HCSHB1263--PROTECTINGMISSOURI'SSMALLBUSINESSESACT(Brown (16)) COMMITTEEOFORIGIN:StandingCommitteeonGovernmentEfficiency andDownsizing Thisbillestablishesthe"ProtectingMissouri'sSmallBusinesses Act". ThisbillrequiresthestateofMissourianditspolitical subdivisionstogivecarefulconsiderationandappropriateconcern forthelastingeffectsofactionstakenduringashutdownorder thatadverselyaffecttheeconomicviabilityandwell-beingof Missouriansandbusinesses. ThebillprovidesthatbeginningJanuary1,2024,ifanypolitical subdivisionwithjurisdictionoverabusinessimplementsany shutdownorderandthebusinessclosesduetotheshutdownorder foratleast21consecutivedaysoratleast45cumulativedays, thefollowingrequirementsapply: (1)Waivingofanyfeeforabusinesslicenseduringtheperiodof theshutdownorderorsixmonths,whicheverislonger;and (2)Reducingtherealandpersonalpropertytaxliabilityofthe businessbasedonthenumberofdaysthebusinesswasshutdownin agivenyear,asfurtherexplainedinthebill. Ifataxpayerrentsorleasesalloraportionofthetaxpayer's affectedrealpropertytooneormorerentersorlessors,the taxpayershalldoaproratadistributionoftheamountbywhich thetaxliabilityisreduced,totherentersorlessorswhoare currentonallleaseorrentalpayments. Thisbillisnottobeconstruedasanexemptionofpropertyfrom taxationthatrequiresthestatetoproviderestitutionor replacementoflostrevenuestoapoliticalsubdivision.
