Inthisbill,anypersonwhoacquires,uses,produces,possesses,
transfers,oradministerspsilocybinfortheperson'sown
therapeuticusewillnotbeinviolationofstateorlocallawand
willnotbesubjecttoacivilfine,penalty,orsanctionsolong
asthefollowingconditionsaremet:
(1)Thepersonis21yearsofageorolder;
(2)Thepersonsuffersfromposttraumaticstressdisorder,major
depressivedisorder,orasubstanceusedisorderorrequiresend-
of-lifecare;
(3)Thepersonhasenrolledinaclinicaltrialtostudytheuse
ofpsilocybintotreatposttraumaticstressdisorder,major
depressivedisorder,orsubstanceusedisordersorforend-of-life
careorsoughttoenrollinaclinicaltrialbutwasdeclineddue
tolackofspaceorlackofexistingclinicaltrialsforwhichthe
personwaseligible;
(4)ThepersoninformstheDepartmentofHealthandSenior
Servicesthatthepersonplanstoacquire,use,produce,possess,
transfer,oradministerpsilocybininaccordancewiththissection;
(5)ThepersonprovidestheDepartmentwithdocumentsoutlinedin
thebill.TheDepartmentmustmaintaintheconfidentiality ofany
personallyidentifiableprotectedinformationcollectedfromany
personswhoprovideinformationtotheDepartment;
(6)ThepersonensuresthatalaboratorylicensedbytheStateto
testcontrolledsubstancesteststhepsilocybinthepersonintends
toingest.AnylaboratorylicensedbytheStatetotestcontrolled
substancesorcannabisthattestspsilocybinshallnotbein
violationofstateorlocallawandshallnotbesubjecttoacivil
fine,penalty,orsanction;and
(7)Thepersonlimitstheuseofpsilocybintonomorethan150
milligramsofpsilocybinanalyte(4-phosphoryloxy-N,N-
dimethyltryptamine) duringany12monthperiod.
TheDepartmentmustprepareandsubmittotheGovernor,Lieutenant
Governor,andtheGeneralAssemblyannualreportsonany
informationcollectedbytheDepartmentontheimplementation and
outcomesoftheuseofpsilocybin. Thisbillspecifiesthat,aphysicianwillnotbesubjectto
criminalorcivilliabilityorsanctionunderthelawsofthis
Stateforprovidingdocumentationthatapersonsuffersfrom
posttraumaticstressdisorder,majordepressivedisorder,ora
substanceusedisorderorrequiresend-of-lifecare,andnoState
agencyorregulatoryboardshallrevoke,failtorenew,ortakeany
otheractionagainstaphysician'slicenseissuedunderChapter
334,RSMobasedsolelyonthephysician'sprovisionof
documentationthatapersonsuffersfromposttraumaticstress
disorder,majordepressivedisorder,orasubstanceusedisorderor
requiresend-of-lifecare.
ThisbillalsorequirestheDepartment,incollaborationwitha
MissouriUniversityHospitalandMedicalCenteroperatedbythean
institutionofhighereducationinthisstateorcontractresearch
organizationsconductingtrialsapprovedbytheUnitedStatesFood
andDrugAdministration inMissouri,toconductastudyonthe
efficacyofusingalternativemedicinesandtherapies,including,
butnotlimitedto,theuseofpsilocybinforthetreatmentof
patientssufferingfrompost-traumaticstressdisorder,major
depressivedisorder,substanceusedisorders,orwhorequireend-
of-lifecare.
Thebillspecifiesthatsuchstudyshallincludeaclinicaltrial
ofpsilocybin,aswellasaliteraturereviewandthesubmissionof
variousreports. Nopersonparticipatingintheclinicaltrial
shallbesubjectedtocriminalorcivilliabilityorsanctionfor
theparticipationintheclinicaltrial,exceptincasesofgross
negligenceorwillfulmisconduct.
TheDepartmentofHealthandSeniorServicesshallprepareand
submittotheGovernor,LieutenantGovernorandtheGeneral
Assembly:
(1)Quarterlyreportsontheprogressofthestudy;and
(2)Awrittenreport,submittedoneyearfollowingthe
commencementofthestudy,whichshall:
a.Containtheresultsofthestudyandanyrecommendations for
legislativeorregulatoryaction;and
b.Highlightthoseclinicalpracticesthatappeartobemost
successfulaswellasanysafetyorhealthconcerns.
TheDepartmentmustmaintaintheconfidentiality ofanypersonally
identifiableprotectedinformationcollectedduringtheclinical
trial. Aphysicianwillnotbesubjecttocriminalorcivilliabilityor
sanctionunderthelawsofthisstateforreferringapatientto
theclinicaltrialunderthissection,andnostateagencyor
regulatoryboardshallrevoke,failtorenew,ortakeanyother
actionagainstaphysician'slicensebasedsolelyonthe
physician'sreferralofapatienttotheclinicaltrialunderthis
section.
