BeginningonJanuary1,2024,wheneveranofficer-involvedshooting
occursinSt.LouisCityorCounty,thelawenforcementagencywith
jurisdictionshallnotifytheAttorneyGeneral,who,uponreceipt
ofthatnotification,mustappointalawenforcementagencylocated
within100milesofthejurisdictionofoccurrencetoconducta
specialinvestigation.
Thebillspecifieswhatthelawenforcementagencyconductingthe
specialinvestigationmustreportupontheinvestigation's
conclusion,includingarecommendation tothecircuitattorneyor
countyprosecutorastowhetherthelawenforcementofficerought
tobechargedwithacrimeduetotheirinvolvementwiththe
shooting.IftheAttorneyGeneraldeterminesthereisnobasisto
prosecutetheinvolvedofficer,theymustprepareandpublicly
releaseareportexplaininghowthatdeterminationwasreached.
Thebillspecifieswhatmustbeinthereport.
Thelawenforcementagencythatemploystheinvolvedofficermay
conductaseparate,internalinvestigationintotheshooting,but
thatinternalinvestigationmustnotinterferewith,orbe
conductedinlieuof,thespecialinvestigation. Additionally,the
agencywithjurisdictionovertheshootingmustreimbursethe
investigatingagencyforanyexpensesincurredthroughtheduration
oftheinvestigation.
