislatorwhointroducedtheconstitutionalamendmentor
10billandthespeakerofthehouseorthepresidentprotemofthelegislativechamberthat

12theproposedconstitutionalamendmentorbill.Theattorneygeneralshallwithintendays

18 2.Theofficialsummarystatementshallcontainnomorethanfiftywords,excluding
19articles.Thetitleshallbeatrueandimpartialstatementofthepurposesoftheproposed
20measureinlanguageneitherintentionallyargumentativenorlikelytocreateprejudiceeither
21fororagainsttheproposedmeasure.
116.225.Politicalsubdivisionsorspecialdistrictsofthisstateshalllabelballot
2measuresofanytypethataresubmittedtoavoteofthepeoplealphabeticallyinthe
3orderinwhichtheyaresubmittedbypetition,ordinance,voteofapoliticalsubdivision
4orspecialdistrict,orothermethodauthorizedbylaw.Thesecretaryofstateshalllabel
5statutoryinitiativeandreferendummeasureswiththelettersAthroughI.Thecounty
6governingbody,unlessotherwisespecifiedbyacountycharter,shalllabelcountyballot
7measureswiththelettersJthroughR,andthegoverningbodyofeachcity,town,

5commission,bureau,orotherpublicbodyestablishedbylaw.
6 3.Inanycivilactioninastateorfederalcourt,nopublicofficial,includingany
7attorneyrepresentingoractingonbehalfofapublicofficial,hasanyauthorityto
8compromiseorsettletheaction,consenttoanycondition,oragreetoanyorderin
9connectiontherewithifthecompromise,settlement,condition,orordernullifies,
