ThisbillspecifiesthattheParoleBoardhasnoauthorityto
provideahearingtoanoffender,ordertheoffender'srelease,or
ordertheoffender'sparoleuntiltheoffenderhasservedthe
minimumprisontermimposedontheoffender.
Currently,thereisatieredscheduleforconditionalrelease
terms,andthisbillchangesittonomorethan15%ofthesentence
ofimprisonment. Thebillalsoincreasesminimumprisontermsfor
offenderswhohavepriorcommitmentstotheDepartmentof
Corrections(DOC),andtheincreasesareasfollows:
(1)ForoffenderswhohavehadonepreviouscommitmenttoDOCfor
afelonyoffense,60%,increasedfrom40%;
(2)ForoffenderswhohavehadtwopreviouscommitmentstoDOCfor
feloniesunrelatedtothepresentoffense,75%,increasedfrom50%;
and
(3)ForoffenderswhohavehadthreeormorecommitmentstoDOC
forfeloniesunrelatedtothepresentoffense,90%,increasedfrom
80%.
Thebillalsorepealsaprovisionthatexcludescertainoffenders
frombeingsubjecttotheminimumprisontermsprovidedbythe
section.
Currently,individualswhoarereleasedfromimprisonmentandare
onparoleorconditionalreleaseandwhoviolateanyconditionsof
theirparoleorreleasemaybetreatedasparoleviolators. This
billrequiressuchindividualstobetreatedasparoleviolators.
Additionally,thebillrequirestheParoleBoardtorevokesuch
individuals'paroleorconditionalrelease,ratherthangivingthe
ParoleBoardtheoptiontodoso.Thebillalsorequiresaperson
toserveatleast60%ofhisorhersentencepriortopetitioning
thesentencingcourttoreduceatermofsentence,probation,
parole,orconditionalrelease.
Thebillrequiresapersonfoundguiltyofrapeinthefirstdegree
orattempttocommitrapeinthefirstdegree,orenticementofa
childorattempttoenticeachild,toserve100%ofhisorher
sentencedpriortosuchpersonbeingeligibleforprobationor
conditionalrelease. Apersonwhocommitsarmedcriminalaction
willnotbeeligibleforparole,probation,conditionalrelease,or
suspendedimpositionorexecutionofsentenceuntilthepersonhas
servedatleast75%ofthesentenceimposed. Apersonwhocommits asecondoffenseofarmedcriminalactionwillnotbeeligiblefor
parole,probation,conditionalrelease,orsuspendedimpositionor
executionofsentenceuntilthepersonhasservedatleast85%of
thesentenceimposed. Apersonconvictedofathirdorsubsequent
offenseofarmedcriminalactionshallnotbeeligibleforparole,
probation,conditionalrelease,orsuspendedimpositionor
executionofsentenceuntilthepersonhasserved100%ofthe
sentenceimposed.
