Thisbillcreates"Noelle'sLaw",whichrequireslawenforcement
agenciesthatuseconfidentialinformantstoadoptcertainpolicies
andproceduresthatwouldaddresshowtoworkwithinformantsand
thatwouldprovidecertainprotectivemeasurestotheinformants.
Lawenforcementagenciesthatuseconfidentialinformantswillalso
berequiredtoestablishpoliciesandprocedures,asspecifiedin
thebill,toassessthesuitabilityofusingapersonasan
informant. Astateorlocallawenforcementagencythatuses
confidentialinformantsmustperformperiodicreviewofactual
agencypracticeswithrespecttoconfidentialinformantstoensure
conformitywithagencypolicies.
Alawenforcementofficerwhowillfullyfailstocomplywiththis
sectioncommitsaclassCfelony.
Lawenforcementagenciesthatuseconfidentialinformantsmust
collectandreportcertaindata,specifiedinthebill,tothe
DepartmentofPublicSafetybyMarchfirstofeachyearwith
informationfortheprecedingyear,andtheDepartmentmustissuea
publiclyavailablereportconsistingofacompilationofthedata
receivedfromthevariousagencies,andthereportmustbepublicly
availablebyJunefirstofeachyear.
